THE Department of State Services (DSS) lacks the power to force the Abuja Bureau Chief of The Independent, Mr. Tony Ezimakor, to disclose the source of his information, activist-lawyer Femi Falana (SAN) has said.

Ezimakor was released from detention last night.

Falana, in a statement issued in Lagos yesterday titled, “Tony Ezimakor cannot be forced to disclose his source of information”, advised the DSS to release him unconditionally as he has not committed any offence known to law
.

The senior lawyer, who said Ezimakor’s detention was illegal and unconstitutional, drew the attention of the DSS to Section 35(2) of the Constitution, which provides that “any person who is arrested or detained shall have the right to remain silent or avoid answering any question until after consultation with a legal practitioner or any other person of his own choice”.

“Since Mr. Ezimakor is constitutionally entitled to “remain silent”, the Department of State Services lacks the power to subject him to disclose the source of his information.

Femi Falana, a senior advocate of Nigeria (SAN), has called for the protection of journalists from government suppression because “press freedom is the freedom of the society”.[/b]

Falana spoke on Friday at the West Africa Media Excellence Conference and Awards (WAMECA) held in Ghana.

According to the human rights lawyer, society must protect journalists and aid the development of journalism “in the interest of the basic freedom of humans and democracy”.

There is no low this treacherous character won't go, morally bankrupt individual that provided legal support for sunrise scam against Nigeria to obtain an unjust ruling against us and stealing our dollars. Remember the same Sunrise company is linked to Sambo who also misappropriated $2.1B of our money.

Now he intimidates the same journalist he claims to fight for and routinely sues government for the same purpose. The man is a hypocrite who acts primarily for his selfish motive!

I said something similar that it is illegal to invite Kemi because she ha no case to answer.
But I got attacked by ignorant and emotional posters who wants Kemi to
be crucified for daring to state her position.

It is a shame that Falana has chosen to destroy his assumed moral standing because of money.
