seunmsg: Under National Competitive Bidding, Domestic Preference is given to the domestic firm. Maybe the domestic firm, must have passed the Technical evaluation and informed as required by the Procurement Act, hence they should ordinarily be awarded the contract, like you rightly said the court decides. Amaechi and Malami are in for serious trouble if they have found culpable for a serious Country.. |

Truthisunique3: Malami as the Minister of Justice and AGF is a member of the National Council on Public Procurement according to the PPA 2007 (though not inaugurated inline with PPA 2007), now you see it ain't solely political but inline with the Act. So he has got influence there, the council supercedes the BPP(the public face of procurement in the country)! |

Houstency: Was the railway project advertised under national or international competitive bidding? Again, you need to understand that preference is given to local bidder if the company has the same technical capacity to deliver the project just like the foreign company. That is why the rule is emphatic about being responsive. It is not just to quote the least bid, the firm must also show capacity to deliver the project. If not, I can just register SEUMSG LIMITED and quote a ridiculously low amount for a project I have no capacity to deliver and then start claiming I won the bid because my quotation is the least. |

seunmsg: We can't ascertain which Open Bidding method they employed from the news, just pointed out the scenario under NCB. The process is an open process, so if the company submitted financial bids, most likely they have passed technical evaluation. That's the first thing to look at during the bidding process for works of this magnitude. The naming is part of the job description of the Evaluation team, when applying domestic preference. Also, I understand them quoting the lowest price during financial bids doesn't translate to 'lowest responsive bid', but they cited infractions and other offences which are serious offences against public procurement. |
