The Supreme Court has declared as unlawful and unconstitutional the Executive Order 10 (EO10) issued by President Muhammadu Buhari on the funding of State Judiciary and Legislature.

In a split decision on Friday, majority of the court’s seven-member panel agreed that the President exceeded his constitutional powers in issuing the EO10.

Six out of the seven members of the panel proceeded to void and set aside the EO10.

The majority decision also held that it was not the responsibility of the Federal Government to fund the capital and recurrent expenditures of the superior courts created for States under Section six of the Constitution.

All the seven members agreed that the States were not entitled to be refunded all they have spent before now to maintain those courts.

The judgment was on the suit filed by the 36 States against the FG on the funding of the Judiciary and the constitutionality of the EO10.

Whether having regards to the provisions of Section 6 and 81(3) of the Constitution read together with item 121(3) of the third schedule, the defendant is not constitutionally obligated and or charged with the responsibility for funding all capital and recurrent expenditure of the High Courts, Sharia Courts of Appeal and Customary Courts of Appeal at the states of the Federation being courts created under Section 6 of the constitution.

-Whether considering provisions of Section 6, 80, 81, 120, and 121 whether the Presidential Executive order number 10 of 2020 made by the President on May 22, 2020, to compel the plaintiffs to fund State High Courts, States Sharia Courts of Appeal and Customary Courts of Appeal in violation of the Constitutional provisions vesting responsibility for funding the said courts on the federal government is not unconstitutional and unlawful.

Wonderful... So many policies of this government have sent this country 100 years backward.

I doubt if Bubu read and understood the Executive Order he signed.

The Constitution places funding of the State High Courts & Houses of Assembly under the purview of the State Executive.

I don't understand what you mean by stepping on their toes?

When the money for the House of Assembly and the Judiciary is paid directly to them, they don't need to go to the Governor begging for anything.

They will become more independent to take actions.
