He decamped to PDP before the election and so the challenge is not whether he contested under PDP but his first tenure which he won under APC was still running as at the time he decamped.

you know this simply means he will return the 2 months salary he earned as governor while still on an APC election mandate.

The other thing this will mean is that if he ever decides to decamp back to APC (his current fiasco with Wike in view), he will cease to be Governor and the PDP primaries runner up will become governor

Obaseki, Tambuwal and Ortom are currently on PDP mandates. If APC wins the case, Obaseki only has to forfeit two months salary he earned as PDP Governor while on APC mandate.

it would be a very foolish move considering Obaseki's current issue with Wike as it would foreclose any chance of Obaseki decamping back to APC

Why is APC still considering? Then APC will not exist because all those that formed APC (ACN governors and PDP governors) defected and would face the same fate, hence APC would be disbanded legally.
