https://naijalatesttrend.com/?p=731 Federal High Court Abuja strikes out Umahi's suit for stay of execution of judgement on defection. The judge threw out the suit following confirmation that a valid appeal had been entered at the Court of Appeal, Abuja division, challenging the verdict that sacked them for defecting from the Peoples Democratic Party, PDP, to the All Progressives Congress, APC. After several minutes of arguments by Chukwuma Machukwu Umeh SAN, counsel to the governor and the deputy as well as Chief James Ogwu Onoja SAN for PDP, the attention of the court was drawn to the substantive appeal already pending at the Court of Appeal. For those who don't understand the judgemement! When such court sacks a governor in such a manner, the governor doesn't just leave office immediately. He would try his luck first by applying or filing what we call STAY OF EXECUTION which will be granted him by the court. If the court grants him such prayer/application it then means that he won't be leaving office yet. It means that if even though he was asked to vacate the office, he has obtained permission from the court to remain in office pending when the case at hand will be over. It is now left for the court to grant him "stay of execution" or decline him same. If they grant him, then he still remains governor while the matter is heard if he is denied, then he's gone for good pending when Supreme Court decides otherwise.... Wotowoto judgement and the miserable inconsistent jugdement. Unlike samfara and kross river, what is the contexual difference in the action taken by umahi from dumping pdp for apc. Justice is absolutely not equal in this land. |
