Is the alleged crime not bailable? You should arrest and charge people to court promptly, if you grant administrative (police station) bail and the criminal refuse to show up, arrest the big man that stood as surety. What would be the basis for such arrest? After arrest what do you charge such people for, requesting for the bail of an arrested person? What of when Police arrest people on trump up charges? Arrest any one who wants to see to the release of such person(s)? What we need is a review of the Nigeria Criminal justice system as a whole to ensure the following 1. No individual, no matter how powerful or connected (including law enforcement agents) can circumvent the system 2. Remove the undue delay in the court and justice system. The era where a case will last for years in court without headway should be dealt with 3. Overcrowding of court with cases to the extent the judge is overwhelmed need to be urgently addressed - the idea of a judge physically writhing down all testimonies and evidences given in court should be done away with. 4. Locking people up unduly on the guise of awaiting trial is bad for national development. These are some of the fallouts of a failing / ineffective justice system. The DPP needs to wake up to her responsibility. Government need to invest more in the 3rd estate of the realm 5. Police need serious revamping of the operations and process. Picking people up and detaining them on little or no evidence gives too much room for abuse. 4. |

Well, we can all try to remember that there is no law against seeking bail or standing surety for an arrested person, and that any police officer who tries to arrest anyone who does that is, himself, committing an offence. Mr Minister of the FCT is not God, and cannot, with certainty, describe an arrested person as a criminal until he/she has gone through a judicial process which declares them guilty. One would expect a person of with his experience and exposure to know that. |
