The Court of Appeal in Abuja has asked the Academic Staff Union of Universities (ASUU) and the Federal Government to opt for an out-of-court settlement in handling the impasse between both parties. The court took the decision on Wednesday while hearing the appeal by ASUU over the September 21 judgement of the National Industrial Court, which ordered the university lecturers to suspend their strike action. Lead counsel to ASUU, Mister Femi Falana (SAN) and Mister James Igwe (SAN), lead counsel to the Federal Government are all in court. ASUU has been on strike since February 14. In August, the union declared a “total and indefinite” extension of its industrial action, noting that the government has failed to meet its demands satisfactorily. The academics seek improved welfare, revitalisation of public universities and academic autonomy among other demands. One bone of contention for academics is the non-payment of university revitalisation funds, which amounts to about N1.1 trillion. Industrial Court of Nigeria ordered ASUU to resume ASUU appealed their judgement at Appeal Court On the side, FG registers another lecturers union CONUA Going forward, the Appeal court hears ASUU’s appeal urging Appeal court to prevent FG from ordering them to resume. The Appeal court instead asks ASUU to please settle with FG outside the Court. But FG no want again cos CONUA (ASUU breakout lecturers) have been registered and gazetted It is just like your senior student beating you in school, you go to Principal Office and report to Principal, principal asks you to go and settle with Senior student. Meanwhile senior student don dey friend your seat mate ASUU game overrrrrrr FG dey pummel you. Na supreme court remain Up CONUA! As a student of labour relations, l earlier stated that the Fg is moving in circles as regards measures taken by the supervisory ministry in charge of getting this dispute settled. He only conciliated two times in eight month and then went to industrial court when there are other options given to him to address the issue. How about industrial arbitration panel, what about body of inquiry even the use of third party mechanism. With the right frame of mind and sincerity of purpose, this matter would have been resolved long ago. In negotiations, you don't go with biased mind. From my point of view, the minister is biased already and would not be able to settle this matter with ASUU. The only solution now is for him to set up the industrial arbitration panel made of seasoned arbitrators in both the gov. and ASUU side or find recourse in the window explored by Hon. Speaker HoR.
