Senator Adamu Aliero’s bid to return to the senate has suffered another setback as the Court of Appeal sitting in Sokoto, Sokoto State, has upheld the judgement of Justice Babagana Ashigar of the Federal High Court, Birnin Kebbi, that Alhaji Haruna Sa’idu is the PDP candidate for Kebbi Central Senatorial Zone.

Justice Mohammed Danjuma, who read the judgement on behalf of a panel of justices, upheld the judgement of the respondents: Peoples Democratic Party (PDP) and Independent National Electoral Commission.

The appellate court held that the decision was arrived at after perusing all the arguments presented by different counsels, citations of court judgments and other judicial considerations.

He further said that the eight appeal legs were considered, thereby dismissing the suit based on lack of merit and upheld the lower court’s judgment.

This is another good judgement for APC. Once Aliero is fully out of the race, it is going to be an easy ride for APC in Kebbi. In fact, Aliero may even return to APC with this development.

This is another good judgement for APC. Once Aliero is fully out of the race, it is going to be an easy ride for APC in Kebbi. In fact, Aliero may even return to APC with this development.

I can't laugh 58% of the billboard of PDP in kebbi state is sponsored by aliero, hard to see any billboard without bearing his image..

He refurbished 25% of secretariats, and you think he'll leave the PDP like that.

Kebbi Senatorial seats: Appeal Court dismisses Aliero, Abdullahi, PDP suits

The Court of Appeal sitting in Sokoto has upheld the High Court ruling validating the nomination of Alhaji Haruna Sa'idu Dandio as the Peoples Democratic Party (PDP)Candidate for the Kebbi Central Senatorial District.

Kebbi Central Senatorial District comprises Birnin Kebbi, Gwandu, Jega, Maiyama, Koko-Bese, Kalgo, Aliero and Bunza Local Government Areas of the state.

The plaintiff, Dandio, was declared winner unopposed in the PDP Primary conducted by National Electoral Officers of the Party on May 24, 2022 and monitored by the Independent National Electoral Commission (INEC).

Muhammad Adamu Aliero, a two-time Governor, former FCT Minister and incumbent Senator of the APC defected to the Peoples Democratic party (PDP) on June 09, weeks after the first PDP Primaries was conducted.

He was announced winner of the fresh Primaries on the same day of his defection with 246 votes against Dandio's 15 votes with three votes as invalid. The election which held at the Birnin Kebbi Civic Centre was monitored by INEC officials and party stalwarts.

Dissatisfied with the conduct of the Party, Dandio, the plaintiff had sued Aliero, PDP and the INEC for conducting a fresh Primary when he neither withdrew or had been pronounced dead, in violation of the Party Constitution and Section 33 of the Electoral Act 2022.

Justice Baba Gana Ashigar of the Federal High Court, Birnin Kebbi in September, upheld the prayers of the plaintiff.

In his judgement, Justice Ashigar said, “since the first primary election was not challenged, it is in my humble view that the first primary election for Kebbi Central senatorial district remained authentic.

“I therefore, upheld all the prayers of the plaintiff.”

Aliero however approached the Appeal Court in Sokoto for a favourable ruling.

But in same vein, Justice Mohammed Danjuma JCA who read the judgement on behalf of a panel of justices, affirmed the respondent (Dandio) as the Valid Candidate of the Party.

The appellate court held that the decision was arrived at after perusing all the arguments presented by different counsels, citations of court judgments and other judicial considerations.

He further said that the eight appeal legs were considered, thereby dismissing the suit based on lack of merit and upheld the lower court’s judgment.

In likewise manner, Yahaya Abdullahi Abubakar also did not get a favourable ruling at the penultimate Court. Abubakar (representing Kebbi North Senatorial District), then of the APC, was elected Senate Majority leader in 2019 until June 07 when he defected to the PDP.

Hon. Sani Bawa Argungu, the plaintiff, had asked the court to declare that by the combined provisions of Section 84(5) (c)(I) (II) of the Electoral Act 2022(as amended), Article 2, 50(1), (2), (c) and 50(4) of the Constitution of the PDP, 2017 (as amended), Article 5(i)(ii) , 9(a) (d) and 11 of the PDP Electoral Guidelines for Primary Election and Articles 1,7.16 and 17(a) of the INEC Regulation for the Conduct of Political Party Primaries and the PDP Result Sheet for the party’s primaries for Kebbi North Senatorial District, the plaintiff who scored a total of 038 votes and became the first runner up at the PDP (2nd defendant) primary for Kebbi North Senatorial District on 24th May 2022 is the lawful and validly nominated candidate of PDP for Kebbi North Senatorial District at the February 2023 polls.

In September, Justice Ashigar also ruled that Argungu was the valid Candidate, a position the Appeal Court in Sokoto has now validated.

Aliero is the only one that could have given Apc a fight for their money in Kebbi. Now , that he is not on ballot . It is safe to say APC has won Kebbi state even before the election begins.

No one has heard of Obi here in kebbi state

You should be more concerned about why Abdulahi Adamu and his counterpart have decided to kick against BVas at this critical moment, and not about whether or not you've heard about Obi in Kebbi State.
