He is forum-shopping.
1st - Emenike went to the Abia High Court (Umunneochi Div under Justice Benson Anya) praying the Court to compel INEC to publish his name as the Candidate. The Judge allegedly held that judgement past 14 days. INEC was the sole defendant, he won.

When Ogah got wind of it, he applied for leave of Court to be joined at the Appeal Court, the Appeal Court declined as it was filed outside 14 days. Leave of Court is not an Appeal per se so whatever the judgement, it is not binding on him.

2nd - A Dan Eke, a Guber aspirant complained about the mode of Primaries and that he wasn't informed of the Primaries or its mode as an Aspirant. He lost at the FHC, then at the Appeal Court this month. (That's the one you are talking about)... He has gone to Supreme Court now.

In Ogah's suit at the FHC, Abuja.... Emenike, APC, Abdullahi Adamu & INEC were parties. Dan Eke even filed to be a party to the suit and it was granted.

Hence, it is binding on all. I am sure, Emenike must have appealed.

The judgement should extend t punishing those judges in the lower courts who nullified their candidatures in the first place. The only way APC could be prevented from dominating the entire state was that tried and failed attempt at taking them off the ballot paper. Now lets have a free, fair and credible election. Whoever wins has my blessing. It will even be interesting to see Obi win the presidency

TA is the most senior PDP official in the region by virtue of been a former Gov and the State is under PDP unlike Egwu & Udenwa.

He also co-ordinated the SE Govs for GEJ in 2015.
