MTN, Africa’s largest wireless carrier, said it has received a GHS 8.2 billion, R11.5 billion, N350 billion back-tax bill, including penalties and interest charges, in Ghana that it plans to fight.

The bill is for the period between 2014 and 2018 and implies that the South African company under-declared its revenue in the country by 30%, the company said in a statement on Friday.

MTN said it received the notice this week.

“MTN Ghana believes that the taxes due have been paid during the period under assessment and has resolved to vigorously defend MTN Ghana’s position on the assessment,” the company said.

Ironically, Ghana awarded MTN for "excellent compliance" in 2019

Curiously, the Ghana Revenue Authority presented MTN with its Platinum award in 2019 for excellent compliance with all tax laws and for being the country’s highest contributor to tax revenue.

The award specifically covered the 2018 tax year — one of the years the GRA has called into question in its audit on MTN.

In its 2018 annual report, MTN noted that it contributed an average of around 3% of Ghana’s total tax revenue.

It has consistently won the GRA’s award for being the country’s biggest taxpayer.

MTN's Nigeria tax dispute

Africa’s largest wireless carriers are increasingly caught up in tax disputes on the continent.

MTN was victorious in a conflict in Nigeria in 2020 when the government had to drop a $2 billion, R34 billion, N905 billion claim for back taxes following a 16-month battle.

More recently, Vodacom Group Ltd. (South Africa) has been embroiled in a controversial tax demand in the Congo that saw the government seal parts of its offices and freeze its bank accounts.

The Ghana Revenue Authority (GRA) used a third-party consultant as well as a new methodology, the company said.

“MTN Ghana strongly disputes the accuracy and basis of the assessment, including the methodology used in conducting the audit,” the company said.

Florence Asante, a spokeswoman for the GRA, said she couldn’t immediately comment when reached by phone.

Ghana economy in crisis

Ghana, which lost access to the international capital markets due to its ballooning debt and loan service costs, suspended interest payments on its external debt last month.

The nation is trying to restructure its obligations to finalise a $3 billion, R50.5 billion, N1.4 trillion bailout from the International Monetary Fund.

MTN said in the statement that the GRA had begun an audit of its Ghanaian business in 2019 to look into the “reliability and completeness” of the revenue it declared during the five-year period.

The GRA hadn’t issued the unit with any guidelines or standards relating to its new audit methodology, MTN said.

“MTN Group and MTN Ghana will continue to engage with the relevant authorities on this matter and MTN remains resolute that MTN Ghana is a tax compliant corporate citizen,” the company said.

Secondly, you might be the biggest economy in Africa but not by a landslide and South Africans are generally 3 to 4 times richer than Nigerians (per capita income). And MTN can expand to the middle east and Asia, like it already is doing.

MTN can pack up and leave anytime honey - just like Vodacom, Shoprite, Massmart and MrP have, to name but a few. You're not holding us hostage as can be seen by the unabated xenophobic attitudes in SA and you can't do a dime about it.

Ghana has always lived beyond its means. I can never understand why

My dad remembers when coming back from the UK on ship in 1969 and having a stopover in Ghana. He said prices of consumer items were quite high.

Nigeria was to suffer the same fate in about 12 years time when the price of oil collapsed and Shagari did nothing to resolve the issue except some ludicrous "austerity measures" rather than serious structural economic reform.

Buhari junta who overthrew the Shagari government displayed his poor understanding of economics by introducing price controls which led to artificial scarcity of consumer goods.

It was only Banangida who overthrew the Buhari junta introduced market based reforms but it failed to achieve the expected results due to the reckless overspending by that government that led to high inflation and persistent depreciation of the Naira.

Also, his reforms weren't deep enough because it would have left him with nothing to use as patronage to his loyalists or win friends.
