THE IGNORANCE OF THE WORKINGS OF BVAS IN OUR ELECTION AS RELATED TO RESULTS TRANSMISSION TO INEC SERVER AND THE REPORTAGE BY THE SERVER.

1. Inec put maximum of 500 to 750 registered voters per polling unit, thus the BVAS were programmed like that.

2. However, there are several polling units with over 1200 registered voters.

3. In such polling units as in (2) above will use minimum of two BVAS on election day for the purpose of election in the affected polling units.

4. At the end of the election, the votes are counted together regardless of the number of BVAS used for the election. The results are then filled into INEC form EC8A and same is then sent to INEC server via the BVAS. This is where the challenge is, remember each BVAS machine does *NOT* contain total number of accredited voters, infact, each BVAS will make the result "seemly" over voting until all the BVAS(s) used in such polling units *SYNCHRONISED*

5. In this context synchronisation means that all data on each of the BVAS machine has been processed together in the server such that all the data added up to form a single data. However, this takes time and depends on many factors such as data size, network of service provider, memory of server and processor, internal working of various diodes, resistors etc.

Practical examples of (5) above is when salaries of say police is made through a bank, it is programmed as a single schedule in the bank and paid by the push of a single button "pay" or "approved" but in reality the police officers will get their payment alert at different times across days sometimes weeks. By the way, the BVAS machines are the primary data source. Why didn't the compromised Tribunal Chairman refer to them rather than embrace a server report that derives from the BVAS devices.

Which Bvas report was relied upon to declare the winner APC applied for the Bvas report and they were given. Up till the time of judgement, INEC did not deny the Bvas report given to APC. All these syncronise talk are just after thoughts.

It's not even funny when INEC is admitting to declaring the wrong result shocked

Is it not INEC's job to check the uploaded results on the portal with BVAS data....It's called verification...it happens in all elections across the world.

Imagine declaring a presidential candidate winner of Feb 25 election only before swearing in the courts say NO....that person did not win cos bvas data shows different number of votes......INEC can easily end Nigeria as we know it.

You're a mumu and the money spent on your education was wasted.

1. APC got a truly certified report from INEC. I don't know why you said they "fraudulently" got BVAS report.... It's obvious you didn't follow the Tribunal proceedings.

2. They didn't get the report immediately after the election - it was two weeks after. PDP got there own after the "pendency" of the case at the Tribunal. If you don't know the meaning of pendency, consult a lawyer.

3. Even INEC came to court with a report totally different from what they gave both APC and PDP. It got to a point that PDP lawyer had to disown INEC's BVAS report.

4. The majority judgement held that for INEC to have issued a different report to PDP and come to the Tribunal with another report, it meant they were tampering with official documents since they didn't withdraw the earlier reports.

5. It's like a witness contradicting himself in the witness box. No judge will overlook such a misdemeanor.

You can continue to amuse yourself with meaningless jargons. Synchronization is not known to our electoral laws.

Any polling unit that bypass BVAS, the votes from the polling unit will be deducted from the total votes, the way it was done in Osun State.

Another example is that we get many alert balance of account that is incorrect, infact sometimes the gives two different balance in a single text message -
i. Current bal. X
ii. Available bal. Y

7. This was what happened in the case under review, the APC fraudulently got a report from the server while synchronisation is ongoing while the PDP got another report from the same server after more data has synchronised.

From your above analysis it means Inec will have to wait for total synchronisation of the Bvas data which might take days before declaring a winner?

By the way, the BVAS machines are the primary data source. Why didn't the compromised Tribunal Chairman refer to them rather than embrace a server report that derives from the BVAS devices.

I have no doubt that the Appellate court will set aside that procured "Jankara" judgement.

I disagree with this assertion, that couldn't have happened in all the over 700 PU cancelled. Even at that, if all BVAS used were captured, it would have indicate PU 1 & PU 2. Osun issue is a lesson to all.

When apc asked for the records....
Why did they give APC unsynchronized data...but when apc discovered the evil schemes...they tendered in court another data daht they went and altered as an after thought...Oga use yo head Nah.

If the result was tie after the deducted votes, there would have been a rerun at the cancelled units

But after some polling units were cancelled and the result was declared, Oyetola defeated Adeleke, so why should there be a rerun in an election Oyetola clearly won?

So inec declared a winner without the so called synchronisation but suddenly remembered they need to synchronise, over 30 days after election and after signing certified true copy of a bvas result ? All these your bullet points is not necessary, the court works with evidence and not theories.

The 2022 Electoral law recommends cancellation and the failure of INEC to cancel it violated the electoral law. Outright cancellation was in the law to act as strong deterrrent to rigging by overvoting by politicians in their strong political bases.
It was either a fatal flaw by the lawyers of Mr Nurudeen Jackson not to do a cross appeal and investigate the results of areas where APC got its highest votes or his lawyers found out that Oyetola's votes were clean and matched BVAS.
