announce the result of an election, subject to his or her verification and
confirmation that the—
(a) number of accredited voters stated on the collated result are correct

(b) the votes stated on the collated result are correct and consistent with
the votes or results recorded and transmitted directly from polling units
under section 60 (4) of this Act.
(5) Subject to subsection (1), a collation officer or returning officer shall
use the number of accredited voters recorded and transmitted directly from
polling units under section 47 (2) of this Act and the votes or results recorded
and transmitted directly from polling units under section 60 (4) of this Act to
collate and announce the result of an election if a collated result at his or a
lower level of collation is not correct.

Let me school you further, even though I am not a lawyer but just using my common sense that is not common.

Section 60 of the Electoral Act states that “the presiding officer shall, after counting the votes at the polling unit, enter the votes scored by each candidate in a form to be prescribed by the commission as the case may be”.

More so, section 60 (5) of the Act states that the presiding officer shall transfer the results including total number of accredited voters and the results of the ballot in a manner as prescribed by the commission”.

Now, what was prescribed by the commission? The prescribed manner here is the BVAS, which INEC introduced to ensure that the electoral process is credible. The BVAS was introduced by INEC in line with Section 148 of the Electoral Act, which gives INEC power to make guidelines and regulations to ensure the full effect of the law.

Can INEC now turnaround and say its never introduced BVAS to transmit results from polling units for the credibility of the polls?

The polling unit I was the LP agent there voted APC on the premise that he would prefer Yoruba man to be there. He also told me that he chose to be LP agent because of the money involved. In such case LP wouldn't have gotten vote there if not because 9 people came to vote LP.

INEC is an independent body....a court cannot dictate to INEC on how it will carry out its own responsibility. This is an abuse of court process. This judge will soon be sanctioned by NJC.

Go and ask CBN.
