*I was assistant polling officer at that election. It was a big lie that the North didn't vote for Awolowo. Obasanjo blocked it. He single handedly changed the constitution of the country. He removed the clause that says, in case of a tie, they should go to electoral college. It was not the work of the Supreme Military Council at the time. Obasanjo had done worse things in the past during his tenure.*

Shagari won by popular votes and by number of States.

Obasanjo is never the type of person to be used as a reference point. He is too shady you will doubt is if his real name is Obasanjo.

And what happend thereafter? The vestigial remains of the post 1975 Gowon northern military who used Obafemi Awolowo to execute mass genocide against the Eastern region threw him under the bus for Shagari despite the servitude. My dad was among rhe military convoy that facilitate his burial rites in Ibadan then in 1986 or so.

There was no tie
He got 25% in 12 states and 19% in Kano the 13th state
Richard Akinjide SAN said the constitution was wrong that 2/3 of 13 was. 12 2/3 not 13 and therefore in the 13 th state what we needed was 25%/ of 2/3=16%
That argument went to the Supreme Court which agreed and said in future it must be 13

In those circumstances there should have been a run off or Electoral College but the Military government cooked up judicial magic and Shagari was sworn In
Akinjide was made Attorney General

The Supreme Military Council was not the Supreme Court.

When you said the Constitution said explicitly 13 States, that's not true. Our Constitution will only say two-thirds and stop there. The 1979 Constitution like the 1999, simply said two-thirds and stopped there.

Statutes in our Constitution must be given their literal and ordinary meaning.

Section 34A(1)(c)(ii) of the 1977 Decree (1978 Amendment) was promulgated a year before the election was at play here. OBJ signed them I think in July, a month before the election. The election held in August 1979, how will Obasanjo have had someone in mind (if any), maybe Baba did we are not certain.

THIS IS THAT SECTION. IT NEVER SPECIFIED 13.
'A candidate for an election to the Office of President shall be deemed to have been duly elected to such office where - he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation'

Akinjide SAN is like Malami SAN like Aondoakaa SAN like Adoke SAN and all others before them.

It's just like the FCT issue we have now. That case simply went to the SC and they decided how they deemed fit. Even till now, what we had then is what we have now. Electoral Spread, then when it gets to the SC they decide.

I have a full-text of that judgement, can't see where OBJ did what was claimed here. Presidential Elections are tedious and our Courts refrain from taking a step of cancellation or even a run-off.

E don tey igbos have been calling Lagos no man’s land to ridicule the then western regions power.

If only Azikiwes NCNC had listened to Awolowos AG about not making Lagos the capital of Nigeria and about secession, we would have avoided the bloody tribalist past of this country. This same professional manipulative land grabbers and chestbeaters pushed for secession removal so they can enter northern civil service.
