It is simply shocking that the Senate President, Dr. Ahmad Lawan, did not understand the import of the Electoral Act 2022 he supervised its enactment.

During plenary last Tuesday, Lawan, said there was no provision for the electronic transmission of results in the Electoral Act. He added that the parliament only made provision for the transfer of results from the polling units to the INEC server.


But to show that he was ignorant of the law he passed, two PDP senators, Gershom Bassey (Cross River South) and Abba Moro (Benue South) faulted his argument. They said the Act mandates the Independent National Electoral Commission (INEC) to transmit election results electronically from polling units to its central server.

Briefing newsmen in Abuja, Senator Moro lamented that the INEC went ahead to announce the results of last Saturday’s elections despite local and foreign outcry due to substantial non-conformity with the Electoral Act regarding the electronic transmission of results.  

Moro said: “By the passage of the Electoral Act, BVAS should be able to transmit electronically from the polling unit to the server in the INEC office. When it gets to the wards, it is supposed to transmit to the local government and later to the state. It is expected that when this sequence is followed, we can guarantee the transparency in the system.”

Senator Bassey also corroborated the submission of Moro, saying, "The key element of the process is that when the results are collated at the unit level, they should be uploaded to the server which must be accessible to everyone.

“It is the leg upon which the transparency of the INEC stands. We are saying that the process has been compromised because many polling units have not been uploaded and it is a major flaw of the election,” he said.


Will Lawan say that he does not know the import of Section 60 (5) and Clause 38 of the INEC Regulations and Guidelines for the Conduct of Election 2022.

Clause 38 of the INEC Regulations and Guidelines for the Conduct of Elections, 2022 stipulates thus: “Upon completion of all the Polling Unit voting and results, procedures, the Presiding Officer shall:

-(i) Electronically transmit or transfer the result of the Polling Unit, direct to the collation system as prescribed by the commission.

-(ii) Use BVAS to upload a scan of ES8A to INEC Result Viewing Portal (IReV), as prescribed by the commission.”

According to new electoral law, the determination on how to transmit the election results shall be determined by the committe which is INEC an independent body.

Prof Yakubu and Inec was so smart not to transmit the results in the public portal in real time but instead have them in their own server which they waited for the physical delivery of results by both Rec and Scope and compare to what was sent to the Inec server before posting on public portal.

Do you know how confusing it would be if a Candidate A is leading in online portal while candidate B is leading in results declared by INEC.

Those who have evidence of rigging should head to court and present their case without disturbing Nigerians. We go see how concorted results will be admitted as the original results in court

Agreed that INEC may even be the one to decide( however the electoral act mandate-not allowed INEC the any choice of using electronic transmission of election results).

So a moral question is, why would the APC-that called itself a progressive party and government be afraid or opposed to a simple and a most viable democratic process of electioneering as electronic transmission of election results?

Why the irresistible urge to continue with the analogue system of voting when digital technology have made it easier? @ least our electronic banking and other ICT applications have made this possible? Why is the APC always fond of speaking on behalf of INEC?

He was accused by fellow supreme court judges( including the sitting Justice Arowolo) of high handedness, impunity and gross unimaginable corruption-the first and worst ever seen against a sitting CJN even forcing him to retire prematurely. What about his chronic health issue?

Justice Tanko was lucky he was not prosecuted because he was Buhari stooge CJN. The otherwise would have been the case if he were a non hausa-fulani. Then I now ask you- who loose or won? Don't be warped man.

That was how the now disgraced house leader, Ado Alhassan Donguwa was shamelessly saying on national TV that the law allows National assembly contestants to be in possession of 70 million naira in cash "hard copy" on election day

Abi, Inec are in the position to determine how to transmit the results whether manually or electronically.. In addition, INEC is an independent body

Atiku was in far away in Dubai while Obi was busy investing with the money he ripped Atiku off in the 2019 election.

Add Obi's votes to Atiku's own, seh you see Pdp winning convincingly, Atiku also thought about that but once bitten, infinite shy.

Peter Obi is a demented liar who will never ever rule Nigeria or Anambra again using his stooges. He has no case at all. As long as there is substantial compliance with the electoral act, Tinubu's election will be upheld. Substantial is the key word because full compliance is never required. Uploading of the election results from polling unit to Irev is at the discretion and direction of INEC even the electoral act says so. They had glitches and even evidence from Galaxy backbone that over 200 hacking attempts were made to comprise their system. The judiciary doesn't need any more to convince them.

SC are not in any position to tell INEC what to do but they can make recommendations.

SC are only interested in figures which must have been in your sworn affidavits that shows you won the election . Your evidence must indicates you have the highest figure and also have the required 25% spread in 24 states.

Any arguments outside what's your own sworn affidavits won't be admitted. So start preparing your evidence now

SC are not in any position to tell INEC what to do but they can make recommendations.

SC are only interested in figures which must have been in your sworn affidavits that shows you won the election . Your evidence must indicates you have the highest figure and also have the required 25% spread in 24 states.

Any arguments outside what's your own sworn affidavits won't be admitted. So start preparing your evidence now
