This has been in contention for a while and will still be till a stand is given at the supreme court of Nigeria. Recently on a Broadcast on Channels, the Vice Presidential aspirant of the Labour Party Datti Baba Ahmed urges the President and the Chief Justice of Nigeria not to participate in the swearing in of the president elect Bola Tinubu on May 29, 2023. This means the constitution applies to the FCT the same way it applies to other states of the Federation, with certain modifications and exceptions as may be necessary due to its unique status as the capital territory of Nigeria. That's settled already. For you to be declared winner you must win 25% in the FCT. It is a constitutional requirement. FCT has a special status. APC weren't expecting to perform so badly in FCT being the incumbent party, so it took them by surprise. Yakubu Mahmoud declared Tinubu in error and put the Judiciary on trial by saying 'Go to court', because he believes there are corrupt Judges who are pro-Tinubu and who would stand logic on it head. Teddy0147: My brother don't use emotions to interpret this section of the constitution. Hillary Clinton won more votes than Trump but Trump became president due to the higher electoral college voted. The FCT is not a state. They don't have a governor. They don't have a house of assembly. It is akin to the US electoral college votes. When you use "and" it means additional to. It is different from "including". Moreover the supreme Court already explained this same matter in 2007/2008 in the case between Buhari and Yaradua. And they said you must get at least 25% of the votes cast in the FCT. APC made a mistake. They probably forgot to fight hard in the FCT. I don't know how they made such a mistake. 9 Likes 4 Shares |

My view is Nigeria consists of 36 federating units and a federal capital. So FTC is not a state. The framers of the constitution I believe knew what they were doing, when they insert the clause "... and the FTC". So in this clause the FTC has the same rights as of 36 states. This then means we should be looking at 2/3 of 37 as the FTC is seen as equal to any of the 36 states under this specific clause. 1 Like |
