see this one! That is the first thing the court will adjudicate on before going into the case proper. Once the court lacks jurisdiction to entertain the case, no matter your evidence, it is thrown out. The court has said this is an internal issue within the party and a case on this cannot be instituted by anyone except members of APC who feel aggrieved by it. Therefore, Obi is just an interloper.
Also, in the Osun guber case, the court said the issue of forgery by Adeleke has been settled severally and therefore threw out the case. The same thing with the Tinubu cases. It has been settled severally and will therefore be thrown out of court.

At the bolded, if Atiku has no legal basis for this nomination case then it is Obi that will have abi? Can't you see in clear terms the legal basis the court is implying is that nomination of candidates is an internal party affair. It's not the business of Peter Obi and Atiku how Tinubu and Shettima were nominated by their party as they're not APC members. Maybe Peter Obi joined APC overnight that I'm unaware of.

let's be guided, first this case started from the high court and so clearly not an election tribunal matter which normally is instituted in the appellate court.
second, the case was dismissed on ground s of locus standi, this is because the case was not filed by mr atiku but by pdp.
Note-what might change? now that the matter have been filed before the appelate court which doubles as the presidential election tribunal having both Messrs Atiku and Obi and their respective polical parties joined in the suit and then INEC, Messrs Shetima and Tinubu as 3rd,2nd, and 1st respondents in that order then a locus standi in my view has been established. this means that the matter of double candidature will now be heard and tried under the provisions on our laws.

Reason the federal high court throw out the case is due to Locus standi. That is, pdp doesn't have the legal position to file such case. At that level, only somebody that did primary with shetima, tinubu, or APC member can file such case.

But at election petition tribunal, pdp, LP, candidates have the locus standi to file such case by the provisions of the law.

OYetola petition challenged the results and pray Adeleke be disqualified over forged results .. process & result

True talk. The FCT can be used to make up the 24 states require by law. It is not necessary for any other purpose.

PDP don't have power to challenge APC primaries only individuals that participated can file that case. But PDP has the locus standi to file the case at the tribunal because they participated in the election. You can only challenge an election you participated in.

After the names of APC candidate has been forwarded to inec, the case becomes status barred.

The opposition can only challenge the candidates after election if they didn't meet up with the requirements of participating in the general election.

APC primary case is status barred at presidential tribunal, there is a time frame to challenge nomination of a candidates and the time elapsed before tribunal case.
E.g zamfara,rivers, and bayelsa case. Apc lost these states to pre-election case not Tribunal.
