That means with the expiration of the 21days window no party can file any petition. However the DSS can take up the matter, lock him up (damning the consequences) and make a high court judge refuse him bail.

The fact is, having dual citizenship is unconstitutional to be president and perjury is a serious crime for elected officials.

And why exactly will the DSS lock up the president- elect over a mere allegation that has not been proven in court? An accuse is presumed innocent until a court of competent jurisdiction rules otherwise. So, why should DSS detain the president- elect illegally over a social media rumor?

No.

First there needs to be an investigation. It is when it has been proven that DSS can take such extreme action.

Remember you asked under what circumstances can the May 29 not hold.

Perjury is a criminal case that has to be proved in a court of law. So to start with, a case of perjury will have to be instituted by the police or DSS in the high court. Because it’s a criminal mater, the case will go to trial with all parties presenting evidence and even subpoena may need to be served on Guinea embassy and INEC. At the minimum, the case will take 6 months. So, even if there is a valid case of perjury, it cannot be concluded before May 29. Sadly, the case can’t even continue after May 29 once the president is sworn in because of immunity. So, this is a dead end.

So, we go back to the tribunal case. Unfortunately again, tribunal can only hear election related cases and not criminal cases. They can’t rule on perjury because it’s a criminal matter. The Guinean passport issue was also not pleaded in Peter Obi and Atiku’s cases so they can’t bring it up again. Another dead end. So you see, the dual citizenship issue is all noise and nothing else. It can’t affect the swearing in and it can’t be pleaded again at the tribunal.

Oh, thanks for that. You mean the chicago certificate was not mentioned by LP? it means the court will not entertain that if it was mentioned/. I think I missed something.
