It's obvious you want to interpret it with your lay man's understanding...but at this point, you have to agree that for someone to pay over a million to become a lawyer in this Nigerian educational system, it means he is trying to acquire a knowledge you cannot buy at oshodi market...

It's either the law or nothing... when lawyers are talking about the constitution and electoral laws, just close yourouth and listen
Who see this your comment now go think say you no finish primary school..
So Tinubu's lawyers are not lawyers but historians ba?

so on what ground will the supreme court overule the decision, knowing well enough that the fraud of using technicality can not even help this time, the law is the law. But I don't expect tinubu's supporters to understand or have regards for the law.
Maybe, maybe not.

That's what the law always have been.

The disqualification should have been done by INEC themselves.
INEC has no power to disqualify a Candidate, the SC has said that many times. So even if you submit a forged document, INEC's only responsibility is to publish for the public to scrutinise.

This is the law on the 14 days deadline or do you have another section they are relying on?

When a lawyer files a process, the respondents are expected to respond in writing...this is a new process and the respondents are yet to respond...only to find you on nairaland responding for them ..hahahhahahahahahhaba..

Tinubu lawyers or historians are yet to respond to this particular one...they only responded to that of obi on double nomination and the court has given a ruling...get your fact right

All the elements are against Tinubu.

PDP/LP is pursuing him with double nomination while APM is pursuing him with invalid nomination.

Tinubu nominated Shettima 21 days after Masari withdrew instead of the legally mandated 14 days.

This one Jagaban is threatening judiciary and our constitution. Please is he bigger than Nigeria ??
If he doesn't meet the constitutional requirements they will be no anarchy.
Let him get out of that place.

We want a Nigeria built on Truth, trust and fair play. We have suffered enough.
Re: Human Right Activist, Silas Joseph Onu, Analysed The Petition Of APM Against APC by JuicyStar: 9:21pm On Jul 17, 2023
Inconsequential argument. What sections 31 to Section 33 of the Electoral Act envisages is the withdrawal of the flag bearer (candidate) of the party in an election and not the vice/deputy. That it’s why it is mandated that a fresh election should hold for a party to elect a new candidate. Shetimma was not elected by party members at a primary but nominated so he doesn’t fall within persons covered the sections. Masari or Okupe who were place holders at the time can be replaced after fulfilling outlined procedures.

Matter would be thrown out.
Re: Human Right Activist, Silas Joseph Onu, Analysed The Petition Of APM Against APC by MasterTeeUSA: 9:23pm On Jul 17, 2023
They might have informed INEC in writing but kept it low. Court always give parties leeway and this was dismissed before election. If tribunal finds the election valid...only a dumb would think Supreme Court will remove the President on technicality....equal powers before the law. Only INEC results can remove Tinubu not 25% abuja, bvas upload or Shettima nomination...the World has moved on. Tinubu is ECOWAS Chairman.,.talk about a great maneuver by the JAGaBAN himself

IN SUMMARY..
If the APC agreed that Shettima was nominated on an earlier date,, (which was supposed to coincide with the last possible date for his nomination, without which Tinubu gets disqualified), then Shettima would go in for double nomination..
And then, if they agreed that Shettima was nominated on a later date, then, Tinubu must already had been disqualified,, being that his 14-days for replacing the resigned place-holder had already elapsed long time ago.

Lol. 14 days was mentioned in the article. My attachment which mentions primary election quotes the section 33 that speaks about the 14 days that was mentioned in the article.
Any other useless question?

Firstly, APM did not argue any such thing. The poster just intelligently analysed the response of the APC team to LP petition and said based on that.... Then the post suffices...

This invalid nomination relief was never sought by any of the concerned parties. Courts cannot grant you reliefs you did not seek for.

Having closed cases, no party can join any new issues even up to the supreme court when the election matter gets there.

so what was APM argument in court then

pls be factual with evidence

The truth is that the analysis is valid, and you know it does.

Tinubu is getting ready for a rerun but you, his minions, are here on nairaland making noise.

And if there's a re-run, tinubu will lose because
1) all eyes will be INEC, they wont be able to do mago mago again
2) Tinubu scammed the North by making them think he was too frail to govern. That's his strategy and why he was making those speech blunders and the north foolishly fell for it believing Tinubu will soon handover or die and a northerner will take over. Now, they've seen they were scammed and it's the reason you're slowly seeing backlash from them.

Too much forces are against Tinubu. He'll be the first Nigerian president to be removed from seat

Yeah probably because in 2012, he felt oil prices were high and he didn't trust Jonathan in terms of corruption but in 2015 when oil prices slumped to like 30 naira from 100 naira in 2012, that was a good time to begin to remove the fuel subsidy and he advised Buhari to do that then.

Re: Human Right Activist, Silas Joseph Onu, Analysed The Petition Of APM Against APC by Novarisammy2: 10:32pm On Jul 17, 2023
this is for the naive, shallow minded supporters

The APM had in its petition marked: CA/ PEPC/04/2023, contended that the withdrawal of Mr. Masari who was initially nominated as the Vice- Presidential candidate of the All Progressives Congress, APC, invalidated Tinubu’s candidacy in view of Section 131(c) and 142 of the 1999 Constitution, as amended. The party argued that there was a gap of about three weeks between the period that Masari, who was listed as the 5th Respondent in the petition, expressed intention to withdraw, the actual withdrawal of his purported nomination, and the time Tinubu purportedly replaced him with Senator Kashim Shettima. It further argued that Tinubu’s candidature had elapsed as at the time he nominated Shettima as Masari’s replacement. According to the petitioner, as at the time Tinubu announced Shettima as the Vice Presidential candidate, “he was no longer in a position, constitutionally, to nominate a running mate since he had ceased to be a presidential candidate of the 2nd Respondent having regards to the provisions of section 142 of the 1999 Constitution”. More so, APM, contended that Masari’s initial nomination activated the joint ticket principle enshrined in the Constitution, stressing that his subsequent withdrawal invalidated the said joint ticket.
