Appeal Court Dismisses Smart Adeyemi’s Appeal Seeking Nullification Of Ododo by Bobloco: 2:50pm On Aug 18, 2023

The Court of Appeal in Abuja on Friday dismissed an appeal brought before it by Senator Smart Adeyemi, seeking to nullify the governorship primary election of the All Progressives Congress (APC) in Kogi State, which produced Ahmed Usman Ododo as the party’s flagbearer for the November 11 poll.


The appellate court held that the appeal argued by Adekunle Oladapo Otitoju on behalf of Senator Adeyemi was completely bereft of merit and was thrown out.

In a unanimous judgment of a three-man panel of justices of the court, Adeyemi, who recently represented Kogi West Senatorial District in the Senate, was said to have failed to establish all allegations made against the conduct of the primary election by APC and its leaders.


Justice Mohammed Lawal Shuaib, who delivered the lead judgment, resolved all three issues in dispute against Adeyemi.


Shuaib said the allegations of manipulations and falsifications of the primary election results made by Adeyemi, being criminal, ought to have been proved beyond reasonable doubt as required by law.

He also dismissed another allegation by the appellant that he was denied a fair hearing by the Appeal Committee of the APC based on his petition against the alleged unlawful conduct of the primary election.


He said the issue of denial of a fair hearing was not raised in his originating summons at the Federal High Court, hence, cannot be raised as a fresh issue at the Court of Appeal.

In the absence of cogent and verifiable evidence on the part of Adeyemi, the Court of Appeal held that his allegations remained mere assertions that could not enjoy any probative value.

Justice Shuaib proceeded to dismiss the appeal for want of merit.

The Court of Appeal upheld the judgment of Justice James Omotosho of the Federal High Court in Abuja delivered on July 12 and which held that Adeyemi did not prove his allegations that Ododo was not lawfully nominated by the APC.

Yeye Bello don hijack the judges in Kogi. Smart should have known this and avoided wasting his funds after all,he is not the one contesting for the governorship position.

The Smart guy is 10% better than Dino and other Kogi APC members but you know,evil always win in Nigeria.

Is there any election in Nigeria where someone doesn't feel cheated?
Mechanic associations, tailors associations, Lawyers associations, Doctors associations, Estate associations even church selection processes are all fraught with allegations of cheating and illegalities. We have a bunch of sore losers who are incapable of accepting defeat.
Everyone always feels cheated whenever they lose an election. A Nigerian will rarely accept defeat and moves on in any elective process. It's always one rubbish story about they would have won if this and that had not happened.
Obi has made it even worse now. He learned the new style from TRAMP and the world's most famous SORE LOSER.

This same Mr. Smart was telling LP members that they should wait till 2031 for their turn to become president (he didn't encourage them to see justice from the courts). But when the fraud was committed against him, he cried blue murder. He went to court and could not present a good argument to support his case. I wonder what his parent was thinking when they named him Smart. Whatever they thought their son was they will be very disappointed to see how dumb he is.

Possibly the best lost opportunity for the Okun people to be residents of Lugard House in this generation.

It is noteworthy that the leadership of a Kogi State that the Okun people fought so hard to get carved out largely from Kwara State has become a mirage.

The next best opportunity is with Dino Melaye, but considering the perennial controversial/bloody nature of elections in Kogi, the Okun people will need more than sheer luck to win this one.

Smart's lawyers were not smart on this one.
