I have searched online, but can't get it, I thought the court removed him and ordered a rerun, meaning the initial 1yr or sworn in was as though it never happened.
How come he was stopped because he was sworn in twice?
Was he impeached?

This is the case;

1. Sylva finished a distant 2nd in the Bayelsa Guber Primary to GEJ in 2007.

2. GEJ was nominated VP, Sylva snatched the Primary and went ahead to win in 2007.

3. The Appeal Court sacked Sylva alongside 4 other Govs (Adamawa, Cross-River, Kogi & Sokoto) in 2008, declaring a re-run.

4. The re-run took place in 2008 and all 5 Govs won and took another oath of allegiance.

5. INEC announced in 2010 that Governorship Elections for all 36 States will hold on April 15, 2011.

6. Sylva then having some friction with GEJ fought hard to win the Primary for a second term in Jan 2011. Many said when he came in as Gov in 2007, he claimed he met a State with no Govt, many debts and no development. He was one of the closest Govs to Yar'Adua.

7. With the doctrine of necessity and GEJ been in-charge temporarily, Sylva filed a suit through his lawyer, Femi Falana, asking the Court that his tenure started from 2008 when he took his second oath of allegiance, precisely May 25, 2008.

8. On Feb 23, 2011 the FHC agreed with him that his tenure will expire in 2012 and not in 2011.

9. INEC appealed, and the Court of Appeal in April 2011 agreed with the Federal High Court that the tenure should expire in 2012.

10. INEC thereafter shifted the Governorship Elections for these 5 States to 2012.

11. With Jonathan fully in-charge after YarAdua's death, another Primary was conducted. Sylva participated and was screened out, he went to Court saying that of January should suffice, that he was still the valid Candidate.

12. PDP argued that the January Primary was for the election slated for April 2011, with that date shifted, another Primary had to be conducted for the new date in 2012. Dickson was declared winner of the Primary.

13. INEC set the new date for elections in these five States for Feb 11 or 12, 2012 (can't remember).

14. Buba Marwa of the then CPC who lost to Nyako (the Adamawa Gov) with a leave of Court approached the Supreme Court to challenge the Appeal Court decision in April 2011, i.e to challenge the Appeal Courts decision in No 9 above.

15. Supreme Court set 27th January 2012, for judgement on the Marwa suit filed in 14 above.

16. In December 2011, the Supreme Court ruled that Sylva participated in the new Primary and was screened out, that it was the internal affairs of a domestic Party, hence the Apex Court affirmed Dickson as the PDP Candidate.

17. In a unanimous decision, the Supreme Court sitting in 7 and judgement read by Onnoghen... The Apex Court held that the tenure of a Governor or President is like the Walls of Gibraltar that can never be moved. That the election should have been conducted in 2011.

That even though there was a second oath of allegiance, it didn't invalidate the decisions they all made from 2007-2008, hence their tenures began to count from 2007.

It is settled law that the time fixed by the constitution for the doing of anything cannot be extended. It is immutable, fixed like the rock of Gibraltar. It cannot be extended, elongated, expanded, or stretched beyond what it states. To calculate the tenure of office of the governors from the date of their second Oaths of Allegiance and of Office while ignoring the period from 29th May, 2007, when they took the first oaths is to extend the four years tenure constitutionally granted the governors to occupy and act in that office which would be unconstitutional. It is therefore clear and I hereby hold that the second Oaths of Allegiance and of Office taken in 2008, though necessary to enable them continue to function in that office, were clearly superfluous in the determination of the four years tenure under Section 180(2) of the 1999 Constitution.

18. Dickson was declared winner in 2012.

19. Sylva went back to the Court in 2012, that since the Supreme Court said May 29, 2011 was the date their tenures should have expired, that as at May, he was the Candidate since the PDP had not conducted the Fresh Primary. Hence, he should be declared Governor since votes belong to the Party.

20. Sylva lost at the Federal High Court, Appeal Court, lost and was fined by the Supreme Court in 2013.


That is it!

The reason for this has been due to many election litigation on sylva. Firstly, after winning under the ruling party PDP, the supreme court ruled that they should do another rerun. He won and supposed that the term will start counting after the run, court also ruled that the term has started counting from when the election was first conducted. He was booted out and an interim was put there. Fast forward to this time, the court now deem it that another 4years will exceed total number of 8years by almost 2 years. Like seriously, Sylva may have won if he has good lawyer

It's the "ruining" mate for me. Sylva out of greed has already RUINED the APC chance of mounting any substantial challenge.

It's really unfortunate that a single individual can hijack a party or institution without any repercussion.
The "ruining mate" description is even appropriate especially when the running mate is a former militant leader.

He is really a "ruining mate" alongside his principal that is a "ruining candidate"

He was sworn in twice but elected once unlike gej...that law will start working on those with clean slates tabula rasa

Finally,the person that took the matter to court is neither an apc member nor an aspirant and even filed out of time.therefore,the matter is dead...

God help us with our law, the court should endeavor to consider the future effect of their actions so it doesn't disenfranchised people at the long run.
If the person is a popular candidate of an opposition, it's likely going to cause issues as supporters are likely to see it as muscling out the person

I don't know Silver from Adam but this is purely an injustice for him. By precedence, Ex-president Jonathan won this same court case when he last contested having being sworn in twice before as president of the Federal Republic of Nigeria when he served by completing the tenure of Yar'adua and contested afresh and won after the expiration of Yar'adua's tenure and yet contested the third time which he eventually lost.
So, why is the Silver's own different? Law is indeed a two-faced sword!
