Adeleke also approved the appointment of Olayinka Afolabi as the new acting chief judge of the state.

Osun State Governor, Ademola Adeleke, has suspended Adepele Ojo from office as chief judge of the state.

This was disclosed in a statement on Thursday by the spokesperson to the governor, Olawale Rasheed, saying Adeleke approved the suspension of Ojo after the resolution of the state house of assembly.

Rasheed said Adeleke also approved the appointment of Olayinka Afolabi as the new acting chief judge of the state.

“Meanwhile, following the approval of the resolution of the House by the Governor, the Deputy-Governor has been directed by the Governor to perform the swearing-in ceremony of the Acting Chief Judge of Osun State which will be held tomorrow at the Executive Lounge, Governor’s Office, Osogbo,” the statement partly read. Earlier, the National Industrial Court restrained the governor from removing him from office.

Governor Adeleke Approves Resolution of the Osun Assembly Asking Osun State Chief Judge to Step Aside

The Executive Governor of Osun State, Governor Ademola Adeleke has approved the resolution of the Osun State House of Assembly asking the Osun State Chief Judge, Adepele Ojo to step aside pending investigation of allegations of misconduct, abuse of power, corruption and disregard for rule of law against her by the House of Assembly.

In the resolution of the Osun Assembly sitting today 16th November, 2023, the House resolved that the Executive should be informed of the House resolution and that the next in order of seniority to Justice Adepele Ojo be sworn-in immediately to avoid any vacuum in the third arm of government in Osun State.

The House had earlier resolved as follows:

“Having received various petitions against the Chief Judge of Osun State bothering on gross misconducts, abuse of office, corruption and lack of respect for due process and rule of law, this Honourable House, in performance of its oversight functions and exercise of its investigative powers vested by the 1999 Constitution of Nigeria (as amended) hereby resolved as follows:

1. That the Committee on Judiciary, Public Petitions and Legal Matters investigate the petitions against the Chief Judge of Osun State, Honourable Justice Adepele Ojo, by inviting the Chief Judge and report to the House within 7 days from today.

2. That pending the outcome of the investigation, the Chief Judge of Osun State, Honourable Justice Adepele Ojo should step aside, not for any disciplinary action, but to allow for proper investigation of the allegations

3. That while she steps aside pending the investigation, the Executive Governor should immediately swear-in the next judge in order of Seniority as the Acting Chief Judge of Osun State.

4. The the Executive should immediately notify the National Judicial Council and the State Judicial Service Commission of the resolutions of this House immediately for their awareness.

5. That the Clerk of this House should forward the resolutions of this House to the Executive, the National Judicial Council and the State Judicial Service Commission

Meanwhile, following the approval of the resolution of the House by the Governor, the Deputy-Governor has been directed by the Governor to perform the swearing-in ceremony of the Acting Chief Judge of Osun State which will be held tomorrow at the Executive Lounge, Governor’s Office, Osogbo.

He can not suspend a Chief Judge. Only NJC can. This was how problem started in some states leading to serious issues. I think Cross Rivers was one of such states. And when it happened in Kwara state, the case of Elelu-Habib v AGF is the locus classicus on the matter.

I expect NJC to react very very soon or immediately to avoid any confusion because that his 'Acting Chief Judge' may not be accepted by NJC. If that man accepts that appointment from Gov Jackson Adeleke, he may even land in trouble with NJC. Check my signature for free stuffs!

It’s only NJC that can suspend a chief judge of the State. Is this not a battle between executive and judiciary here. And the legislature arm of government in the State is much compromised too.

The most painful thing to me is the misinformation and deceit during our government classes. They told us we have three arms of government.
What we have is a single arm of government in Nigeria. The executive have the absolute power in Nigeria.

The Governor is their employer and if Ooni do anyhow he go see anyhow or relocate his ancestral seat to another state like Lagos.

Adeleke is more learned than the majority of those who hate him. Education isn't only about going to a university.

He couldn't have done that without due consultation. A few days ago, Rivers State Assembly suspended their chief judge. Are they also illiterate?

(1) A judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances -

(ii) Chief Judge of a State, Grand Kadi of a Sharia Court of Appeal or President of a Customary Court of Appeal of a State, by the Governor acting on an address supported by two-thirds majority of the House of Assembly of the State,

Praying that he be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct;

(b) in any case, other than those to which paragraph (a) of this subsection applies, by the President or, as the case may be, the Governor acting on the recommendation of the National Judicial Council that the judicial officer be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct.

You're absolutely right. I don't know why the executive government cannot maintain their lane. They don't know that other arms of the government have autonomy as much as they do.. The executives want to be the legislative, and judiciary at the same time. This is why we have chaos everywhere today.
