The state assemblyโ€™s lawyer, Lukman Fagbemi, contended that the court in Abuja โ€œis not imbued with territorial jurisdiction to entertain this suitโ€.

Fagbemi argued that the purported dispute between the lawmakers arose from Portharcourt, insisting it is outside the jurisdiction of the FHC Abuja.

How can a senior lawyer make such an argument. The FHC has universal territorial jurisdiction.

Hmm ๐Ÿค” so the yesterday leaked judgement was very true. Our judiciary have been heavily compromised. Very unfortunate. So our constitution isnโ€™t followed again. Our law makers are now law breakers.

Which part of the law was not followed? First of all what do you understand by interim injunction??

Federal might, what Fubara never considered before fighting Wike. Yesss he is fighting a just fight but such fight is a fool fight in an unjust society like ours. The one time Saraki fought Buhari, he lost kwara. It takes a fool politician to fight people with strong federal connection. For all his brilliance, fubara is still olodo in Nigeria politics. this is certainly his one and only term already as governor.

Unfortunately Sim is chicken-livered, I wish someone else like Wike was in Sim's position. This would have been a good fight. To think that Sim almost resigned. These godfathers need to learn to take the back seat. Everyone rose through someone.

People Lagosians have been fighting for years to dislodge from their politics is who you guys voted for?

๐Ÿ˜‚๐Ÿ˜‚๐Ÿ˜‚

Look at how they are bastardizing the judiciary. OBJ tried it with the constitution to perpetrate himself in power until Atiku, Saraki, and SE senators stopped him.

That was how Zamfara PDP bought the Judiciary to sack all APC elected politicians.

Same way Bayelsa PDP bought the Judiciary to sack the APC governor who won the 2019 election. What a Judiciary!

So, when are you too going to buy your own?

This has nothing to do with ethnicity.

We a don't want Wike, if he likes he should buy a the court orders he is on his own.

Interestingly they have gone to a court of coordinate jurisdiction to procure a different order that was given by the high court of Port Harcourt. Only the court of appeal can vacate the earlier order and not same high court.

All this judgement givening by state high Court will not safe Sim

The state high court and federal high court are of coordinate jurisdiction.

You can't use fed high court to vacate an order of state high court, only a court of appeals can vacate the order of a state high court. This order is a waste of time.

So Wike and his men are afraid of a declaration made by a five-member speaker? grin Where is the federal might now? They are in for a long ride. They can keep their titles while meeting in Wike's Abuja apartment. grin

As it is, their seats stand vacant! Loving Fubara. wink

Section 109(2) gives the Speaker the right to declare those seats vacant.

The problem is that a speaker can only be removed by impeachment of 2/3rds of the members of the house of assembly. The so called new speaker cannot be speaker as the old speaker was not impeached.

This case will go to the Supreme court and the 27 will win and then Sim Fubara will have to either appease them or fight with them.....his impeachment may then happen OR his second term may be gone.

The governor need to start working with those 27 ...win them to his side...he's the governor and he has influence if he continues to fight them he will loose. They seem to be supported from the FTC and Asorock

๐Ÿ˜‚ how many injunctions will the judge grant? Infact Pdp at the National level has approach federal high court in Abuja over the decamping of pro Wike lawmakers. You see that pro Wike lawmakers are in deep mess. As it stands today, their seats have been declared vacant.
Is there a crisis in Pdp Rivers State? The judiciary will clear your ignorance in due time.

Section 109 (1) (g) of the Constitution of the Federal Republic of Nigeria 1999 (as amended) which is clear. If their membership of another party is a result of division in the political party of which they were previously members or of a merger of two or more political parties or factions by one of which they were previously sponsored.
