The court should have ordered for DNA Test to determine paternity.
This is not issue of DNA or paternity. You can be a legitimate child and still be left out of a will if the deceased doesn't want to give you anything. It's at the prerogative of the will owner.

His name was not included in the will. A father can choose not to include any of his children or child in his will.
This is not matter of DNA.

Years ago , When my friend's dad died. He willed all his properties to my friend. When their father was alive and on a sick bed, his children were just sending money lavishly without taking care of the him. Except my friend who stood by him. That was why the old man , changed his will .

His brothers took him to court , they lost .
But he was advised by elders to give a little to his brothers.....which he did.

At least they have the man's name (he didn't disown them). They are like some sort of "royalties" in Igbo-land.

If they are enterprising, they can make more money than Ojukwu ever saw in his lifetime.

If this case was in Europe or America the First thing they would determine First is paternity issue because Debe needed a closure to know if actually Emeka Ojukwu was his biological father or not. If the result came out negative the case will be thrown out there will be no ground for the case to continue but if comes out positive he can now have legitimate argument and his children will be sure of their family root. Just imagine the situation of late Debe's children technically they have no family.
Re: Court Quashes Debe's Suit, Awards Ojukwu's Will To Bianca by centpado(m): 11:18pm On Mar 29
Debe actually was Ojukwu first child, borne by one of his mistress, Debe has exact resemblance as Ojukwu, so no need for any DNA. So, in matter about WILL, it’s left for the owner of the will to include those he wants to include and those he wants to leave out….

Back then I read that Debe and Ojukwu never got along well, even though they were father and son, there was bad blood between them

1.Ojukwu was alive when the whole saga began, he couldn't put his house in order before he passed on. It shows how incompetent he was as a father and husband.
2.Bianca cannot be trusted to not have used her influence to obtain a favourable judgement.
3.Bianca is from Enugu, why was the litigation in Enugu and not Anambra where the deceased properties are located?. Bianca must have used her home town influence.
3.The plantiff should appeal the judgement and his other siblings should be allowed to join in the case.
4.Bianca has benefited immensely by bearing the surname of Ojukwu than any of biological children and immediate siblings of Ojukwu. She has had many confrontations with the family household, while she potrays herself an angel in the public, reverse is the case to her husband's family.
5.Every children of Ojukwu, born out of wedlock or not, including his wives, must receive a share of the properties of their father and husband, as was the case of MKO Abiola.

He should have awarded half of his estate to the wife and the other half to his other children. What he did was mean

The fact that it took a court a whole 11 years to determine a case before it should be worrisome to every sane person in the country.

If you read the news report here well, you will see that it Is the disclaimed Ojukwu son who took out the lawsuit in Enugu, not Bianca.

Also, if you have been reading the papers on this issue you will also know that the deceased properties are located all over the south East including Enugu, and several parts of the country.

Also, other children of Ojukwu inherited properties from their father, and there is nobody living in south East who don’t know that the two other wives of Ojukwu are dead, and Bianca is the only surviving wife.

As for Benefiting from Ojukwu name, Bianca also has a famous surname, hardly anybody in the country that doesn’t know she is the daughter of a former governor who is one of the wealthiest men in South East.

My thoughts exactly. Why enugu state high court. Would bianca have tolerated it if some other women did exact same thing in her family?

If she was as virtuous as being portrayed everywhere, she should spearhead an out of court, amicable settlement to appease all the factions within ojukwus household.

The one between ojukwus brothers and herself, i am not sure if it has been settled.

Everybody already knows how igbos brothers will fight a wife of their dead brother over the assets of her husband. Even the male sons in a polygamous family. They are notorious for shameful widowhood practices.

This guy should have gone for DNA and save himself all this trouble.

Omo, go back and read the story again before you comment. Where did it mention ancestral properties? Ojukwu distributed his properties to his children and relatives in his will which was published in all the newspapers.
Bianca and his lawyers are named as administrator of the estate. It doesn’t mean he gave her all his property. Receive sense.
Those of his children and relations who he gave properties clearly have received their share otherwise they will have sued her to court. It is the one he did not recognize as his son that have gone to court.

You cannot compare MKO and Ojukwu. MKO was a yoruba man and a Muslim both with rich culture of handling inheritances. In igboland, they say all inheritance belongs to the first son. A good cultural solution to handling inheritances.

It may have been Bianca manipulated her husband, lawyer, and the court or he didn't trust the mother of the plaintiff or doubt the paternity of the boy.

Inheritance and property tussle amongst families of any deceased rich person is always terrible. He went to court but never lived to hear the verdict. Too bad
Re: Court Quashes Debe's Suit, Awards Ojukwu's Will To Bianca by onumadu: 3:01am On Mar 30
The key to this case is in bold letters below:

the plaintiff was not able to prove that he was acknowledged by the late Dim Chukwuemeka Odumegwu Ojukwu in the course of his lifetime, as his biological son .

According to the Judge, “it is the prerogative of a man to recognize a child born out of wedlock as his child,” maintaining that acknowledgement of paternity could also be inferred from certain acts by a father towards a purported son, and were not evident in the instant case.

Bottom line is that a man must accept a child for purposes of inheritance in his will. Biological son or not.
This should serve as a lesson to all those waiting to inherit from people that never accepted them.
You cannot force a man to add you to his will.

The only way for "real legal issue" to arise for such unrecognized child is if the man died intestate (.i.e without a will).
And even at that, the said child has an uphill battle against the dead man's family members (wife, children, siblings).
