“Heck No!” Lawal Shuaibu, the National Secretary of the Action Congress of Nigeria (ACN), has said to his appointment as a member of the Task Force on the passage of the Petroleum Industry Bill.


But Mr. Shaibu, a former Senator, tried to be as diplomatic as he possibly could, explaining that his position at the ACN is keeping him, so to say, occupied.

“I wish to acknowledge the appointment as member of the Task Force on the passage of the Petroleum Industry Bill as announced by the Hon. Minster of Petroleum Resources, Mrs Diezani Allison Madueke,” he said in his rejection letter, “and to state that while appreciating the appointment, I wish to humbly decline by reason of principle.”

Shuaibu was definitely wrong here!

What a "Nigerian" ought have done is accept with fanfare to garner attention then insist publicly that the original bill goes through with none of the usual obfuscation and "dulling" of its expected transformational edges!

As it is, he has achieved naught and forever has no stand from which he can "assess" whatever ends up coming through!

What happened to all the [b]'it's not just removal of subsidy rhetorics but fight against corruption' if the very people we look up to as alternative would be playing politics with the very novel ideas they were advocating during the strike. HYPOCRISY I assume?

This lends credence to GEJ's ascertion that the protest in SW was truly hijacked for reasons order than human rights and good governance.

Why would it take GEJ this long to even touch the subject of PIB. If his only reason is to deflect criticism, you know the bill is going to meet a horrible end, along with the reputations of whoever allows themselves to be used. PIB does not need a task force (er, bribe). It is pretty clear cut.

Its pathetic that people are playing politics with the future of this country.

One thing I love about the attempt at deregulation is the way it has begun to expose the true enemies of Nigeria's progress.

Some sections of the country have been blocking the passage of the bill. One section(the "Born-to-Rule" fellas) was blocking it in the open for obvious reasons.
Another section(the Rascals) has been pretending like they are in support, but behind closed doors they've been working against the bill.
Its amazing!!
That same section keeps harping on true federalism.They keep harping on devolution of powers from centre to bottom.
They harp in the open to the hearing of their population but behind closed doors they work against these things.
The only reason they probably screamed true federalism was because of what Abacha and IBB did to steal Abiola's mandate.

Whether they like it or not, The PIB bill will be passed, by fire or by force!!

The comments on Nairaland alone provides a good insight into why Nigeria is where it is today! There is obviously no sincerity on the part of the president and Mr Lawal Shuaibu knows this so he decided to reject the appointment. Jonathan is playing to the gallery, for something this important to him he should have sent an emissary or reached out to the man in anyway possible before announcing it to the media, who are his advisers Another issue is the lack of understanding of the people's plight by the president, his over bloated government was a talking issue during the protest, but what does he do, sets up another committee to do something that some people are already paid to do talk about duplication of efforts! Jonathan attitude is now no different to the born to rule mentality of the core North.

Were you on Mars when Ekweremadu (deputy senate President) called protestors "charlatans" because they wanted a quick passage of the bill? All your eyes were elsewhere when Allison-Madueke plus David Mark et al ,before the elections, assured many times that the PIB will be passed before the last republic ended. You must all also be ignorant of the money that has been embezzled by committees set up to "plan" the passage of the PIB.  If we do see a PIB it is likely to be one extremmely watered down and impotent. Group seeks probe of Petroleum Ministry over N481m spent on PIB Bill .

AN advocacy group known as the Africa Network for Environment and Economic Justice (ANEEJ) yesterday faulted the alleged spending of over N481 million on the proposed Petroleum Industry Bill (PIB) by the Ministry of Petroleum Resources, saying the probe initiated by the House of Representatives over the fund is commendable.

It said such “frivolous spending” is an indictment on the transparency effort of the current administration.

ANEEJ Executive Director, Rev. David Ugolor, said though the group recently commended President Goodluck Jonathan for halting the renewal of oil lease pending when the PIB will be passed, the action of the Petroleum Resources Ministry further demonstrates lack of transparency in the country’s oil and gas industry.
Ugolor said: “The ministry’s action underscores the necessity for the quick passage of the bill. The National Assembly should investigate how the N481 million was spent; and if it is discovered that the money was misappropriated and wrongly spent, those behind the frivolous and extravagant expenditure should be brought to book and made to return such monies to the coffers of the ministry.”

LAGOS — Political intrigues and wranglings within the Senate and the executive have been identified as major factors for the non-passage of the long-awaited Petroleum Industry Bill, PIB, which has had a chequered history at the National Assembly.

Deliberations on the PIB, according to a former lawmaker, had been concluded and ready to be passed as at December 2010.

Senator Lee Maeba, former chairman, Senate Committee Upstream, who spoke for the first time regarding the intrigues at a conference organised by Energy Correspondents in Lagos, yesterday, said in the end, selfish interest overrode national ones, thus preventing the bill from being passed.

Maeba, who spoke on “Implication of Delay in the Passage of the PIB,” said continued delay portended grave consequences for Nigeria and the economy, as already the industry had lost in excess of $28 billion in investments.

Most of these investments have found their way into neighbouring countries including Angola, Ghana and Burkina Faso, which have more stable policies.

Besides, he expressed fears that the original PIB, as drafted by the Oil and Gas Industry Committee, OGIC, and brought to the National Assembly, might not be the one that would eventually be passed as many of the clauses in the original bill had either been watered down or thrown out completely.

The Senator, who revealed that he had earlier in the day been warned “to be careful what you say,” noted that the initial bill was predicated on a tripod that would make the oil and gas sector more vibrant for the benefit of all Nigerians.

He said: “We wanted a law that will protect the interest of foreign investors, enhance the welfare of the people of the host communities by allocating 10 per cent equity of oil and gas projects, while also increasing the participation of indigenous companies in the industry that has remained the enclave of multinationals such that in the nearest future at least 30 per cent of crude oil export will be done by Nigerian companies.”



Specifically touching on some of the intrigues, the former legislator identified Clause One, in which he said, “So much power was conferred on the minister, such that the minister had the power to revoke and reallocate oil blocks to who he/she deemed fit based on being a good company.

Furthermore, he said that the legislators strived to remove the industry regulator from the grips of the ministry, as is the current situation, to make it truly independent, effective and efficient with the creation of the National Petroleum Directorate, to replace the Department of Petroleum Resource, DPR.

There were also the issues of the scrapping of the Petroleum Products Price Regulatory Agency, PPPRA, and the Petroleum Equalisation Fund, PEF, as their roles would no longer be needed under a deregulated downstream system, to ensure equitable and sustainable distribution and supply of petroleum products.

However, he regretted that selfish interests in government overrode these national interests and these clauses were watered down, so much that the PIB, which should have given additional strength to the Nigerian Content Act, is now one of its greatest weaknesses.

According to Maeba, “Most of the industry projects are based in the upstream, and the PIB would have guided legislations that would increase indigenous participation especially the marginal field operators, who were given special tax exemptions to encourage their growth.”

In view of the provisions of the constitution that all proceeds from the industry must be paid into the Federation Account, the lawmaker recalled that late president Umaru Yar’Adua after negotiating with state governors, approved that the value of the 10 percent equity should be paid into a fund on behalf of the host communities, but this was not to be.

The consequences of these and a host of many other factors is that apart from capital and investment flight, the industry is also at the risk of the resurgence of restiveness, as the equity participation is one of the ways that was used to broker peace in the Niger Delta

The PIB bill has been in the NASS since ages and it has being systematically delayed . . . recent claims also suggest that the current PIB bill is a watered down version of the original bill that had robust reforms measures . . . .

To fast track such bill, why not create a group of experts to fine tune the details of that bill with experts from various parties and interest group to add or minus parts seen to be in the best interest of Nigeria . .also giving it the much needed transparency . . . But when you decline, and people like you try to play cheap politics with it . .it is a sign that the passage of the bill is not of importance to you or the party you stand for . . .  and that is not a good taste . . .

I used to hold the notion that the open confrontation of the Northern NASS members held it down, but am beginning to get convinced that the PIB is where it is today because the corrupt NASS with the ACN involved don't want to see it passed . . .

It's easier talking about a bloated government while they keep mute about their own bloated allowances and salaries in the name of statutory allocation of how much . . . A whopping N150 billion . . .

ACN and Shuaibu should not be sentimental in this. At least, appreciate a government that embrace the oppoisition parties. Work together for the betterment of the common man.
He wants to do things right and transparently, that is why he is inviting the 'critics' to be part of it so that best decision can be made.
How are we sure that Nigeria will better if ACN assumes power, considering the kind of selection that we had in Lagos State during the Local Government poll.

Thank you Sir !!! All these fake patriot now lambasting everyone. How idiotic is it to point at the ACN in all of this? Some people are just showing a distasteful lack of knowledge as per how democracy remains the will of the majority. Sheer vindictiveness against any opposition of GEJ now leads them to speak ignorantly, unintellignetly and in a feudalistic manner.

PDP President, Vice President, Senate President, Deputy Senate President and Speaker house of rep and clear PDP majority in upper and lower house for the past few years yet the PIB remains unpassed after so much money has being spent. Now some jokers want to implicate the ACN in this while barking at anyone well withing their rights, because of all that has gone on, to refuse joining what is likely to be another charade till the heat dies down. Jokers. I wonder where all these new patriots and Mr. Nigeria were when some of us did the PIB threads to death for over a year on this forum.

If GEJ is serious about moving Nigeria forward, he should start with his government first.

1. Declare his assets
2. Sort out his bloated cabinet, with hoards of Ministers, Minister of state, Advisers, and all sorts of busy-bodies collecting fat salaries

3. Aggressively pursue corruption, not just pay lip-service to it.
Although deregulation of petroleum sales is good in principle, its not beneficial to the people under a corrupt regime like GEJ's government. They said we are spending N1.3 trillion, when the true figure is probably N300 billion - N1 trillion lost to corruption! Any serious president will take this serious. He shouldn't expect Nigerians to keep quiet about such monumental fraud, especially educated Nigerians.


4. GEJ should seek help from all Nigerians, rather than attacking some group of Nigerians(eg Lagosians). This group of Nigerians ignored their party to vote him to power. You can't just appoint the scribe of a party like ACN without talking to him first - not everyone is devoid of principle!

5. He should realise that the protest is more massive in Lagos because people in Lagos are very smart, and understand what is going on in the country more than the rest of the country. Lagosians are not just Yorubas only(before anyone read tribal associations to this statement), they are Ibos, Ijaws, Hausas, Fulanis, Yorubas - Nigerians of all tribes are fully represented in Lagos. To survive in Lagos, you have to have your thinking cap on - hence Lagosians tend to be more aware of how things really are, rather than what they are being told.

Are you not the one being sentimental about this? If you have followed the sad history of the PIB , and are not a post-protest "Mr. Nigeria", you will understand why this guy does not want to be part of what is obviously a charade including the biggest political positions in the land!!!

With the top four positions in the Country, including two in the legislative arm, belonging to the PDP , and with the Party also enjoying a clear majority in the Senate, what on earth do you think is preventing the passage of the PIB if not the fact that many in the PDP are the ones impeding the bill?

This is an open secret and I really don't know why folks can't allow this man his skepticism given all we have seen. I think the problem is that most Nairalander did not follow events. They now just talk as commentators who only pitched their tent firmly behind the Government after the recent protests. Some of us can even use Nairaland search functions to gain an education and note those who spoke consistently and analytically on the PIB.

The present legal regime of oil and gas industry is outdated and not in alignment with international best practices.  The present system is characterised by corruption and wastefulness and lacks good governance practices. It is the desire to correct these anomalies in the sector, the mainstay of Nigeria’s economy that prompted the drafting of the Petroleum Industry Bill (PIB), a piece of legislation that will overhaul the petroleum industry and re-write Nigeria’s over five decades relationship with International Oil Companies (IOCs) operating in the country. Chika Amanze-Nwachuku writes that political intrigues and wrangling within the National Assembly and executive have continued to stall the passage of the bill, reducing oil and gas industry activities to lowest ebb


Exactly two years ago, precisely in December 2009, the Joint Senate Committee on the PIB headed by Senator Lee Maeba announced that the PIB would be passed in December that year.

This was reaffirmed on December 10, 2009, by the then Chairman of the Senate Committee on Gas Resources, Senator Osita Izunaso who was categorical that the bill would be passed before the National Assembly proceeded on Christmas break in December 2009. But the lawmakers failed to fulfill that promise citing inability to resolve contentious issues raised by stakeholders.

Again, in February 2010, Maeba had assured that the report of the Joint Senate Committee on the PIB was ready for submission to the plenary, rekindling the hope that the bill would soon become law. “Our committee report on the PIB is ready. In the next two weeks, it will be submitted to the plenary”, Maeba had told his audience at a 2010 budget defence session organised by the Senate Committee on Petroleum Resources (Upstream). This was also not to be. After more than two years of what could be simply put as ‘promise and fail’ ,Petroleum Minister, Mrs. Diezani Alison-Madueke also announced to the admiration of oil and gas industry stakeholders that the controversial bill would be passed by the National Assembly and accented by President Goodluck  Jonathan before his swearing in on May 29, 2011.  She sounded very optimistic that those contentious issues had been sorted out to pave way for the passage of the bill.

“Those amendments are with both sides of the National Assembly, even though the original bill had already been placed before the Senate and they also have the amendments. They are looking at everything side by side. The bill is critical for us as Ministry, just as it is critical for the country as well”, she said, rekindling the hope that bill would become law in May this year. Again, this was not to be, as controversies have continued to trail its passage.

Political intrigues hindered passage
An indication that the bill might not be passed this year emerged in June when the Petroleum Minister revealed in an exclusive interview with THISDAY that there were still very fundamental issues in the sector that had not been addressed in the PIB, suggesting that more work still needed to be done before its eventual passage.  For example, she said the fiscal regime, especially for gas had not been touched at all. Secondly, she said the issue of commercialisation of NNPC was not fully addressed especially how funds would be raised and revenue disbursed.

More shocking were revelations by Maeba at an oil and gas conference in Lagos in August that what has been hindering the PIB passage was political intrigues and wrangling within the Senate and the executive. He disclosed that deliberations on the PIB had been concluded and that the bill was actually ready for passage as at December 2010. The former chairman, Senate Committee Upstream specifically stated that  selfish interest overrode national ones, thus preventing the bill from being passed. He noted that Clause One of the PIB, conferred so much power on the Petroleum Minister, such that the minister had the power to revoke and reallocate oil blocks to who he/she deemed fit based on being a good company.

"Starting from clause 1, we discovered that there was imminent danger when so much power was allocated to a minister of petroleum. Some of the powers was the power to revoke oil blocks and re-award it to any company, if in the opinion of the minister, is a good company. We do not know what the minister will see as a good company. We said something should be done to address this situation. We agreed that the PIB must create stronger institutions that are stronger than anybody running them".

According to him, the legislators also wanted to remove the industry regulator from the grips of the ministry, as is the current situation, to make it truly independent, effective and efficient with the creation of the National Petroleum Directorate, to replace the Department of Petroleum Resource, (DPR).

He also stated that the scrapping of the Petroleum Products Price Regulatory Agency, (PPPRA) and the Petroleum Equalisation Fund, (PEF) were among the issues that the Senate had to contend with.

It had been argued that their roles would no longer be needed under a deregulated downstream system. Maeba disclosed that selfish interests in government overrode these national interests adding that these clauses were watered down, so much that the PIB, which should have given additional strength to the Nigerian Content Act, is now one of its greatest weaknesses. Maeba noted that most of the industry projects are based in the upstream, and the PIB would have guided legislations that would increase indigenous participation especially the marginal field operators, who were given special tax exemptions to encourage their growth.

Multiple versions worsened delay
Another major reason why the PIB could not be passed by the sixth national assembly was multiplicity of the PIB versions before the Senate. Investigations revealed that there were three versions of the oil reforms bill before the National Assembly- the original bill submitted by the Petroleum Ministry in 2008, the version submitted by the Joint Committee of the National Assembly on the PIB and the one adjusted by the Petroleum Minister.

The existence of different versions of the bill in the National Assembly had elicited reactions from Nigerians who expressed concern that the original PIB, as drafted by the Oil and Gas Industry Committee(OGIC) and brought to the National Assembly, might not be the one that would eventually be passed as many of clauses in the original bill had either been watered down or thrown out completely.

Confirming the multiplicity of the PIB versions, Senate President David Mark, who spoke during the inauguration of the Senate Committee on Petroleum (Downstream),  said the existence of different versions of the controversial oil industry reforms bill, had been the major stumbling block to its passage by the two arms of the National Assembly.

The bill, which had generated a lot of interests among Nigerians, did not go beyond the first stage of clause-by-clause consideration in the two chambers before the Sixth Assembly wound up in June this year.

The Senate President said: "The problem with the PIB was that when it showed up, there were so many versions", adding that "as many as three or four versions were in the hands of senators and members of the House of Representatives."

Mark, who described the PIB as "the Bible for the petroleum industry", said it was "necessary to get it off the ground if we are to build the sector and that is why it is necessary for cooperation between the legislature and executive".

He pointed out that since the entire economy of the country depended on the petroleum industry, the much-talked about Vision 2020 would be a mirage "if we don't get it right in the sector".

Seventh Assembly’s Stance on the Bill
Stakeholders’ expectation that the bill will be passed within the first quarter of next year, following calls by investment community was further dashed last week, as the Senate declared that the bill was introduced in the sixth assembly and lapsed with the sixth assembly.

Chairman, Senate Committee on Rules and Business, Senator Ita Enang  had noted that the Senate was inaugurated for a period of four years and at the end of the four years, it stood dissolved and every bill that was pending became dead unless reintroduced.

Enang said:  “A session is a period between June 6, 2011 and June 5, 2012. That is one legislative session. It does not refer to a term. You just adjourn and go on break. You go on break after the end of a session, then you come and resume. Session means one legislative year. It does appear that those who drafted it thought that a session covers the term. Therefore, if the president wants the PIB, he has to send a letter reintroducing it”.

Reactions Trail Request for ‘Secret Meeting’
At a forum in Lagos last week, the Petroleum Minister said a new bill would be sent to the Senate to ensure that the right version gets to the lawmakers. She also asked for a ‘secret meeting’ with members of the Senate Committee on Petroleum (Upstream) on the controversial oil industry reform bill during a meeting with the Committee in Abuja.

Senator Enyinnaya Abaribe had sought to know why the minister did not mention the PIB in her submission to the committee on what the petroleum ministry planned for the next fiscal year.

The lawmaker wanted to know whether the minister planned to forward a fresh PIB to the Senate given that the bill before the sixth assembly lapsed with that session. But the Minister who described the PIB as "highly topical and very sensitive", stated that issues connected with bill were issues  that should be discussed in a closed door session.


Reactions have however continued to trail the minister’s request for a closed door meeting on the PIB.  Some of the stakeholders spoken to at the weekend held similar views on the issue, insisting that to ask for a secret meeting at this point would erode transparency in the whole exercise.

They urged that every discussion on the controversial proposed legislation must be done publicly and in a transparent manner.  Also reacting to the said request, a Non Governmental Organisation (NGO),  Africa Network for Environment and Economic Justice (ANEEJ), a Benin-based Civil Society Organisation, said asking for a secret meeting with the senators showcases the unending opacity, lack of transparency and accountability that has become the sign post of the Nigerian Oil and Gas industry in spite of its being the first country to sign-on to the Extractive Industries Transparency Initiative (EITI).

"We are appalled by the request of the Minister of Petroleum Resources to brief members of the Senate Committee on Petroleum (Upstream) over a simple demand by Senator Abaribe who merely requested her to tell the committee what the government wanted the Senate to do with the Bill that lapsed with the Sixth Senate.

“Asking for a secret meeting with the senators showcases the unending opacity, lack of transparency and accountability that has become the sign post of the Nigerian Oil and Gas industry in spite of its being the first country to sign-on to the Extractive Industries Transparency Initiative (EITI)," said the Executive Director of ANEEJ, Rev. David Ugolor.

He added: "This is not an era of secrecy in government. Secrecy gives room for conspiracy against citizens. The controversy that has trailed the PIB is enough for all issues concerning it to be put in the public domain and let's debate them. We expected the Minister to give a straight answer to the question posed by Senator Abaribe and not to request a secret meeting to provide what ought to be an innocuous answer.”

“The Bill is not about the heritage of one individual or a group of friends. It is about the commonwealth of Nigerians. A bill or law is a public, not a secret document so the process of formulation of such a document must be open and transparent in line with democratic norms. It is for these reasons that we want to urge the Senate Committee on Petroleum Resources (Upstream) to make the meeting with the Minister public because all previous secret meetings around the Bill have not yielded any result. We fear that if policy issues as vital as the PIB are discussed in secret places, then our quest to achieving vision 20:2020 economic blue print will be a mere wishful thinking,” he also stated.

ANEEJ insisted that discussing such an issue in secrete rooms “smacks of unseriousness, unpreparedness and weak disposition to face the monster in the oil and gas industry".  The group insisted that for reforms to be meaningful to all stakeholders and for the reformist to be taken seriously, the process must be open and transparent

Lawal Shaibu was in order rejecting his appointment for the following reason.
1: Any number of "well-informed" individuals with vast knowledge of the industry could have been carefully selected "picked". The Purpose and "content" of the Bill is in public domain, even a university student can make pointed contributions  grin
2: It is deeply apparent that there is no love lost between PDP and ACN.  grin given his position in ACN, the value of Ethics and Principles should come into play in Lawal's decision

Also you cannot rule out the possibility of "Politics" and the Oracle of Bourdillion's influence on the matter - be that as it may, the decision has been taken - Move on and get down to work already.

I am mostly cynical of a PDP-led Administration especially when it comes to reforms but who knows - let us see how this goes down.

When Abati a well known government critic accepted to serve the FG, he was accused of selling out when he switched camp. Oshiomole who always fought the FG when he was NLC President too was accused of joining the said government he fought when he became Governor. Given Shuaibu's place in the ACN. Accepting an offer from a PDP led Government will make him appear has a coward and someone who has no principles so He hasnt done any wrong by rejecting the offer made by the FG.

From Senate President, David Mark who keeps telling us that "there are 4 to 5versions in circulation"? Cant david Mark, at his age, come to the "childish conclusion" that if a "Committee" is given a job to draft a Bill, "the AUTHENTIC VERSION IS THAT ONE THAT IS SUBMITTED BY THE SAME COMMITTEE"? But he rather chose to be playing games to stall the passage!

Again, lookt at House Rules Senator, Ita Giwa (Enang), (the same Pros.ti.tute that Dele Giwa married who, instead of giving him children, collected money from her millitary boyfriends, to plant bomb on her estranged husband), telling us that because the bill was presented in the Sixth Session and the 4yrs of that house has lapsed, the Every Pending Bill is DEAD! That LovePeddler must be smoking ganja as well! What about continuity in govt?

So if i took those dofus in govt 4yrs to do a job that should not take more than six months, Madam Bakassi says we must start all over again, and who says the same thing will not repeat itself?
