For the record Prof, nobody has an ethnic bias against the Fulani. I for one don't have such but I am just against their anachronistic, archaic and outdated belief in nomadic rearing of cattle that is causing social tension between these Fulani nomads and the aborigine farm owners. This culture of theirs is against natural justice, equity and good conscience. Culture is dynamic, so it is high time they changed to ranching and bought cattle feed. This mentality of owning all land by Fulani will always bring hatred to this tribe. Very natural.

These pastors are very smart, if their prophecies didn't come to pass, they would say the congregants do not have faith or better still they may likely say God changed his mind as he does in the stories of Jonah and Nineveh and others in the Bible. They really have a nice manipulative weapon to always use against the gullible sheep.

I used liberal there to mean judicial activism and it didn't also mean legispulation where judiciary would think it is empowered to make laws rather than interpreting law. If you know quintessential lord Denning and if you know our principle of negligence was created in Stevenson v. Donoghue ,you will definitely know the importance of liberalism or judicial activism in jurisprudence. Lord Denning as a judicial activist did not create new law, but construe extant law extensively to incorporate reforms and cover many legal situations. My learned friend , I cited authorities. But you failed to react to that. Please consult that your note and get back to me . Read my previous comments, read section 357 of the criminal code again, and get back to me. It is trite that men or boys cannot be raped since you don't have what it takes to be raped. If you see section 357 of the criminal code act, the section that defines rape, some key words are used " girl" or * woman* , "unlawful carnal knowledge***" that phrase " unlawful carnal knowledge" is an euphemism for * vagina*. Sir do you have a vagina or pussy. Most importantly, the most important ingredient or elements of offence of rape to prove by the prosecution in order to succeed is PENETRATION. A man cannot be penetrated and even anal Penetration is no Penetration. In a situation where a woman abuses or violates a man or a boy sexually, she cannot be charged with rape but she can be prosecuted for indecent assault or sexual assault. So men are so protected.

I will like to ask you a very elementary question in the law of contract, what are the factors that vitiate consent ? I am sure you would say undue influence, duress and fraudulent misrepresentation. They are not different from the law of consent the defendant must canvass to raise an atom of doubt in raising a defence of his innocence against a charge of rape. By virtue of section 357 "... Intimidation of any kind..." is open to a wide interpretation that includes promises to seek advantage , undue influence, duress and even fraudulent misrepresentation that is later specially listed in the definition . mind you, you would have been more right if you had said to prove rape under economic circumstances such as in the case of industrial or labour relations is difficult. Nevertheless, if the court will be liberal it is still rape since you cannot tell me that a female job candidate will choose being unemployed because of a sex with a sex predatory boss that seeks for sex ,even though the said candidate had been tested and qualified for the job. Your opinion would have been right and would have held true of a lecturer that would fail student if she didn't have a sex with him. Would you say a female student should rather fail honourably rather than accepting the sex offer of the lecturer.? Or do you think lecturer- female student relationship is not economic in nature?

thanks for clarifying. Like you rightly said ,a lot of people including me were ignorant of the bolded,although I knew it was wrong to intimidate a person to have sex just didnt know it was catogrised under rape. This is very educative,a lot of women have been raped and don't even know it and some men have been rapist and don't even know it either.

Baba I am not a Sissy, I just stated a principle of law under the criminal code. However, you had a point that girls may abuse it and tend to always use as a weapon against the celebrities. I sincerely agreed with you if you look at the UK that we received our laws from particularly criminal law and also the USA that have a similar common law relics with us, you will see that what you said always hold true. See Akon, Michael Jackson, Neymar etc have battled with this sex scandal. That means it is still a civilised trend, however, if you are a celebrity and you have a lot to lose ,tread cautiously to avoid a smear campaign against your reputation. If possible, draw agreement to have sex, let her speak her consent on a phone recorder before any sex since that is what saved neymar. However, the law, for me , is a good one as it will protect women against rape. I also have a daughter.

I doubt that rape accusation will fly in court, its the same scenario where bosses sleep with their staff with the threat of loosing their jobs,a beg lawyers should clarify .
The major challenge is the great deal of ignorance of criminal law of rape. Even many educated rape victims do not even know when they were raped, and majority view rape as "only sex by force " where the victims must show evidence of bruises, black eye , swollen faces etc. Where victims claimed rape and they cannot show evidence of being battered, even the Police officer taking the report of such incident by the victims would be the one that would chastise the victims first by asking these questions " why did you go to his house alone if not for the fact that you want to be copulated with ? Are your panties torn? No bruises no sign of struggle ,that means you consent to the sex?. Nay the above notion about rape is very narrow in defining what Nigerian criminal law of rape envisages. By virtue of section 357 of the criminal code act cap c38, rape is defined " any person who has unlawful carnal knowledge of a woman or girl, without her consent, or with her consent , if the consent is obtained by force or by means of threats or intimidation of any kind, or by fear of harm, or by means of false and fraudulent representation as to the nature of the act, or , in the case of a married woman , by personating her husband , is guilty of an offence which is called rape." From this definition, it is deduced that where consent is obtained by intimidation of any kind such as promises of advantage, undue influence and duress may be factors thay may vitiate the seeming consent and make it a rape. For instance where a pastor told a female worshipper, if I pour my holy water, euphemism for sperm, on you, you will be healed of your blindness and the girl consents to have sex with the pastor, and after the sex she still remains blind, it is rape because of fraudulent representation and this is also an undue influence from pastor to his female worshipper. This goes for a male medical Doctor to his female patients, a male lecturer to his female student , a police officer who promises the wife of the arrested suspect " if I have sex with you I will release your husband", see a common law case of R. v. Williams where a choirmaster told a chorister (girl) that if I have a sex with you, your voice hoax and texture will be improved , the girl consented and had sex with him, lo and behold her voice did not improve. The House of Lord HELD that IT WAS A RAPE.

A friend of mine was into this nollywood shit in pH. She said when these top actors visit their producer in those days, he organises up comming actresses to warm their beds. It is rape since consent was not freely obtained but induced by the influence on , promises, and intimidation of the victims by the assailant.

What is the unified marriageable age in Nigeria? undecided
It depends on the marriage , if it is a marriage conducted under the customary law including Islamic law, the marriageable age is the age of puberty... The moment the girl had reached puberty I.e. menstruating ,she can be married.
Under marriage conducted under the statute viz. Marriage Act/Marriage Causes Act, the marriageable age is 21 years but 18 years old girl below 21 years may be married only with the consent of her father. See section 18 of marriage Act 2004; section 29(4) of the constitution of the federal republic of Nigeria 1999 as amended; see also the relevant provision of the Child Rights Act 2004. So there is no unified age of marriage in Nigeria.

When Charlie Hebdo was attacked with about 12 people killed, others injured on the first day alone with numerous other attacks, murders and hostage situations on subsequent days, was it not because Mohammed was depicted in a humorous way in a cartoon? A cartoon of Mohammed laughing with the caption “a hundred lashes if you don’t die of laughter ‘ or something like that caused so much death and destruction. the whole world was against the Islamist group not because they cared about the cartoon but because of the horrific way the extremists showed their displeasure. People should learn to respect what others hold in high esteem instead of desecrating what they don’t understand or agree with. The Phnch staff understand that Christians won’t get wild and kill them that’s why they had the audacity to come up with that cartoon.

... Nigeria is supposed to be a secular state . the cartoon is very illustrative of the situation at hand. It illustrates desecration of the temple of God. In the column, he cites ezeugo also known as Reverend king and other charlatans. He vividly paints the picture like a good artist that he is. With his paintbrush, he draws a caricature of a drunk Biodun Fatoyinbo emitting urine on the holy book. The innuendo is not for the church as a whole but directed to that drunk charlatan, Biodun fatoyinbo who emits his urine on the holy Bible. He does not draw that emitter to be the sole true practice of Christianity. This is a lampoon on an individual not the whole Church. I am sorry for this nation, we are so hypocritical. God , if you be, burn Nigeria, for our iniquities should be more than Sodom and his Gomorrah.

Brother, there has always been a controversy about age of consent in Nigeria since different relevant statutory and legal authority stipulates what they perceive age of majority or age to give capacity. In summary, under customary law .I.e. Islamic law and non islamic customary, age of majority ( age to give consent) is the age of puberty see abake v. Labinjoh, under marriage act and marriage causes act, age of majority is 21, as a girl of 18 years who has not attained 21 can only marry by the consent of her father, under the constitution 1999 by virtue of s. 29(4)(a) and under the child right act ,age of majority is also 18. Be guided, please don't be misled. Under criminal law, it is 16 years for sex related offence see section 363 of the criminal code act 2004

Does it make it right and legal if the minor girl or guardian alleges rape after the sex. Read the sex scandal of Akon etc. The only defence the defendant could veritably muster is that he lacks the knowledge of the age of the girl as she showed maturity of someone of age of majority, her composure, dresses could have made a representation that the girl is definitely not a minor at that time. Although in the instance you just cited would the law not be unreasonable to hold the male child for statutory rape at the instance of the parents or guardians of the female child ?
However , this situation is totally different from this case, -seeming consensual sex between an adult male to a girl of minority age. It is always rape, by applying mischief rule, the law intends to protect the minor girls from being sexually taken advantage of by the adults. Therefore, a minor girl does not have a capacity to give consent unless she is married under the customary law.
