A Nigerian Senator under the Peoples Democratic Party, PDP, Elisha Abbo from Adamawa State is currently embroiled in a hot case of Assault.According to Premium Times, Abbo, representing Adamawa North Senatorial District, descended on the woman after she pleaded with him not to physically assault the shopowner whom the senator had accused of insulting him. He said the shopowner called him a drunk.Below is a video of the assault, which occurred on May 11 — nearly three months after Mr Abbo became a senator-elect and a month before he was sworn in on June 11.

The attack happened as an armed mobile police officer looked on, and instead made attempt to arrest the victim.The assault was reported on May 14 at the Maitama Area Command Headquarters on Nile Street, but the police told the victim to go look for Mr Abbo’s telephone number or they would not be able to do anything about it.The victim of the assault and the storeowner declined comments for this story, saying they were afraid there could be a violent backlash from the senator. The victim’s lawyer also declined comment.But witnesses and other sources familiar with the matter told premium times their accounts of what happened. They all declined to be identified, citing fears for their safety.Mr Abbo, a member of the opposition Peoples Democratic Party (PDP), had entered the shop at about 6:00 p.m. on May 11, a Saturday. The senator walked in with three young women to purchase adult toys.

But shortly after they began shopping for the toys, one of the three girls brought in by Mr Abbo started throwing up. She vomited multiple times, prompting the shopowner to remark that the woman should have vomited outside and not inside her shop, especially since she was not a child.Mr Abbo, who was said to be agitated by the sudden illness of one of his girls, was said to have accused the shopowner of poisoning the store’s air conditioner.The shopowner’s argument that if the air conditioner had been contaminated others in the shop would have also taken ill further angered Mr Abbo, and the two began exchanging words over the matter.In the first five minutes of the 10-minute video, Mr Abbo is seen sitting on a yellow power generator near the entrance of the shop.

He could be heard within this time making calls and asking some people where they were and how close they were.Just before the first half of the video, an armed police officer walked in. Mr Abbo explained to the officer in Hausa that the woman insulted him and that he had called the assistant inspector-general (AIG) over the matter, who then assured him that he would call the police commissioner to call the Maitama Area Command. He also said he was disappointed in the shopowner, with whom he said he had been friends for five years.Mr Abbo, 41, said the police officer should take the shopowner away.

The shop owner quickly called her father to inform him that Mr Abbo had called the police over the matter and that she was about to be taken away.Mr Abbo asked the shop owner to stop the call because he was talking to her, a demand the woman refused to accede to. Another man could be seen coming from behind the police officer to snatch the shopowner’s phone from her.Next, the shopowner’s friend who had been standing nearby tried to intervene by pleading with the second man to take things easy.“Oga, please take it easy now,” she said.Mr Abbo switfly descended on the shopowner’s friend, saying she was “very stupid” and slapping her repeatedly, including directly on the eyes.The senator then demanded that the two women should be taken to the police station.

He repeatedly told the shopowner that he was disappointed in her for calling him a drunk, and that he would have harmed her more and closed down the shop but for their friendship.

Section 141-143 of the evidence act places the burden of proof on the accused to establish certain facts, the accused is required to deny the allegation, offer explanations or give evidence that makes the case of the accuser improbable or which raises reasonable doubt on the case of the accuser in which case the burden of proof then shifts to the prosecution to prove it's case beyond reasonable doubt.

He has neither given any explanation or evidence to make us disbelieve her, in the case of Neymar you saw how fast he brought evidence against his accuser. While the burden of proof rests on the accuser, the accused has to give evidence in his defence.

Stop allowing your misogyny cloud your judgement.
In a criminal matter , does burden of proof shift?
If you are talking about evidential burden which may make the defence to prove certain facts such as alibi. The prosecution to succeed must always prove their case beyond reasonable doubt and that is not to mean that the defence must proof his innocence since what he only needs is to simply bring or raise a doubt.

The dude asked for the meaning of rape and that is what I simply explained here and I dwelled more on where people always get the meaning of rape wrong. Many always think she who must allege being raped must have been battered, assaulted and her clothes must have been torn. And I explained the law from the dimension of even where force was not used by the assailant. I never dissected the merit of Mrs Dakolo's case. Be rest assured, as I agreed with you that court of law is not a court of emotions but court of evidence . How can she prove the main ingredient of PENETRATION since 17 years ago without any documentary evidence of medical report to prove being penetrated.

By virtue of the Nigerian criminal law of rape, it is an offence committed when a man knows the carnal knowledge of a girl or a woman without her consent or with her consent if it is obtained by threat or intimidation and in the case of a married woman by impersonating her husband or if it is obtained by fraud or any misrepresentation. This definition means a girl can still be raped if she consented to the sex and later found out that you deceived her into having sex I.e. you obtained the consent by fraud. See R v. Williams where the choirmaster told the chorister that if she had sex with him, her voice would be improved. After the sex she found out that her voice did not improve. The court held: RAPE WAS COMMITTED. and that the consent of the girl was obtained by fraud.

Williams , a girl was told by a choir master that the girl voice would be improved if he had sex with her and she agreed and had sex with her. The court HELD that the GIRL WAS RAPED as the consent was fraudulently obtained.
A victim of rape need to prove only PENETRATION to succeed in her claim. Therefore, whenever a victim is just raped, please don't go to the Police station first, rather you must first go to the HOSPITAL so as to get a medical evidence of PENETRATION.

I say this so that populace who might think is a proper due process won't be misled. In another breath , kudos to him for paying up pensioners . Let's make them (our leaders) to be accountable by demanding for 100% at all time. According to Lord Archer " power we want ,.power we seek, for without power we cannot serve" . therefore we have given them much power to serve us, so we should not expect less. I must say the immediate predecessor was a disaster, the incumbent should avoid the same appellation . WE ARE WATCHING HIM.

Exactly 30 days ago, history was made in Imo state when His Excellency Rt. Hon. Emeka Ihedioha, CON, KSC was sworn-in as the 6th democratically elected governor of Imo state.

For a man who campaigned on the backdrops of rebuilding a destroyed and looted state, Gov. Ihedioha wasted no time in setting the balls rolling as he immediately swung into action with his RebuildImo agenda.

I have listed some of the achievements in deliberate state government policies that will greatly be of immense benefits to our people.

They are as follows:

1. He ordered for 100% Salary for Imo civil servants.

In fufiling his campaign promises where he assured Imo workers of good working conditions and full remuneration against the half salary regime of the immediate past administration of Gov. Rochas Okorocha, Gov. Emeka Ihedioha ordered for the payment of 100% salary scheme for all Imo workers which the past governor paid only 70% for 8yrs.

2. Striking Doctors called off strike action after the governor reached a truce with them. One of the first things that the new governor of Imo State did was meeting with striking doctors and health workers in the state to resume work.

Gov. Emeka Ihedioha ordered for the resumption of work by striking doctors that downed their tools since over 4months of the last administration - thereby saving many casualties that could have been recorded as a result of continued strikes of doctors and other health workers. Because the well-being of Imo people were of very high priority, he saw the returning of the striking doctors to attend to sick Imolites as a first grade matter requiring of urgent attention.

3. He opened Striking IMO Poly for full academic activities.

Again, as a compassionate governor who places high premium for the needs of his subjects, Gov. Emeka Ihedioha ordered for the resumption of full Academic activities for Imo poly that has been on strike for over 4months there by bringing back our children back to school.

4. Gov. Emeka Ihedioha ordered for the opening of Douglas road to allow the free flow of traffic for ease of movement for Owerri residents. For those conversant with Owerri would know the full potentials of that road as it is one of the major economic roads in Owerri.

The economic activities of Owerri was stagnant for over two years as a result of the closure of that very important road in Owerri which the immediate past governor closed down in order to cripple the economic activities of Owerri people whom the then governor was having a running battle with because they refused the governor from illegally acquiring their ancestral lands for personal family use of the Okorocha's.

But the new governor saw the need for the indenginous people of Owerri and reopened the road which was recieved with high commendation from the locales.

5. Gov. Emeka Ihedioha ordered for a stop to the dredging of sands by illegal miners which posed a great environmental harm for residents of Owerri. The activities of these illegal sand miners constituted by the past administration posed not just environmental damages, it also posed great economic sabotage to the state as revenues were siphoned to purses of Ex governor Okorocha's family members instead of that of the state government.

6. Gov. Emeka Ihedioha restored the sanctity of due process and rule of law in place in government as he can be seen following normal procedures at public places.....and as he seemed to have been nickened by Imo people as "Mr. Due Process".

7. He commenced work on abandoned 132/33KVA power Sub stations.

In order to uplift the industrial revolution in the state, Gov. Ihedioha has ordered for immediate commencement on the 132/33KVA power Sub station in Ibeku Okwuato and in Ideato Nation.

They will also kick-off work simultaneously on both sites to ensure that they are activated to serve the people of Imo State.
These were some of the projects His Excellency attracted while at House of Representatives as the Deputy Speaker during the regime of President Good luck Jonathan but were sadly abandoned when he left office in 2015 as the immediate past governor could not constinue on the said projects.

9. ISOPEDEC was returned to Ohaji and Oguta people.

In line with his campaign promises of returning the ISOPADEC to the real owners which are the people of Ohaji/Egbema and Oguta, H. E Rt. Hon. Emeka Ihedioha has handed the oil producing LGA's agency to the right owners are of where the 13% derivative funds will solely be used for the betterment of the oil producing areas that have known devastation due to the activities of oil exploration on their lands.

10. He has started recovering the stolen properties of Imo state government.

Another feat that our governor has achieved is the setting up of the Recovery team which has so far made some mouth watering recoveries of government properties looted by ex governor Rochas Okorocha and his thieving family members.

First, the School of Nursing and midwifery in Opkoro in Orlu LGA that was moved to ex governor Okorocha's home town on Ogboko and converted to his private school has so far being recovered and returned to Imo people.

Many government properties especially vehicles have been recovered as the recovery exercise are still on course and many more properties like immovable ones will be the next focus.

11. State of emergency declared on public infrastructure.

To show it's seriousness, the governor has approved N49million specifically for the Otamiri water.

The Otamiri water project is a public infrastructure that has been allowed to ruin in comatose. The public water infrastructure services the entire town in water supply as it was the reason that no public tap ran during the 8yrs that Okorocha held sway as the governor.

Not a single borehole was sunk in any of the community in Imo for these 8 wasted years of ex governor Okorocha and no drop of tap water ran in the whole state.

Due to the urgency it required, he promptly declared a state of emergency on the scheme and released the sum of 49 million Naira for the immediate take off of the rehabilitation project.

In the state of emergency on public infrastructure regime - these other public infrastructure are to receive immediate attention and they include: the Federal Polytechnic, Nekede-Ihiagwa-Obinze Road, Assumpta-Control Post axis, Mgbidi-Oguta Road, MCC-Toronto Junction, Aba Branch-Mbaise Road, among others.

12. Avuto Poultry coming back to life.

The governor has also constituted a team that are now currently working in the Avutu poultry as both foreign and local investors are assessing the best ways to revitalise the state owned agric firm to start earning money for Imo people again.

13. N20m debt from judgements revisited.

As Mr. Due process who respects the rule of law and constituted authorities - Governor Ihedioha through the state Attorney General has asked all the people who won court cases against the state government in the last 8yrs reign of Okorocha to come forward with their claims for a possible repayment plan.

Recall that the ex governor Rochas Okorocha never hornored any court judgement against the state government for 8yrs as judgement debts were in excess of over 20 Billion Naira layed ambush for the new government.

Now, the governor as a law abiding citizen is reviewing the records with the view of settling them.

14. Imo pensioners to smile again.

In fulfilment of his campaign promises of paying Imo pensioners who are being owed over 30months salary arrears, the governor has constituted a team that will review the pension matters with the views of clearing the pension of our senior citizens.

Recall also that for 8yrs, the immediate past governor Rochas Okorocha deducted pension cuts from worker's monthly pays but never remitted same to the Nigeria pension fund as all the worker's monthly salary deduction for pensions ended up in individual accounts instead of the pension funds, hence the inability of pension payment running to the tune of over 50billion Naira.

15. He ordered Dan Anyiam Stadium To receive a comprehensive facelift.

Words has been backed with commensurate actions as works for the commencement of the comprehensive facelift of Dan Ayiam stadium and the Grasshoppers stadium was not left in the plan.

16. He refused and rejected the offer of Ruga settlements for Fulani herdsmen in Imo, in line with personal the south east governor's forum position. This is a further step in securing the lives and properties of the state as many other security matters are discreetly being carried out which of course, I can not reel out here.

These were the key things that His Excellency has achieved within 30 days in office as Imo state governor.

Note the words: "Key points" as there are many others strives already achieved which if I continue listing them, the space will not be able to contain them.

As we await for other mouth watering policies of the RebuildImo government which will soon unfold, let us commend the governor for keeping to his words as being a responsible and proactive governor responsive to the demands of Imo people.

Indeed, we can now beat our chests and make bold to proclaim that we now have a governor in the person of His Excellency Rt. Hon. Emeka Ihedioha, CON, KSC. Omenkeahuruanya n'ezie.

The era of impunity, iberiberism system of governance, disobedience to rule of law and lack of due process are forever gone in Imo.

Indeed, a new Imo in which we all can be proud of is born.

No 6 is conflicting with number 10. Maybe the poster does not know the meaning of " due process ". As an executive , you didn't follow due process by willfully entering somebody's shop to recover the alleged government stolen property without the court order. That is a draconian act.

It seems IMO is cursed with their leaders, even this gov ihedioha is more wrong in attacking a private citizen's shop without any legal justification such as court order. What right did he have to send the task force ? How could he prove that properties belong to the state government? Who has a right to seizure and confiscation of the government stolen property ? All these stunts are not needed only if he has a plan and agenda for the state. I would have loved the tort feasee to sue gov ihedioha personally , now I guess she can't do it because of governor immunity and if she sues the state ,the state will pay costs of what this stupid governor is doing. The step will make the state to be more liable in costs ,compensation etc and hence, backward. In an ideal society, this man can never be a Governor, may be he could be a NURTW LEADER.

Baba get your facts right, the pyrates confraternity he founded was an intellectual but radical group who fought with pens and a bit of activism such as taking over of the radio service announcement to declare the cancellation of the western region election of 1965.. Mr wole Soyinka (as he then was) never preached violence or used axes on the oppressors. Rather he fought intellectually but aggressively. Please always get your facts right. He created confraternity, if you like sorority, but not cultism.

That is neocolonialism... Na we they enslave ourselves . As you rightly said, they cannot treat dennerby or rohl the way they treated Stephen keshi or omagbemi. The local coaches are not on the same salary level with foreign coaches , yet the local coaches will still be owed even though foreign coaches are being paid more. And the way they treat super falcons is very appalling compared to super eagles. I must clearly say our local coaches are better or they have achieved similar feats as the foreign coaches and super falcons successes are more than super eagles. Therefore, they should be treated equally and if not equally, fairly. Pay the Ladies.

United States are always doing what they preach against , the first question to ask is, was the United States act right in sending drones into the territorial waters of another State? Under the international law united States do not have a right to breach the sovereign entity of another state and I am very sure they would not have accepted China or Russia to send drones into the territorial waters of the USA. Territorial waters are part of the territorial entity of a state unlike high seas that are owned by every States including landlocked state . may be , united States are another empire ruling the world, that means, every other States are slaves. I just hate the hypocrisy of the USA and the UN.

To your mind I am a kid, I doubt whether you passed through any reputable institutions, if not, you won't come online with this gibberish about examination malpractice . For your information, I relied on obafemi awolowo university , ile ife examination regulation as a case study . As of fact, I graduated here, and examination malpractice is a serious offence, read about the former speaker of the ekiti state house of assembly, how he could not graduate oau because of examination malpractice .

Yes, it is an act that is inconsistent with the council of legal education Act, and Nigerian Law school regulation .. He is not just studying law, he is a student of the Nigerian law school that has just that rules... You must be a full time student with total class/ externship attendance before you will be fit and proper to be called to the bar.

Rustication is usually as a result of lite offences such as exam malpractice or fighting while expulsion is a punishment for criminal offences like cultism,rape,riot etc know the difference. My friend was rusticated for one year due to exam expo and he stayed a year behind while another one O2 was expelled coz he was a cultist, he never got to graduate.

Which school is this ? Examination malpractice is a very serious offence that may cause you expulsion if you are found guilty. Some schools may even hand you over to the police to try you in court. It is a criminal offence.

Everybody is an hypocrite.. So, some people are only leading struggles or are activists or critics to be noticed by the oppressors they claim to fight or criticise. If such people are given the opportunity of joining the wagons of oppressors, they will forgo all moralities and jump on the rails of the wagons and join the parties. On this note, I believe just as George Orwell " if there is Hope it lies in " Proles"" not an individual activism or a hungry critic. I pray revolution, how we will all act in harmony without traitors , I still can't fathom .
