Abbylove: Hi.
Little chatting is still chatting.
Its not going to pose a problem
You may choose to provide an explanation for why you have little evidence of communication during that period in the "additional information" space of your online application form...or in your cover letter
Ensure pictures for the before, duration & after that time he was with you (Nov '15 to Feb '16) are dated and included
Good luck @oladunni4real |

Will that pose any problem to our application under genuine relationship? |

Its two means to an equal end. One option isnt better than the other. Read up about both routes at www.gov.uk and Do whats most convenient for you. Both options would yield the same result. Which is your wife and son living with you in the UK. Just ensure your financial & accommodation requirements are met. abakilikiboy: Thanks lexusgs430 Please am waiting you guys. I need you guys advice best way to go about their application 1-I will be in Nigeria in February next year so am thinking of going to registry in Lagos since I will be around, so that they can apply everything while in Nigeria which will be around July 2017 after my British citizenship. 2- Or invite her on fiancé visa and do the registry when she gets here in uk. |

@abakilikiboy -Please go ahead and marry your Baby mama. -Ensure that you both state in your affidavits (this is required at the marriage registry) that you are single with a Child. -Create a folder & begin to collect hardcopy evidences of your relationship with your baba mama. Past, Present & Future ones. Emails, pictures, chats, calls, money transfer etc) Am not sure of the year you said you would become a British citizen (u wrote April 2016) but whenever that is go ahead and put in for your spouse's settlement visa. It is not the ECO's job to Judge the circumstances of the birth of your son. & If they do have questions they would invite you for an interview. abakilikiboy: Hi everyone I came to uk in 2008 with student visa, I got married to eea national and I was given 5year eea family member visa in October 2010, due to some issues we separated in September 2015. In October 2015 I applied for my permanent residence which was granted in April 2016 so I will be due for British citizenship in April 2016 by Gods grace. In 2011 I traveled to Nigeria when I was still with my ex, I met my former girlfriend when I was in university in Nigeria, some how one thing lead to another she became pregnant and gave birth in 2012, the boy is now for years old now. My issue now is I want to marry my baby mama so that I can bring both of them here in uk tho I want to do that after getting my British citizenship. Please the guru's in the house what is the best way to go about it. |

@Nkiruka1986 I read this over and over again. I think you should put in an appeal and see if the decision would be over turned at the review stage. Do a timeline of your relationship on your cover letter. Ensure you address each and every point raised by the ECO in the refusal. Be honest. And supply every evidence you can find. New evidences can be supplied as long as its not dated after the refusal. Use the 1st refusal to your advantage because it is proof that you two did try to be together. It might seem worrying that you got married the 1st time you met physically but its not their job to Judge how you choose to operate in your relationship. If you can use your own call history. Your hubby isnt the 1st person to change phone numbers. State it if you can in your cover letter that he changed his number on xx/xx/201x State in your letter why you only have chat records for the period you do. Not everyone jumps on the smartphone wagon early. List every money transfer sent to your hubby through his family in your cover letter. They are his family. State his relationship to the recipient in the letter. Do this and if the ECM sticks to their initial decision afterwards then apply again. Nothing can change in the history of your relationship. It is what it is. And for the record you did appeal clearly addressing everything the ECO used against ur application. With that and more evidence you are able to gather over time your reapplication should be successful. You have a right to be with your husband. @Lexusg430 how you see am Nkiruka1986: Hi All,
This is the first time I am ever posting on a forum so not sure exactly how this works... If I break any rules rest assured that it will be unintentionally so please let me know.
I am a British/Greek citizen (dual nationality) who recently got married to a Nigerian. I have been living in the UK for the past 11 years and my husband lives in Nigeria. We have been friends for a few years now and officially became a couple 2 years ago, on my birthday A few months after we got married we applied for a spouse visa and were refused. The reason for refusal is that they don't believe that our relationship is genuine and to be honest, looking at it from their point of view I can see why... Following bad advice from my solicitor I only provided evidence of our relationship from our wedding onwards but nothing before that. Things are actually made even worse by the fact that we got married on the first day we physically met. When I arrived in Nigeria we already knew we wanted to get married so we went to the registry office to find out what we needed to do where we were told that for an extra fee we could get married on that same day! We decided to go ahead and do it thinking that the sooner we did it the sooner we would be together... The truth is that the evidence of communication we have before that is very limited as my husband did not have a passport so any money I sent was to his parents and as he didn't have a smartphone or computer until my visit we don't have emails or messages before our wedding. Due to the high cost of calls our communication was not very frequent and as he had a different number then (which he no longer has) there is an itemised bill of calls to a number that can no longer be verified along with calls to other members of his family (when the call to his number could not go through or when his phone had no battery). The only other evidence I have is the receipt for a watch I bought him as a gift for our first Christmas as a couple (back in 2014) which has a picture of the watch on it and he can be seen wearing on our wedding day. I also have the itemised bill I mentioned above which unfortunately only goes back to September 2015 as Lycamobile only keep records for 1 year, a log of western union money transfers going back to 2013, an undated letter that I wrote him where I do not refer to him by name, cards from friends about our wedding (undated and not stamped), and some undated Christmas cards I sent him with the watch... Is it worth me lodging an appeal in your opinion? Any chance that the decision may be overturned by the ECM on this new evidence? If I reapply I understand that we may get turned down based on the fact that we have already been turned down before. My biggest fear is that we will never be able to get a uk visa as the reason they are refusing is not something we can fix... unless someone knows to collect evidence from the beginning then there is no second chance... can this be fixed? If we apply again in a year's time with evidence that we are still together (communication, visits to Nigeria) do you think that they will still turn us down based on the fact that we have no evidence from before the wedding? I apologise for the long post and I look forward to any advice you can give me.
A (heartbroken) Nigerwife |

FINALLY I AM GETTING SOME WHERE GUYS:
Dear ….
Immigration Health Surcharge (IHS) payment needed
On 6 April 2015, the UK Government introduced a Health Surcharge payment requirement for non-EEA nationals who apply to come to the UK to work, study or join family for a period of more than 6 months. The consideration of your visa application has been deferred because you have not made that payment.
What you need to do next:
You must make the payment by visiting ………….
Please note that if the full payment is not made by 19th October 2016 then your application will be refused. If this is the only reason for refusing your application, you will have to make a new visa application and your visa fees will not be refunded.
To prevent any further delays with processing your application, once you have made this payment please send an e-mail to ihs.sheffield@fco.gsi.gov.uk containing your name, GWF reference and the amount that you have paid for IHS.
MY HUSBAND RECEIVED THIS EMAIL TODAY TO THE ADDRESS I HAVE BEEN TRYING TO GET THEM TO CHANGE IT TO....HOWEVER THE ONLY THING NOW IS THAT THE LINK THEY SENT EXPIRED ON THE 19TH OCT. HE ONLY GOT THE EMAIL TODAY 31/10/2016. I HAVE GOTTEN HIM TO COMPLETE AN EMAIL REQUESTING A NEW LINK. HOPEFULLY WE GET THE NEW LINK ASAP...
PROGRESS GUYS...FINGERS CROSSED NOW AND PRAYERS UP |

@caribbeanwify27 now I see where the complication is. Even if HO did contact ur hubby on the IHS payment you guys didnt get it due to the incorrect email address. Really sorry about the situation hun. Does your MP have the email address to which the New & Old GWF-number and the IHS reference number would be sent to? If No...have him request for it using the same medium he used to make the inquiry. As for the consent letter...wait for them to get that as well. Whichever they respond to 1st would still yield the same results. Its not advisable to use the email address with which they contacted you or any other email address from someone else's experience 'cos your case is unique (not in a bad way). I know how hard it is to be away from your spouse for so long. The emotional strain alone is depressing...coupled with this whole IHS & Email address drama. Please accept my sympathy and just keep believing that there would be light at the end of this dark-dark tunnel. Also, the IHS payment request isnt an indication that your hubby's visa has been granted. You would just have to wait it out and see. I pray you would hear good news in the end Caribbeanwify28: @Abbylove Thanks for your response.
We didn't receive an email staying we need to pay. My MP wrote to me and said The HO contacted him regarding the inquiry he made and told him they have been emailing my husband on numerous occasions and that he has to pay his IHS for his application to be concluded and if he doesnt pay his application would be refused.
I clearly remember in April in the lawyers office when he said he has never seen this before that we have been issued with the payment receipt without even entering my card I said to him should I ask if I had to pay since the beginning he said they will contact us if there is an issue. My husband even said when I told him that this thing will later cause an issue and it now has. The worst thing is If I didnt invlolve my MP I would not have known because the HO didnt even contact the lawyer.
The whole thing is stressful my husband left since December last year, I've now travelled to NIgeria 3 times. This year has just been so unsettled.
QUESTION: do you think I should use the same emails given above or wait until the HO get the letter of consent and communicate with me on what to do? |
