An Ondo State High Court sitting in Idanre has stopped the Ondo State government from forcefully evicting over 10,000 farmers from the Idanre forest reserve. Governor Oluwarotimi Akeredolu, in his bid to key into the Central Bank of Nigeria initiative on agriculture, ceded 30,000 hectares of forest to three private firms for the purpose of large-scale cultivation of oil palm, cashew and cocoa. The farmers, in a motion ex parte moved by their lawyer, Tope Temokun, prayed the court for an order of interim injunction restraining the defendants from forcefully evicting them or grading the farmland pending the hearing and determination of the motion on notice for interlocutory injunction. Defendants in the suit are Capital Management Limited, Ondo State Government, Attorney-General and Commissioner for Justice in the state, Ministry of Agriculture,Ondo State amongst others. |

Don’t block roads during Eid prayer – FCTA begs Muslims The Federal Capital Territory Administration (FCTA) has appealed to Muslims not to block roads during Sallah. The administration made the plea in an announcement on Friday. Muslim faithful will observe the Eid prayer at the National Eid Ground along Airport Road on Saturday. The FCTA said there would be a traffic diversion on the Dantata bridge from 7 to 10am. Motorists who are not praying will be diverted under the bridge en route to Galadimawa, Jabi and Life Camp. Muslims were advised to avoid blocking the expressway “as there is enough space within the prayer ground”. The FCTA enjoined worshippers and residents to cooperate with security agencies to ensure the free flow of traffic. “Vehicles will not be allowed to park in front of the prayer ground on the express and service lanes. “Security operatives will be deployed to ensure orderliness and seamless traffic”, the statement added. Wadume escapes? There were indications yesterday that kidnap kingpin Hamisu Wadume was among the inmates that escaped in the aftermath of Tuesday night’s attack on Kuje Correctional Centre in Abuja. Authorities at the Interior Ministry confirmed on Wednesday that 64 terrorists, including Boko Haram Commanders, escaped from the centre after the attack. The escape of the Taraba State kingpin attributed to a source could not be confirmed. Wadume was arrested and being detained in connention with the killing of three members of the Police Intelligence Response Team (IRT) in a special operation led by embattled Deputy Commissioner of Police (DCP), Abba Kyari. Kyari, who was arrested over alleged involvement in drug trafficking, is one of the high profile inmates at the centre. Others are: Former governors Joshua Dariye (Plateau) Rev Jolly Nyame (Taraba), former Pensions Reform Task Force Team Head Abdulrasheed Maina and former House of Representatives member Farouk Lawan. Salami Agbaje was one of lbadan's indigenous entrepreneurs and textile dealer in the early 1920's. He was the first one to own a car in Ibadan. His textile store in Gbaji area of lbadan was the Mecca for all sorts of people who come from the entire stretch of lbadan and Lagos to buy his wares. However, the competition between the Lebanese and indigenous entrepreneurs increased the rate of insecurity for the latter, while the former continued to expand trading activities. For instance, Salami Agbaje reported had to quit textile trade because of them (Ojo, 1988, p. 30). Overall, the rivalry and competition did not favor Nigerian merchants. MKO got support from Osoba, Kolapo Ishola, Isiaka Adeleke, Lamidi Adedibu, Bola Tinubu, Lateef Jakande, Chuba Okadigbo, Sule Lamido, Balarabe Musa, Abubakar Rimi, Dosu Ladipo, Yohana Madaki, Tony Anenih, Ango Abdullahi etc. First Ballot.... Abiola 3,617 Kingibe 3,255 Atiku 2,066 Those three were the leading aspirants and a run off must be conducted among the trio to select the flagbearer. After MKO hugged Atiku and told him "you will be my deputy", here is the politics that follows.. Atiku and co left Ambassador Kwande's house and headed to the Jos Township Stadium where he mounted the podium and announced his withdrawal from the race leaving only Abiola and Kingibe. Atiku's withdrawal gave victory to MKO. The normal thing for MKO was to immediately announce his deputy during his acceptance speech, that was the plan. But immediately Abiola was declared winner, before anyone could say Jack Robinson, Kingibe stood up and walked towards MKO "My President, I'm loyal", he said, before Abiola could recover from the shock of Kingibe unexpected greeting "I'm the best VP that can give you victory" Kingibe continued right inside the stadium while his "corpse" is not yet cold. Abiola was in dilemma. Again, Abiola was to address SDP supporters in Kaduna, expectedly, to announce his deputy. Atiku had arranged two horses, one for Abiola, one for him. That was SDP style of celebration. Again, for the fear of the governors and IBB, Abiola didn't announce his deputy again, for the second time. One day, in his house in Ikeja, Abiola, via a press conference, announced Kingibe as his deputy, There by bowing to the deadly wishes of Governors and ready to go into war with IBB and pacify Atiku. The excuse given to justify this was that "Atiku stepped down but he didn't say he stepped down for Abiola".....Abiola supporters knew that Abiola won't win if Atiku didn't step down but politics is a crafty game. It pained Atiku to his bones. Indeed, IBB kept his threat. He sabotaged June 12 and Yar'adua took his pound of flesh when he threw his weight behind the annulment and opted for Interim Government!! Four passengers have sustained injuries when gunmen attacked motorists along old Ila-Orangun/Ijabe road in Osun State. The information gathered that, the vehicle conveying four passengers to Ijabe community in Odo-Otin Local Government of Osun State from Ila-Orangun were waylaid by the gunmen who fired several shots at them. A security operative, who confirmed the incident, said a passerby informed men of Osun Amotekun of the dastard attack which prompted them to swing into action. According to him: “They attacked the four passengers at the early hours of Sunday but the men of Amotekun arrived the scene after they got information about the attack. They engaged the gunmen and one of them was arrested but the four passengers sustained injuries.” The Field Commandant of Osun Amotekun, Comrade Amitolu Shittu, confirmed the incident on Monday. “One of the gunmen was arrested by our men while the four passengers that were attacked are currently receiving treatment.” www.thenationonlineng.com |

Four farmers, including three males and a female, residing at Elegbeka community near Ifon in Ose Local Government Area of Ondo state, have been reportedly abducted. The farmers were said to have been abducted in the early hours of Saturday. They were said to be be going to Akoko area of the State when gunmen kidnapped them. Sources said the abductors have contacted families of the victims and demanded N4m naira for each of the victims. The sources said there was exchange of gunfire between local hunters and some herders at Idogun in Irekari axis inside a forest in the borders of Ondo/Kogi/Edo states. The local hunters were said to have been joined by their counterparts from Idoani, Ipesi and Ifira A traditional ruler, who spoke on condition of anonymity, said the Owo terror attack has renewed calls for stakeholders to urgently find solutions to the problem of insecurity in Yoruba land. He said all hands must be on deck not only to win the battle but win the war against insecurity. Ondo police spokesman, SP Fumilayo Odunlami, said she was yet to be briefed on the incident. |
The All Progressives Grand Alliance (APGA) has nominated its vice presidential candidate for the 2023 general elections. He is Abdullahi Muhammed Koli. A former Anambra Chief Judge Prof Peter Umeadi emerged the party’s presidential candidate. A statement by Peter Umeadi Campaign Organisation on Sunday made available to our correspondent in Awka, Anambra State, said Koli was a frontline labour inion activist and social crusader who led many struggles for the welfare of Nigerian workers as chairman of Nigeria Labour Congress (NLC) in Bauchi State from 1999 to 2002. The statement reads partly: ” Ahead of the June 17th deadline set by the Independent National Electoral Commission (INEC) for submission of party candidates to the INEC online portal, the presidential candidate of the All Progressives Grand Alliance (APGA) in the 2023 general election, Prof Peter Umeadi has nominated Comrade Abdullahi Muhammed Koli as his vice presidential candidate( running mate). “A release by Peter Umeadi Campaign Organisation says Comrade Muhammed Koli is a frontline labour Union activist and social crusader who has led many struggles for the welfare of Nigerian workers in his capacity as Chairman of Nigeria Labour Congress NLC, in Bauch State from 1999 to 2002.” Umeadi, a Prof of laws at the University of Nigeria, Nsukka,(Enugu campus), had promised to leverage his background as a legal practitioner to reposition the country where the rule of law would prevail, noting that Nigerians deserved a better country. The Chairman, Independent National Electoral Commission (INEC) has asked the presidential and governorship candidates of the 18 registered political parties to pick and submit the lists of their running mates in the next eight days. The INEC Chairman, Prof. Mahmood Yakubu, said this on Thursday in Abuja at a meeting with the Resident Electoral Commissioners (RECs). This means that the presidential candidates of the Peoples Democratic Party (PDP), Alhaji Atiku Abubakar; All Progressives Congress (APC), Senator Bola Ahmed Tinubu; and New Nigeria Peoples Party (NNPP), Engr. Rabiu Musa Kwankwaso, and others have about a week more to nominate their vice presidential candidates to the commission. According to him, while the conventions and primaries of candidates by political parties for the 2023 general elections end on Thursday, the nomination of the candidates and their running mates commenced on Friday and ends a week later. “For the next one week from tomorrow, 10th June, all political parties are required to submit their list of candidates for national elections (presidential/vice presidential, senatorial and house of representatives) latest by Friday, 17th June. “For state elections (governorship/deputy governorship and state houses of assembly), the list of candidates shall be uploaded from 1st to 15th July as already provided in the Timetable and Schedule of Activities for the 2023 General Election already released by the Commission,” Yakubu said. He also said that all political parties are required to upload the details of their candidates for each constituency to the INEC Candidate Nomination Portal (ICNP). The INEC boss said that to achieve this objective, four officials recommended by each of the 18 political parties were trained in the procedure for uploading the nomination forms to the dedicated web portal. “Confidential Access Codes to the portal have already been given to each Political Party to facilitate the uploading of its nominations. “For emphasis, the commission wishes to remind Political Parties that only the names of candidates that emerged from democratic primaries as provided by Sec. 84 of the Electoral Act 2022 shall be submitted to the commission,” he said. He added that the list of all presidential and governorship candidates must be accompanied by the names of their running mates (that is vice presidential and deputy governorship candidates) without which the nomination is invalid, warning that all nominations must be uploaded to the portal on/or before the deadlines. He said, “All nominations must be uploaded to the portal on/or before the deadlines. The portal will automatically shut down at 6.00pm (1800hrs) on Friday, 17th June 2022 for national elections and 6.00pm (1800hrs) on Friday 15th July 2022 for state elections. “With this innovation, the commission has eliminated the physical interface between party officials and INEC staff for the purpose of submitting the list of candidates for the 2023 general election.” Yakubu said that a nomination centre has been set up at the commission’s headquarters to receive and process all nominations by political parties, including dedicated telephone lines to serve as help desk for any party that may need assistance. Journalists later visited the nomination centre, where the INEC boss said that each of the 18 registered political parties were expected to submit 1,520 nominees or 27,360 total for all the parties. …speaks on CVR On the Continuous Voters Registration (CVR), Yakubu said that the introduction of the online pre-registration system and the new INEC Voter Enrollment Device (IVED) helped to reduce the long queues witnessed in the previous registration exercise in 2017 and 2018. He said that INEC also created additional registration centres and deployed more machines. Yakubu said, “In three states (Anambra, Ekiti and Osun), the exercise was devolved to Ward level to give more citizens the opportunity to register ahead of their off-cycle governorship elections. Similarly, on weekly basis since 5th July 2021, the commission has been giving weekly detailed updates on fresh registrations nationwide. “Unfortunately, in some places the exercise was disrupted by general insecurity. In other places, our Local Government Areas offices were consistently attacked resulting in the suspension of all activities, including voter registration. “A number of IVED machines were snatched and uncollected Permanent Voters’ Cards (PVCs) destroyed. Worse, our registration officials were violently attacked. Some of them were abducted but later released. In one sad incident, an official lost his life. Despite these challenges, the CVR has continued nationwide.” The INEC boss said that, however, as the deadline for the suspension of the current exercise approaches, the commission has received reports of a surge in the number of prospective registrants that daily throng its state and local government area offices as well as designated centres in many States across the country. “I wish to reassure Nigerians that the commission remains committed to ensuring that all citizens who wish to register are given the opportunity to do so. This is one of the reasons why this meeting has been convened. “Already, some of the Resident Electoral Commissioners (RECs) have requested for more voter registration machines to ease the congestion. The commission will deploy additional machines to areas of need immediately. “Thereafter, the commission will meet to review the progress of the exercise and take further decisions. We will always respond positively to the needs of Nigerians and therefore appeal to all citizens to be patient with the commission as we strive to serve them better. Famous Nigerian comedian and filmmaker, Ayo Makun, aka AY, has opened up on his age-long rift with a colleague, Bright Okpocha known as Basketmouth. AY, in an Ask Me Anything session on his Instagram page, said he has no issues with Basketmouth but avoids him because he has an ‘uncontrollable superiority complex and childishness.’ AY said this after a fan asked, “Do you really have any issues with Basketmouth?” Responding, he said: “I don’t have issues with Basketmouth but people having unnecessary issues with you are the price you sometimes pay for being progressive. “He has been battling with an uncontrollable Superiority complex for the longest. So, avoiding his incessant childishness only became necessary for my own sanity.” AY who went further said he only speaks to those who speak to him. I think it’s safe to say Olamide Baddo has done it again. Airlines to increase flight tickets to N120,000: Allen Onyema “We have only three more days, all airlines in Nigeria will shut down,” Mr Onyema said. Allen Onyema, CEO of Air Peace, on Monday, warned that airfare might rise to about N120,000 if urgent actions are not taken to reduce the price of aviation fuel. Mr Onyema who spoke on behalf of the Airline Operators Association of Nigeria (AOAN) at a parliamentary briefing on Monday called on President Muhammadu Buhari’s regime to grant operators permission to import the product to end the hike. He argued that if airline companies can buy planes worth millions of dollars, they would have no trouble importing aviation fuel. Lamenting that the cheapest flight ticket costs N70,000, Mr Onyema warned there would be further increase if efforts were not made to address the fuel crisis. Responding to the airline operators’ request, the Group Managing Director of the Nigerian National Petroleum Company (NNPC) Limited, Mele Kyari, disclosed that plans were underway to issue airline operators licences to import aviation fuel. It was agreed at a hearing attended by the Major Oil Marketers Association of Nigeria (MOMAN) and the Depot and Petroleum Products Marketers Association of Nigeria (DAPPMAN) that the price of Jet-A1 be set at N500 per litre, down from N670 per litre. Mr Onyema had said at the briefing that airline operators agreed to down tools until the fuel price returned to normal rate. “We have only three more days, all airlines in Nigeria will shut down,” Mr Onyema said. “We are not threatening this country, it is a fact.”

Tragedy As Student Shot Dead, 2 Injured At Inter-House Sports in Ondo 11 MARCH 2022Daily Trust (Abuja) By Bola Ojuola The Annual Inter-House Sports Festival of Agolo High school Ikare Akoko, North East local government area of Ondo state which started peacefully yesterday ended in tragedy as one student was shot dead and two others seriously injured. Eyewitnesses said the Inter-House Sports festival was well attended as secondary school students from various parts of Akoko and many old students were also in attendance. One of the eyewitnesses said "Suddenly gunshots were heard which led to immediate death of a student while two others were seriously wounded." The injured were said to have been rushed to an undisclosed hospital where they are now receiving medical attention. After the sad incident there was panic and apprehension in Ikare Akoko as parents ran helter-skelter looking for their children. Efforts to speak with either the principal of the school or the games master to unravel the cause of the unfortunate incident proved abortive as at the time of press. However, the Divisional Police Officer in Ikare Akoko, SP Olatujoye Akinwande has confirmed the incident as he said the corpse of the student had been deposited at a mortuary while those who sustained injuries were receiving treatment. He also said normalcy had returned to the area. |

A BRIEF ALLOCUTION ON THE SALIENT PROVISIONS OF THE AMENDED ELECTORAL ACT. Yesterday 25th of February, 2022, President Muhammadu Buhari has signed the Electoral Act, Amendment Bill into law. It suffices to recall that the said Bill was signed into law after it has suffered protracted delay and setbacks both from the Presidency and the National Assembly, particularly on the provision of the Bill which relates to mandatory direct primaries. While commending the drafters of the Bill for the wealth of industry and Mr. President for leaving behind a great legacy in our electoral process, it is pertinent to consider salient provisions of the new Act viz-a-viz the provisions of the old Electoral Act. 1. Section 29(1) stipulates that parties must conduct primaries and submit their list of candidates at least 180 days before the general elections. This is a welcome development. Under the Old Act, political parties had a period of 60 days to submit the list of candidates before the general election. The trend before in the country is for political bigwigs in the parties to deliberately postpone their primaries in the bid to get candidates for their personal and aggrandisement. 2. Section 3(3) states that funds for general elections must be released at least one year before the election. This is welcome development and commendations ought to be given to the drafters of this provision. One can easily recall the logistics problems faced in the past by INEC to get adequate resources for ballot boxes and papers. At the last general election, approval of funds for the election were given just few days before the election. 3. Section 51 says that the total number of accredited voters will become a factor in determining over-voting at election tribunals. I believe the above provision is a restatement of the judicial pronouncement of the Courts with respect to the proper way of proving over-voting. The Courts have held that the law is well settled that in order to prove over voting the petitioner must do the following: a. Tender the voters register; b. Tender the statement of results in appropriate forms which would show the number of registered accredited voters and number of actual votes; c. Relate each of the documents to the specific area of his case in respect of which the documents are tendered; d. Show that the figure representing the over-voting if removed would result in victory for the petitioner. See: Haruna Vs Modibbo (2004) 16 NWLR (Pt.900) 487; Kalgo v. Kalgo (1999) 6 NWLR (Pt.606) 639; Audu vs. INEC (No.2) (2010) 13 NWLR (Pt.1212). 4. Section 54(2) makes provisions for people with disabilities and special needs. This section incorporates the fundamental principles of equality of persons as contained in Section 42 of the 1999 Constitution to the effect that no persons shall be discriminated against by reason of their sex, age, or any disabilities. 5. Section 47 gives legislative backing for smart card readers and any other voter accreditation technology that the Independent National Electoral Commission (INEC) deploy. INEC is to be commended for the innovation of the Card Reader machine to bolster the transparency and accuracy of the accreditation process and to maintain the democratic norm of "one man one vote" by preventing multi-voting by a voter. However, the issue of smart card reader has been a knot to tie in the previous election. Even though this provision was earlier incorporated in the INEC election manual, the validity of same has been contested in court up to the Supreme Court. For instance in the case of NYESOM V PETERSIDE, The Supreme Court held that “the INEC directives, Guidelines and Manual cannot be elevated above the provisions of the Electoral Act so as to eliminate manual accreditation of voters. This will remain so until INEC takes steps to have the necessary amendments made to bring the usage of the Card Reader within the ambit of the substantive Electoral Act.” The Court further held that the use of smart card has not taken the place of manual accreditation provided for in Section 49 of the Electoral Act. The question to be determine now is whether the codifying of the use of Smart Card takes the place of manual accreditation? 6. Section 34 gives political parties power to conduct a primary election to replace a candidate who died during an election. Under the provision of Section 33 of the old Electoral Act, a political party shall not be allowed to change or substitute its candidate whose name has been submitted pursuant to Section 32 of the Act, except in the case of death or withdrawal by the Candidate. Worthy of note is that the provision did not specifically stipulate the time frame to make the substitution in the case of death of a candidate. One would recall that a similar situation happened in Kogi State which ended up in INEC declaring the party with the second highest number of votes as the winner of the election. By this new provision, one can easily conclude that votes cast at the poll are not for the individual but for the party has held by the Courts in several decisions. 7. Section 50 gives INEC the legal backing for electronic transmission of election results. It is interesting to recall that the issue of election server was the highlight of the 2019 presidential election tribunal. It is pertinent to recall that it is the petitioners’ case that the results of the Presidential election were transmitted electronically into the imaginary server from all the polling units in the country. It suffices to start on the premise that such an argument is a sham. Of more importance is that what Nigerian Electoral law recognises is the Form EC8 Series, especially Form EC8A, signed by agents, collation officers, etc, at the Polling Units. The only way to prove election results in Nigeria today is by the approved forms: the EC8 series. Not by any Server or Servers. With this new provision, the perdurable question we have to consider is whether the servers would take the place of Form EC8 series. We would also have to battle the issue of data networks and availability of electronic voting for persons in the rural and remote areas. 8. Section 94 allows for early commencement of the campaign season. By this provision, the campaign season will now start 150 days to the election day and end 24 hours before the election. Under the old Act, campaign season is usually a period of 90 days before the election. This new provision will allow candidates and political parties reach more people in record time before the election and to be able to determine the strength of their political reach before the election. 9. Section 84 stipulates that anyone holding a political office – ministers, commissioners, special advisers and others – must relinquish the position before they can be eligible to participate in the electoral process either as a candidate or as a delegate. This is a very commendable and quite innovative provision of the Act. This will effectively checkmate political appointees who believe that the electoral college is their exclusive preserve. |
