…Urges Nigerians to be mindful of aspirant promising restructuring
…Says Buhari presiding over a divided Nigeria

By Daud Olatunji & Gabriel Olawale

LAGOS—Senate President and presidential aspirant of Peoples Democratic Party, PDP, Dr Bukola Saraki, yesterday, excited members of the party in Lagos as he assured them that he will do everything within his reach to ensure PDP produced the next governor of the state. Saraki, who spoke at the PDP secretariat in Lagos State, where he was endorsed as favourite candidate, said he had the medicine of the man terrorizing Lagos State.

He said: “What you have been fighting for many years, you will have it during the coming election because you now have somebody that has intention and charisma to deal with those disturbing you.

“I have a medicine of the man who regards himself as godfather terrorising Lagos State. We have their formula, come next year, PDP will take over Lagos.”

Saraki warned Nigerians to be mindful of presidential aspirants promising to restructure Nigeria, if elected president. He said restructuring agenda was not something a president could single-handedly promise as it required the input of the legislature.

He said: “Many aspirants will tell you that they will restructure Nigeria, but don’t let them deceive you because restructuring is not something only a president can do because certain laws also need to change.

“So you need a president that has political sagacity to carry people along. But there are very few aspirants today that possess such charisma. Once I assume office, I will devolve more powers to the state.’’

On unemployment

On unemployment, Saraki said no government could create enough jobs, stressing that it was only private sector that could do so.

He said: “You need a president that can speak private sector language. So, this is the time to elect the right president to lead the country.

“In Nigeria, we are at the crossroads and we need to save the soul of this country because we have not been so divided like we are currently across the country. In his response, Acting Chairman of Lagos State PDP, Alhaji Wali Hassan, assured the Senate President of their support, even as he commended him for the love he had for the party in Lagos.

“As you can all see, he had his primary and secondary school education in Lagos and his wife is a Lagosian, so we are going to support him,” Hassan said.

On his entourage were former Minister of State for Power, Alhaji Mohammed Wakili; immediate past governor of Kogi State, Captain Idris Wada; Dr. Doyin Okupe, former Senior Special Assistant on Public Affairs to former President Goodluck Jonathan; Senator representing Kogi West, Dino Melaye; and Chairman of the defunct nPDP, Kawu Baraje, among others.

Buhari presiding over a divided Nigeria

Meanwhile, while meeting with delegates in Abeokuta, Ogun State, Saraki described Nigeria under the control of President Muhammadu Buhari as a divided nation, where citizens don’t have a sense of belonging.

He said: “Today in Nigeria, we are here at the crossroads. The country is divided and to unite the country, we need someone who will make everybody feel a sense of belonging. Today, there is no sense belonging in some parts of the country. “We need a president that rules and represents Nigeria. We want a president where everybody will say they belong here. Where there is no unity, there can never be progress. After unity, we can talk about development and progress.”

*Says he remains loyal APC member

THE Deputy Speaker of the House of Representatives, Hon Sulaimon Lasun Yusuff, on Sunday dismissed the rumour making the round that he has defected from the ruling All Progressives Party (APC), to the Peoples Democratic Party (PDP), ahead of the 2019 general elections.

This was contained in a statement made available to newsmen in Abuja yesterday by his Chief Press Secretary, Wole Oladimeji‎, describing the alleged defection to the PDP as “highly misleading and highly uncalled for.”

According to the statement, “Lasun has said it repeatedly that he is progressive to the core and remains in APC as loyal party man to the core ‎, it is the machinations of his political distractors who are head bent in maligning his political image that is spreading the rumour.”

It recalled that Hon. Lasun warned against direct primary election held recently in Osun State, which had consequently led to the defection of other governorship aspirants who participated in the said direct primary election in the State.

It explained further that Lasun at several occasions publicly condemned the direct primary which was now causing disaffection among the party faithful across the country.

“A silence does not mean that he has left the party, the rumour recently being spread is by his political distractors,” it stated.

PoliticsOmisore Campaigns In Adeleke’s Town, Receives Timi Of Ede’s Royal Blessings by afroniger(op): 7:37am On Sep 16, 2018

*DPP GOVERNORSHIP CANDIDATE STEPS DOWN FOR OMISORE

September 15, 2018 Seyi Gesinde

THE governorship candidate of the Social Democratic Party (SDP) in Osun State, Senator Iyiola Omisore has taken his campaign to Ede, the hometown of his People Democratic Party (PDP) contender, Senator Ademola Adeleke.

Omisore, and his campaign train, led by a national leader of the party, Dr Yemi Farounbi, earlier before addressing a mammoth crowd, who had awaited his arrival late on Friday in Ede, went in to pay homage to Timi of Ede, Oba Munirudeen Adesola Lawal, who warmly received them in his palace, in company of Baales across the town, his palace chiefs and other subjects.

Oba Lawal, who said he was glad to have Omisore in his palace, said he considered him a son and not a visitor, because of the relationship he said Omisore had personally built with himself, the palace and people in his domain.

The monarch recalled Omisore’s contributions to the development of Ede and his willingness to help on occasions he had the opportunity to do so, as he also lauded him on his philanthropy, saying, “God recognises good deeds, and He rewards good efforts accordingly.

He admonished Omisore, the Akinrogun of Ede, to continue with his good works, and while giving his royal blessings, he beseeched God to grant Omisore his desire to be the next Osun State governor, as according to him “it is only God who enthrones and answers prayers. The way of God is not the way of man, hence, no one can acclaim glory to himself on the success of others, even if such person has offered a helping hand. I pray God will grant your desire to be the next governor of Osun State.”

In his response, Omisore thanked Oba Lawal for his kind gesture, fatherly role and prayers, while he also promised to fulfil his campaign promises and live up to expectation as the state governor, saying, he had been instrumental to developments in the state and Ede most especially, as he asked the people to be prepared to vote SDP to victory in the coming election, while he promised to repair the Ede road by December 2018 if voted in as the state governor of the state.

He recalled a water project he said he facilitated to the town in 1980, which he said he followed up as a senator after it was neglected for long, which he said had also suffered neglect from the outgoing All Progressive Congress (APC) government in the state, but which he said he would take care of as a governor in the state, while also promising to pay outstanding workers salaries and pensioners arrears.

Earlier, Farounbi in his address at the palace, extolled Omisore’s virtues, calling him a friend of the people of Osun State, who he said was always willing to offer help, which he said was the situation when he was a deputy governor in the state and as the appropriation committee chairman in the Senate.

Farounbi, a former chairman of SDP in the state in 1991, said, Omisore, being a consultant to international financial institutions which included the World Bank, International Monetary Fund (IMF), African Development Bank (AFDB) and as an engineer, he would be able to facilitate funding to develop projects in the state.

He said then, in 1991, as SDP chairman, the same way he brought Omisore to the palace was how he led the late Senator Isaka Adeleke to the palace of Timi of Ede, before going to the polls, where he later won to become the Osun State governor, saying, “same way, Omisore and SDP already used to winning will win the coming September 22 governorship election.”

Also at the Ede campaign rally, a governorship candidate of Democratic People’s Party (DPP), Prince Ayedeji Eniola Oni, withdrew his candidature for Omisore, saying he was stepping down to support Omisore, who he considered to be the best of all the 48 candidates passed by the Independent National Electoral Commission (INEC) to participate in the September 22 governorship election.

According to him, “I look at Omisore as a lover of youths, someone who the youths can follow, and who has a plan for them. Omisore is the only one who can do it as a governor and we shouldn’t give it to a wrong person, so, for this reason, I am stepping down for him, while I encourage all my supporters in the state for the coming election to vote for Omisore.”

All I am saying is that you Adeleke supporters should do more to promote your candidate by showing his rally pictures the way APC has been doing with their candidate. Failure to do so is making it seem like PDP isn't doing much campaigning. At least we have seen a few impressive rallies of Omisore on this same forum that hit front page on more than one occasion. Adeleke is the candidate of the major opposition party so one would've expected his media handlers to match APC's media projection of their own candidate.

PoliticsLabour Party Rejects Mimiko As Its Presidential Flagbearer by afroniger(op): 6:22pm On Sep 13, 2018
The Nigeria Labour Congress (NLC) has rejected plan by former National chairman of the Labour Party, Abdulkadir Abdulsalam to adopt Olusegun Mimiko as the party’s Presidential flagbearer for the 2019 general elections.

Mr Ayuba Wabba, NLC President and Mrs Ebere Ifendu, the National Publicity Secretary, Labour Party, stated this at a joint news conference on Thursday in Abuja.

According to Wabba, this is very important for labour to make its position clear for the 2019 General Elections.

“It is not possible for Mimiko to run under the labour party and we want to say no to that. As Mimiko has no business as a member of Labour Party.

“ The party is registered by the NLC and the Trade Union Congress, Market Women Association, students, we register the party and the certificate of the party is with the NLC General Secretary.

“Therefore, bringing money to buy the party or the structure will not work, we do not share in the same ideology with him. It is a party with a difference.

“Therefore, I want to call on Minimko once again to make sure he off-his –hands off the party.

“Therefore, A.A Salam cannot continue to function as the chairperson of the party, ‘’ he said.

He added the Labour Party is not a place for any candidate to join when the condition is favorable and when you arrive at your destination, you abandon it.

Also, Mrs Ebere Ifendu, National Publicity Secretary of the Labour Party also warned Nigerians and political aspirants to disregard the purported party convention slated for 13th September in Abuja.

“It has become necessary for the leadership of the Labour Party to draw the attention of the general public to the fraudulent collection of Expression of Interest and Nomination Form fees from innocent and unsuspecting political aspirants.

“That is for those who desire to contest various elective positions under the Labour Party through Alhaji A. A. Salam, the former national chairman of the party.

“It would be recalled that A. A. Salam was removed at the special national convention of the party held on 3rd October, 2017.

“This illegality was also confirmed by the Independent National Electoral Commission (INEC) report, presented by the three INEC officials that were detailed to supervise its conduct, ‘’ she said.

She also disclosed that the party’s counsel, Femi Falana has served INEC, A. A. Salam and Julius Abure, the Court contempt summon, hence warned them not to proceed with the illegal party convention otherwise they risk arrest.

“Credible information reaching us revealed that A. A. Salam has concluded arrangements to pull a rented crowd to declare Olusegun Mimiko as the Labour Party’s Presidential Candidate.

“This illegal event is schedule to hold in Abuja on Thursday, 13th September. This is a total violation of Article 27, section 1, subsection i and ii of the Labour Party’s constitution.

Ifendu said the party constitution stipulates that ‘aspirants for presidential election shall be nominated as candidate for the party at the national convention.

“Where the National Executive Council identifies a credible and nationally acceptable person, it shall nominate and present such a person for ratification only at the national convention as the party’s presidential candidate.

“The same rule applies to the nomination of a gubernatorial candidate in section 3, subsection i & ii, in the case of which the state Congress is saddled with the responsibility of pronouncing their gubernatorial candidate, ‘’she said.

She called for caution in the light of the above violations and open disregard to the constitution of the party.

She called on all Labour Party National Working Committee members, State officials in the 36 state, FCT, among others to disregard the illegal gathering being summoned by A. A. Salam and Julius Abure.

“The law enforcement agencies have been adequately notified of this illegal gathering and they are poised to take legal action against any person or group of persons that attend this illegal gathering. To be fore-warned is to be fore-armed.

“That all intending aspirants and candidates, willing to contest elections under Labour Party, should desist from dealing with A. A. Salam and Julius Abure on election matters. Those who make payments to them does so at their own risk.

“Consequently, the party hereby disowns and rejects Olusegun Mimiko as its presidential candidate, since neither the national executive council nor the national convention has been notified, as provided in the party’s constitution referred to above.

“Be informed also that a court contempt proceeding has been served on A. A. Salam and his gang leaders.

“Any attempt by them to convene an illegal NEC convention or any gathering of such similitude will amount to a court contempt and a total disregard for the rule of law,” Ifendu said.

She maintained that Nigeria Labour Congress, who is the Founder, custodian and promoter of the party, had intervened in the fracas that almost tore the party apart.(NAN)

PoliticsCourt Strikes Out Suit Seeking To Stop Saraki’s Removal As Senate President by afroniger(op): 1:16pm On Sep 13, 2018
By Ikechukwu Nnochiri

ABUJA – The Federal High Court sitting in Abuja, on Thursday, struck out a suit asking it to stop any attempt to reconvene the Senate for the purpose of removing Dr. Bukola Saraki as the Senate President.

Justice Nnamdi Dimgba terminated further hearing on the suit which was filed by two former All Progressive Congress, APC, Senators, Rafiu Adebayo and Isa Misau, following an application by the Attorney General of the Federation and Minister of Justice, Mr. Abubakar Malami, SAN.

At the resumed hearing of the case marked FHC/ABJ/CS/843/2018, no lawyer appeared on behalf of the plaintiffs. Consequently, the AGF who was represented by Mr. T. D. Agbe, urged the court to strike out the case for want of deligent prosecution.

The AGF further prayed the court to award a cost of N10million against the plaintiffs who he accused of filing a frivolous suit. He noted that the plaintiffs who were previously represented by a consortium of Senior Advocates of Nigeria led by Mr. Mahmud Magaji and Emeka Etiaba, were aware that the matter was slated for hearing.

“We apply for a substantial cost to be awarded against the plaintiffs to teach them a lesson. This court is not a play ground, it is a place for serious business”, the AGF submitted. Counsel to both the Inspector General of Police, Mr. Kola Oluwole and that of the Department of State Service, Mr. Shimana Azeh, adopted the position of the AGF and requested that the case should be struck out.

In a short ruling, Justice Dimgba acceded to request of the Defendants and struck out the case for want of deligent prosecution. The plaintiffs who are representing Kwara South and Bauchi Central, respectively, had alleged that some chieftains of their former party, APC, led by its National Chairman, Adams Oshiomohole and the AGF, had perfected plans to use security agencies to force Saraki to vacate his position as the Senate President.

They applied for an order of interlocutory injunction stopping any impeachment proceeding against Saraki, pending the determination of legal issues they posed before the court. In a 13 paragraphed affidavit that was personally deposed to by Senator Misau, he told the court that the APC was collaborating with key security agencies and the AGF to ensure Saraki’s removal, notwithstanding the number of Senators in his support.

According to him, “Unless the Defendants and their agents are restrained by this Honourable Court from taking the law into their hands, the constitution of the Federal Republic of Nigeria would not only be breached and violated by the Defendants but would also plunge the entire Country into a constitutional and social crisis of immense magnitude”.

The plaintiffs urged the court to among other things, determine whether, “In view of the combined reading of sections 50(1) (a), 53(1) (a) and 60 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and Rules 12 (2) of the Senate Standing Orders 2015 (as amended), the Senate of the Federal Republic of Nigeria, has the powers to regulate its proceedings including the power to adjourned its sitting to a date certain?

“Having regards to sections 50(1) (a), 53(1) (a) and 60 of the ‘ Constitution of the Federal Republic of Nigeria 1999 (as amended) read in coniunction with Rules 12 (2) of the Senate Standing Orders 2015 (as amended), whether any member of the Senate other than the President and Deputy President of the Senate can re-assemble the sitting of the Senate to an earlier or later date other than the adiourned date?

“Whether by virtue of the provision of the Rules 12(1), (2) and (3) of the Senate Standing Orders 2015 (as amended), it is the Senate President or in his absence the Deputy President of Senate that is vested with the exclusive powers to convene and give notice of the meeting of the Senate at any earlier date before or during the period of recess/break of the Senate, ending on the 25th September, 2018.

“Whether on a proper interpretation of Rule 12 paragraph 2 of the Senate Standing Order 2015 (as amended), the leaders of a single political party can validly direct the Senate President to reconvene the Senate sitting on an earlier date other than the date fixed for resumption of Plenary/ Sitting by the President of the Senate.

As well as, “Whether by virtue of the provisions of sections 4, 5 and 6 of the Constitution of the Federal Republic of Nigeria I999 (as amended), the Defendants other than the 2nd and 3rd (Saraki and Ike Ekweremadu) are statutorily empowered to issue directives to the lst, 2nd and 3rd Defendants to reconvene the Senate of the Federal Republic of Nigeria after same was properly adiourned in accordance with the extant laws of the Senate of the Federal Republic of Nigeria”.

Aside praying the court to declare that only Saraki or in his absence, Ekweremadu that has the powers to give any notice for the purpose of reconvening the Senate before September 25, the Plaintiffs urged the court to abort any move by any other authority, to recall the Senate.

Cited as Defendants in the suit were the Senate, Saraki, Ekweremadu, Senator Ahmed Lawal (Senate Leader), Senator Bala Ibn Nallah (Deputy Senate Leader), Senator Emma Buacha (Deputy Minority Leader), Clerk of the Senate and Deputy Clerk of the Senate. Others were the AGF, the IGP and the DSS. The AGF had earlier challenged the jurisdiction of the high court to entertain the suit, even as he discribed the two lawmakers who recently defected to the Peoples Democratic Party, PDP, as “mischief makers”.

The AGF maintained that the plaintiffs failed to show how Saraki’s removal would affect their personal rights. He further contended that the fact that Police summoned Saraki for interrogation with respect to the Offa robbery incident, was not sufficient ground for either the plaintiffs or Saraki himself to file action to consolidate his position in the Senate.

“My lord, I do not think this court is so free to allow itself to be used by mischief makers like the plaintiffs in this matter. The present suit as constituted has not shown any wrong done to the plaintiffs.

“We submit that the directives of the invitation of Dr Bukola Saraki to appear before the IGP for further investigation in line with paragraph 5(f) of the DPPF’s advice cannot create a cause of action in favour of either Saraki himself or the Applicants herein.

“It is pertinent to state that if there is a threat to powers of the Senate President as conferred on him by the constitution and the Standing Rules of the Senate, the first person to complain should be the Senate President and not the plaintiffs herein”, the AGF stated in his preliminary objection dated August 27.

Foreign AffairsCalifornia's Poverty Rate Is Highest In Nation, Stats Show by afroniger(op): 7:44am On Sep 13, 2018
https://www.vcstar.com/story/news/2018/09/12/californias-poverty-rate-highest-nation-stats-show/1286786002/

Newly released federal estimates show California’s poverty rate remained the highest in the nation, despite a modest fall, and the state’s falling uninsured rate slowed for the first time since before Medicaid expansion.

According to the Census Bureau, the share of Californians in poverty fell to 19 percent — a 1.4 percent decrease from last year. However, policy experts warned that in spite of the good news, more than 7 million people still struggle to get by in the state.

The poverty figures released Wednesday are said to paint the best picture of life for California’s working poor since it encompasses income from government programs and factors in the high cost of living in some corners of the state.

Although California has a vigorous economy and a number of safety net programs to aid needy residents, it’s often not enough to forestall economic hardship for one out of every five residents, the data show.

The high cost of living, primarily in housing, is a strong counterweight to many of the state’s efforts, said Caroline Danielson, policy director at the Public Policy Institute of California.

“We do have a housing crisis in many parts of the state and our poverty rate is highest in Los Angeles County,” she said, adding that cost of living and poverty is often highest in the state’s coastal counties. “When you factor that in, we struggle.”

The portion of uninsured residents dropped from 7.3 percent to 7.2 percent. The one-tenth of a point decrease was a significantly smaller decline than the last four years.

California, like many states, expanded Medicaid after the passage of the Affordable Care Act. The law has come under attack by the Trump Administration in the last year — a fact some blame for the state’s slowed progress.

Scott Graves, director of research with the California Policy and Budget Center, said the tumult over the health law and multiple attempts to repeal it carry most of the blame for the state’s slowing improvement.

“We saw this huge cloud of uncertainty descend over the Affordable Care Act and Medicaid last year,” Graves said, adding that the multiple attempts to undermine the law likely discouraged people from signing up.

“We’re definitely seeing some of those federal headwinds showing up in the data here in California to the extent that our uninsured rate, which has come down several years in a row — in 2017 it sort of stalled out.”

Since 2013, the share of Californians who are uninsured fell by 10 percentage points. The only other state to see remotely similar growth was New Mexico, according to a Census report.

“From our standpoint, this represents a historic low. It’s only a small kick down from where we were a year ago but it does represent a new historic low in California,” said James Scullary, a spokesperson for Covered California. “California has experienced the largest decrease in uninsured than any state in the nation.”

..order fresh election in Benue, Sokoto, Kwara within 90 days

By Ikechukwu Nnochiri

ABUJA – The Abuja Division of the Federal High Court, on Wednesday, okayed three separate suits seeking to declare the seats of Governors Samuel Ortom of Benue State, Aminu Tambuwal of Sokoto State and Abdulfatah Ahmed of Kwara State, vacant, following their defection to the Peoples Democratic Party, PDP.

The suits marked FHC/ABJ/CS/901/2018, FHC/ABJ/CS/940/2018 and FHC/ABJ/CS/943/2018, respectively, were lodged before the court by a civil society group under the aegis of Incorporated Trustees of Advocacy for Change and Social Values Network.

The group is praying the court to direct the Independent National Electoral Commission, INEC, to within 90 days, conduct fresh poll to elect new Governors in the three states and a Deputy Governor in Benue State, in accordance with the law.

It equally applied for an interim order, directing Chief Judges of the states to swear-in Speakers of the State Houses of Assembly, to hold office as Acting Governors, pending the conduct of fresh elections by INEC.

Whereas Governor Ortom was sued alongside his Deputy, Mr. Benson Abounu, both Tambuwal and Ahmed were sued alone. Also joined as Defendants in the suits were INEC and the All Progressives Congress, APC.

Specifically, the plaintiff, among other things, wants the court determine, “Whether having regard to the totality of the Constitution of the Federal Republic of Nigeria I999 (as amended), a person elected into office as Governor or Deputy Governor on the sponsorship of a particular political party which won the election, can move or defect to another political party without the consent of the sponsoring political party, whilst still retaining the benefit of the election won by the initial political party?

Whether by the combined provisions of Sections 177(c) and 221 of the 1999, Constitution, as amended, and the decision of the Supreme Court in the case of AMEACHI v lNEC (2000) S NWLR (Pt.l080) 227, it was not the APC that won the 2015 governorship election in Benue, Sokoto and Kwara states.

Whether having regard to the Constitution of the Federal Republic of Nigeria, I999 (as amended), there is any provision that allows or empowered the three governors and the deputy governor of Benue State, elected under the APC, to move or defect to another political party?

“Whether an election victory won by a political party, in this case the APC, can be transferred to another political party, without the express consent of the political party that won the election, and contrary to the express provision of the Constitution of the Federal Republic of Nigeria, 1999 (as amended)?

“Whether, except for the offices or positions and under the circumstances specified in the Constitution of the Federal Republic of Nigeria 1999 (as amended), the Defendants who were declared elected into the office or position of Governor and Deputy Governor on the sponsorship of a particular political party (the APC) can transfer the victory of such election to another adverse political party by retaining the office or position?

“Whether, except for the offices or positions and under the circumstances specified in the Constitution of the Federal Republic of Nigeria 1999 (as amended), the Defendants who have withdrawn and resigned their membership of the political party upon which they were elected, are still entitled to the rights and privileges that accrued to them as, and while they were, members of the initial political party (the APC)”.

In the case of Benue State, the plaintiff asked the court to further determine “Whether the 2nd, 3rd and 4th Defendants (Ortom, Abounu and the APC) can, either expressly or impliedly and outside the contemplation of the law, reconfigure, restructure or extinguish the political platform and framework upon which they canvassed and secured votes and mandate of the electorates represented by the Plaintiff and the other electorates in the 2015 General Governorship Election in Benue State, and still retain the position, and if not, was the of the 2nd and 3rd Defendant’s defection and invariable restructuring and reconfiguration of the political platform and framework upon which they were voted, not unlawful, ultra-vires the Constitution and amounts to a violation of the electorates’ right to elect political party of their choice?

As well as, “Whether having regard to the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the circumstances and justice of this case, the proper order for the Court to make is not one directing the 1“ Defendant (INEC) to conduct a new election for the completion of the unexpired term of the 2nd and 3rd Defendants as Governor and Deputy Governor of Benue State respectively?”.

Upon determination of the legal questions, the plaintiff, sought for a declaration that the defection, movement, crossing of carpet or howsoever called, by the three governors and the deputy governor of Benue State, from the political party that sponsored them and also won the 2015 General Governorship Election in the states, to another political party, was unconstitutional in the absence of any statutory provision or authority that permitted such movement.

A declaration that the continued stay in office of the three Governors and the Deputy Governor of Benue State, having withdrawn and resigned their membership of the APC which was the political party that sponsored them and also won the 2015 General Governorship Election, and defected to the PDP, was unconstitutional and in gross violation of mandate of the electorates.

A declaration that the Defendants, having withdrawn and resigned membership of the APC, the political party that sponsored them and also won the 2015 General Governorship Election in their states, and defected to another political party, the composition of the Office of Governor as presently being held and occupied by two different political parties, represented by the APC and the Defendants, is unconstitutional, violates the mandate of the electorates including those represented by the Plaintiff.

“A declaration that under the Constitution of the Federal Republic of Nigeria 1999, (as amended) and existing laws, no two adverse political parties can present a single candidate in an election in which both party are contesting or lay claim to victory in one elective position or office, except as provided and contemplated by the Constitution.

A declaration that under the Constitution of the Federal Republic of Nigeria 1999 (as amended), the legal right to the electoral victory won by a political party, in this case, the vested right of the APC in electoral victory in the 2015 General Governorship Election in Benue, Sokoto and Kwara States, cannot be severed or transferred from the political party that won the election, to another political party, without subjecting same to a re-election by the electorates, in accordance with the law.

A declaration that the Defendants cannot, either expressly or impliedly, reconfigure. restructure or extinguish the political platform and framework upon which they canvassed and secured votes and mandate of the electorates, including those represented by the Plaintiff, in the 2015 General Governorship Election, except in accordance with the law.

As well as, “A declaration that the defection and invariable restructuring and reconfiguration of the political platform and framework upon which the Defendants canvassed and secured votes and mandate of the electorates, including those represented by the Plaintiff in the 2015 General Oovernorship Election in Benue, Sokoto and Kwara States, was unlawful, ultra-vires the Constitution and amounts to a violation of the electorates’ right to elect political party of their choice”.

Meantime, Justice Nnamdi Dimgba has ordered service of all the relevant court processes on the Defendants to enable them to appear before the court on October 10. The court equally okayed substituted service of the processes on the Defendants through their various liason offices in Abuja.
