THE NEW 2026 NIGERIAN TAX LAWS - A dominant topic in the Nigerian media space in the past 3 months is the Nigerian Tax Laws that took effect from 1st January 2026. There has been so much misinformation about the laws especially on social media. I blame the government for not giving adequate information to Nigerians regarding this policy that affects a large number of Nigerians and the economy. Firstly let me attempt to correct some of these misinformation: 1. The government will not tax money in bank accounts. 2 The government will not tax transfers from your accounts 3. The government will not tax transfers into your accounts 4. The government will not tax transfers without descriptions. 5. The government will only tax various taxable income received by you 6. Salary earners are taxed before they get their salaries so they will not be taxed again 7. Self employed are expected to register as tax payers and make regular tax payments to the relevant tax agency. The new 2026 Tax Laws are being erroneously tagged as a law made for Nigerians to pay more tax but in the real sense it is a reform that aims to: 1. Bring reliefs to low income earners and small business owners 2. Encourage taxable adults & entities to be more compliant by simplifying the compliance process. 3. Most importantly to widen the tax base. As it is often said that it is only salary earners such as civil servants & those in the organised private sectors that pay tax. Self employed individuals are largely outside the tax base. This brief shall be limited to taxation of individuals and small businesses(sole proprietorship, partnerships & other businesses with less than N100 million yearly turnover.) Taxes are being paid on income alone and income are: 1. Salaries, allowance & wages 2. Profits from sale of assets(capital gains) 3. Fees received from services rendered 4. Prizes, honoraria, grants etc 5. Dividends, interests, royalties, rents etc(investment income) Tax paid by individuals is known as Personal Income Tax(PIT) which is from 0% to 25% of taxable income. In computing the PIT, there are reliefs avaliable which means that not 100% of your income is taxable . Such reliefs are 1. Tax exempt for those earning less than N800,000 & for the 1st N800,000 of income 2. Rent relief of 20% of income or N500,000 whichever is less 3. Pension contributions to PFAs 4. NHF contributions 5. Interest on loans for owner occupied residence 6. Premium paid for life insurance 7. Exemptions from certain capital gain income Businesses that deal in the following items are VAT exempt. 1. Basic food items 2. Education services & materials 3. Health & medical services 4. Pharmaceutical services The most advantageous relief is that small businesses with less than N100 million turnover are exempted from paying VAT. All the above mentioned reliefs are not automatic in the sense that when tax officials visit, you cannot just say that you are a small business owner so you are tax exempt. You need to have proper & up to date documentation which shows evidence of 1. Registration of your business as a sole proprietorship, partnership or LLC 2. Registration of your business with the relevant regulatory bodies if any 3. Tax Identification Number(TIN) 4. Required documents(valid identification, proof of address & other relevant documents 5. Registration with State & Federal Tax Offices as tax & VAT payer Once registered as a tax payer and obtained your TIN, the next step is to make tax payments based on assessment using the following methods: 1. Online payments through FIRS websites 2. Physical visit or online payments to designated banks 3. Remita or other authorised payment platforms. At the end of the year or not later than 31st of March of the following year a tax payer is expected to file annual returns with the FIRS that contain all necessary and truthful information concerning tax payments made in the preceeding year. The following are tax offences that carry stiff penalties: 1. Failure to register as a tax payer by a taxable adult or business entity 2. Failure to file tax returns 3. Late payment of tax Your business and bank details will be scrutinised and investigated to determine how much tax to be paid based on best judgement basis. At the end of the year and on full compliance with tax payments every tax payer is entitled to TCC that verifies tax compliance. TCCs are required for various private and official purposes. This TCC have a validity of one year(The TCC of 2024 expires at the end of 2025) TCC can be obtained through application to the relevant tax agency --------- ©Amitage Partners. I use a blackberry Q5 with airtel monthly subscription of N1,500 for 2G. But my subscription hardly last 2weeks, I'm mostly on Facebook(I'm admin in two groups), I dont download music or movies, I dont sype or make calls on my internet connection. Yet i consume up to 300mb per day. Please what can wrong? |
