The Buhari administration is out to weed, sweep, blow and stamp corruption and financial crimes out of the country (though we now see that it is only Buhari that feels so). However, an idea was once muted that they ('convicted' looters) should "vomit" the loot (or a huge chunk of it) & like Jesus would say, 'go and sin no more'. This plan was implemented for one of Buhari's friends...anyway, the idea is called plea bargain. A plea bargain is an agreement between the prosecutor and the accused person in a criminal trial. The prosecutor will give the accused person the opportunity to plead guilty to a lesser charge or to the original charge with lighter sentence. Although plea bargain has become a global means of achieving results in prosecuting criminal offences, most countries including Nigeria have refused to codify it or create a legal frame work for its use and thus has led to various abuses. A plea bargain can also ocur when prosecutions and defense lawyers come to an agreement on a certain case and defendant. The defendant agrees to plea guilty to a charge in order to avoid a court trial. The case of Lucky Igbinedion has opened the eyes of Nigerians to many puzzles on plea bargain as practiced by the EFCC. Among the puzzles are (i) was it a good bargain for the commission to compress and reduce 191 - count charge to one - count charge? (ii) was it a good bargain for the commission to accept N500m and 3 houses and allow Lucky Igbinedion to keep N2.4b and other properties? (iii) was the option of fine a part of the plea bargain or it was imported into the judgment by the presiding judge? (iv) was it a good bargain for the commission to charge Lucky Igbinedion on a mere non-disclosure of an account with GTB when among the 191- count charges there were weightier and more serious count charges on corruption and embezzlement? (v) was it a good bargain to enter into an oral agreement with Lucky Igbinedion in the circumstances of the case? (vi) was it a good bargain to let Lucky Igbinedion off the hook on a N2.9b fraud with an understanding not to prosecute him again when there was a N25b fraud pending against him? Plea Bargain however have some merits, thus:- 1. Plea bargains take away the stress and questions that surround a trial by jury. The anxiety that is involved with not knowing if you will be found guilty or not is completely removed. 2. Cases are closed much quicker when pleas are involved. This is great for society because it de-clogs the court systems for more serious cases. 3. The person who has taken the plea, often pleads guilty to a lesser charge than what they would have normally been tried for. This ultimately translates into a lesser sentence or punishment. 4. From a prosecutor’s point of view, plea bargains are a God send. They allow them to have an open and shut case, that still always results in a prosecution. 5. When a person takes a plea bargain, they no longer have to go through trial. This means that other crimes that may have been committed and any damning evidence will not be discovered. 6. The biggest reason that many people take a plea bargain is the fact that you cannot receive the maximum sentencing for you crime. 7. Prosecutors will often roll other conditions into their plea agreement. Often it is that the defendant will testify against a co defendant, which may aid larger cases in a prosecution. 8. If all criminal cases actually made it to a trial by jury, then the justice system would not be able to sustain itself. Courts would be backed up by months, if not years. Plea Bargain is loathed for the following reasons:- 1. Innocent people will often take a guilty plea bargain. This is done out of fear of being found guilty by a jury in a trial. 2. The victims, people affected by the crime, or the general public may be very angered by a plea bargain. Especially if they fee the crime deserves to be punished with the full extent of the law. 3. Defendants are often pressured into taking a plea bargain because it is simply easier for everyone involved. Even if they do not really want to admit guilt. 4. Plea bargains have caused quite a large amount of “shotty” investigations to occur. Investigators and prosecutions begin to slack, thinking a plea will be reached anyway. 5. The biggest disadvantage of a plea bargain is that you have to admit that you are guilty, even if you are not. This can cause turmoil for a very long time in someones life. 6. If you are a victim, or a victim’s family member then a lean punishment may be very painful to take. Plea bargain can never be sustainable. It encourages more corruption, as it sets the stage for an uneven operating ground for us. People can go ahead, embezzle money and then invest it well. The profit can then be submitted back to the government when "needed". What then happens to the fame, positions, fanfare, cronies, investmemts, etc that were gained by the looter/theif before the prosecution? Plea bargain is subtle, and doesnt really portray the heinious nature of stealing public money. #JailAllYamEaters #RemoveEveryBudgetGatePublicOfficialNow |

I always wish that leaders will find time to ask their pple wat dia problems are, & not just believing that they are on the right track all by themselves...basking on the fleeting euphoria of acolades by their aids!!! Fine, it's a good move...good rapport with our trading partners! But the youths r yearning, they r watching & will keep waiting for those moves that directly assist them to get help & grow |
