NAIJAHITPLAY: Human rights lawyer, Chief Mike Ozekhome (SAN), said efforts had begun to secure release of former Governor of Ekiti State, Mr Ayodele Fayose, from Economic and Financial Crimes Commission (EFCC) custody.
Ozekhome said this in an interview with the Newsmen in Abuja on Thursday.
Fayose, whose tenure as governor ended on Monday, had on Tuesday reported at EFCC office in Abuja to answer to some allegations levelled against while in office as governor.
Ozekhome said “Fayose’s lawyers are already taking steps to enforce his fundamental human rights by getting him released.
“Yes, his lawyers will go to court to enforce his fundamental human rights.
“The EFCC has no right to keep him for over 24 hours.
“If they have done that by obtaining a Magistrate Court’s Order that will be in the form of “holding charge” which has been declared unconstitutional and illegal by the Supreme Court.
“Holding charge is illegal. It is unconstitutional.’’
Ozekhome said that the section of the Administration of Criminal Justice Act (ACJA) permitting a magistrate to detain a suspect for 14 days was illegal.
According to him, any action outside the provisions of Section 35 of the Constitution which specifically provides for 24 hours, is illegal and unconstitutional.
He explained that the ACJA allowed for detention of a suspect for 14 days, but that Section 35 of the Constitution made it clear that a person could only be detained for 24 hours.
“So, when there is a clash between the statute, like the ACJA, and the Constitution, the Constitution prevails by virtue of Section 1(3).
“If they have gotten an order for two weeks from the magistrate court, it is unconstitutional,” Ozekhome stressed.
Recalls that Ozekhome was among Fayose’s supporters who accompanied him to the EFCC on Tuesday.
He had said that the present administration was governed by constitutionalism, and that it was a constitutional democracy.
When contacted for update of Fayose, especially on the detention, Head, Media and Publicity of EFCC, Mr Wilson Uwujaren, he simply said, “there is no update at the moment.”

A PDP Gubernatorial Aspirant in Benue state, Paul Orhii is battling for his life in an undisclosed hospital after being poisoned a day to the party's primaries.
Orhii has also been facing criticisms for selling all his billboards to an APC leader in the state, Barnabas Germade. Defending the action, Orhii said he had no intentions of spiting or attacking the party or anyone but had to make the move in order to raise money to pay his hospital bills.

Since the issue of the sale of my billboards to Chief Senator Gemade has generated so much unnecessary political heat, especially for those who might have paid for the billboards and for those who are so concerned about my political future, I feel that I should state my own side just for the records.
I met His Excellency Dr Gabriel Suswam for the first time in 2006 when he visited me in Houston to consult on his Governorship project. I was then working with Professor Hagher and I frankly told him so. But then I so much liked him as a person and because we enjoyed each other's company, and still do, we became very close friends and that friendship extended to our families. Therefore when he won the Gubernatorial Primaries in 2006 it was easy for me to agree to work for his election. I mobilized myself from Houston, arrived Benue, borrowed a very old car from a family friend and started following him around for the campaigns. Sometimes the car would stop on the way and I would fix it and meet them later. Luckily he won that election in 2007 and became the Governor. I went back to Houston. However luckily for me some circumstances played out and a friend from Houston, Dr Kase Lukman Lawal, an oil magnet introduced me to President Yar-Adua. With the help of this my very good friend, my Late Uncle His Lordship Justice Katsina-Alu, my Brother Chief Kaase Aondoakaa, SAN, who was then the Attorney General of the Federation and Minister of Justice, and of course with the full approval of my friend, H.E. Dr Gabriel Suswam President Yar Adua later appointed me the DG NAFDAC. Naturally when I moved back to Nigeria my friendship with Gov. Suswam became even stronger and the two of us became more inseparable. When the time for his re-election came in 2011 I massively contributed, financially, morally, etc to enable him win that very tight race. I again massively supported him in 2015 for his Senate bid. Unfortunately we could not win. But we have remained the best of friends. It goes without saying that if I supported my friend Suswam in 2007 to win governorship, then supported him again in 2011 to win re-election and again supported his Senatorial bid in 2015, it was not totally unreasonable for me to expect him to support me in the only election that I had decided to run. Unfortunately due to circumstances that I came to understand were clearly beyond his control he could not support me in my gubernatorial bid, which I fully understand.
Therefore I did not sell my billboards to Chief Senator Gemade as my show of support against Suswam as is being speculated. Or to spite H.E. Suswam. The truth of the matter is that I arrived Makurdi two days before the Gubernatorial Primaries. The very next day, which was the eve of the primaries I was poisoned. That is why I was not even able to go out and greet the delegates when they arrived Makurdi, even though I had paid money for their transportation, booked and paid their accommodation for many of the delegations in Makurdi. I was actually on drips fighting for my life while my co-aspirants were going out there to meet and greet the delegates. I managed to go to the field the next morning but had to rush back to bed after the event. Everybody moved on as there were other primaries scheduled in other towns across the state and I was left there with no money and just a few friends and family members to fend for myself.
It was at this point that Mr Tyover Atetan, an aide to Chief Gemade reached me that Chief Gemade was offering to buy my billboards. At this point it was a matter of life and death as I badly needed money for my treatment and survival and was so glad to take the offer because I could never even have imagined that someone would offer me money for the billboards. So we made a deal and Chief Gemade promptly transferred the money to my account which enabled me to go to Lagos for treatment. It is quite unfortunate that people who would have loved to see me die from the poison are so peeved that I managed to sell my billboards to enable me afford treatment when they thought I had been abandoned to die from poisoning. But thank God I survived. I will be leaving for the USA next week for more detailed medical checks to make sure that no residue of the poison is still in my system. I still need more money and would appreciate any assistance.
Unknown to these people I am still very good friends with Suswam. He explained to me and I fully understand why he could not be there for me when I needed his political backing. Despite our tight schedules we still communicate almost on a daily basis. He knows that I still support his Senatorial ambition 100%.
In any case most of these people criticizing my decision should understand that as a full grown adult I have the right to chose friends, chose which politicians to support and even to chose political parties, and we have 91 of them. It is out of my personal choice that I have chosen to support Suswam or even to continue to stay in the PDP despite all the injustice that was done to me. I contributed massively to building the PDP and have financially supported many of its candidates since 2007, only to almost get killed just for coming out to offer myself for service to the state.
I hope this my side of the story should put all these stories to rest, at least in the minds of reasonable fair-minded persons. Those who know me know that I do not go two ways. My yes is yes. My no is no. If I am with you I am with you. I don't know how to support one person or one party in the day time and another person and another party at night.

“1) The anti-corruption drive of Mr. President put to a halt the exogenous leakages in the Agricultural sector to encourage, empower, and enhance the locally made farm produce thereby increasing our internally generated revenue (IGR) index and foreign exchange capacity and reserve to over $45 Billion in cash and bonds.
2) President Buhari initiated the Home Grown Feeding Programme which is designed to put an end to importation and market monopoly of farm produce that can be grown here in our country which is a pilot vehicle to sustainable economic, agricultural, academic and job creation across the length and breadth of our nation.
3) Under President Buhari, the Standing Inter-Ministerial Technical Committee on Zero-Reject of Agricultural Commodities and Produce / Non-oil Exports in Nigeria was inaugurated.
4) Under the Buhari-led administration, Nigeria has benefitted from 13.1billion Euros honeybee project.
5) The Buhari administration has commenced steps improving the standards of Nigeria’s agricultural exports to align with global standards due to the rejection of our produce at the EU Border Controls.
6) Under President Buhari, Standards and Quality Control measures have been developed in.
7) Under President Buhari administration at the end of 2016, agricultural goods as a share of total trade got N212.73bn and 4.02 percent and Agricultural goods exports were 2.7 percent higher in Q4 2016 than Q3 2016.

14) The Livelihood Improvement Family Enterprises (LIFE) programme was initiated by the Buhari Administration and it is aimed at bringing life back to rural communities through the empowerment of youth, women and other vulnerable groups across the country.
15) Livelihood Improvement Family Enterprises (LIFE) Programme initiated by the President Buhari administration is geared towards promoting community-based on-farm and off-farm business activities as a model for job and wealth creation amongst unemployed youth and women in rural and suburban households.
16) Livelihood Improvement Family Enterprises (LIFE) Programmes under President Buhari are expected to establish 150,000 cooperatives nationwide under commodity value chain groups.
17) Livelihood Improvement Family Enterprises (LIFE) programme under President Buhari will establish and operate up to 1,000 cottage industries in the country, and ultimately engage about 1,995,500 youth and 997,500 women for enhanced productivity.
18) Livelihood Improvement Family Enterprises (LIFE) programme under President Buhari would add about 5,965,000 metric tons of foods to the national food store.
19) Anchor Borrowers’ Programme is an intervention of the Buhari administration aimed at fast-tracking access of rural farmers to finance productivity.
20) The Anchor Borrowers Programme (ABP) of the Central Bank of Nigeria under the Buhari-led administration has made available N82billion in funding to 350,000 farmers of rice, wheat, maize, cotton, cassava, poultry, soybeans and groundnut; who have cultivated about 400,000 hectares of land.
21) The Buhari-led administration has made provision of agricultural credit for financing the production of rice, wheat, ginger, maize and soybeans in Kebbi, Niger, Kaduna, Kano, Enugu, Benue, Zamfara, Anambra and Kwara States.
22) The Anchor Borrower’s Programme (ABP) under Buhari’s administration has provided a quantum of money for dry season farming in 2015, wet season rice and wheat farming in 2016 and is currently supporting the 2016 dry season farming in many states.
23) The President Buhari administration has commenced the use of National Soil Map Data, with the promotion of the use of soil-specific fertilizer formulations and application in prescribed dosages based on soil types following the conduct of soil mapping/test to enhance agricultural production and productivity.
24) Under President Buhari administration a resurrected interest in agriculture has awakened among smallholder farmers.
25) Under the Buhari-led administration, Nigeria’s fertilizer market is growing.
26) The President Buhari administration has signed an agreement with the Government of Morocco for the supply of fertilizer raw materials on concessionary terms to boost local blending to facilitate making soil and crop-specific fertilizer blends available and accessible to smallholder Nigeria farmers.
27) The Ministry of Agriculture under President Buhari is facilitating the timely access of farmers to appropriate quality seeds.
28) The President Buhari administration has facilitated seed trading locally and internationally through the application of regionally agreed principles and rules.
29) The enabling environment for private investment in the seed industry has been created by the Buhari-led administration.
30) Under President Buhari, the National Irrigation Policy and Strategy has been developed and focuses on the need to overcome the irrigation challenges and put available irrigation facilities in the country into effective use.
31) The PMB Administration has assessed the status of infrastructure in all the 12 River Basin Development Authorities (RBDAs) hence, commenced immediate and effective use of the facilities for commercial farming.
32) Under President Buhari, the Bank of Agriculture (BOA) has been strengthened for improved delivery of services through consolidation and recapitalization in collaboration with the Bureau of Public Enterprises (BPE) to ensure loan disbursement at a single digit interest regime in the agricultural sector as obtainable in developed and emerging economies.
33) The President Buhari administration has approved the restructuring, re-capitalizing, and repositioning of the Bank of Agriculture (BOA).
34) The Buhari administration has secured the approval of a grant of $1.1 million from the African Development Bank (AfDB) for the restructuring of the Bank of Agriculture, aimed at staff training to strengthen service delivery.
35) The President Buhari administration has embarked on the re-validation of the claims of agro-dealers and input suppliers under 2014 wet and 2014/2015 dry seasons to ensure that genuine claims are paid by the government.
36) The President Buhari administration has facilitated the payment of the sum of N20 billion, as part of the debts owed agro-dealers while efforts are on to fully settle the outstanding liabilities.
37) The President Buhari administration has established a N50 billion mechanization fund to facilitate the second phase of Agricultural Equipment Hiring Enterprise (AEHE) to roll-out 6,000 tractors and 13,000 harvest and post-harvest equipment units across the country.
38) With the Buhari-led administration, Tractors and Implements were rolled out in Ilorin and Abuja on January 12, 2016, to support targeted commodity value chains.
39) The rising spate of hostilities and attendant insecurity arising from clashes between crop farmers and nomadic herdsmen has raised serious concern within the government. Accordingly, the PMB administration has commenced efforts towards the resolution of pastoralists-farmers conflicts through the provision of 55,000 hectares of land by 11 states as part of the 5,000 hectares each expected from the 19 northern states for the development of pasture/paddocks grazing reserves.
40) The Buhari administration has established 40 large-scale rice processing plants and 18 High-Quality Cassava Flour (HQCGF) plants with a stake commitment of China EXIM (85 percent) and Nigeria Bank of Industry (BoI) (15 percent) through concessional credit facilities of US$383,140,375.60 for the rice mills and US$143,722,202.40 for the HQCF Plants.
41) The President Buhari administration through the Ministry of Agriculture is embarking on a programme of distribution of rice mills, of ten tons per day capacity, 20 tons a day, 40 tons a day, 50 tons and a few 100 tons. Collectively between them, the capacity for rice milling will be close to 3,000 tons a day nationwide. That is expected to close the gap between paddy availability and mills to process it.
42) The President Buhari administration has established 10 large-scale rice processing plants and 6 High-Quality Cassava Flour plants to be owned and operated by the private sector and would be funded by the Special Rice Processing Intervention Fund and the WB Assisted Agricultural Development Policy Operation [AgDPO] Funds.
43) Through President Buhari administration, Real GDP in agriculture grew by 4.11 percent in the year 2016, and this growth rate was higher than that recorded in 2015 of 3.72 percent.
44) Under Buhari’s administration as captured by the National Bureau of Statistics (NBS), there was a continuing strong growth in Agriculture (especially Crop Production) in the Q4 of 2016.
45) Agriculture contributed 21.26 percent to nominal GDP in the Q4 of 2016 and the sector grew by 6.45 percent year-on-year under President Buhari administration.
46) In the Buhari-led administration, the contribution of Agriculture to overall GDP in real terms was 25.49 percent in the quarter under review, higher than its share of 24.18 percent in the corresponding quarter of 2015.
47) The Ministry of Agriculture under President Buhari administration also provided 2283 bags of industrial salt to hides and skin dealers in 12 targeted states.
48) The President Buhari administration placed a ban on rice importation and that has saved Nigeria an average of $5 Million daily.

52) The Buhari-led administration set up the Presidential Fertilizer Initiative (PFI) to deliver commercially significant quantities of affordable and high-quality fertilizer to the Nigerian farmer at the right time
53) The Presidential Fertilizer Initiative (PFI) under the President Buhari administration has resulted in the revitalization of 14 blending plants across the country, with a total installed capacity in excess of 2 million MT.

mrakeli62: A former Governor of Kaduna State and one of the 12 presidential aspirants on the Peoples Democratic Party, PDP, platform, Senator Ahmed Mohammed Makarfi has said that the party’s presidential candidate, former Vice President, Atiku Abubakar, will be the best for Nigeria.
According to Markafi, who got 75 votes during the primary election, Atiku will return Nigeria to the right track if elected in 2019.
Makarfi, a former Chairman of the National Working Committee, NWC of the PDP, noted that the emergence of Atiku as the PDP flag bearer was an indication that the party has, “turned a new leaf in broadening the democratic process and space.”
This was contained in a congratulatory message dated October 8 which Makarfi personally signed, and addressed to Atiku, copies of which were made available to journalists in Kaduna on Wednesday. The message reads, “Your emergence as the candidate of the party has gone further to reinforce the new philosophy and the promise that the PDP holds for both the present and the future of this country. “Having known your strength of character, never-say-die spirit as well as total commitment to, and the dogged pursuit of any cause that you believe in, I have no doubt in my mind that you will successfully lead us in this very crucial battle to rescue our country and return it to the path of sanity.

The presidential candidate of the Peoples Democratic Party (PDP), Alhaji Atiku Abubakar, has challenged President Muhammadu Buhari of the All Progressives Congress (APC) to tell Nigerians what he used the N13 trillion his government borrowed within three years of his administration for.
Atiku, in a statement Tuesday by his Atiku Presidential Campaign Organisation, said that the Buhari government and the APC have been very idle of late, which explains their abandonment of the vital duties in order to focus on hurling insults and false accusations on the presidential candidate of the PDP. It said: “The Atiku Presidential Campaign Organisation runs an issue-based campaign where refined language and cerebral arguments founded on facts are used to disseminate the vision of our candidate which is why we call on the Buhari Campaign Organisation to waste no time in taking the #BuhariChallenge in clearing the air on these knotty issues bothering the minds of Nigerians.”
While challenging the Buhari Campaign Organisation to take the #BuhariChallenge and answer the following questions among others, it said: “Name one year that Nigeria’s GDP grew faster than her population under Buhari (for 16 years of PDP administrations, Nigeria’s GDP always grew faster than population growth).
“Name the initiatives the Buhari government has put in place to address Nigeria being named the world headquarters for extreme poverty under Buhari.

ishaq05: Kano state chairman of All Progressive Congress, APC, Abdullai Abbas, has resigned
Abdullahi Abbas, wrapped in the feud between Governor Abdullahi Ganduje and deputy Hafizu Abubakar, tendered his resignation letter on Thursday.
He is yet to give reason for the decision.
An aide to the Commissioner of Information, Faizu Alfindiki, confirmed the development to Premium Times.
Deputy governor Abubakar recently indicated that he would not run on the same ticket with the Gov. Ganduje in 2019.
Abubakar, a Professor of Food and Nutritional Biochemistry at the Bayero University, accused the Kano chapter of the APC of sidelining him in scheme of things.
