law is not base on sentiment. The issue of age in the constitution still subject to judicial interpretation. For example at what point a person must be 35years. 1. When buying form 2. As at the day of election 3. When taking oath of office.
He must be 35 when being cleared to contest, and that is one of the duties of Inec. And moreover before any party will present a candidate they must have gone through the rules.

*INEC Does Not Have Power to Disqualify Candidates, Says Court*

Just like Muykem argued..... The question here is who has power to disqualify or pronounce a candidate illegible. INEC or court, this case has been settled even recently in Kogi election. Court is the only one with power to do so even in David Lyon case in the same election.
Go check those cases their offence was not clearly written in the constitution.

ORIENTATION101:
agreed andp didnt meet up with the substitution window according to inec
The bone of contention is who have the power to disqualify a candidate/party in election?

Is it the inec or court?

It was court that disqualfied APC in zamfara, Rivers, bayelsa not inec.
Inec have the power to disqualify a candidate if the offence is clearly drafted in the constitution.

ORIENTATION101:
funnycheesy the ineligibility of the andpcandidate is a pre-election that should have been taken up by inec or another party. Nobody challenge it court until this moment.

So the case before the court now is why inec excluded andp without court order
What you wrote here is just like asking, why will Inec disqualify a candidate without certificate or an affidavit that effect, or disqualify a foreigner from contesting, or disqualify an inmate who has been convicted of murder or other offences, or disqualify a 10 years old boy. And remember Inec is a product of the law and it is an independent body until proven otherwise.

Why INEC didn't not wrote APC and remove their name from ballot since their deputy governor was not qualified to contest in the same election or is INEC saying it has power to disqualify candidate only on age issue?
Is INEC saying it has power to disqualify candidate only on age issue?
Yes, and other things that are clearly written in the constitution, in the case of apc it was forgery which needed evidence and witnesses prove, but Andp case is clearly stipulated in the constitution.

I disagree with this dissenting judgement. The letter written by INEC had no locus standing if the party fulfilled all constitutional requirements so they didn't need to challenge the case at high court. Secondly the question here is who has power to disqualify or pronounce a candidate illegible. INEC or court, this case has been settled even recently in Kogi election. Court is the only one with power to do so even in David Lyon case in the same election.
Inec did their job by removing the party from the ballot as the elections umpire, that is why they first scrutinize candidates before election. It is the party's duty to go to court within 14 days or submit a substitute for the deputy before 9th of September and they did neither.

seunlayi:
underage - the party accepted this already by substituting the candidate but it was LATE. Stop defending what is not
The party knows the deadline to submit a name which is 9 and they submitted 13th that is the substituted name I mean, the constitution is there for them to read or they don't have lawyers who is to advise them on the age limit for governorship or his deputy?.
PoliticsRe: INEC Reacts To Tribunal Ruling On Diri's Sack, says ANDP Candidate Was Ineligible by babajero(m): 1:22pm On Aug 18, 2020
ORIENTATION101:
Inec should stop playing to the Gallery.

The court is clear on the ruling, inec have no constitutional power to remove a candidate or political party whether they re ineligible or not.

The power lies in the hand of competent court of jurisdiction to do so.
Then there shouldn't be an inec then if they don't have such power, what you are implying is that inec should just conduct any election even if the candidate is 10 years old because according to you it is not their duty to disqualify anybody.

Go check again, the man who filed the case at the tribunal was disqualified by inec that was why his name was omitted from the ballot. go and read dissenting verdict of the chairman of the tribunal.

Okay... In 1999, the election of Muazu was set aside by the tribunal and the appeal court because his deputy governor presented forged certs. A new election was conducted and Muazu participated alongside a new deputy governorship candidate and he won. What’s the difference between then and now?
He was disqualified before the election so it has nothing to do with the election. and in the case of the apc governor he was disqualified by the Supreme Court and that is the highest court in the land.

Can you explain the basis upon which the chairman of the tribunal based his minority judgement on?
How can someone who was disqualified by inec, who was not even eligible to context, go to tribunal and they still went ahead and entertained his case, it was the court that was supposed to entertain such case and not tribunal because it has nothing to do with the election, his disqualified was based on the age of his deputy and it has to do with the constitution.

Facts;

1., Mr. Governor, You Are Not Party To The Case Decided At Tribunal, So Your Appeal Holds No Water.

2. INEC Did Not Call A Single Witness At The Tribunal Trial, Thereby Messing Up Their Case.

3. INEC May Not Even Appeal The Case.

Don't deceive yourself, it is not about 200 million people, it is how productive the 200 million people are. though Lagos have big economy but it's a cesspit run by corruption.

Bros, if they had proof of their claim, they will not take it down, wake up abeg!
My question to you is, have corruption been happening in Nigeria for ages? if yes where are the proof? most of this reportage are public opinion, that should lead to intense investigation, but instead it lead to stifling of opinions of the public. now politicians are licensed to steal, as far as there are no proof you are good to go. for instance the man that came to talk of the killings in kaduna, he said what everyone already knows but instead of investigating and sanctioning the man if necessary, they went after the media house in order to stifle the media and send message to other media houses. I am still saying it many media houses will recant their earlier postage and stop posting anything meaningful against the government not because of the lack of proof but because of the fear of 5 million naira, moreover ganduje was caught on camera and the federal government still supported him. This one is just small just wait till campaign period and see how they will be slamming people 5 million naira fine. When you say or report what is happening in the military they will slam you 5m, when you say or report what is happening in the economy they will slam you 5m, when you say or report what is happening in aso rock they will slam you 5m, when you say or report how your people are being killed they slam you 5m. NiggarArea (Nigeria) is really now in big problem.

All the stealing and embezzlement going on in Nigeria for years how many do you have proof for, or we should just take it that non of it happened?. Most of this sayings are public opinion, and it should warrant the appropriate authorities to investigate, but instead they stifle the opinion of the public with 5 million naira fine because it is against their interest. For instance what have CNN not said about Trump, even accusing him of alliance with Russia, but still he didn't stifle their reportage, instead it lead to intense investigation.

Nigeria is dying really fast, just imagine people celebrating on nairaland because the government has found a way to stifle public opinion, with the scare of 5 million naira. time will come when those who celebrate today won't have the mouth to speak for themselves, very soon even nairaland will be afraid to post the things we write.
