Chuks9000: Guy, most nairalanders are either kids or adults stock in kids mentality. What they feel about Nigeria is what their parents have passed to them. Their brain isn't well developed to access Nigeria as a 21st century country. No pipe borne water, epileptic power supply, down pressing security outfits, comatose health care, secrecy in government, misfits running the government, education system that is more of creche like all the way, etc. People will leave all these challenges and be worried that the other tribe might be doing better than theirs. I am Igbo. I do not send who sits on the chair. Just do what the dictates of the position demands. Another issue is that the black man is not contended. That's why the just concluded elections had more people with o'level contesting for positions (they will never be able to handle) rather than those with proven experience and education. Lastly, our mumu is in built. What percentage of our population can say they understand what governance (not politics) is all about? That is why we can kill for tribal reasons to keep our parapo in government rather than insist on (good) governance. Very good submission I must say |

Sola Ojo, Kaduna Leadership of Jamaa’tu Nasril Islam (JNI) has advocated death penalty for drug dealers as one of the means through which the menace of drug and substance abuse can be checkmated in Nigeria. Also, the leadership of Christian Association of Nigeria (CAN), in Kaduna State, has suggested full enforcement of existing laws on drugs, which it believes would, in turn, apply strict penalty on offenders. The two religious bodies made the calls, yesterday, in their separate meetings with members of Presidential Advisory Committee on Elimination of Drug Abuse (PACEDA), led by Brigadier-General Buba Marwa (retd), who were in Kaduna as part of their nationwide consultations on elimination of drug abuse. Speaking at the headquarters of JNI in Kaduna, the Secretary-General of JNI, Sheikh (Dr) Abubakar Khalid, said the time has come for Nigerians to address the menace of drug abuse squarely, as done in places like Europe and Middle East. “I think the matter has gone so terrible and dangerous to the extent that all measures taken have failed. Until a very decisive deterrent variable is taken as done elsewhere, we may not be able to tackle it. “In Europe, Asia and the Middle East, when the menace reaches this level, it is death penalty or a very draconian legal action with serious imprisonment, and not the way we are toying with it in this country. vindisick: I am not a lawyer but i research a lot. Do you remember the case of bakassi penissula?. The argument put up by the Government of Nigeria to the effect that Bakassi Peninsula could not be yielded up to Cameroun on the principal ground that section 12 of the Nigerian Constitution would need to be complied with so as to effectively delete Bakassi as a Local Government by way of Constitutional amendment was roundly rejected by the International Court of Justice. In fact, in a later 2012 case of Attorney-General of Cross-Rivers State vs. Attorney-General of the Federation and Anor, the Supreme Court (SC.250/2009) , speaking through Rhodes-Vivour, J.S.C., was more punchy when it eloquently declared with a tone of finality that; “This Court has no jurisdiction to decide ownership of oil wells located on oil-rich Bakasi Peninsula for the simple reason that Bakasi Peninsula is foreign territory. It is Cameroun land. Supreme Court jurisdiction is restricted to Nigeria land.” What i am trying to say is that though the Nigerian state is sovereign over all its affairs, its [Nigerian] accession to the African Charter on Human and Peoples Right by its [Nigerian] domestication of the said Charter has effectively watered down the indivisible and indissoluble portion of our Constitution. If Nigeria had wanted it could have reneged on the agreement to abide by the court ruling on that matter as there would have been no way to enforce it. Under international law, enforcing treaties is based on consent. This means that no sovereign state is compelled to abide by any agreement entered into with another entity. The clause for self determination in the UN charter is not not an absolute one but merely one of principle, in other words the UN in principle acknowledges the right of peoples to self determination but in practice rarely permits the exercising of that right. So no the peoples of the so called Biafra have to legal right under international law to demand their own state. The international community will not even look their way |

vindisick: The truth is that Nigeria Nation out of her own volition whittled down and surrendered part of its soverenty which enables any part or section thereof to secede when they decide.And i will explain. There is no doudt that the president has powers to enter into treaties with foreign nations. Section 12 of the ammended 1999 constitution has laid down the procedure for the domestication of such treaties as a condition precedent to their activation into law in Nigeria. Article 20 of the African Charter on Human and Peoples’ Right most lucidly proclaims in clear language that: “All peoples shall have the right to existence. They shall have the unquestionable and inalienable right to self-determination. They shall freely determine their political status and shall pursue their economic and social development according to the policy they have freely chosen.”
Nigerian parliament has entrenched the said African charter on Human and peoples right as part of the corpus juris of the country by way of domestication in compliance with the dictates of Section 12. Domestic laws cannot be allowed to constitute a drag on the operation of foreign laws under which a state party has undertaken to fulfill its international obligations This argument of yours will be derided with scorn by any constitutional lawyer reading it. No foreign treaty entered into can take precedence over the Nigerian constitution. None |
