1. Position does not qualify for category

This is most common with cases filed in the EB-2 category. As a reminder, a position qualifies for EB-2 if it is one that requires a Master’s degree or a Bachelor’s degree plus five years of progressive experience as a minimum for entry into the profession. A Master’s degree means a U.S. Master’s degree or the foreign equivalent of a U.S. Master’s degree. A Bachelor’s degree means a U.S. Bachelor’s degree or the foreign equivalent of a U.S. Bachelor’s degree. Nothing less will qualify for EB-2.

The adjudicating officer must first determine whether the position as described on the labor certification qualifies for the EB-2 category. This is where the drafting of the labor certification can make or break an EB-2 case. If a labor certification application states that a position requires a Bachelor’s degree and that the employer will accept a three-year bachelor’s degree to meet this requirement, the position described on the labor certification is not an EB-2 position. The employer will accept something less than a U.S. bachelor’s degree, which is a four-year degree. The case would be denied on the grounds that minimum requirements for the position are less than a bachelor’s degree and “do not support 2nd preference classification.” The exact wording of the minimum requirements of the position should be carefully considered prior to beginning the labor certification in order to ensure that the position will qualify for the intended category at the I-140 stage.



2. The Beneficiary does not qualify the position

The adjudicating officer must determine whether the sponsored employee meets the minimum requirements stated on the labor certification. If the position the worker is being sponsored for requires experience, the worker must document that he or she met that experience requirement as of the priority date (i.e. the date the labor certification was filed). This is usually done by submitting experience letters from former employers. Sometimes, USCIS may deny on the grounds that there is not sufficient documentation to establish that the experience requirement has been met, such as where an experience letter could not be provided or is not detailed enough. Or, USCIS may deny on the grounds that the experience was gained with the sponsoring employerin a substantially similar position and therefore cannot be counted to meet the experience requirement.

The adjudicating officer will also look at the education requirement for the position as described on the labor certification to decide whether the sponsored worker qualifies for the position. The sponsored worker must have the right degree and in the right field of study. If the field of study is not exactly matching what was stated on the labor certification (for example the worker has an MBA but the labor certification requires a Masters in Computer Science), the I-140 could be denied unless an argument can be made that the worker’s field of study is closely related to the requirement. Also, the length of the degree programs will be looked at. A Master’s degree usually means that the worker must have six years of study. A Bachelor’s degree usually means that the worker must have four years of study. A three-year bachelor’s degree can often cause a denial if not handled carefully during the planning phase.

3. Ability to Pay

Title 8 of the Code of Federal Regulations, at part 204.5(g)(2) states:

Any petition filed by or for an employment-based immigrant which requires an offer of employment must be accompanied by evidence that the prospective United States employer has the ability to pay the proffered wage. The petitioner must demonstrate this ability at the time the priority date is established and continuing until the beneficiary obtains lawful permanent residence. Evidence of this ability shall be either in the form of copies of annual reports, federal tax returns, or audited financial

The following information and documents are typically reviewed by the adjudicating officer: priority date, proffered wage, company tax return and employee W-2 for each year plus the employee’s most recent pay statement showing the year-to-date pay received. If the salary that has been paid to the sponsored worker is less than the proffered wage stated on the labor certification, a Request for Evidence is usually issued and can lead to a denial if the company’s net income is not sufficient. The best way to avoid a denial on this issue is to ensure that the salary being paid meets or exceeds the proffered wage on the labor certification starting from the day the labor certification is filed.

Hopefully these points will help you be on the lookout for pitfalls in your own process so that you can avoid a denial at this stage.

I'm about to order Evaluation report from CGFNS, but not too sure of the secondary school part were yoi have to submit certificate and transcript, I wrote my NECO exam as an external candidate in a private secondary school and didn't do the normal 1-6 in the school. How do i obtain transcripts in this case since i only took NECO exam alone in the school

Please can someone who has similar experience or someone that has passed this process help out here. I would really appreciate suggest
Send the transcripts from the school you attended and add your NECO result / certificate to it. It may even be a waived requirement for you.

This is to those who would be subsequently heading to Abuja for the Philippines visa in the coming days....kindly heed to these instructions and warnings.....

Get to the embassy as early as 8am, even though the embassy does not open until 9am...get there early enough

Embassy opens between 9am and 11am everyday, if you go at a later hour......O.Y.O....cos u would be asked to return the next day.

Also, get your documents ready....(I MEAN BOTH ORIGINAL AND PHOTOCOPY) cos once you go in...you are not allowed to leave the embassy again, unless you want to leave only to come back the next day to continue the process.

When cgfns recieved my secondary school credentials,it took them just 2 days to inform me they have recieved it,i have Sent my lincensed verification from nursing council for like a week now and up till now no email from them...how longs does it takes to send me an email??
verification from council usually takes 4 to 6 weeks so be patient.

Apart from EB3 visa which other visa can u use to work in the US after getting your RN license.
I guess there are other short term work visas you could apply for but it's only eb3 that issues a green card

Register before traveling so that you can trash out any issue that may arise. It will be more difficult to follow up with your school or nmc if you are abroad. And you need to be outside the USA to apply for your EB3 visa

To all those starting the cgfns application, please be aware that the transcript request form and license validation form has been upgraded to a new format which can only be accessible after registering your cgfns account and filing your details online.

Do not send the old forms to Nursing council or your school to avoid rejection by cgfns and unnecessary delays.

You don't have to pay for cgfns before you can download the new forms, all you need to do is register your account, log in to cgfns connect and fill in your data.

Good work I see here. I salute the creator of this thread. Kudos to all the great contributors and the gurus in the house. I respect you all.

Please, I have few questions that bothers me. For someone who is married to a Registered Nurse in naija. What happens to the husband or wife if either of the partners is successful in any of the traveling applications. Will the partner also be allowed to enjoy the benefits of the EB-3 visa(green card) or only the carrier of the application stands to solely benefit apart from allowing the family to also travel.

Secondly, who has successfully completed the Canada process or in any stage of the application?. I want to know.

Lastly, I have a suggestion for the creator of this thread to consider creating a WhatsApp group for this thread. This will give room for a faster communication and sharing of ideas.

I'd to get responses from the gurus and masters in the house. Thanks.

you can pay for express service at nursing council, tell them to use a courier service to send yours so that it will be faster then get a contact there that can monitor the progress to prevent unnecessary delays

I thought these recruiters takes longer processes in all this, are they really straight forward in helping one? Ogardy Peyton sent me a mail to inform them whenever am ready to take their pre nursing assessment but have not replied since then. it's true that the agencies take a long time but that is because they have a lot of applicants to attend to and they won't let you sit for nckex unless you are 101% sure of acing it plus they are shouldering all the expenses so you need to have a lot of patience when dealing with them. However it's faster if you decide to do it on your own ,you can pay for expedited service and get your report within 10 days after receipt of relevant documents but bear in mind that this route is expensive and you have the responsibility of preparing for nclex and passing it on your own which is entirely possible @iyiman is a testimony to that.
You can try out OGP if you are comfortable with waiting a bit longer if not, then do it yourself.

2. *Why is Council doing PUF?*
This is to establish an electronic database of all records of Nurses and Midwives registered in Nigeria and to facilitate the commencement of online renewal of license
3. *Who are the people to complete the form?*
All categories of Nurses/Midwives are to complete and submit their online Professional Update Form(PUF)
4. *How many form am I expected to complete?*

Instructions:

All categories of Nurses/Midwives are to complete and submit their online Professional Update Form(PUF)

Only one form should be completed by an individual Nurse/Midwife. Multiple forms are not allowed.

Names must be in FULL.

All Information Provided MUST be accurate.

All registered Nurses/Midwives must provide registration number(s) for all professional qualification(s) registered with Nursing and Midwifery Council of Nigeria.

Registration number(s) MUST be alphanumeric while entering the data e.g. RN1234 or RM1234 (no dot, no space).

All registered Nurses/Midwives must provide their PIN as it appears on their licence except for Basic Midwives and Psychiatric Nurses with single professional qualification only.

Employment record must be current and accurate.

It would be assumed that Nurses/Midwives who do not complete this form are not registered with Nursing and Midwifery Council of Nigeria.

your speaking has to be at least 7.0 to qualify for the visascreen certificate

yes, you can start the evaluation process with cgfns without work experience, you can also write Nclex without it.
