Politics › Photo: Alledged Forgery Of Senate Rule: No Case Submission- By Sen. David Umaru by BeeBeeOoh(op): 3:20pm On Jul 30, 2015
By Senator David Umaru

Under the Penal Code Act, forgery is defined in section 362 thus:

a person is said to make a false document if:

a. who dishonestly or fraudulently makes signs, seals or executes a document or part of a document with the intention of causing it to be believed that the document or part of a document was made, signed, sealed or executed by or by the authority of a person by whom or by whose authority he knows that it was not made, signed, sealed or executed or:

b. who without lawful authority dishonestly or fraudulently by cancellation or otherwise alters a document in a material part thereof after it has been made or executed either by himself or by any other person whether such person be living or dead at the time of the alteration or,

It further went on to state in Section 366 that fraudulently or dishonestly uses as genuine any document which he knows or has reason to believe to be a forged document, shall be punished in the same manner as if he had forged such document

The business of the senate is guided by the Senate standing order. However, under the 2011 standing rules, order 110 provides for the amendment of the Senate standing order. It provides thus;

1. Any Senator desiring to amend any part of the Rules or adding any new clauses shall give notice of such amendments in writing to the president of the Senate giving details of the proposed amendments.

2. The President of the Senate shall within seven working days of the receipt of the notice, cause the amendments to be printed and circulated to members. Thereafter, it shall be printed in the Order Paper of the Senate.

3. The Move or Movers of the amendment shall be allowed to explain in details the proposed amendments; thereafter the Senate shall decide by simple majority votes whether the amendments should be considered or rejected.

4. If the decision is to consider the amendments, then another date shall be set aside by the Rules and Business Committee whereby opportunity would be given to Senators to further propose amendments but must strictly be confined to the original amendments.

5. Two-thirds majority shall decide the amendments and such amendments shall form part of the Rule of the Senate.

Order 111 provides that business must continue from session to session. It states that the legislative business of the Senate which remains undetermined at the close of a session of the Senate shall be resumed and proceeded with in same manner as if no adjournment of the Senate had taken place; and all papers referred to committees and not reported upon at the close of a session of the Senate shall be returned to the office of the Clerk of the Senate when they shall be returned to several Committees to which they had previously been referred.

In the instant case with respect to the present 2015 Standing Order, it had always been the practice (convention) of the Senate that upon the completion of the four years life span of the Senate, the rules elapses and new rules are used to govern the activities of the incoming Legislature. However, while the 2011 standing rules provides for the procedure for amendment of the 2011 Standing Order, it is silent on the revision of the new standing order for the incoming legislature. That is to say that any procedure of amendment stated in the 2011 standing order is limited to the life span of that Legislature and does not in anyway affect the regulation of activities for the incoming Legislature.

in addition, Senators where giving the 2015 Standing Order prior to the election of the Senate President and nobody raised any issue in this regard. The Fraud allegation is frivolous and an attempt to embarrass and bring the Senate to disrepute. Therefore, assuming without conceding that the 2015Senate standing order was forged, it goes to reason that Senators who have been using using these rules to regulate their activities and still went ahead to lay a report of forgery are also culpable by virtue of section 366.

WHO THEN REVISES THE STANDING ORDER?

The Constitution of the Federal Republic of Nigeria is silent on such matters, in fact the 2011 Standing Order is also silent on this issue. It goes to reason that where there is a lacuna, the Management of the National Assembly is saddled with this responsibility since the Clerk of the National Assembly is the Chairman of the National Assembly in the absence of a Senate president (there shouldn’t be any vacuum). Therefore he should be saddled with the responsibility of providing the rules and regulations that would govern the incoming Legislature which maybe subject to ratification.

CONCLUSION

From the foregoing, it can be validly concluded that a case of forgery cannot stand. This is because from the definition of forgery above, the following are the elements of the offence;

1. Making of a false document or writing knowing same to be false
2. With intention that such document maybe acted upon as genuine
3. Causing another to act or refrain from acting upon the alleged false document believing that such document is genuine.

It goes to reason that for there to be a forged document, there must be a genuine document. How then do we determine that the 2015 Senate Rules is forged or fake when the Senate 2011 standing Rules has become spent with effluxion of time and no longer exists? The 2015 Rules remains unimpeachable and the allegation of forgery in respect thereof is “much ado about nothing!

Crime › CULT WAR: Death Toll Rises To 16, Soldiers Take Over Deserted Aggah Community.. by BeeBeeOoh(op): 1:17pm On Jul 30, 2015
.....Residents sleeps in farms & neighbouring community..

From Chris Anucha, Port Harcourt

Soldiers have taken over Aggah  community in Ogba/Egbema/Ndoni Local Government Area of Rivers State, where there was a bloody clash  between two  cult groups, De-gbam and De-well.

It was gathered yesterday that  three  more  bodies   had  been  retrieved from the bush, bringing the total number of murdered persons to 19.

There was  heavy  presence of  security men, especially stern-looking soldiers when Daily Sun visited yesterday. The soldiers were seen ordering  people  entering into  Egbema  to raise their hands,  frisking  them thoroughly,  before allowing them to continue their journey.
Investigation also confirmed that  residents of Mgbede and Aggah communities, who fled their homes  as a result of the cult war, were still taking refuge in their farm settlements  close to Okansu  community in Ogba.

A community leader in Aggah, who spoke with Daily Sun on the condition  anonymity, said   the sporadic   gunshots  witnessed in  the past two weeks  had ceased since three days the community  was  ‘militarised’.

Efforts  to speak with the traditional ruler of Aggah, His Royal Highness, Eze Ignatius Ekezie, the Ezeali II of Aggah, were futile. One of his aides said: “He  is not in the mood to speak to press for now.”

There  has been  a  raging   cult  war  in Aggah community  for more than two weeks now. It was  allegedly  triggered by job opportunities   offered by one of  the  multi-national oil companies in the area. Those involved in distributing  the job opportunities allegedly decided to give them to members of their families. The allegation resulted  in a clash between De-gbam and De-Well cult groups  used sophisticated weapons to unleash mayhem in the community. In the process, 19 persons were killed, while not less than 50 buildings were burnt by the cultists.
The clash also turned the community to  a ghost town,  as the residents, including prominent   sons and daughters,   fled their homes.

An indigene  of Ogba/Egbema/Ndoni LGA, who  pleaded that his identity be concealed  told Daily Sun:  “The  Aggah crisis  erupted  a week after the flow station of  Italian oil giant, Nigeria Agip Oil company, located at Ebocha Egbema went up in flames, following multiple explosions, caused by  failing, aged equipment of the company.

“This  incident threw the Egbama communities into severe environmental hazards and economic hardships. As they were trying to absorb the shock, the deadly cult war started. As I am talking to you  now, no relief materials, no medicare or rehabilitation efforts by  the  Rivers State."

Politics › Cost Cutting: Shell To Cut 6,500 Jobs.. by BeeBeeOoh(op): 1:04pm On Jul 30, 2015
Royal Dutch Shell says it will axe 6,500 jobs this year and step up spending cuts, to deal with an extended period of lower oil prices.

Besides, the company announced on Thursday in London the sale of a 33 per cent stake in the Showa Shell refinery in Japan to Idemitsu, for about $1.4 billion.

The Anglo-Dutch company also said it was planning more asset disposals, bringing total asset sales between 2014 and 2018 to $50 billion.

“We have to be resilient in a world where oil prices remain low for some time, whilst keeping an eye on recovery,” Chief Executive Officer Ben van Beurden said.

Shell said it anticipated 6,500 staff and direct contractor reductions in 2015 from a total of nearly 100,000 employees.

Lower oil prices have contributed to a 37 per cent drop in the oil and gas group’s second-quarter profits.

And the group said it would reduce 2015 capital investment for the second time this year to $30 billion by 20 per cent from a year ago.

Big oil companies have cut 2015 spending by 10 to 15 per cent from 2014, to cope with a halving of oil prices over the past year to below $55 a barrel LCOc1.

Rivals BP (BP.L) and Total (TOTF.PA) announced further cuts this week.

Shell said its operating costs were expected to fall by $4 billion, or around 10 per cent, in 2015 as part of a broad efficiency drive to boost its balance sheet.

It also expects $30 billion of asset sales between 2016 and 2018, on top of a total of $20 billion in disposals for 2014 and 2015 combined.

Shell, however, have planned to return to the line of profit by pushing ahead with its proposed $70 billion acquisition of BG Group (BG.L).

Shell hopes to complete its BG deal by early 2016 and is still awaiting key regulatory approvals from the European Union, China and Australia.

But Brazil, the United States and South Korea have formally cleared it.

The deal is expected to generate pre-tax benefits of around $2.5 billion per year, starting 2018.

The tie-up will turn Shell into the world’s leading liquefied natural gas company and one of the largest deep-water oil producers, with a focus on Brazil.

Shell maintained its quarterly dividend at 47 cents per share and is committed to rewarding shareholders with at least the same pay-out in 2016.

Travel › Nigerian Passport Ranked 57th In The World by BeeBeeOoh(op): 12:52pm On Jul 30, 2015
The Nigerian passport is ranked 57th in the world out of 199 indexed passports. This is according to Passport Index – the interactive tool recently unveiled by Arton Capital, a financial advisory firm which specialises in procuring multiple citizenships for its clients.

Commenting on the Index, Oluwakemi Ojo – Head of Communications for Travelstart Nigeria – said, “Arton Capital’s assessment bodes well for Nigerians who love to travel. Currently, Nigerian passport holders enjoy visa-free access to 61 countries in the world including Fiji, Dominican Republic, Madagascar, Mauritius, and Kenya. Visa-free travel is extremely important because it facilitates doing business in foreign territories, and for leisure travellers it reduces the costs and administrative hassles of international travel.”

In West Africa, Guinea has a leg up on the rest of the sub-region. The second most useful passport in the region belongs to Togo whose bearers can travel to a total of 67 countries without having to apply for a visa. Citizens of Sao Tome & Principles are less fortunate with visa-free access to just 28 countries.

The Passport Index filters passports by country, by region, by colour (of the passport cover), and by passport power rank – the ranking system allocates 1 point for each country the passport holder can enter without applying for a visa before departure.

The United Kingdom and United States share the highest passport power rank in the index with access to 147 countries, while Palestinian Territories, Myanmar among others have the lowest with visa free access to just 28 countries. Nigeria holds the same rank on the passport ranking as with Tunisia, Zambia, Mali, Namibia, Philippines, Saudi Arabia, Azerbaijan, Tanzania and Bahrain.

The Index’s visa-free count is based on data and consultations from IATA’s Timaticweb platform and other sources. Passports are ranked based on their Visa Free Score. The higher the Visa Free Score, the better the Passport Power Rank.

The country list is based on the 193 UN member countries and 6 territories (Macao, Kosovo, etc.) for a total of 199. Territories annexed to other countries such as Norfolk Island, French Polynesia, etc. are excluded. Data is based on research from publicly available sources, as well as information shared by government agencies.
