Politics / Nigerian Appeal Court Fails To Hear EFCC Suit Against Order Restraining Ex-kogi by Bellydeen(m): 2:45pm On Apr 22
The Kogi court restrained the EFCC from arresting, detaining and prosecuting Bello in a ruling given on Wednesday, April 17.



The Court of Appeal in Abuja did not sit on Monday to hear the appeal lodged by the Economic and Financial Crimes Commission against the order of a Kogi State High Court which restrained the anti-graft agency from arresting former Kogi governor, Yahaya Bello, NAN reports.

The Kogi court restrained the EFCC from arresting, detaining and prosecuting Bello in a ruling given on Wednesday, April 17.

Bello had filed a case of a breach of his fundamental human rights by the anti-graft agency before the state High Court.

In his fundamental Human Rights enforcement application, the former governor prayed for an order restraining the EFCC from arresting, detaining and prosecuting him unjustly.

Consequently, the court restrained the respondents from persecuting the applicant, safe only when it has reasonable evidence upon proper investigation.



On the issue of jurisdiction, as challenged by the EFCC, the judge said it had failed and so it was dismissed.



“This honourable court has jurisdiction to entertain this application.



“Therefore, the substantive issues of fundamental human rights sought by the applicant succeed,” the judge declared in Lokoja, the Kogi State capital.



The judgment coincided with the siege to the Abuja residence of Bello by EFCC operatives in a bid to arrest him.



The EFCC is seeking to arraign the former governor on 19 counts bordering on alleged money laundering, breach of trust and misappropriation of funds to N80.2 billion.

In another ruling, Justice Emeka Nwite of the Federal High Court sitting in Abuja on Wednesday granted the EFCC permission to arrest the former governor.



In his ruling on the motion, Justice Emeka Nwite also directed that the former governor be produced before him on April 18 for arraignment.



He said, “It is hereby ordered as follows: that an order of this honourable court is hereby made directing and/or issuing a warrant for the immediate arrest of the defendant to bring him before this honourable court for arraignment. That case is adjourned until April 18 for arraignment.”

Natasha Akpoti-Uduaghan, the candidate of the Peoples Democratic Party (PDP), has lost her bid to represent Kogi central senatorial district in the national assembly.

Akpoti-Uduaghan was defeated by Abubakar Sadiku-Ohere of the All Progressive Congress (APC) in the just concluded national assembly election.

Rotimi Ajayi, INEC returning officer for Kogi central senatorial district, announced the result on Tuesday, in the Okene area of the state.

He said Sadiku-Ohere garnered 52,132 votes to beat Natasha who had 51,763 votes.


“Engineer Abubakar Sadiku-Ohere of the APC having scored the highest votes in the election for the Kogi central senatorial seat is hereby declared winner, and is therefore returned elected,” Ajayi said.

Supporters of the APC candidate were seen in jubilation after the result was declared, chanting “we have won”.

On Thursday, Akpoti-Uduaghan accused the Kogi government of trying to disenfranchise voters in the state

She alleged that the government carried out a road excavation around Ihima, Okehi LGA of the state to influence voters’ turnout for the just-concluded presidential and national assembly elections.

But the Kogi government had said the excavation was a security measure.

#BREAKING: OUTCOME OF TONIGHT's ASUU-FG MEETING:
ASUU rejected Federal Government's offer to suspend strike conditionally.

Although ASUU President refused to speak to journalists on the details of the meeting, one of the union members said that there was nothing new except that the government team wanted them to call off the strike for a period of time which they rejected.

But the Minister of Labour and Employment Senator Chris Ngige who spoke to journalists after the meeting claimed the negotiations were fruitful. He said: “We have reached some agreements and we hope that by next week, those agreements will be maturing and the different unions will have something to tell their members, so that they can call off the strike.

“We have put some timelines for some aspects like renegotiation of 2009 agreement in terms of condition of service and wage review. So, we are hopeful that by next weekend, the unions will see a conclusion of that area”.

The Academic Staff Union of Universities (ASUU), Plateau State University Bokkos chapter, on Monday, declared an indefinite strike, saying the state government had failed to fulfil the signed agreements with the union.
The decision to embark on the strike action was made at a stakeholders’ meeting of the union, held at the University.



According to Daily Trust, while making the declaration of the action, the ASUU chairman of the institution, Dr Monday Hassan Zitta, said the strike was “indefinite, total and comprehensive.”
While reading the resolution, the chairman said; “following the Congress Meeting held on Monday 20th December 2021 at the Social Sciences Auditorium (SSA), congress reviewed the level of implementation of 2nd March 2021, Plateau State Government/ASUU-PLASU MOA and resolved that the State Government having signed an MOA with the Union on 2nd March that led to the suspension of that strike action but the government has failed to: address security concerns by deploying the services of armed Civil Defence Corps on resumption.”
Other concerns raised were the state government’s failure to locate a functional police outpost in the university host community, settle the National Minimum wage arrears within the first quarter of 2021, immediately release the sum of N70million as part payment of the Earned Academic Allowance arrears for the first tranche while the second tranche of N72million in October 2021 had been long overdue.
He added that the government had also failed to; “make complete payment of mainstreamed Earned Academic Allowances for 2019/2020 which was indiscriminately paid but with a lot of members short-changed, commence the construction of staff quarters within the first quarter of 2021, complete the perimeter fencing of the institution among other issues as contained in the MOA, allow for the election of Deans and HODs in the Faculties and Departments.”
The chairman maintained that all academic activities of the institution had been suspended until all demands in the agreement were met

Gunmen have abducted the mother of the Chief of Staff to Governor Yahaya Bello, Abdulkarim Asuku, in Kogi State.


Seriya Raji, the victim was reported to have been abducted from her residence on Monday evening at Inese/Ovakere New Layout in Nagazi community, Channels Television reported.

Nagazi community is located in Adavi Local Government Area of the state. Police authorities in the state have yet to confirm the incident.


A resident of the community disclosed that the gunmen arrived Seriya Raji’s residence at about 7:40 pm shortly after she observed the evening prayer at a mosque within the premises.

The source said they entered the victim’s house through the mosque and whisked her away to an unknown destination, using the car they brought for the operation.

The abductors have yet to make any contact with the family of their victim. Police authorities in the state said a rescue mission has already begun.

Academic staff union of universities (ASUU) is set to embark on an indefinite strike any moment after federal government failed to implement the 2009 agreement.

Recall that ASUU had given Federal government several opportunities for dialogue but all prooved abortive.

ASUU had called on well meaning Nigerians to intervene by calling on Federal government to do the needful in ensuring the looming strike action is averted.

ASUU in a memo released earlier stated she will consult with her branches nation wide to deliberate on the way forward since Federal government has refused to implement the 2009 agreement.

The result of this meeting as published on ASUU's Facebook page indicates ASUU is set to embark on an indefinite strike and won't stop until all agreements are are fulfilled.

The memo reads;

"The consequences of the FG's refusal to implement the 2009 agreement is that the union has resolved to go on an indefinite strike any moment and once it begins, it will not stop until all agreements are fulfilled"



Strike is less frequent in the western world because their governments act. But here in Nigeria, you have to go on strike frequently before government can act.

The Nigerian universities are no longer attractive to foreign lecturers, including those from neighbouring countries. This is due to the prevailing slave wage where the highest ranked professor earns less than a thousand dollars monthly

ABUJA-AS ultimatum given by the Academic Staff Union of Universities,ASUU, to the government to implement its demands or face another round of industrial action ended on Sunday,the former has said Nigerians will know its position within 24 hours.


ASUU President,Prof. Emmanuel Osodeke,told Vanguard on the telephone that the union would declare its position shortly after consultations to branches had been made.

He said the meeting held by the principal officers on Sunday resolved to proceed on consultation with branches as prescribed by ASUIU’s laid-down role,after which a position will be taken.




The consultation which he said,was ongoing, would be through within the next one day after which the union would come out with its position.



Asked about outcome of the meeting the union held Sunday,he said:”It is the principal officers that met yesterday (Sunday)”, explaining that,” Following our procedures,we are going to the branches to consult them and then we will come to take final decision.”

When asked how long would it take the union to come out with its position,he said,”Immediately, you will hear from them today.”



Recall that the ultimatum given by the union for government to accede to its demands or face another round of strike ended yesterday.

The union had threatened to embark on another round of strike following Federal Government’s failure to implement the Memorandum of Action (MoA) agreed upon.



Prof. Emmanuel Osodeke, ASUU National President, at a news conference at the union’s National Secretariat, University of Abuja,had

called on parents and all patriotic Nigerians to hold the Federal Government responsible if it failed to address the issues within three weeks after the news conference.

According to him, despite the unions meeting with the Minister of Labour and Employment, Dr. Chris Ngige on October 14, on major outstanding issues which include, funding for revitalisation of public universities and earned academic allowances.

Other outstanding issues, he said, were University Transparency Accountability Solution (UTAS) promotion arrears, renegotiation of 2009 ASUU-FGN agreement, and the inconsistencies in IPPIS payment, which up till now had not been addressed.

“ASUU is fully committed to upholding academic integrity in the universities and is working to make them more globally competitive.

We are equally committed to promoting industrial harmony in the Nigerian university system for as long as all stakeholders are willing and committed to play their parts.

“We call on all Vice-Chancellors, as the main drivers of the system to join us in this mission to safeguard the waning image of our universities.

“They have no business trading honorary degrees and academic positions for personal and immediate gains; thereby smearing the collective integrity of committed scholars and other patriots who are working day and night to uplift the system that produced them.

“Our union shall not shy away from taking the fight to administrators of Nigerian universities as well as internal and external agents who are bent on compromising the standards ASUU has consistently laboured to protect and improve.

“Government of Nigeria should be held responsible should ASUU be forced to activate the strike it patriotically suspended.

“Finally, we call on all patriotic Nigerians and lovers of Nigeria to prevail on the federal and state governments to act fast to prevent another round of industrial crisis in Nigeria’s public universities,” he had said.

Kogi State House of Assembly has suspended the chairman of Okene Council, Abdulrazak Muhammed.

The suspension followed a report from the Department of State Services (DSS) alleging Muhammed used his position as chairman to unduly arrest, intimidate and torture persons who were against his Oziogu clan.


The Speaker, Prince Matthew Kolawole, who read the report, said the chairman would remain suspended until the DSS completes its investigation.

Kolawole directed the vice-chairman to immediately take over the affairs of the council. He also directed the House Committee on Local Government to carry out an independent investigation and report back to the Assembly.


The House of Assembly had, in August, similarly suspended the chairman of Kogi Council, Abdulkareem Isah Sanni, following an alleged criminal offence while in office.

Sanni’s suspension was sequel to a resolution by members of the House after Kolawole read a letter from Governor Bello indicting the council boss of alleged criminal activities.

Kolawole had ruled that the suspension would last until the outcome of an investigation by the DSS.

The Speaker had also directed the vice-chairman, Hasana Jezhi, to step in as acting chairman

Abdulrazaq said he received the sad news with shock considering the position of the late Hajia Hawawu in the life of his children especially Gov. Hajia Hauwau Oziohu Bello, mother of Gov. Yahaya Bello of Kogi State, is dead. A statement personally signed by the governor and circulated among media houses in Lokoja said that Hajia Hauwau died after a brief illness on Sunday at the age of 101 years. “We are relieved that her passing was peaceful and painless,” Bello said in the statement. According to him, she will be buried according to Islamic rites on Monday, March 16 at her residence in Nagazi, Okene Local Government Area of Kogi State. She is survived by children, grandchildren, great-grandchildren, and many adopted children.

The Presidency has clarified its stand on the planned
nationwide peaceful protest against economic hardship
in the country by a group of Nigerians led by popular
musician, 2face Idibia.



The Senior Special Assistant on Media&Publicity to
the Acting President, Yemi Osinbajo, Mr. Laolu
Akande gave the statement in a series of tweets.
According to him, “This administration will not prevent
Nigerians from expressing themselves in peaceful
protests, it’s a fundamental right of the people.”
He said further that, “No govt has ever laid out the
kind of Social Investment Prog, the Buhari govt is now
running across the nation, that will touch millions.”
The popular Afro-Pop artiste, 2Face Idibia, had earlier
in the week, called for the support of his fans and
colleagues via his social media platforms to join his
march against the crippling economic state of the
nation. The protest is slated for February 6, 2017.

In a video posted on his Facebook account on Tuesday,
2Face urged Nigerians to come out in a “peaceful and
articulate manner” for the march, adding that “the need
for urgent solutions to the challenges facing Nigerians
has become very clear. Things are not getting better for
the majority, we are still where we are, poor and
desperate. I will no longer be quiet.”



The group coordinating the protest, @EiENigeria,
wrote in its Twitter handle: “In view of the latest police
update, how do we proceed with the march? Protest
continues as planned. #IStandWiithNigeria. Our
leaders owe us their ears too and they must hear us.
This march is about connecting the government with
the citizens.”


However, the trio of the Special Assistant to President
Muhammadu Buhari on Media and Publicity, Mr. Femi
Adesina, the Special Assistant to President Buhari on
Electronic Media, Mrs. Lauretta Onochie and the Lagos
state Commissioner of Police, Mr. Fatai Owoseni had
variously taken the planned protest from the vantage
points of it being against the Buhari-led government.
Mr. Adesina had while playing host in an interview
with Lagos Talk 91.3fm, described the planned protest
as coming from disgruntled people still living under the
defeat mode of the 2015 election.



He had said thus:“This is a country of about 180
million people. It is impossible for 180 million people
to think the same way. Yoruba has a saying that if
you all sleep and put your head in the same direction,
then you are all foolish because you would be breathing
in one another’s mouth and lungs.”


“Don’t forget the last election and how it went.
Somebody scored 12.5 million votes, another scored
about 15 million votes. There are some people who are
still in that election mode. They have not gotten out of
it and till today, they are still living and
‘rheumatisizing’ about the past.”



“What they don’t know is that that past is gone and
gone forever. Majority of those calling for the protest
are still in election mode. Majority of them are people
that have resolved not to see anything good in this
administration simply because the man they wanted lost
at the polls.”



Similarly, Buhari’s spokesperson on electronic media,
Onochie had also called the African Queen crooner to
come to a national TV and explain his “beef” with
Buhari instead of going on national newspapers.
According to her, “Nigerians would like 2Baba to
explain the policies that he’s not happy with on
National LIVE TV, as well as proffer alternative
economic policies that would better serve all Nigerians.
Not on newspapers that could have been written by
anyone.”


“That way, Nigerians will know it’s entirely his idea,
that he understands what he’s doing, and acting in the
interest of all Nigerians. Otherwise, we might assume
that the protest is for those who miss the heist that
happened under You know who. Nigerians are waiting.
Thank you Sir,” she had said.



“In support of the two above, the Lagos state police
commissioner, Owoseni had threatened to stop or even
arrest the crooner on the pretext that the force had
gotten an intelligence report that some hoodlums
equally planned on hijacking the protest to cause
mayhem.” He said: “Information reaching us revealed
that some hoodlums are planning to hijack the peaceful
protest and at such, we won’t allow it to hold in
Lagos.”

“We know that Tuface does not have the capacity to
contain such a crowd and we will not fold our hands
and watch while things go out of hand,” Owoseni said.
According to him, “no matter how good an intention is,
hoodlums would always find a way to harass, rob and
attack innocent members of the public who may wish
to go about their lawful duties.”


Despite the threat, the pop artiste has vowed to go
ahead with the peaceful protest especially as many
stakeholders voiced support for the protest.

According to the BBC, genetic
researchers say they have found
fresh evidence that Chinese people
are descended from Africans. The
findings also add new weight to
theories that all human life began in
Africa.



Academics from the University of
Texas and their colleagues in China
studied 28 population groups in
China and concluded that most – if
not all – had their genetic origins in
Africa.


They looked at pieces of DNA known
as microsatellites, which are short,
repeating DNA segments that yield
information about genetic variation
among people.


The researchers found that all
Chinese have a great deal in
common genetically, although there
are some regional variations.
The findings, published by the
National Academy of Sciences in
Washington, supports what has
come to be known as the “Out of
Africa theory”.


This theory contends that homo
sapiens, the modern form of human
life, is descended from a population
of ancestors who migrated out of
Africa about 100,000 years ago.
The new data also supports the idea
of an “African Eve ” who is an
ancestor of all living humans.


The Eve hypothesis, first published
in 1987, suggests that all human DNA
can be traced back to a single
female. This “Eve” would have lived
in Africa about 200,000 years ago.
The latest research challenges an
alternative theory which holds that
several different groups of humans
evolved separately at the same time
in several places around the world.
Chinese mythology holds that the
Chinese are descended from a single
ancestor, the Yellow Emperor. More
recent Chinese scholarship has
argued that the Chinese evolved
separately from other races.



H. Imbert, a French anthropologist
said in his book, “Les Negritos de la
Chine”,”The Negroid races peopled
at some time all the South of India,
Indo-China and China. The South of
Indo-China actually has now pure
Negritos as the Semangs and mixed
as the Malays and the Sakais.”
Another author and professor,
Chang Hsing-Lang, revealed similar
information in writing “The
Importation of Negro Slaves to China
under the Tang Dynasty”, “Even the
sacred Manchu dynasty shows this
Negro strain. The lower part of the
face of the Emperor Pu-yi of
Manchukuo, direct descendant of the
Manchu rulers of China, is most
distinctly Negroid.”


These professors through their
research and studies have reason to
believe that a Negro Empire actually
existed at the dawn of the country’s
history citing evidence of substantial
populations of Blacks in early China,
including finding reports of a major
kingdom ruled by Blacks being
frequently mentioned in historical
Chinese history documents. And,
Chinese chroniclers report that a
Negro Empire existed in the South of
China at the dawn of that country’s
history
The notion that blacks were the
original inhabitants of China has
been thwarted by white scientists
and even some blacks as the result
of a sweeping message of white
superiority and inferiority of black
Africans and their descendants
spreading worldwide.


In 2005, DNA testing proved that the
first inhabitants of China were black
Africans. The study was conducted
by a Chinese DNA specialist named
Jin Li and a team of Chinese and
other scientists. Li admits that he
wasn’t trying to prove this fact,
instead he initially wanted to prove
that the Chinese evolved from hοmo
erectus independently of all
humans. After collecting more than
12000 DNA samples from 165
different ethnic groups, Li and his
team found that early humans
belonged to different species but
modern humans had descended
from the East African species.
One scientist on the team, Li Hui,
said that 100,000 years ago humans
began migrating through South and
Southeast Asia into China from
Africa. Their testing showed that 65
branches of Chinese all carry similar
DNA mutations as the people of
Southeast Asia.


Another scientist on the team, Jin Li
had this to say about their findings,
“we did not see even one single
individual that could be considered as
a descendant of the hοmo erectus in
China, rather, everybody was a
descendant of our ancestors from
Africa.”


When asked how he felt about these
findings, he responded, “after I saw
the evidence generated in my
laboratory. I think we should all be
happy with that. Because after all,
modern humans from different parts
of the world are not so different from
each other and we are very close
relatives.”


The team of scientists participating
in the 5 year study of geographic
and genealogical routes tracing the
spread of settlements of ancient and
modern humans were from China,
Russia, India, Brazil and other
nations.


Richard Leaky, a well-known,
Kenyan-born Paleoanthropologist
who has dedicated his life to
studying fossils and the past believes
that we must study the past if we are
to have a future. He had this to say,
“If you get to the stage where you
can persuade people on the evidence,
that it’s solid, that we are all African,
that color is superficial, that stages
of development of culture are all
interactive, then I think we have a
chance of a world that will respond
better to global challenges.”


Wow, so it appears that Africa truly
is the cradle

A picture shows Nigerian President Muhammadu

relaxing in a well-furnished room as well as watching
news about Nigeria. News making the rounds on social
media claim the picture was taken in U.K where the
President is currently on vacation.
President Buhari had told Nigerians he was going to
U.K for a medical check-up.
Also in the room shows the President watching a
Channel’s “Sunday Politics” programme. On Sunday
the 22nd of January 2017, Buhari’s Special
Assistant on Media and Publicity, Femi Adesina and
the Ekiti state Governor, Ayodele Fayose had spoken

Embattled former Petroleum Minister, Mrs. Diezani Alison-Madueke, is not taking allegations of massive corruption leveled against her by the Economic and Financial Crimes Commission (EFCC) lightly.

She rose in her own stout defence yesterday, denying the allegations. She accused the EFCC of taking advantage of her silence all this while to put her on media trial and declared in a lengthy statement from her London home.

She said given the “level of deliberate inaccuracies”, she had now been forced to break her silence and respond to some issues. She specifically denied ever withdrawing $153million from the accounts of the Nigerian National Petroleum Corporation (NNPC) while in office and said the Yenagoa estate, which the EFCC ascribed to her is her family’s compound built in 2011.

The EFCC, according to her, is only out to convict her in the court if public opinion based on “false reports.”

She said: “I have up till now chosen to maintain my silence and not to respond to inaccurate press reporting.




“However, given the level of deliberate inaccuracies, I am now forced to respond because it is clear that the EFCC is taking advantage of my silence to try me by media and to convict me in the eyes of the public on false reports.

“I am deeply disturbed and bewildered by recent media reports (Premium Times Thursday 12 January, 2017 and other dailies about the same time) claiming that by virtue of an order of the Federal High Court, I have forfeited to the Federal Government, the sum of $153.3m which I purportedly stole from the Nigerian National Petroleum Corporation, NNPC.

“First and foremost, whilst the reasons for my being out of the country are public knowledge, the principle of fair hearing demands that I should have been notified of formal charges if truly there was a prima facie evidence or indictment against my person linking me with the said issue, so as to ensure that I had adequate legal representation. This was never done.

“I wish to state that I cannot forfeit what was never mine. I do not know the basis on which the EFCC have chosen to say that I am the owner of these funds as no evidence was provided to me before the order was obtained and they have not in fact served me with the order or, any evidence since they obtained it.” She went on: “As at the time of my writing this rebuttal (Thursday 19th January, 2017) the EFCC have still not furnished me or my Lawyers, with a copy of the order
“I am also informed by my lawyers that the legislation under which the EFCC obtained this order is for situations where the funds are believed to be the proceeds of crime and the owner is not known.

“I do not therefore understand how the EFCC can in the same breath say that the monies in question are mine. “If they had evidence that the monies were mine then they would not /should not have used the procedure which applies only to funds of unknown ownership.

“If indeed they used this particular legal procedure because they did not know who owned the monies, then how can they now be falsely attributing the ownership to me.

“Let me re-state categorically as I have always maintained for the record, I have not and will never steal money from or defraud the Federal Government of Nigeria.

“I am willing to respond to any charges brought against me that follow duly laid down procedures. “However, in their typical manner and style, the EFCC have gone to the media to attempt to prosecute their case as trial by TV and other media, rather than go through the onerous but tried and tested means of the Judicial Court process.

“In the face of the obvious falsification of facts and misinformation, it is only right and proper that the EFCC should publish the details of the $153.3M lodgements, the bank account numbers and the account beneficiaries, showing proof of my link to them.

“Having also alleged that the said $153.3M was ‘wired’ from NNPC, the EFCC should also publish details of the NNPC accounts from where the said $153.3 million was taken from with proof that I authorized such a transaction/transactions acting either in my private capacity or, as The Honourable Minister of Petroleum. “Let me state for the record that as Minister of Petroleum, the operation and management of NNPC finances were outside my purview as outlined in both the Petroleum Act and the NNPC Act. “The only involvement I had in NNPC Finances was in terms of statutory matters where the Petroleum Act prescribed that as Minister, there were certain duties or actions which I had to perform or take in relation to NNPC. On alleged $700million found in her house and some mansions traced to her, Diezani accused EFCC of witch-hunt.
