The first runner-up in the Anambra governorship primaries of the All Progressives Grand Alliance, Mrs. Uche Ekwunife, has gone to court to challenge the eligibility of the party’s candidate in the November 16 election, Chief Willie Obiano.

Ekwunife, a member of the House of Representatives, is contending that the alleged double registration status of Obiano with the Independent National Electoral Commission as a voter disqualified him from contesting the election.

The All Progressives Congress (APC) has rejected Friday’s announcement by INEC to hold supplementary election in Anambra State on Nov. 30th.

“We will not be a party to what is obviously a travesty of election by a self-discredited and conniving electoral umpire,” the party said in a statement issued in Lagos on Friday by its Interim National Publicity Secretary, Alhaji Lai Mohammed.

It expressed absolute shock and incredulity that INEC could even talk of organizing a supplementary election, despite the weight of credible evidence presented by the party as well as election monitors/observers that what transpired on Nov. 16th was nothing but a sham.

A human rights lawyer, Mr. Femi Falana, has identified officials of the Nigeria Police Force and the Department of State Security Service as also culpable in the alleged detention of the wife of the Enugu State Governor, Clara Chime, for four months.

Falana made the allegation at the public presentation of a book titled ‘Honour for sale’ by Major Debo Bashorun, in Lagos, on Friday.

He said, “I have discovered that the police and SSS helped the governor in confining his wife in a room for four months incommunicado.”

The news of the alleged illegal detention of the wife of the Governor broke earlier this month with Falana subsequently saying Clara had requested his intervention in the matter.

SIXTEEN political parties in the Anambra State have accepted the results collated by the Independent National Electoral Commission (INEC) in the governorship election held in the state on Saturday.

Speaking with journalists after a meeting in Awka, on Wednesday, chairmen of the parties said they abided by the final outcome of the exercise.

Presenting the stand of the political parties, their spokesman, who is also the chaiman of Congress for Progressive Change (CPC), Chuba Ikeagwu, said they would also back INEC in its proposed supplementary election for the conclusion of the governorship election, to enable it to declare the result without further delay.

Osun ‘election observers’ granted bail in Owerri
A chief magistrates’ court presided over by Mrs Maureen Onyewuotu, in Owerri, Imo State, has granted bail to 183 accused persons believed to have come from Osun State and lodged at Desney Hotel, Owerri, on what police described as illegal assembly.

The accused persons were said to have lodged at the hotel on Thursday, October 14, two days to the governorship election held in Anambra State.
The Imo State police command was said to have arrested 183 accused persons on the premises of the hotel and subsequently charged them to courts on a five-count charge.

If the police intend to arrest you, they must do the following:

Identify themselves as the police;
Tell you that you’ are under arrest;
Tell you the suspected offence;
Tell you why it is necessary to arrest you;
Explain to you that you are not free to leave.
Touch you to effect the arrest

IF YOU ARE TOLD THAT YOU ARE UNDER ARREST: You should give only your name, address and your telephone numbers and that of your immediate family and employer. This information is needed in granting bail.
STAY CALM: You should be calm and in control of your words, body language, and emotions.

DO NOT RUN OR WALK AWAY: Keep your hands where the police can see them, do not put them in your pocket (you may make the police nervous by causing them to think you have a weapon). Do not make any sudden movements. Never touch a police officer.

DO NOT RESIST ARREST: Do not resist arrest even if you believe you are innocent. You will be arrested anyway, and then you have an additional charge of resisting arrest. Also, the police are more likely to hurt people who resist arrest.

YOU HAVE A RIGHT TO REMAIN SILENT: Say only, “I want to talk to a lawyer”: S.35 (2) of 1999 Constitution. If the police continue to question you, do not answer. Also, do not speak on a video tape or to government prosecutor (District Attorney in U.S.) about anything. Remember, it is in the police officer’s best interest to get you to incriminate yourself. If you are arrested with somebody else, do not talk with them about the incident in the back of the police car even when the police are not in the car; many police cars now secretly make recordings of such conversations.

YOU HAVE A RIGHT TO MAKE ONE PHONE CALL: You have a right to make one call to your family, lawyer or any organization for example; citizens’ Rights and Mediation Centre (remember the phone you use may be tapped).

DO NOT ACT DEFIANTLY: Do not act defiantly or talk about filling complaints. You do not want the police to retaliate against you while you are in their custody.

You may be handcuffed, Searched, Photographed and fingerprinted. Try to get the names and badge numbers of the police officers who arrested you or deal with you in the police station (this information is your right).

AT THE POLICE STATION: Once you arrived the police station, the investigating police officer (I.P.O) must decide whether there are any legal reasons to keep you in custody. They have to release you if there aren’t any.

IF YOU ARE KEPT IN CUSTODY: If you are kept in custody, ideally the I.P.O will tell you why you are in custody and about your rights while held by the police. The I.P.O must ensure that the rules of the police Act and code practice which set out how you must be treated when held are not broken. These include the right to: speak to a lawyer, to have someone told that you are in custody and where you are, have regular breaks for food and the use of toilet.

IF YOU ARE UNDER 17: If you are under 17, the police must find a guardian or parent to come to the station to help you. That person will be presented if the police interview you.

HOW LONG YOU CAN BE HELD: you cannot normally be held for more than 24 hours without begin charged to court. However, for more serious offence, the police can extend that period to 48 hours decide not to make more enquires, they will decide not to make more enquires; they will decide whether they have enough evidence to charge you to court. If they do not have enough evidence, you should be released.
