Barely 10 months after a court overturned $11 billion damages against Nigeria in the controversial Process & Industrial Developments (P&ID) deal, the federal government is facing another legal battle involving a Chinese firm, Zhongshan Fucheng Industrial Investment Co. Limited, which is seeking to enforce a $70 million arbitration award against Nigeria.

But does the federal government stand a chance of emerging as the victor in the current case?

Seasoned analysts weighed the odds in what they described as a mismanaged deal in separate interviews with Weekend Trust on Friday.

Zhongshan recently got an order from a court in France to enforce the award following an aborted contract between the company and the Ogun State Government, which was initiated in 2007.

The order, which authorised the seizure of the three presidential jets under maintenance in France, has since been validated by a United States court, dismissing Nigeria’s sovereign immunity defence to the enforcement of the $70 million award.

The Ogun State government and Zhongshan have been at daggers drawn over the management of an export processing zone in the Gateway state.

In 2010, Zhongshan Fucheng, through its parent company, Zhuhai Zhongfu Industrial Group Co. Ltd, acquired rights to develop a free trade zone in Ogun State, Nigeria.

In 2011, Zhongshan established Zhongfu International Investment (NIG) FZE, to manage the project with the Ogun State government’s permission.

In July 2016, Zhongshan accused the Ogun State government of attempting to terminate its appointment and install a new manager for the free trade zone.

Zhongshan initiated an investment treaty arbitration against Nigeria under the bilateral investment treaty between China and Nigeria (China-Nigeria BIT).

The arbitrators ruled in favour of Zhongshan, awarding approximately $70 million in compensation. In January 2022, Zhongshan sought enforcement of the arbitration award.

In addition to the seizure of the presidential jets, a court of appeal in the US has authorised the Chinese company’s final charging orders over two residential properties owned by Nigeria.

The development worsens a crisis that the Nigerian government has been attempting to manage in Europe and prevent from spilling to other jurisdictions.

Nigeria had pleaded state immunity against the arbitration but was denied by a United Kingdom High Court judge, Sara Cockerill, who noted Nigeria’s abuse of the timeframe for appealing arbitral awards.

In the majority judgement issued by Patricia Millett and Julianna Childs, the US court held that the final arbitration award is enforceable under the New York convention since the dispute is between “persons” that share a legal commercial relationship.

The court ruled that the Foreign Sovereign Immunities Act (FSIA) arbitration exception stripped Nigeria of sovereign immunity in the arbitration award case.

However, in the dissenting judgement, the third judge, Gregory Katsas, argued that when the New York convention was drafted, the word “persons” did not include a sovereign nation.

Katsas held that the action of Ogun State cannot be attributed to Nigeria, adding that the arbitration award “arises solely out of Nigeria’s sovereign acts governed by public international law.”

Meanwhile, the Presidency had accused Zhongshan of attempting to take over Nigeria’s offshore assets through subterfuge.

“The Presidency is aware of the various failed attempts by a Chinese company, Zhongshan Fucheng Industrial Investment Co. Limited, to take over offshore assets of the Federal Government of Nigeria through subterfuge.

“The Federal Government is not under any contractual obligation with the company. The case in which Zhongshan is trying to use every unorthodox means to strip our offshore assets is between the company and the Ogun State Government,” a statement signed by the Special Adviser to the President on Information and Strategy, Mr. Bayo Onanuga, on Thursday read in part.

Also speaking on the development on Thursday, the Attorney-General of the Federation, Lateef Fagbemi (SAN), said Nigeria has initiated both legal and diplomatic steps to ensure the release of three seized presidential aircraft in France and Switzerland.

In the statement by his spokesperson, Kamarudeen Ogundele, the Attorney-General said its efforts were grounded in the principle that the aircraft are sovereign assets, used exclusively for sovereign purposes, and therefore immune from attachment.

“The Offices of the National Security Adviser and the Attorney-General of the Federation, have already set in motion both legal and diplomatic steps to ensure the discharge of the inappropriate orders against the aircrafts, which are covered by sovereign immunity,” it said.

The government also maintained that the interim orders against the aircraft were inappropriate, given their status under sovereign immunity.

Trade zone dispute mismanaged – Lawyers

Some lawyers have criticised the handling of the dispute with the Chinese firm that resulted in the confiscation of the country’s presidential aircraft.

Dayo Akinlaja (SAN) bemoaned Nigeria’s tendency to breach international agreements of this nature, urging the federal government to opt for a settlement.

He said, “If there is a dispute and one side has evinced a view for settlement, I think it is important to explore that option, irrespective of the court or arbitration panel that heard the matter.

“The more reason we should opt for settlement is because they are producing what we cannot on that land mapped out for the FTZ.”

In his view, Nkem Okoro Esq, called for a thorough investigation and the prosecution of officials involved in the mishandling of the contract to show that the government of Nigeria is not complicit in the breach and to avoid soiling its image further.

“The only honourable thing for the Nigerian government to do now is the payment of the sum awarded against it by the arbitration panel. At least this way, Nigeria can reassure would-be international investors of the safety of their investments in Nigeria.

“Nigeria breached the agreement it had with the Chinese company; an arbitral award was made against Nigeria, and Nigeria has refused to do the most honourable thing: pay and atone for your shortcomings.

“The seizure of Nigeria’s assets is a colossal and unmitigated embarrassment to the federation, already. To think that rather than paying, Nigeria will be looking for ways to defeat the award is also exacerbating the situation against the international image of Nigeria,” he said.

He said there is no doubt that Nigeria is a party in the dispute because free zones in Nigeria are managed, controlled, and administered by the Nigeria Export Processing Zones Authority, which is an agency of the federal government.

A human rights lawyer, Nkereuwem Akpan, Esq, also called for a diplomatic approach to resolving the dispute.

He, however, cautioned that under international law, sovereign states enjoy sovereign immunity from execution, and as such, it would be improper for one state to seize the assets of another, which could lead to chaos if it leads to tit for tat.

Nigeria’s image, foreign investment drive at stake

The Zhongshan matter brings to mind earlier cases of P&ID arbitration ruling over Nigeria tardiness in a failed gas supply and processing contract.

Similarly, in 2019, an Irish engineering firm was awarded $9.6 billion in damages against Nigeria by a UK court over a failed gas project. The firm instructed lawyers to identify Nigerian assets worldwide that could be seized to enforce the record-breaking arbitration award.

A former foreign Affairs Minister and professor of political science, Ambassador Bolaji Akinyemi, said there is a provision in international law which provides that where a nation is involved in commercial activities, its agency will not have diplomatic immunity—an exception to the general rule that states enjoy diplomatic immunity.

He said, “In this particular case, Ogun is not a sovereign state. It is Nigeria that is recognised, and so property belonging to Nigeria is now exposed to this exception to diplomatic immunity.

“I don’t know who the lawyers of Ogun State were when this case came up; the last judgement we had was decided in the United States Court of Appeal. And the judges ruled by a vote of two to one that the Nigerian property does not enjoy diplomatic immunity. This is bad for our image and position internationally. It should never have been allowed to get to this stage.”

Commenting on the development, Dakuku Adol Peterside, former Director General of the Nigerian Maritime Administration and Safety Agency (NIMASA), said the development raised fundamental issues worth interrogating.

He said, coming after the Dangote saga, this is one too many, and the global perception of our country is not good.

“At the time we thought we are beginning to see some increase in foreign direct investment inflow, suddenly, the government is giving out false signals. We already have economic policy challenges; we have foreign exchange volatility and there is a general clout of negative perception about the strength and health of the Nigerian economy.

“Right now, there are institutional weaknesses that investors are grappling with, including the fact that our judiciary doesn’t give people a lot of confidence. Added to all these challenges is the Nigeria-Ogun-Chinese company crisis. There is no way it will not significantly impact investors’ confidence.

“It (the confidence) will weaken, and this is not good for us. Government needs to understand the place of signalling. Perception means a lot to investment. Investment will not go to where it is not safe,” he stated.

Peterside contended that the case reeked of the untidiness that has characterised Nigeria’s international contracts.

He said states and even private companies had found ways of roping in the federal government into their untidy deals.

“In the process, our national reputation has even further cheapened,” he added.

Options available for FG

Prof. Akinyemi urged the federal government to warn all state governors about cancelling contracts signed by their predecessors, whether the agreements involved foreign or domestic companies.

“To me, it is arrogance of power on the part of the Ogun State government. Governors come in and just decide to do anything. They have ruined a lot of domestic companies whose contracts have been cancelled like that,” he added.

Prof. Akinyemi, who is the chairman of the National Think Tank, also admonished the federal government to approach the Chinese government and Chinese companies doing business in Nigeria.

“The Chinese government should call the Chinese company and put pressure on it to settle out of court with Nigeria. That is the important proposal, so that Chinese interest in Nigeria will not be adversely affected by what is going on,” the diplomat said.

On the way forward, Peterside said Nigeria could not continue to be seen as a country whose transactions are opaque and not respectful of contracts, saying these perceptions could deter foreign investors from having anything to do with the country.

Peterside, who is also a former House of Representatives member, advised that the office of the Attorney General of the federation should take a closer look at international contracts entered into by states to insulate sovereign assets from culpability.

Nigeria has a strong case –Agbakoba

However, a former President of the Nigerian Bar Association (NBA), Olisa Agbakoba (SAN), has insisted that Nigeria has a strong defence on two grounds.

He said in international law, there is a compelling reason to argue that attachment of property belonging to a sovereign state such as Nigeria is free from attachment under an order of court.

“In this case, evidence that the aircraft are owned by Nigeria and are strictly used for diplomatic purposes, is in my view a good ground for Nigeria to successfully recover the aircraft from attachment.

“The second strong reason would be that the attachment of the aircraft is said to be in respect of a debt owed by Ogun State, which is a wholly different political entity from the sovereign state of Nigeria. The attached aircraft would, in those circumstances, be unjustified and I think it is reasonable to presume that Nigeria has a very good chance of success,” he stated.

Chinese firm mulls negotiations, releases seized jet

Meanwhile, Zhongshan has said it is open to negotiations with the Nigerian government over the matter. The company was quoted in a statement reported by Premium Times on Thursday that it only sought to assert its rights under international law and was confident in its case.

“Zhongshan has for a long time been ready to enter serious negotiations with the federal government of Nigeria to settle this case and still awaits an indication that the government is equally willing,” the statement said.

On Friday, the Online Newspaper quoted a Zhongshan spokesperson as saying that the company had released one of the confiscated aircraft.

“Zhongshan has consistently sought to act reasonably and fairly in the course of a legal dispute with Nigeria which was not of its making.

“It (Zhongshan) has now been made aware that an Airbus A330, currently detained in France as a result of a French court order obtained by Zhongshan, is needed for the President of the Federal Republic of Nigeria to travel to a scheduled meeting with President Macron of France early next week.

“As a gesture of goodwill, Zhongshan has lifted the seizure of that aircraft immediately. This will allow it to be used for the President’s trip.

“Zhongshan remains committed to talks with representatives of the Federal Government of Nigeria, this time serious and substantive on both sides, with a view to reaching a reasonable compromise settlement rapidly,” the official said.

AS the off-cycle elections in Edo and Ondo states beckon, registered citizens in the states should troop out to vote for their chosen candidates without undue pressures or ‘stomach infrastructure’ inducement. They should consider the electoral process as a tool to assert their sociopolitical rights and contribute to shaping their states’ future.

The Independent National Electoral Commission recently announced that 2.6 million voters and 2.1 million were registered in Edo and Ondo states. The governorship polls will be held in Edo on September 21 and November 16 in Ondo.

INEC’s national commissioner, Sam Olumekun, stated that 52.1 per cent of the voters in Edo were male, while 47.9 per cent were female. He added that youth (34.7 per cent), and middle-aged demographics constituted 72.2 per cent of registered voters in the state.

For Ondo, 50.4 per cent of the 2.1 million are male, while 47.9 per cent are female. The youth account for 35.4 per cent, while the middle-aged constitute 35.2 per cent of registered voters.

The youth and middle-aged demographics in both states may portend a shift in the poll winners if they vote. Irrespective of their choices, young people should realise that this election will determine their lives’ trajectory, their states’ development, and the dividends of democracy for the next four years. They should not sell their votes.

They should vote for competent, incorruptible, and visionary leaders who can spearhead the development of infrastructure in their states.

Unfortunately, Nigerians have reacted to the years of corruption, poverty, and misgovernance by refusing to exercise their electoral franchise. Electoral participation has hit a downward spiral due to repeated electoral violence, ballot snatching, rigging, bad governance, logistics nightmare, and voting inconveniences.

While the UK had a 60 per cent voter turnout in the July 4 general election, Nigeria’s voter outlook is abysmal. It steadily dwindled from 57.4 per cent in 2007 to 53.7 per cent in 2011, 43.6 per cent in 2015, and 34.75 per cent in 2019. It reached a 44-year low at 27 per cent in 2023. This highlights a lack of confidence in the electoral system.

The Pew Research Center stated that the 2020 US presidential election had a 66 per cent voter turnout amid the COVID-19 pandemic. Political parties, NGOs in the governance space, and religious organisations should embark on sensitisation campaigns and programmes to drive higher voter outcomes.

Nigeria should learn from these countries and create the necessary systems to boost the confidence of the electorate. It should make the electoral process seamless. Ad hoc staff for the Edo and Ondo elections should be thoroughly screened before they are onboarded to serve.

Nigeria’s electoral dilemma is compounded by the political elite’s failure to provide good governance. While Nigerians are grappling with poor wages, a high cost of living, and low purchasing power, The Economist of London stated that Nigerian lawmakers are the highest paid in the world. The political elite should not make Nigerians turn their backs on democracy.

The judiciary has a pivotal role to play in elections. While the law is set to protect the redress of the oppressed, it should save itself from judgements based on problematic technicalities, and the stereotype of errors by ensuring that judgements abide by the electoral laws. Recent electoral judgements concerning the senatorial seats of Godswill Akpabio and Ahmad Lawan were contentious. The courts should provide clear judgements.

Nigerians must not be weary of democracy. Building a prosperous and sustainable democratic country demands time and concerted efforts. They must go out and vote, evaluate the winners’ performances, and vote them out when they fail to fulfil their manifestos. They should use the ballot to protest bad governance and choose those whose vision aligns with their dreams.

THE last word on subsidies has not been heard after former President Olusegun Obasanjo declared recently in a viral interview that the petrol subsidy abolished by President Bola Tinubu in his inaugural speech in May 2023 is back. Obasanjo’s assertion contradicts the Tinubu administration’s “fuel subsidy is gone” mantra, which has also been challenged by economic commentators, the IMF, and the World Bank. The key to resolving the subsidy conundrum lies in solidifying the domestic refining industry.

The former president suggested that the Nigerian government should have implemented specific measures to cushion the economic impact before removing the subsidy, which he blamed for the inflation topping 34.19 per cent in June, the highest rate in 30 years. Inflation eased to 33.40 per cent in July.

In his August 4 broadcast in response to the 10-day #EndBadGovernance protests, Tinubu ruled out the possibility of reviving the petrol subsidy, which was one of the protesters’ key demands. The President insisted that the cancellation was “painful but necessary,” emphasising that it had been a major economic obstacle. He likened it to a “noose around the economic jugular of our nation.”

Undoubtedly, the fuel subsidy is back in force. Fuel importers, under the aegis of the Major Energies Marketers Association of Nigeria, asserted that the landing cost of imported petrol was N1,117/litre as of July 16. The NBS put the average price of petrol in June at N750.17/l, while the average price of diesel was N1462.98/l in the same period. The pump price at NNPC retail stations in Lagos is N568 per litre with an implied subsidy of N549 per litre.

During the June Federal Accounts Allocation Committee meeting, the Minister of Finance, Wale Edun, said the Nigerian National Petroleum Company Limited is seeking a refund of N4.71 trillion from the Federal Government to cover outstanding debts incurred for importing petrol.

The demand is based on exchange rate differentials and joint venture taxes related to petrol imports between August 2023 and June 2024. In effect, the NNPC is bleeding from bearing the cost of importing and selling petrol well below market rates. This questions NNPC’s status as a commercial entity.


The situation reinforces notions that little thought was given to the petrol subsidy removal policy from the outset. Prices are at a record high, yet subsidy costs have risen in the real term.

The government is in a fix as a complete removal of petrol subsidy will send pump prices well above N1,000, worsening the punishing inflationary trend with a real risk of triggering chaos and public disorder. Fuel imports cost $600 million monthly.

The situation demands domestic refiners to fill the gap. The Dangote Refinery, with 650,000 barrels per day capacity and the four NNPC refineries under refurbishment, can easily meet Nigeria’s daily fuel consumption requirements.

Dangote has exported fuel cargoes to Europe, and industry watchers have acknowledged that the refinery’s operations have put pressure on European refiners, with about 90 under threat of closure as they lose their West African markets. Nigeria must benefit substantially from this and other refineries, even if it means leveraging state power. The Federal Government needs to minimise the impact of forex on domestic petroleum product prices.

Nigeria will save $7.32 billion yearly selling crude oil and buying refined products from Dangote Refinery at local currency as proposed, a 94 per cent decline from the actual spending.

The government must stick to its commitment to supplying domestic crude to local refiners while all efforts must be focussed on ramping up crude production. OPEC figures showed that Nigeria produced just 1.3mbpd in July, much lower than the 2024 budget benchmark of 1.78mbpd despite a potential for 2.2mbpd. Oil theft and pipeline vandalism remain a major drain on the economy and a threat to domestic crude availability for local refiners.

The southeast at no time lambasted the Lagos-Calabar coastal highway project by describing it as "waste of money."

Atiku, Peter Obi, and other notable Nigerians pointed out the fact that the project is not a priority. In fact, Atiku described it as a highway of fraud. Peter Obi, on the other hand, mentioned that the project is not a priority. He further said that there are existing roads like the east-west coastal highway, the calabar itu road, and others major roads that are in a very dilapidated state, which a reasonable government should have prioritised by making sure it's in good shape instead of earmarking #15 trillion into building a new Lagos-Calabar coastal highway that will take decades to complete.

Mr. Tellmeastory, You don't need to tell stories laced with lies and falsehood just to denigrate the entire southeast region in order to make your point. It's unnecessary. The south east has no business lambasting the project by describing it as a waste of money because when the project is completed and put to use, all Nigerians will make use of it. Just as the Niger Bridge is being used by all Nigerians, not just the southerners alone.

Daily Trust had reported how Ubah, who represented Anambra South Senatorial District at the National Assembly, died in the United Kingdom.

A report said he had travelled to the United Kingdom (UK) to attend the graduation of one of his sons from a University there. Another report said he was due for surgery at the time of his death. His demise was sudden as there were no prior reports of illness.

However, in the list of the National Campaign Council of the APC for the poll, Ubah’s name was seen in the finance committee chaired by Senate President Godswill Akpabio.


His name made it as 23rd on the list nearly a month after he passed on.

The council’s list which was divided into seven sub-committees was signed by the APC National Organising Secretary, Sulaiman Muhammad Argungu.

The sub-committees include contact and mobilization; security; election monitoring; youth mobilization; media and publicity; election management and strategy; and finance.

The council is chaired by Governor Bassey Otu of Cross River State while Governor Dikko Radda of Katsina is the Co-chairman.


There have been reports of dead persons found on INEC register and some documents of national importance.

Interestingly, this is not the first time a dead person would be assigned a strategic role in the Nigerian polity.

Under the administration of President Muhammadu Buhari, six dead persons were appointed into various offices.

Tobias Chukwuemeka Okwuru was named as a member of the board of the Federal Character Commission on Tuesday, two months after he passed on.

The deceased was appointed alongside 37 others.

In a letter sent to the senate on Tuesday, Buhari had sought the confirmation of the appointees.

Okwuru, a former member of the House of Representatives who represented Ezza south/Ikwo Federal Constituency, passed away at the age of 59 after battling an unknown illness.

Among the late persons appointed at the time include Francis Okpozo, a senator in the second republic; Donald Ugbaja, a retired deputy inspector-general of police; and Ahmed Bunza, sole administrator of Jega local government area of Kebbi state.

Others were Christopher Utov, a former proprietor of Fidei Polytechnic, Gboko; and Kabir Umar, a former emir of Katagum in Bauchi state.

Zhongshan Fucheng Industrial Investment Co. Limited, a Chinese firm has released one of the seized Nigeria’s presidential jets.

Recall that Zhongshan, the Chinese firm had secured a court order to confiscate three Nigerian presidential jets pending when Zhongshan receives $74.5 million awarded to it against Nigeria.

The spokesperson of the company who made this known to newsmen on Friday said, the company released the aircraft because President Bola Ahmed Tinubu would need it to travel to a scheduled meeting with President Macron of France early next week.

His words according to Premium Times: “Zhongshan has consistently sought to act reasonably and fairly in the course of a legal dispute with Nigeria which was not of its making,” the official told this newspaper Friday afternoon.

“It (Zhongshan) has now been made aware that an Airbus A330, currently detained in France as a result of a French court order obtained by Zhongshan, is needed for the President of the Federal Republic of Nigeria to travel to a scheduled meeting with President Macron of France early next week.

“As a gesture of goodwill, Zhongshan has lifted the seizure of that aircraft immediately. This will allow it to be used for the President’s trip.

“Zhongshan remains committed to talks with representatives of the Federal Government of Nigeria, this time serious and substantive on both sides, with a view to reaching a reasonable compromise settlement rapidly.”

Vanguard had reported how the Special Adviser to the President on Information and Strategy, Bayo Onanuga had said that the federal government in collaboration with the Ogun State government are doing everything to quash the frivolous order obtained by Zhongshan in Paris to seize Nigeria’s presidential jets.

His words:

“The Presidency is aware of the various failed attempts by a Chinese company, Zhongshan Fucheng Industrial Investment Co. Limited, to take over offshore assets of the Federal Government of Nigeria through subterfuge.

“The Federal Government is not under any contractual obligation with the company. The case in which Zhongshan is trying to use every unorthodox means to strip our offshore assets is between the company and the Ogun State Government.

“The federal government is fully aware of efforts being made by the Ogun state government to reach an amicable resolution to the matter.

“It must be said without any equivocation that Zhongshan has no solid ground to demand restitution from the Ogun State Government based on the facts regarding the 2007 contract between the company and the State Government to manage a free-trade zone.

“When the contract with Ogun State was revoked in 2015, the company had only erected a perimeter fence on the land earmarked for a free trade zone.

“While the Attorney-General of the Federation and Minister of Justice are working with the Ogun State Government on an amicable resolution, Zhongshan obtained two orders from the Judicial Court of Paris dated March 7, 2024, and August 12, 2024, without any notice being duly served on the Federal Government of Nigeria and Ogun State Government.

“This arm-twisting tactic by the Chinese company is the latest in a long list of failed moves to attach Nigerian government-owned assets to foreign jurisdictions.

“Material facts in the transaction between the Ogun State Government and Zhongshan point to another P&ID case in which unscrupulous and questionable individuals falsely present themselves as investors with the sole objective of cheating and scamming Governments in Africa.

“Undoubtedly, Zhongshan withheld vital information and misled the Judicial Court in Paris into attaching the Nigerian government’s presidential jets, which are on routine maintenance in France. The use and nature of the Presidential jets as assets of a Sovereign entity whose assets are protected by diplomatic immunity forbid any foreign Court from issuing an order against them.

“We are convinced the Chinese company misled the Judicial Court of Paris regarding the use and nature of the assets it seeks to attach and did not fully disclose to the court as required by law.

“This same Chinese company had tried to enforce its questionable judgment in the UK and USA but failed.

“Like the P&ID case, foreign companies are trying to defraud Nigeria with the collaboration of some bureaucrats. Zhongshan appeared to have sold the judgment they got to a venture capitalist seeking to make money by embarrassing the Federal Government and President Bola Tinubu.

“We want to assure Nigerians that the Federal Government is working with the Ogun State Government to discharge this frivolous order in Paris immediately.

“Nigerian Government will always work to protect our national assets from predators and shylocks who masquerade as investors”

According to Daily Nigerian, President Tinubu initially tasked Senate President Godswill Akpabio with delivering the news to Ganduje. Akpabio reportedly informed Ganduje that the ambassadorial offer was intended to shield him from the ongoing legal proceedings.
One obvious fact about this Tinubu government is that it does not intend to initiate any fight against corruption. 
In fact, corruption and state graft are in bed with the Tinubu government, and sane Nigerians aren't surprised.

A notorious narcotics drug trafficker and certificate forger who syphoned and milked the entire common wealth of Lagosians for over two decades and counting is not expected to fight corruption. 

This is the only government in Nigeria's history that is integrity-deficient. Nigeria under the Tinubu government has lost its soul and moral bearing.
