Oga I have studied and suffered a lot to be at least a lawyer. I don't imagine going through similar stress again. I also engage in ( Pro Bono )free legal services to poorest of the poor. Most of these doctors earn at least 200k per month yet they are not a bit grateful to God. I understand that their job is quite risky but that should not be a reason to dump tools at these trying times. That is repugnant to equity and good conscience.
You are a GOOD MAN, nobody is encouraging or supporting the doctors to down tools but just telling Hls Excellence the Govornor of Enugu State to impliment what he agreed and signed that is paying them full CONMESS as obtainable in other Tertiary Health Institutions in Nigeria.

It may interest you to know that His Excellence signed and agreed to pay them the full CONMESS but later declined. Is that a sign of good leadership. It may also interested you to know that it's only Parklane and Abia State that is not paying FULL CONMESS to their doctors.

ASSOCIATION OF RESIDENT DOCTORS (ARD) ESUT TEACHING HOSPITAL PARKLANE ENUGU, THREAT TO EMBARK ON STRIKE

By the provisions of Section 31 (6) (a) of the Trade Union Act, Cap. T14, LFN, 2004, as amended by the Trade Union (Amendment) Act, No. 17 of 2005, it is unlawful for any person, trade union or employee that engage in the provision of essential services to take part in a strike or lockout or engage in conduct in contemplation or furtherance of a strike or lockout.

Section 7 (1) (b) (iv) of the Trade Dispute (Essential Services) Act, Cap. T9, LFN, 2010 clearly define essential service as any service in connection with hospitals, the treatment of the sick and the prevention of disease.

The Resident Doctors of University College Teaching Hospital Parklane Enugu are engaged in rendering essential services within the contemplation of Section 48 (1) of the Trade Disputes Act, Cap. T8, LFN, 2004; Section 7 (1) (b) (iv) of the Trade Dispute (Essential Services) Act, Cap. T9, LFN, 2010 and 31 (6) (a) of the Trade Union Act, Cap. T14, LFN, 2004, as amended by the Trade Union (Amendment) Act, No. 17 of 2005. Consequently, they are not in law entitled to embark or threaten to embark on any strike.

In 2010, in SUIT NO. NIC/EN/16/2010; A-G ENUGU STATE V. NATIONAL ASSOCIATION OF GOVERNMENT GENERAL AND DENTAL PRACTITIONERS (NAGMDP) AND ANOR, the National Industrial Court on the 20th of June, 2011 held that service in a hospital is essential service under the Nigerian Law.

Similarly, in NICN/EN/226/2013; UNIVERSITY COLLEGE TEACHING HOSPITAL BOARD V. NATIONAL ASSOCIATION OF RESIDENT DOCTORS OF NIGERIA & 2 ORS, the National Industrial Court on the 23rd June, 2014 decided that the Resident Doctors are engaged in the provision of essential services and cannot take part in any strike, or engage in any conduct in contemplation or furtherance of any strike/industrial action.

Out of abundance of caution, when the Association of Resident Doctors (ARD) ESUT Teaching Hospital Parklane Enugu, by a letter dated 28th day of February, 2020 threatened to embark on industrial action, the Enugu State Government in SUIT NO: NIC/EN/16/2020, ENUGU STATE GOVERNMENT V. DR. EDOGA CHIME EMMANUEL & ANOR took our Originating Summons on the 2nd of March, 2020 for the court to determine whether in view of the extant laws and earlier decisions the Resident Doctors can embark on a strike action.

Following the Originating Summons, Motion Ex Parte and Motion on Notice filed and upon the hearing of the Motion Ex Parte, the National Industrial Court sitting in Enugu on 2nd March, 2020 issued an order restraining the Resident Doctors, ESUT Teaching Hospital Parklane Enugu from embarking on any strike pending the determination of the Motion on Notice. That order has been duly served on the representatives of the Resident Doctors and they have filed their response to the court processes served on them through their lawyer. That case is still pending in court and coming up for hearing on the 20th of May, 2020.

We, therefore, view with dismay the threat by the same Resident Doctors, ESUT Teaching Hospital Parklane Enugu to embark on strike in the face of this Coronavirus Disease (COVID-19) pandemic, worst still when there have been decisions of court against such an action and subsisting order of injunction restraining the Resident Doctors, ESUT Teaching Hospital Parklane Enugu from embarking on strike/industrial action.

The threat to embark on strike made by the Resident Doctors, ESUT Teaching Hospital Parklane Enugu in the face of the subsisting order of a court of competent jurisdiction is unlawful and unjust. A subsisting Court order must be obeyed until it is set aside.

CONCERNED ENUGU STATE CITIZENS

Doctors can go on strike anytime they want, but certainly not this time. All they agitate for always is their emolument, no love and passion for the job. Yes, I don't think any right thinking Nigeria will ever support the government on any issue, because they are useless.
But I am beginning to realise that we the masses are more useless and wicked than the politicians, because new politicians who were part of the masses, get into office and, yet no change.

Doctors going on strike this time, if they are not carefully the masses may begin to target them and their families.

The Holy Book tells us that a worker deserves his wages. You telling us that the masses may begin to target them and their families is uncalled for. Why should the masses target them? Because they are asking the government to pay them what their colleagues in other Tertiary Health Institutions are collecting.

Maybe it may interest you to know that a Resident Doctor as highly skilled as he may be has no Permanent job, No Pension, No Gratuity, No Promotion, No Pay off, what they are asking the government is to pay them the full CONMESS as obtainable in other Tertiary Health Institutions.
If they are ESSENTIAL SERVICE PROVIDERS, then treat them with ESSENTIAL PRIORITY as the issue of strike will never come up again.

Ordinary we the Enugu people would have ignored this paid news but for the sake of the general public who may not have the opportunity of hearing from both sides.

The fact remains that when leaders who are be epitome of honesty, integrity and justice become people of dishonest and double standard, then the society is doomed as you will have medicore governance, propaganda as against facts as we can see from the writer.

On 26th March 2020, the Parklane Resident Doctors went on indefinite withdrawal of service as a result of poor salary and failed negotiations with the state government. However, that was called off the following day following a written approval from His Excellence the Executive Govornor of Enugu State. The letter promised to meet the demands of the doctors with the April 2020 Salary. The doctors called off the strike for interest of the good people of Enugu and to give His Excellence the benefit of doubt.

On 23rd of April 2020 the April salary was paid and the government did not fulfill her promise, rather 25% of their basic was added as COVID 19 allowance. 25% of the 70% CONMESS of 2009. They are not asking for any addition, just pay them the 2019 CONMESS as obtained in other Tertiary Health Institutions. The action of the withdrawal of service is so unfortunate. It is avoidable event solely in the hands of the government. It is more pitable that the government is playing politics in the hospital now we are facing this pandemic.

All hands must be on desk to fight this pandemic Enugu State is in the HANDS OF GOD
