The trial of a former speaker of the Lagos House of Assembly, Adeyemi Ikuforiji, over alleged money laundering was on Monday, stalled because Justice Mohammed Liman of the Federal High Court did not sit.

The case which was first fixed for continuation of trial on November 15, could not proceed at the last adjourned date as the court did not sit and it was, consequently, fixed for November 20.

On Monday, the case also could not proceed as the court did not sit following a letter by defence counsel, seeking an adjournment of the case to a more convenient date.

A new date is, however, yet to be communicated to parties.

Justice Liman, who presides over the case, had been transferred out of the Lagos division but still comes from his division to preside over the case following a fiat.

Ikuforiji is charged by the Economic and Financial Crimes Commission alongside his former Personal Assistant, Oyebode Atoyebi.

They are being tried before on a 54-count bordering on alleged N338.8 million money laundering.


They had each pleaded not guilty and were allowed to continue on an earlier bail granted to them in 2012 when they were first arraigned.

On March 17, 2021, the EFCC had closed its case after calling the second witness for the prosecution.

Prosecution called a total of two witnesses in support of its case.

Meanwhile, Justice Liman was later transferred out of the Lagos division and the case suffered several set backs.

On May 4, (this year) defence counsel Mr Dele Adesina SAN, opened the case for the defence and had began calling witnesses.

Defence called three witnesses, including the first defendant (Ikuforiji).

Among others, Ikuforiji had testified how he was being prosecuted on a faceless petition.

He had told the court that the instant case arose from a petition written by an unknown person, alleging that he had stolen about N7 billion from the Lagos House of Assembly.

The matter was consequently, fixed for adoption of written addresses

The case will now continue on the next adjourned date.

The defendants were first arraigned on March 1, 2012 before Justice Okechukwu Okeke on a 20-counts charge bordering on misappropriation and money laundering.

They had each pleaded not guilty to the charges and were granted bails.

The defendants were, however, subsequently re-arraigned before Justice Ibrahim Buba, following a re-assignment of the case.

Buba had granted them bail in the sum of N500 million each with sureties in like sum.

On Sept. 26, 2014, Justice Buba discharged Ikuforiji and his aide of the charges, after upholding a no case submission of the defendants.

Buba had held that the EFCC failed to establish a prima-facie case against them.

Dissatisfied with the ruling, the EFCC, through its counsel, Mr Godwin Obla (SAN), filed the Notice of Appeal dated Sept. 30, 2014, challenging the decision of the trial court.

Obla had argued that the trial court erred in law when it held that the counts were incompetent because they were filed under Section 1(a) of the Money Laundering (Prohibition) Act, 2004, which was repealed by an Act of 2011.

EFCC further argued that the lower court erred in law when it held that the provisions of Section 1 of the Money Laundering (Prohibition) Act, 2004 and 2011, only applied to natural persons and corporate bodies other than the Government.

The commission had also submitted that the trial judge erred in law when he held and concluded that the testimonies of the prosecution witnesses supported the innocence of the respondents.
In its judgement, the Lagos Division of the Appeal Court, in November 2016, agreed with the prosecution and ordered a fresh trial of the defendants before another judge.

Following the decision of the Appeal Court, the defendants headed for the Supreme Court, seeking to upturn the ruling of the Appellate court.

Again, in its verdict, the apex court also upheld the decision of the appellate court and ordered that the case be sent back to the Chief Judge of the Federal High Court for reassignment to another judge.

According to the charge, EFCC alleged that the defendants accepted cash payments above the threshold set by the Money Laundering Act, without going through a financial institution.

The commission accused the defendants of conspiring to commit an illegal act of accepting cash payments in the aggregate sum of N338.8 million from the House of Assembly without going through a financial institution.

Ikuforiji was also accused of using his position to misappropriate funds belonging to the Assembly.

The EFCC said that the defendants committed the offences between April 2010 and July 2011.

The offences, according to the EFCC, contravenes the provisions of Sections 15 (1d), 16(1d) and 18 of Money Laundering Act, 2004 and 2011.

In a judgment on Sunday, the Court of Appeal, led by Justice Elphreda Williams-Dawodu, ordered the Independent National Electoral Commission to withdraw the Certificate of Return given to Governor Caleb Mutfwang of Plateau State.

The court declared Nentawe Goshwe of the All Progressives Congress the rightful winner of the March 18 governorship election, ordering INEC to issue a new Certificate of Return to him.

Courts have sacked at least three governors whose elections were contested by opposing parties and deemed one election inconclusive, barely nine months after the elections.

The following is a list of sacked state governors and the grounds given by the court:

*Abba Kabir Yusuf (NNPP)
The NNPP received 1,019,602 votes to defeat the APC, whose candidate, Nasir Gawuna, received 890,705 votes, according to INEC. As a result, the NNPP candidate won by a margin of 128,897 votes.

The Election Petitions Tribunal, under the leadership of Justice Oluyemi Osadebay, invalidated the election of Governor Yusuf. The tribunal made this decision by declaring 165,663 votes, garnered by Yusuf invalid.

The ballot papers for the 165,663 votes were not signed or stamped, according to the judge, and thus were invalid.

The court ordered that Yusuf’s certificate of return be revoked and that a fresh one be issued to Gawuna.

The Court of Appeal in Abuja also upheld the tribunal’s decision.

The three-member panel, led by Justice M.A Adumeh, determined that Yusuf was not on his political party’s membership list.

He stated that a party must hold the names of its registered members in both hard and soft copies, citing a clause of the Electoral Act.

The judge stated that the tribunal erred in failing to disqualify Yusuf in its ruling.

“The tribunal was wrong not to have disqualified him. The failure to comply with Section 177(c) is fatal to their election. . Where a party carelessly nominates a candidate such is a nullity irrespective of whether he performs well. Sponsorship without membership is like putting nothing on something, it cannot stand. This is a clear example of acting with brazen impunity as if the Constitution is not binding,” he held.

Yusuf has, however, vowed to reclaim his mandate at the Supreme Court.

* Abdullahi Sule (APC)
The Nasarawa State Governorship Election Petitions Tribunal sacked the state governor, Abdullahi Sule, in October and ordered INEC to revoke his Certificate of Return and give it to David Ombugadu of the PDP.

Ombugadu had taken Sule to court to contest INEC’s announcement of Sule as the winner of the election.

He told the tribunal that his actual votes were unfairly lowered while Sule of the APC’s votes were boosted to help him win, notably in the EC8Bs of Gayam and Chiroma Wards of Lafia Local Government Area.

The tribunal, led by Justice Ezekiel Ajayi, in its decision deducted the incorrect votes added to Sule and added back the votes which were reduced from the overall votes of David Ombugadu. This decision was based on the certified copies of the polling units results (forms EC8A) that were presented by the petitioners.

The Court of Appeal sitting in Abuja on Wednesday, November 15, reserved judgment on the appeal.

* Dauda Lawal (PDP)
INEC had declared Dauda Lawal of the PDP as the winner of the Zamfara State governorship election, defeating the incumbent governor, Bello Matawalle of the APC.

Matawalle had filed a case with the tribunal contesting the results of the governorship election on March 18, but it was dismissed due to lack of merit.

The Court of Appeal issued its decision on Thursday, November 16, declaring the election inconclusive and ordering INEC to hold new elections in two local governments.

According to the appellate court, Matawalle, who is currently the Minister of State for Defence, was able to establish Lawal’s invalid election.

The governor, in a statement by his spokesperson, Sulaiman Idris, said his legal team was reviewing the judgment before taking the next necessary action.

* Caleb Mutfwang (PDP)
Nentawe Goshwe of the APC challenged the victory of Caleb Mutfwang at the tribunal, claiming that the governor was not validly nominated and sponsored by his party.

A three-member panel of the tribunal headed by Justice R. Irele-Ifijeh, in a unanimous decision, dismissed the petition of Goshwe for lacking merit.

The three-member panel of the Court of Appeal led by Justice Elfrieda Williams-Dawodu ruled on Sunday, November 19, that the governor was not legitimately sponsored by the PDP for the election, citing Section 177 of the Constitution.

The judge pointed out that the PDP failed to adhere to a standing High Court order, which mandated the party to organise a legitimate party congress before endorsing candidates for the governorship and other positions.

Mutfwang, who has directed his legal team to submit an appeal with the Supreme Court, expressed hope that the mandate bestowed upon him by the people of the state would be reinstated.

President Bola Tinubu has extended his sympathies to the family of the late Chief of Army Staff, Major-General Chris Alli, and the Nigerian Army, over his passing on Sunday.

President Tinubu’s sympathies were contained in a statement by his Special Adviser on Media and Publicity, Chief Ajuri Ngelale, on Monday.

The late Major-General Alli was the Chief of Army Staff from 1993 to 1994 when he retired from service.

Mourning Alli, President Tinubu described his passing as a painful loss, saying he served his country faithfully.

The President said, “I condole with the Alli family and the Nigerian Army over the sad loss of the former Chief of Army Staff. He served his country with honour and retired meritoriously. May the Almighty God rest his soul and grant his family the fortitude to bear the huge void.”

Major-General Alli held other important positions in the Nigerian Army, such as Director of Military Intelligence, before his elevation to Chief of Army Staff. He was a respected officer.

The Kano State Police Command, on Monday, warned against any form of protest following the Court of Appeal’s verdict upholding the sacking of the state governor, Abba Yusuf.

The command’s spokesman, SP Abdullah Kiyawa, in a press statement, said security operatives have credible information that some persons are mobilising to protest the verdict of the court

The statement read, “The call is as a result of credible information at the command’s disposal that revealed the intention of some groups of political party supporters, using unconventional media platforms, mobilising people and planning to hit the streets in form of protest to the Kano State Governorship Appeal Court’s verdict, which was delivered on Friday, November 17, 2023.

“The information revealed that the intention of the protesters is to shut down the state in an action which may likely result in violence

It is on this note that the police command issued the warning to residents of the state to be extra-careful as whoever intends to conduct any protest or procession should do so in accordance with the provisions of the law.”

Prior to the court judgment, the leaderships of both the New Nigeria Peoples Party and the All Progressives Congress were invited by the state police command where peace accord was signed on Thursday, November 16, 2023.

The objective of the peace accord was to maintain harmony and ensure that the political landscape in the state remained peaceful, irrespective of the judgment’s outcome

They also promised avoid unguarded statements from their members likely to increase political tension or undermine the security arrangements and sanctity of the judiciary.

They added that they monitor, adhere and comply with the details contained in the peace accord signed before the Kano State Police Command.

Also, they promised that their parties will support all the arrangements put in place by the security apparatus to maintain peace and order, and that any person or group of persons directly or indirectly found disrupting the peace before, during and after the appeal court judgment shall face the full wrath of the law

Following the peace accord, the state Commissioner of Police, Mohammed Gumel, called on all residents to maintain calmness and avoid any form of unlawful gathering, protest, or procession that may trigger violence, as joint security forces have since been mobilised and dispatched to strategic locations to safeguard peace and order throughout the state.

Reiteratively, whoever attempts to disrupt the peace in the state will be arrested and made to face the wrath of the law,” he declared.

The CP, while appreciating the people of the state for their cooperation, support and understanding, urged them not to hesitate in reporting suspicious movement of people.

Gaza’s Hamas government said Sunday that the death toll from fighting between Israeli troops and Hamas militants in the Palestinian territory had reached 13,000 since the war began on October 7.

Hamas gunmen killed around 1,200 people, mostly civilians, and captured around 240 more as hostages, according to Israel, when they surged over the militarised Gaza border.

AFP reports that the Hamas government said more than 5,500 children were among the dead, alongside 3,500 women, with 30,000 more people wounded. Its health ministry has previously said it can no longer give exact tolls as intense fighting has prevented bodies from being recovered.

The White House on Sunday however said it was looking into the devastating blast at a United Nations-run school and shelter in northern Gaza, an official said

According to CNN, Washington is gathering information about Saturday’s strikes on the UN-run school that was used as a shelter in Gaza, Deputy National Security Adviser, Jon Finer, said on Sunday.

“What I can say at this point — and we’re also in touch with the Israelis to try to find out what they know about what happened — is that, if harm was done to innocent civilians sheltering at a UN site, that would be totally unacceptable,” Finer said on CNN’s “State of the Union.”

UN Secretary-General Antonio Guterres said on Sunday that he was “deeply shocked” that two UN schools were struck in less than 24 hours in the Gaza Strip, killing and injuring dozens of people – many women and children – “as they were seeking safety in United Nations premises.”

Hundreds of thousands of Palestinian civilians are seeking shelter at United Nations facilities throughout Gaza due to the intensified fighting. I reaffirm that our premises are inviolable,” Guterres said in a statement, according to Jerusalem Post.

A spokesperson for the UN Relief and Works Agency, which runs the schools in Palestinian refugee camps and serves as the main UN relief agency in Gaza, confirmed the strike on Saturday

It was the second time in 24 hours a UNRWA school in northern Gaza was struck, the agency said, as leaders and human rights workers raised concerns over the scale of civilians killed in Israel’s assault on the Palestinian enclave.

The Prime Minister of Qatar, a mediator who has helped broker talks to free Hamas’ hostages in Gaza in return for a ceasefire, said on Sunday “the challenges that remain in the negotiations are very minor,” but did not provide details or a timeline.

“I think that I’m now more confident that we are close enough to reach a deal that can bring the people safely back to their homes,” said Mohammed bin Abdulrahman Al Thani.

US Deputy National Security Adviser Jon Finer told NBC they were “closer than we have been in quite some time” to securing a deal. But he added on CBS, “The mantra that nothing is agreed until everything is agreed really does apply.”

Meanwhile, Israel’s Defense Minister Yoav Gallant on Sunday said the defense establishment had noted a growing trend of “Iran pushing for militia attacks against Israel using its proxies in Iraq, Syria, and Yemen.”

Jerusalem Post reports that although Yemen and Syrian proxies of the Islamic Republic have both attacked the Jewish state several times since Operation Swords of Iron began, to date, Iraq has gone under the radar, and most proxy attacks have been against the US.

“We are followiing these trends, and will know the right time, place, and intensity with which to act,” said Gallant.
