Two places in the constitution where Abuja Capital territory were thoroughly mentioned:

1) under the heading of ELECTION.

2) under the heading of ADMINISTRSTION.

In 1, the constitution says that a presidential candidate must win 25%of votes in 2/3 of the number of states and Abuja capital territory before declared winner.

On 2, the constitution says that Abuja must be administered like other states.
It never mentions Abuja as the 37 state.

The framers of the constitution knew that the president doubles as governor of Abuja federal capital territory, and that to govern a territory successfully, the president must win a minimum of 25% of votes in Abuja federal capital territory; as well as win 25% of votes in 2/3 of the number of states in Nigeria.
Tinubu did not win 25% of votes as required in Abuja capital territory; therefore should not have been declared winner of the last presidential election.
