Yes INEC has the right to choose which mode to use in transmission of electoral results but it is criminal of INEC to electronically transmit the NASS results and choose not to transmit the Presidential especially when all were conducted same day. It smacks of fraud and rigging. The law isn't blind to that.

Also INEC has to prove to the PEPT that indeed there was a glitch. Even if there was a glitch and you claimed it was resolved immediately, why in a hurry to announce the Presidential results? Why not re- transmit the Presidential results after resolving the glitch?

Meanwhile, the appellate court noted that the respondents did not file any brief or join issues in the appeal despite proof that they were served with the appellant’s brief.

This judgment is a clue of what the outcome of the petition at the Presidential election tribunal will look like. I just pray Nigerians remain calm after the pronouncement, because that is what everybody is waiting for.
They remained calm despite screaming that they will shut down the country if Tinubu was sworn in. Same would happen when the tribunals throws out the petitions.

This case and one at PEPT are not the same
This one is telling INEC to use a particular means or way to collate result, the one at PEPT is asking the court look into the fact that INEC did not follow its own regulation.
It's just like going to the swimming pool for a contest, one of the contestants told the ref that, it's best to jump in with both legs, court now said no, ref can decide how one can jump in, now ref now said, you will jump in with your stomach, then during the competition a contestant now crawled in and INEC is said the person that crawled in is right. Was that their regulation?

The manual collation of results that inec use to declare the winner is it not part of the guidelines of inec?

Really? But aside the judgment didn't INEC itself vow to follow and enforce that particular guideline. It is sad how we allow partisanship eat into our psyche like this
The electoral act far supercedes any "guideline" and that act gives INEC discretionary powers to to switch any mode of transmission. This is a matter of law and the law with its flaws has no emotion!

So political parties who have grievances with such should do the needful push for an amendment of that act because if they don't INEC will as they please on this whether they said they will follow a guideline.

How can he claim to have won an election by challenging number 1 and not challenging number 2? He came 3r d place according to INEC now. He had nothing to prove and he knows it. That is why he refused to give us figures but opted to attack and question Tinubu's electoral credibility instead. Hence his digging into the president's past. He hopes to use that to disqualify Tinubu so that a reelection between him and Atiku alone will be done. Mumu strategy.

Bro, this is not about Obi or anything. Pls, we need our country to work. We need an election that is electronically transmitted to improve transparency. This is obtainable in serious countries.
We cant keep doing anyhow and expect Nigeria to grow.

I would be the happiest if Nigeria can have a reliable electoral system. U maybe benefiting from the malfunction maybe from political appoitments but for how long will Nigeria remain like this?
When are we stopping the nonsense elections we run using pen and biro to record results and manually inputing data like we are in 10th century.

I'm with you. I'm not sure what people are arguing against. Watching parts of that election on Twitter left me dumbfounded and embarrassed. Election officials literally put ballots in Tupperware containers and called them secure?

Nigeria can't grow or work if people are comfortable with it as is.

Bro evidence was tendered at the tribunal where INEC vowed to do so both documentary and in broadcast. It became the least expectation of every party including the citizenry. No one coerced INEC into doing so. They chose it. They insisted on it. They didn't even deny this fact at the tribunal. It is curious and a fatal anomaly that they failed to adhere to their own guidelines in one aspect the Presidential while employing it to another, the National Assembly for elections held on the same day.
Don't fall on a sword for another. Is it a norm to just apologize for breaking your own rules? Where is the justice for those that are adversely affected? Why can't they do it again next time and simply just apologize. We must hold our institutions to task in this country to progress. My opinion.
What part of the bolded statement below do you not understand? It's already on plain English. Maybe we should translate it to broken english lol.

The court held that Section 50(2) and Section 60(5) give INEC “very wide discretionary powers” to determine how it transmits or transfers election results.

“As I had demonstrated earlier in this judgment, the Electoral Act gives the 43rd respondent (INEC) discretion on how it carries out its assignment including how it transmits or transfers the result of election from polling units,” Umar stated.

All they have now is forfeiture, Certificate, and Abuja 25% argument.
Even the 25% issue had been thrown out by another court in a seperate case. 20million naira fine was also issued to the petitioner.

There’s a distinction between making rules and breaking rules…
Accordingly, that the law grants INEC discretion to set its own rules doesn’t mean that, once set, such rules can be ignored.

Even where INEC has discretion to “vary” its rules, such variation should be formalized just as the original rules…
An administrative agency cannot publish rules that are binding on everyone else and then “vary” such rules by breaking them

Rules and regulations enacted pursuant to statutes become part of the body of Administrative Law…
Accordingly, they can only be “varied” (ie, amended) in the SAME manner as enacted - by formal publication and distribution.
