Sorry am Emmauel i run a pig farm amongs other bussiness in the agro sector, applied for a credit facility for expansion of my business and after evaluation from the bank the application was approved for payment but am required to pay 10% of the loan sum which amounts to 150k and another 25thousand naira insurance fee total amount is 175k...what i have presently is around 120k.

@LEGIT..As a follow up from my earlier post where I stated explicit with relevant authorities that the Bank will not be liable..I will like to address the issue of NEGLIGENCE of which you have raised.

Negligence in itself is not a one way street as it is one of the most complex principles in the law of Tort..just as u may know that d tort of negligence is not actionable per se I.e actionable without proof of special damage like the tort of tresspas..for you to establish the tort of negligence u must establish 3things(Duty of care, breach, damages) and should you fail in one then your case is invalid.
Equally note that not every act of carelessness or negligence is actionable as LORD WRIGHT explained in the case of LOCHGELLY IRON V McMullan, he posited that "in strict legal analysis, negligence means more than heedless or careless conduct whether in omission or commission. it properly connotes the complex concept of duty, breach and damages thereby suffered by the person to whom the duty is owing"

thus in dis case u may be able to establish that there is a Duty of Care owned by the bank to the customer, but in actual fact the Duty is that of safe keeping of the customer's money of which falls under their possession,until then there is no duty of care.

The next element to prove if you successfully prove that there was a duty of care owed is that there was a BREACH of that DUTY, and this is the part that occupies the most time of the court as it looks at several elements including the REASONABLE MAN's TEST..other elements include the likelihood of harm and measures to avoid the harm..I will not bore u with lengthy notes because it is a long issue.

But in Brief conclusion the Bank's lawyer just need to state to the court that the likelihood of harm (the coming of robbers) into the bank is not frequent and even if it is frequent the provision of security guards will suffice and will exclude the bank from any attack therefrom as it could be seen that measures were taken to forestall the act you can see the Case of BOLTON V STONE..remember the Law does not require the doing of the impossible, so once necessary precaution is taken you are freed from liability that is why we have a Defence called AN ACT OF GOD under the tort of NUISANCE..
Finally since the tort of Negligence is not actionable per se you can't even go ahead to prove damages when you have failed in the other two elements. cases where you can easily hold the bank on negligence include, unauthorized publication of your account, injury with the bank equipments negligently displayed, drinking of contaminated water frm d banks water dispenser,injury from slippery floor etc..

Under the Banking Law the relationship between a customer and the bank is that of bailee and bailor and under the same provision not every body who does business with the bank is regarded a customer at law..for u to be properly called a customer of a bank you must have a valid account in line wit d relevant laws prescribed by the bank, by virtue of dat the relationship as regards where liability lies its stricto sensus very clear, the bank is onli liable for the lost of monies been deposited in ur account and not that which is lost within the premises if a reverse is the case it will cause untold hardship to the bank and d courts to ascertain the exact amount that was stolen as certain individuals may bring frivolous claims...so until the bank agent receives ur money the liability is on the customer if any lost should arise.ipso facto do so mean that you can't sue..talking frm the stand point of banking law and not common sense

Onliie: He has a case. He must convey the impression that he belongs to the armed forces to be guilty of violation of this law. If he just wear it as a fashion piece, he is not guilty. Do youknow that Nigerian Army wears dark plain green uniform too? Does that make any green cloth illegal?
Sir conveying an impression is 1aspect covered under fraudulent misrepresentation, and that has to do with when the person who wears the uniform has an intention to mislead the public fraudulently and that is where section 109 comes to play,,however section 110 covers aspects where a person wears it for fun with no intent to mislead anybody and that is where the OP falls under,that is why the penalty for defaulting section 109 carries 1year imprisonment while section 110 carries 1month imprisonment.

P.S.I'm not hating oh,I myself plan to join the Military someday,but the Truth has to be said. Also,

The Constitution says; Section 34.

-(1) Every individual is entitled to respect for the dignity of his person, and accordingly -

(a) no person shall be subject to torture or to inhuman or degrading treatment;
Sir the issue should not be confused, if you wear a camo that has no affiliation with that which is used by d nigerian soldiers of which section 109 and 110 of the criminal law applies then no body has a right to touch you,if you are harassed you have valid grounds 2secure conviction and recover damages against the nigerian army.

As regards the people that put on only the snap back cap as u said they will still fall under d law if it resembles that which is used by the army, and dat it was only the cap is no valid defence since section 109 Sub (A) states ''Wears any part of the uniform''.

Finally section 34 of the 1999 constitution is not an absolute right, which means it can be violated by a valid law if you have violated any established law as provided by section 36 sub 12 of 1999 constitution as amended...the section is interpreted with other sections.

am sorry op you cannot claim violation of ur human right as contained under chapter 4 section 34 of the 1999 constitution as ur act was a violation of section 109 and 110 of the criminal code.see the section below

 
109.        Any person who, not being a person serving in the armed forces of Nigeria nor a member of the police forces, and with intent that he may be taken to be such a person or member as aforesaid-
 
(a)             wears any part of the uniform of, or
 
(b)            wears any garb resembling any part of the uniform of, a person serving in the armed forces of Nigeria, or a member of the police forces,
 
                is guilty of a misdemeanour and is liable to imprisonment for one year.
 
110.         Any person who- Unlawfully wearing the uniform of forces, etc. L.N. 112 of 1964. 1967 No. 27.
 
(1)            not being a person serving in any of the armed forces of Nigeria, wears the uniform or any part of the uniform of such forces, or any the armed dress having the appearance or bearing any of the regimental or other distinctive marks of such uniforms; or
 
(2)            not being a person holding any office or authority under the Government of Nigeria or of any part thereof, wears any uniform or distinctive badge or mark or carries any token calculated to convey the impression that such person holds any office or authority under the government;
 
                 is guilty of an offence and is liable to imprisonment for one month, or to a fine of ten naira, unless he proves that he had the permission of the President or of the Governor of a State or wear such uniform or dress, badge or mark or to carry such token:
 
                 Provided that this section shall not apply to the wearing of any uniform or dress in the course of a stage play or in any bona fide public entertainment.

Finally since he didn't apply any force on you your case is slim..better luck next time.

Yea the production is limited and the price is high, starts at about 800thousand usd (one hundred and twenty eight millon naira)..but the power is unmatched to so many cars.it has a horsepower of abt 725.wit 533pht..its a speed devil.

It depends on the car and its horsepower plus the level of torque..the fastest I have sprint from 0 to 60 is 5seconds, and the worst was about 20seconds..note that the 5seconds was with a bmw x6..still looking forward to sprint 0 to 100 in 3seconds (BMW x6 G typhoon) wish I had that large cash.
