Nigeria’s former minister of finance, Dr Ngozi Okonjo Iweala has described allegations that she spent $2.1 billion out of the Excess Crude Account “without authorization” as “false, malicious and totally without foundation”. Nigerian state governors had yesterday alleged that the former finance minister spent $2.1 billion from the Excess Crude Account, ECA without authorisation based on the balance of $2 billion now in the account. “The last time the former Minister of Finance and Coordinating Minister of the Economy, Mrs. Ngozi Okonjo Iweala, reported to the council, and it is in the minutes, she reported by November 2014 that we had $4.1 billion. “Today, the Accountant General office reported we have $2 which means the honourable minister spent $2.1 billion without authority of NEC and that money was not paid to states, it was not paid to the three tiers of government,” Governor Adams Oshiomole told journalists after the NEC meeting. He also announced that a committee made up of four governors have been set up by NEC to probe the unauthorized spending as well as failure of the Nigeria National Petroleum Corporation, NNPC to remit about $3.8 trillion it earned between 2012 and May 2015 to the federation account. But the former finance Minister denied the allegation of unauthorised spending in a statement signed by Paul Nwabuikwu, his media adviser on Tuesday. She added that decision to withdraw funds from the account is always made in conjunction with the states. The former Minister also said the allegation presupposes non existent of the Federal Account Allocation Council where the States and the Federal Government usually agree on revenue sharing. “We want to state categorically that no unauthorized expenditure from the ECA was made under Okonjo-Iweala’s watch in the Finance Ministry. Decisions on such expenditure were discussed at meetings of the Federation Accounts Allocation Committee (FAAC) attended by finance commissioners from the 36 states “It is curious that in their desperation to use the esteemed National Economic Council for political and personal vendetta, the persons behind these allegations acted as if the constitutionally recognized FAAC, a potent expression of Nigeria’s fiscal federalism, does not exist. “But Nigerians know that collective revenues, allocations and expenditures of the three tiers of government are the concern of the monthly FAAC meetings,” said Iweala. The Minister said the allegation was intended to smear her reputations as has been attempted in the past. Fourteen years after the gruesome murder of a former Minister of Justice and Attorney General of the Federation, Chief Bola Ige (SAN), the Inspector-General of Police, Mr. Solomon Arase, on Monday, said the case could be reopened. Solomon, who spoke on Monday during a programme, “View from the top,” on Channels Television, said that the investigation into the murder failed because it was not based on proper intelligence. It will be recalled that the candidate of the Peoples Democratic Party in Osun State and a former Chairman, Senate Committee on Appropriation, Chief Iyiola Omisore, the immediate past Minister of Police Affairs, Mr. Jelili Adesiyan, and the current National Secretary of the PDP, Prof. Wale Oladipo, were arrested and charged for the murder. They were, however, discharged by the courts after a series of trials. Arase, who was a member of the special homicide unit that investigated the case, said the investigation was also marred by the political atmosphere at the time. Arase said the suspects were made to undergo lie detector tests. He said, “Some people were charged to court but just as I said before, our investigation was not intelligence-led. So, we tended to situate it within the political complexion of Osun State at that time. And you will also remember that there were a lot of distractions when that investigation started. “So, it looked as if the attention of the police was diverted from the original cause of the event. I remember we also brought in the FBI (Federal Bureau of Investigation) and we wanted to ascertain if the people that we had in custody were the real people. “So, we administered the polygraph examination but it did not work out. The polygraph test showed that they were not the perpetrators. The scientific aid we were trying to get was not in tandem with the circumstantial evidence that we had gathered. And when you have such issues, the suspect is given the benefit of the doubt. So, they walked away.” Arase, who was also the Deputy Inspector General of Police in charge of Intelligence before he was promoted last month, said the case had not been closed. The police boss said if new evidence emerged, the case would be revived. He said, “Murder cases don’t have statutes of limitation. Cases can always be reopened as it is done in other countries. Once there is fresh evidence to suggest that the probability of involvement or the criminal responsibility of one of the suspects in that matter is higher, it can always be reopened. You hardly close a criminal investigation that way.” Arase said it was his plan to implement police reforms and also increase the standard of living of junior police officers. The police boss urged his men to be more professional and continue to operate on the assumption that suspects are innocent until allegations against them were proven otherwise. He, therefore, ordered his men to stop the habit of arresting suspects before gathering evidence. He said for things to improve in the police, the best university graduates must also join the security agency. He said, “We must ensure that those who are brought into the force are intelligent enough and can be easily trained. When your manpower is wrong ab initio, you get everything wrong. The Director of Public Prosecutions of the Federal Ministry of Justice, Mr. M.S Diri, on Monday withdrew the N2.45bn fraud charges instituted against a former governor of Bayelsa State, Mr. Timipre Sylva. The Economic and Financial Crimes Commission had on May 18, 2015 re-arraigned Sylva on six counts of fraud before Justice Evoh Chukwu of a Federal High Court in Abuja. But the EFCC, represented by its Assistant Director, Legal and Prosecution, Mr. J.O Ojogbane, said the anti-graft agency was not part of the decision to withdraw the charges. Following the withdrawal of the former prosecuting counsel, Mr. Festus Keyamo, from the case on May 25, 2015, it was handed over to the DPP. But instead of the DPP appearing in court on Monday for commencement of trial, he issued a fiat to a private lawyer, O.J Nnadi (SAN), to continue prosecuting the case. Nnadi, during the Monday’s proceedings tendered the freshly issued fiat before the court and told the judge that the EFCC had instructed him to withdraw the suit. He then urged the court to strike out the case. He said, “We are ready for trial, but following the instruction this morning, EFCC directed that this charge be withdrawn. “I received instruction from Ojogbane that this charge against the defendant be withdrawn. We urge this court to strike out the charge.” But Ojogbane, who appeared together with Nnadi and other lawyers for the prosecution, expressed surprise over the team leader’s claim that the EFCC gave the instruction for the withdrawal of the case. The EFCC lawyer said, “I’m a little bit surprised by the submission of the learned silk (Nnadi). “The instruction from my own director, legal and prosecution of the EFCC, Mr. Chime Okoroma, is for me to appear with the DPP of the Federation who he said would be coming to court this morning to withdraw this charge on behalf of the Attorney General of the Federation. “When I got to the court this morning I did not see him (DPP) but I saw the name of the learned silk on the cause list. I approached him and he confirmed to me that he had been briefed by the office of the AGF. He (Nnadi) told me he has the fiat of the AGF which is already admitted as exhibit in this court. “He (Nnadi) put a call through to the DPP Federation whom I had the privilege of speaking with on the learned silk’s phone and he told me that the learned silk was going to withdraw the charge. “It is not correct to say that EFCC asked him to withdraw the charge. EFCC did not instruct me to come and withdraw the charge.” Ojogbane explained that the reason given by the the DPP for withdrawing the case was that the Sylva had similar charges pending against him before Justice Ahmed Mohammed of the same Federal High Court in Abuja. He said, “I can confirm that this charge is to be withdrawn this morning by the office of the DPP and the reason given was that there are two similar matters against the accused person in this court – one before your lordship and another one beofre Justice A.R Mohammed which has progressed more than the one before your lordship.” Sylva’s lawyer, Mr. Israel Olorundare (SAN), did not oppose the application for the withdrawal of the suit. He urged the court to strike it out as prayed by the prosecution but he also urged the court to order the release of his client’s passport which had been in the custody of the court since he was first arraigned in 2012. Olorundare also urged the court to restrain the EFCC from arresting Sylva based on the charges that were withdrawn. While Nnadi did not oppose the release of Sylva’s passport to him, the lawyer said the court could not possibly give any order in anticipation of his arrest. Justice Chukwu in his ruling struck out the case as he held that the Attorney-General of the Federation possessed the power under the constitution to delegate his power to issue a fiat as it was done in the case.
