Commends Appeal Court’s verdict

Osun State Government has commended the Court of Appeal for denying the All Progressives Congress (APC) the opportunity to relist the case on the Local Government matter in the state, saying that the imbroglio over the crisis has now been settled.

Reacting to the judgment delivered in Akure on Friday, the Commissioner for Information and Public Enlightenment, Kolapo Alimi, declared that the Court of Appeal judgment reaffirmed that the local government election conducted by Osun State Independent Electoral Commission (OSSIEC) in 2022 under the administration of Mr Gboyega Oyetola was unconstitutional, null and void.

Alimi maintained that, with the refusal of the appeal court to relist the case of APC, it shows that the judgement of the Federal High Court in suit No FHC/OS/CS//94/2022 which sacked the Osun APC Yes/No Chairmen and Councilors still subsists and binding on all those Chairmen and Councilors.

“To God be the glory that the political brigandage of APC under the leadership of Alh. Gboyega Oyetola, current Minister of Marine and Blue Economy has been legally destroyed.

“It is therefore, quite unfortunate that the pronouncement of the Court has never been ambiguous in all the cases before the court, to the extent that, there has never been any judgment that reinstated the Yes/No Chairmen in the first instance.

The APC led by former Governor Gboyega Oyetola inflicted on the people of Osun state (the most peaceful state in Nigeria) the unwarranted, unprovoked and unnecessary political crisis leading to loss of many lives and properties in the state.

“We therefore, call on Alhaji Adegboyega Oyetola and Osun APC to apologize to the good people of Osun state for the unwarranted and unnecessary chaos which they inflicted on the people of Osun state for the period it lasted.

“We use this opportunity to appreciate and thank the Judiciary for their courage and steadfastness in standing by the truth, justice and rule of law,” Alimi said.

On whether the chairmen and councilors of the Peoples Democratic Party (PDP) will resume to the council, Alimi said the government will wait for the certified true copy of the judgment and write the concerened stakeholders before they withdraw all the suits before the court.

The Court of Appeal sitting in Akure has reportedly struck out a request by the All Progressives Congress (APC) to relist its appeal against the Federal High Court judgment that nullified the controversial October 15, 2022 local government elections in Osun State.

OSUN DEFENDER reports that the Federal High Court sitting in Osogbo had nullified the election that produced the APC council chairmen.

However, there has been a political crisis since a Court of Appeal judgement which reportedly reinstated the APC council chairmen, according to the APC, a claim that the Peoples Democratic Party (PDP) has always debunked.

In a unanimous decision, Justice Peter Obiorah, who read the lead judgement on Friday, also condemned APC’s misrepresentation of its February 10, 2025 judgment.

The court reportedly clarified that it never reinstated the sacked APC chairmen, warning the party against distorting the court’s decisions for political gain.

The justices emphasized that the judiciary must not be treated as an extension of any political organization.
“It is a case of violenti non fit injúria, they cannot complain on a self-inflicted injury. Equity aids the vigilant, and not the indolent,” the Appeal Court held.

Justice Obiorah further held that “If they knew their tenure is just three years, and they went to sleep over their Appeal against their sack for two years, it is inconceivable.”

“There are three appellants with one joint Notice of Appeal, only one party is making an application to relist. Even if that one party can come alone, what are the reasons for bringing this application? If the APC is sincere, as a party that has many candidates affected by the Appeal, one wonders why they went to sleep and failed to transmit records on time in accordance with the law and the rules of the court.

“I draw attention to this fact in order to show that the 3rd appellant applicant (APC) who was pursuing the sister appeal based on the same facts and similar judgement of the same Judex, Ayo Emmanuel J, cannot claim ignorance for not compiling the records of Appeal or have any credible reason for abandoning the prosecution of this Appeal that was dismissed on the 13th day of January, 2025. The sudden attempt to resurrect this appeal through this same court will only lead to confusion and this Court will resist such attempt to lure it to unwittingly seat on Appeal in CA/AK/270/2022. Everything in this application shows that the third appellant has not shown good cause why this application should be granted. The fate that has befallen them is self-inflicted. It is therefore my conclusion that this Appeal lacks merit and it is accordingly, dismissed,” the judges reportedly ruled.

Meanwhile, the Certified True Copy of the judgement has not been released.

Osun PDP to APC: Leave us out of your problem with Asiri Eniba

Osun State Chapter of the Peoples Democratic Party(PDP) has called on the state All Progressives Congress(APC) to fulfill its promises to hired thugs deployed for the July 16th election, affirming that PDP has no agents of deaths like the APC and that the party is not involved in any attacks on APC offices.

In a statement signed by the state Caretaker Chairman of PDP, Dr Akindele Adekunle , the PDP urged APC to settle its internal problems involving its failure to settle Asiri Eniba and other imported thugs who were mobilized to hijack PDP strongholds and ensure maximum mayhem.

"We are shocked with all these rumours of attacks. What we heard is that after the arrest of Asiri Eniba and Rasheed Oko Ilu during the July 16 polls, Mr Oyetola and his team abandoned their recruited gangs. After the election, we were told nobody cared about the bad boys who were nurtured by them for fours years.

" We don't know but we learnt those boys were angry and they are going after Omowaiye and others who anchored the recruitment drive for the former Governor. How is that our business? We are in government and we are busy with how to deliver on our five point agenda to the good people of Osun state.

" Please tell them to talk to their political thugs.We are too busy with our 100 days programmes to be going after a failed Commissioner and a deceitful former Governor", the statement noted.

Forensic report admitted as exhibit today at the Osun Governorship Election Petition Tribunal affirmed Senator Ademola Adeleke duly won the July 16 election with 402,349 votes to beat Mr Gboyega Oyetola who polled 374,256.

The report which the Tribunal accepted as a key document posited that the above figures were arrived at after reviewing cases of irregulaties.

The forensic expert, Mr Samuel Oduntan posited that "pursuant to the Order of this Honourable Tribunal dated 2nd day of September, 2022 directing the 1st Respondent (INEC) to allow the 2nd Respondent inspect all the electoral materials used in the conduct of the Osun State Governorship Election, the 2nd Respondent instructed me to carry out the physical inspection as well as digital forensic examination on the BVAS machine devices used for the election.

Noting that he is familiar with all relevant Electoral Documents based on experience since 1999 viz: Voter Registers, Form EC8 series, EC25 Series, EC40 series, Ballot papers, other relevant electoral forms / Guidelines and electoral devices, Oduntan noted that the Respondent instructed him to carry out statistical analysis on the Independent National Electoral Commission’s (INEC) form EC8 Series used during the conduct of the election and also to carry out Digital Forensic Examination of the BVAS machines used in the conduct of election

"I examined the following documents (materials) / BVAS machices obtained from or supplied by INEC: CTC of Forms EC8A, EC8B, EC8C & EC8D ii) CTC of Forms EC40G (where provided) iii) INEC Osun State Directory of Polling Units, 2022 iv) BVAS Authentication Report v) BVAS Machines vi) INEC Regulations and Guidelines for the conduct of elections, 2022 and (vii) Manual for Election Officials 2022.

The report posited that of the 750 polling units being challenged by the petitioner, only six have issues as per over-voting as alleged in the petition with 771 votes of APC affected while affected votes of the PDP was 1, 022.

According to the report, votes of parties on EC8D were 375, 027 for APC and 403,371 for PDP. Less votes affected by irregularities are 771 for APC and 1, 022 for PDP.

According to the report, votes of parties after deduction was put at 374, 256 (APC) and 402, 349 (PDP).

Mr Oduntan who brilliantly defended the forensic report said the observations were reached in consonance with the global best practices required of a Statistician / Forensic Examiner in reaching the observations and discoveries made therein.

The oath of office was administered on the Governor by the State Chief Judge, Justice Oyebola Adepele-Ojo, around 11:47am.
Adeleke arrived the venue around 11:20am after which his deputy mounted the podium to take his oath before the governor took his turn.

I took my time to read the whole long epistles and I can see that they are all verifiable facts and figures most of the projects are facts, some people just decided to either hate oyetola because he’s Apc member,close to Tinubu or just hate him for the sake of it, but I know for a fact that if all the evidences of election malpractices against pdp and adeleke before the tribunal is concluded, adeleke won’t last 6 months as the governor of osun state, he lack the mental,and the intellectual capacity of a governor, I know deji his elder brother will have to relocate to oshogbo for the time being otherwise Jackson will be organising dancing competitions at the government house every weekend.

FAREWELL ADDRESS BY OSUN GOVERNOR, MR. ADEGBOYEGA OYETOLA, ON COMPLETION OF HIS FIRST TERM ON NOVEMBER 27, 2022

My Dear Good People of Osun,

As I step aside today following the conclusion of the four-year tenure you freely gave me, I thank God and I thank you for your support, cooperation and prayers over the years.

I recall how the journey began four years ago; how by your belief in me and your conviction in the plans and programmes of our Party, you exercised your right to vote for me.

Motivated by God’s promise, my conviction, we promised that we would serve you with steady heart and hands. We promised that we would hit the ground running once we assume office. We gave our words that we would put you first and run a people-centred government. We pledged to uphold the best ideals befitting of an Omoluabi.
As we draw the curtain on this first tenure, We are convinced that we neither reneged on our promises nor disappointed you. We kept faith with you and maintained fidelity with our electoral promises. It was our wish to continue to serve you but we are constrained by the outcome of the July 16 Governorship election which we are already challenging in court.
As a law-abiding citizen and government, we are stepping aside to allow the law take its course.

However, we look forward to continue to serve you in no distant future. We have absolute trust in God that we shall be back soon, as we have implicit trust and confidence in the judiciary to do justice in the case before it.

We are confident that this period of temporary political eclipse shall pass. The sun shall shine again, brighter and warmer and the sustainable development and participatory governance that we enthroned, which have been applauded by local and international organisations, shall be restored and put on a surer and better footing.

There can be no substitute to people-oriented and development savvy governance in a democracy. The tap roots of the unprecedented good governance, inclusive and participatory governance that we introduced, which delivered massive equitable projects and programmes are too strong to be uprooted.

My Dear Good People of Osun, I cannot thank you enough for not only supporting us throughout our tenure but for also standing by us even after the outcome of the July 16 election. Your goodwill encouraged us to continue with all our projects till the last day.

Let me reiterate here that in this first tenure, we were able to take care of the fears and evil of fiscal indiscipline and lack of implementation, which hamper projects and services in the nation’s public service. This can be seen in the myriad of people-centred and masses-focused projects we delivered for the use of the people of the State in this first term.

We proved that infrastructure and economic development are doable in a depressed economy and that stagnated development in a struggling economy is a product of intellectual laziness, dearth of creativity, shortage of innovation and lack of political will.
The laudable and people-centred projects we were able to deliver include the feeding of 30,000 vulnerable persons in Osun on a monthly basis through the Osun Food Support Scheme and financial support for the aged and widows; opening up of the Mining sector that attracted big investors to the state; reforming of the educational sector, including the recruitment of 2, 500 teachers; review of the single school uniform regime among others in line with the demand of the people; renovation of school buildings, distribution of educational materials to our pupils, provision of free education and free meals to them as well as training and re-training of our teachers to provide quality education for our children to enhance their performance as leaders of tomorrow.

In order to increase access to quality and equitable education at all levels with a view to empowering Osun citizens to realise their full potential, we upgraded the existing Osun State College of Education, Ilesa to a full-fledged University of Ilesa, with a world-class funding strategies that would not exert unnecessary pressure on the finances of the State; fixing of the State Specialist Hospital, Asubiaro and equipping same with state-of-the-art equipment, where we constructed120-bed ward and 30 units of Doctor’s Quarters; rehabilitation of the Ejigbo and Ifetedo General Hospitals; we also instituted the Osun Health Insurance Scheme (OHIS) to deliver affordable healthcare to our workers while offering free health services to the vulnerable under the scheme; revitalization of 332 Primary Health Centres -one per ward across the State.
We constructed, reconstructed and rehabilitated rural and township roads to open up our rural areas, help our farmers to transport their produce to the market and generally bring equitable development to our State. Apart from the Olaiya Flyover, which is an architectural masterpiece, a paragon of aesthetics and a socioeconomic signature on the economic transformation captured by the Development Agenda we exchanged for the mandate of our people, other major roads that were touched by our administration are: Ada-Igbajo road, Osogbo-Kelebe-Iragbiji road, and Akindeko-Awosuru link road via Adejumo Street with Oremeji spur, Akinlade Street, Adewale Street with loop to WAEC road all in Osogbo; Army Barack (Ede)-Ara-Ejigbo township road, Moro-Yakoyo-Ipetumodu-Asipa-Ife/Ibadan Expressway Junction Road and Ereja Roundabout-Ereguru-Isaare-Oke Oye-Sabo (Irojo)-Ilesa/Akure Expressway Junction.

Others are: Lawyer Atanda Road, Iwo; Ila-Arandun-Kwara Boundary Road; Nike Gallery – Ido – Osun Township airport with palace spur; Ikirun – Eko-Ende Road; the access road to Fountain University, Osogbo; Osogbo (Lameco)-Okinni-Ilobu – Ifon Osun Market with Spur to Olobu’s Palace; Osogbo/Ilobu-Akari-Erin Osun Roundabout on Osun LCDA Junction; Post Office-Ayetoro – Jamodo – Ifon Palace – Janta Ifon Osun; Isale-Asa-Oke Aree road, Iree, as well as Ikire township roads among other interventions. There are however a few other roads that are still on-going, while some are nearing completion. Among these roads are: Ife Township Roads; Inisa Road and Osogbo-Iwo Road among others. We did all these because fixing our State’s infrastructure deficit is a critical item on our Development Agenda. This is because no economy can truly succeed without adequate infrastructure to make life easy for residents and businesses.

We also restored the lost glory of our civil service and ensured that workers’ salaries are not only promptly paid but continued to pay minimum wage despite the devastating effect of COVID-19 pandemic. We stood tall among comity of states in the fight against COVID-19.
We also resolutely defended and prioritised the welfare of workers and pensioners. For this first term, we expended over N50 billion to cater for our senior citizens to settle their pensions and gratuities. We remitted the contributory pension as and when due, and we were at the same time reducing the backlog we inherited from the previous administration. By and large, we were able to stabilise the economy of the State under our leadership.

We never toyed with the security of our people as we cooperated with other States in South-West to set up Amotekun to support the conventional security agencies in order to further secure our State.

We also launched the Osun Youth Policy Document to take care of the present and future of our younger generation, just as we injected over N2billion into the economy through the Osun Microcredit Agency to empower our market men and women.

From a little above 10billion in 2018, we have been able to grow the State IGR N20billion, just as our performance in the World Bank’s States’ Fiscal Transparency, Accountability, and Sustainability (SFTAS) has continued to earn us accolades and financial benefits.
In 2018 before we came into office, Osun was placed 32nd on the fiscal sustainability index, finishing just ahead of Taraba, Plateau, Adamawa, and Kogi states.

However, by the latest ranking in 2021, we have climbed to the 19th place on the index, as we are now ranked 13th out of 36 states of the federation.

As we end our first term, rest assured that Osun is more stable economically than we met it in 2018 and it remained the most peaceful state in the country under our leadership.

For four years, we did not take any bank loan facility. But we benefitted from the N3billion monthly intervention from the federal Government to all the States for six months to cushion the effect of deductions of budget support facility and salary bailout accessed by the previous administration, just as we have paid N97 billion from the total debt we inherited in 2018.

We are leaving behind cash of over N14 billion. In addition to the N14 billion cash, another N8 billion is being expected between December and January from our performance in SFTAS and the IGR. Also, another Seventy-Two million Dollars will come to the State soon from RAMP 3, NG-CARES, Nigeria for Women Project and Ease of Doing Business. These are earned, based on performance. And we have indeed performed to earn them. It was part of the same performance that earned us the award of Best Governor on Efficiency of Public Expenditure and TOP Performer on Domestic Revenue Mobilisation by the World Bank’s States’ Fiscal Transparency, Accountability and Sustainability, SFTAS, recently.

We have gone this length to let you know that Osun under our leadership was sustainable. It was done through fiscal discipline and personal sacrifices.

On behalf of our team, I appeal to you all to continue to be law abiding and to work assiduously to build the Osun of our dream. Together, we shall continue to mend the broken walls of our dear State and restore her glory for our collective good and that of posterity.

Governor Adegboyega Oyetola of Osun on Saturday disclosed that his administration is leaving behind for the incoming government a total sum of N14billion cash in the State’s coffers.

Oyetola also revealed that his government had successfully paid N97billion from the total debt inherited in 2018 when he assumed office.

He disclosed that his administration didn’t borrow a dime anywhere in the world to finance the economy of the State, saying he successfully kept faith and maintained fidelity with his electoral promises since the assumption of office.
Governor Oyetola was sworn in on 27th November, 2018 taking over from his predecessor, former Governor Rauf Aregbesola.

The results of the last governorship election as declared by the Independent National Electoral Commission (INEC) favoured Senator Ademola Adeleke, a decision that is already being challenged by Oyetola and his party — the All Progressives Congress, APC — at the Osun State Governorship Election Petition Tribunal, sitting in Osogbo.

Oyetola in his address, averred that his administration has put Osun’s economy on a surer footing through the myriad people-centred and masses-focused projects timely and promptly implemented to make life worthwhile for the people of the State.

According to him, Osun under his watch has been stable economically as manifested in the astronomical increment in the GDP of the State since he assumed office.

Governor Oyetola affirmed that Osun is more stable economically than he met it in 2018, saying despite all the visible socio-economic challenges confronting the State with its attendant effects, he was able to take care of the fears and evil of fiscal indiscipline and lack of implementation, which hamper projects and services in the nation’s public service.
“As I step aside today following the conclusion of the four-year tenure you freely gave me, I thank God and I thank you for your support, cooperation and prayers over the years.

“I recall how the journey began four years ago; how by your belief in me and your conviction in the plans and programmes of our Party, you exercised your right to vote for me.

“As we draw the curtains on this first tenure, we are convinced that we neither reneged on our promise nor disappointed you. We kept faith with you and maintained fidelity with our electoral promises. It was our wish to continue to serve you but we are constrained by the outcomes of the July 16 Governorship election which we are already challenging in court.

“As a law-abiding citizen and government, we are stepping aside to allow the law take its course.

“However, we look forward to continue to serve you in no distant future. We have absolute trust in God that we shall be back soon, as we have implicit trust and confidence in the Judiciary to do justice in the case before it.
“We are confident that this period of temporary political eclipse shall pass. The sun shall shine again, brighter and warmer and the sustainable development and participatory governance that we enthroned, which have been applauded by local and international organizations, shall be restored and put on a surer and better footing.

“There can be no substitute to people-oriented and development-savvy governance in a democracy. The tap roots of the unprecedented good governance, inclusive and participatory governance that we introduced, which delivered massive equitable projects and programmes are too strong to be uprooted.

The life and times of the former Head of interim National Government, Chief Dr. Ernest Adegunle Oladeinde Shonekan has been brought to a halt and his body was laid to rest today, 04 February 2022. The funeral service in honour of the Late Patriarch took place at the Cathedral Church of Christ, Marina, Lagos and was graced by eminent church prelates of our National church, ably led by the Metropolitan and Primate of All Nigeria, His Grace, The Most Revd Henry Ndukuba, accompanied by Mama Nigeria, Mrs. Angela Ndukuba and The Archbishop of the Ecclesiastical Province of Lagos, The Diocesan and Missioner, The Most Revd. Dr. Humphrey Bamisebi Olumakaiye and Mama Lagos Province, Prof.(Mrs.) Motunrayo Olumakaiye, were present.
In his sermon, the Former Primate of the Church of Nigeria, Anglican Communion, His Grace, The Most Revd. Dr. Peter Jasper Akinola described late Shonekan as a notable Captain of Industry, a guru of the boardroom and a resourceful and successful elder Statesman. The erstwhile Bishop of Lagos and Dean Emeritus, Church of Nigeria, Anglican Communion, the Most Revd. Dr. Ephraim Adebola Ademowo and other Bishops were present at the service.
The Federal Government delegation was led by the Vice President, Prof. Yemi Oshinbajo, SAN. Former President, Dr. Goodluck Ebele Jonathan, GCFR, GCON, General Yakubu Gowon(Rtd) & wife, Boss Mustapha, Mr Babajide, Prince Dapo Abiodun, Mr. Godwin Obaseki, Sen. & Mrs. Ibikunle Amosun, Sen. Rabiu Kwankwaso, Alhaji Lai Mohammed, Arc. Olamilekan Adegbite, Adeniyi Adebayo, Sen. Olorunminbe Mamora, Muazu Jaji Sambo, Dr. Charles Akinola and other notable personalities attended the funeral to bid the late Icon farewell.
His remains was laid to rest at the Ebony Vaults, Ikoyi, Lagos. May his
soul rest in the bossom of the Lord and may God grant the entire nation the fortitude to bear the colossal loss.
