A former student of Hillcrest School, Jos, has dragged the school authorities before a Jos Federal High Court, demanding N100m as damages over the `deliberate cancellation’’ of his admission.

The minor, who sued the school through his friend and guardian, Mr Steve Gukas, accused Hillcrest School management of breaching his fundamental human rights to education by denying him the opportunity to continue his studies in the school.

The News Agency of Nigeria reported that joined in the suit are the Registered Trustees of Hillcrest School, Jos, and Mrs Anne Lucasse, the Principal, as 1st and 2nd respondents respectively.

When the case came up before Justice Musa Kurya, the Judge, on Thursday, the minor, through his counsel, Mr Silas Onu, in an Originating Motion, prayed the court to declare the management’s action as “contrary, and in violation of the African Charter on the right and welfare of the child.’’

Onu told the court that the minor was rightly admitted into the school, but that on September 10, 2017, the management “blatantly and illegally cancelled his admission because he was said to have an allergy for nuts.

The school had claimed that they could not manage that allergy.

The lawyer argued that the health challenge of the plaintiff was well known to the school management before the admission since it was captured in the medical report obtained from the Jos University Teaching Hospital.

“Because of the physical and mental torture the minor has suffered as a result of the unlawful, illegal, immoral, discriminating and unjustifiable cancellation of his admission, we are demanding the sum of N100m being general and exemplary damages.

“My Lord, we are urging the court to give a mandatory injunction compelling the respondents, jointly or severally, to immediately pay the said amount to my client,’’ he said.

But the counsel to Hillcrest, Prof. Clement Dakas (SAN), objected to the claims of the minor and challenged the jurisdiction of the court to entertain the matter.

Dakas said Hillcrest School was not a federal institution and could not, therefore, be sued in a Federal High Court, arguing that the case should be dismissed since it was lacking in merit.

“My Lord, I want to point out that the application does not fall under the ambit of this court because Hillcrest School is not a federal institution.

“By law, this court lacks the jurisdiction to hear such an application. I hereby urge the court to dismiss it for lack of merit and with cost against the applicant,” Dakas pleaded.

In response to Dakas’ claim, however, Onu argued that the court had the jurisdiction to hear fundamental human right cases, especially when they affected the African Charter and the right and welfare of a child.

Justice Kurya, after listening to the arguments of the two counsels, adjourned the case till Sepember 28 for ruling on the issue of jurisdiction.

There was commotion in Akute Odo, in the Ifo Local Government Area of Ogun State, after a 62-year-old man, identified only as Wadada, allegedly defiled a five-year-old girl.

PUNCH Metro learnt that the victim, who stayed with her mother in a church, had gone to fetch water at the suspect’s borehole, when she was defiled.

He was alleged to have pacified her with N20.

The victim’s mother, upon seeing the money, reportedly queried how she came about it and she confessed that it was given to her by the suspect after defiling her.

Wadada was reportedly seized by some angry residents, who dragged him before the traditional ruler of the community.

A resident, who spoke on condition of anonymity, said the victim’s mother was asked to allow the community handle the case.

He added that the single mother was threatened with eviction from her church abode if she went public with the matter or reported to the police.

The resident noted that the suspect had been caught many times in the past for a similar offence.

He said, “The girl’s father is late. She stays with her mother in a church in the neighbourhood. The man has a borehole around the church, where he sells water to people.

“The girl was sent on an errand when he lured her on Friday. He inserted his fingers into her private parts and broke her hymen, as blood gushed out. He tried to use a piece of cloth to clean up the blood and gave her N20.

“When she returned home, her mother saw the money and asked where she got it from. She said Wadada gave her. She asked what she did for him to warrant such a kind gesture. She did not want to talk initially, but later opened up. Her mother opened her pants and found bloodstains in her private parts.”

The source said when the suspect was challenged, he owned up to the crime.

He was allegedly taken before the traditional ruler of the community.

PUNCH Metro learnt that the victim’s mother was asked not to inform the police, as she also confessed helplessness over lack of funds.

A source alleged that Wadada, who hailed from Ogun State, was a serial child molester, adding that he was protected by the community because he was a native.

“The last time he was caught, he was asked to sign an undertaking that if he was caught again, he would be banished from the community and he would forfeit his property.

“So, when he was caught this time, the community appeared to be more interested in banishing him and selling off his property than giving the victim justice and maybe compensation.

“The community leaders have been telling the mother to allow them handle it the traditional way. The woman also agreed because she did not know the implication of what the man did to her daughter,” the source added.

Some residents were reported to have counselled the mother and assisted her with transport fare to the nearest police station.

Our correspondent gathered that there were pressures on the police to drop the case against the suspect.

A rights lawyer, Okere Onyekachi, said he spoke with the Divisional Crime Officer and the Investigating Police Officer, adding that they assured him that justice would be done.

He said, “The IPO told me that they would not drop the case because they also got information that it was the eighth time that he would be committing the offence.

“I told them that the offence was against the state and they should not allow anything to sway them from the path of justice. The police said they would do their best because they even foot the bills for the medical tests.”

PUNCH Metro learnt that the case had been transferred to the State Criminal Investigation and Intelligence Department, Eleweran, Abeokuta.

Efforts to get the state police spokesperson, Abimbola Oyeyemi, to react to the story since on Monday were abortive.

He had also yet to respond to enquiries on the incident on Thursday.

But the Zonal Police Public Relations Officer, CSP Dolapo Badmos, confirmed the case, saying it had been transferred to the SCIID, Eleweran.

“We learnt that it was not his first time, although the previous cases were not reported to the police. He usually tricked his victims with small things. We will ensure justice is served. The case has been transferred to the SCIID, Eleweran,” she added.

The national leadership of the Peoples Democratic Party met in Abuja on Thursday over the conduct of the rerun governorship election in Osun State.

While rejecting it, the party also said that the Thursday election was one of the worst days in the history of Nigeria.

It described the election as a black day for the nation.

The National Chairman of the party, Prince Uche Secondus, spoke at an emergency meeting after the meeting of members of the PDP National Working Committee.

He lamented that Osun State was put under siege and the citizens’ right trampled upon by security agents, whom he said were backed by both the All Progressives Congress and the Independent National Electoral Commission officials.

He expressed concern that if what took place in Osun State was what would take place in 2019, then the future of Nigeria’s democracy “is bleak and the nation sliding into crisis.”

He said, “What we have witnessed in Osun shows clearly that the All Progressives Congress is not ready for an election and we are afraid that President Muhammadu Buhari will not hand over if he loses the election next year.

“Today, we are all aware of the rerun election in Osun State as we address the press conference. We, the members of the National Working Committee, have reviewed what has happened from the distribution of materials to the actual voting in some of the units and wards.

“We found that Osun is under siege. Therefore, today is a black day for Nigeria.

“We would think that it is a state or some units, but if you look at what has transpired so far from Ekiti to Osun State, Nigerians are groaning in pains especially the Osun people.

“The right of the citizens to be able to come out and vote had been trampled upon and the entire state and the wards and units have been seized by the security agencies who were acting on behalf of the APC to make sure the election is rigged by all means.

“We are sad that if this is what is going to take place in 2019, then the future of Nigeria’s democracy is bleak and we are sliding into crisis.”

Secondus challenged INEC to rise above what happened in Osun and declare the PDP candidate as the winner of the election.

He also called on the commission to immediately cancel the elections in all the units where security agencies seized the Permanent Voter Cards of PDP members and also where their members were prevented from voting.

In his reaction, the Deputy National Chairman (South-West), Dr Eddy Olafeso, noted that security agents colluded with the APC people by allowing those wearing uniform bearing the APC governorship name to vote.

He alleged that in Orolu and Garage Olode and some of the units, the PVCs of PDP members were seized and INEC members of staff were induced with cash, which he said they could not refuse.

The Imo State police command has arrested three men for armed robbery and rape.

Marcel Chibuzo Iwuchukwu, 21, Agim Ugochukwu, 22, and Ifeanyi Chukwu, 23, were arrested in the act, on the 24th of August, 2018, following a distress call from Laurel Suite hostel behind Imo State University.

The suspects specialized in armed robbery and rape of innocent victims within the area. One locally made shotgun and other exhibits were recovered from them.

The Inspector-General of Police Special Intelligence Response Team has arrested a suspected bank robber, Olatunde Adetunji, in the Isolo area of Lagos State.

A trader, Bashirat Akinmushire, aka Area Mother, who allegedly kept weapons for Adetunji and his gang members, was also arrested by the police team.

Both Adetunji and Akinmushire were said to be members of the Eiye Confraternity.

PUNCH Metro learnt that the gang specialised in robbing bank customers in the Ikeja and Isolo areas.

The suspects were alleged to have recently attacked and dispossessed a woman on her way to depositing money in a bank at Opebi, Ikeja.

Adetunji was reportedly arrested a few days later when the woman allegedly sighted him on Toyin Street, Ikeja.

She was reported to have raised the alarm as operatives of the IRT, who raced to the scene, apprehended the 31-year-old.

The suspect, during interrogation by the police, allegedly confessed that members of his gang usually carried out robberies and cult killings in the Ikeja and Isolo areas.

Adetunji also allegedly said the guns they used during operations were kept with Akinmushire.

A police source told our correspondent that the suspect led detectives to a market on Jakande Low Cost Housing Estate, Isolo, where Akinmushire was arrested.

However, the trader reportedly claimed to have passed the weapons to another member of the gang, identified only as Junior, aka Jungle.

“When she was asked to take the operatives to Junior’s house so he could be arrested and the weapons recovered, she misled the policemen and took them to a wrong location, where she also attempted to escape.

“She ran into a ditch in the process and sustained serious injuries, which made the policemen to stop their search and take her to a hospital,” the source said.

Adetunji said his gang usually paid Akinmushire N5,000 to keep weapons for them.

He said, “I am a member of the Eiye Confraternity and I joined the cult while at a university in Ogun State. When I dropped out, I came back home to join members of my cult on Jakanda Estate and I discovered that they had already procured an AK-47 rifle and a revolver pistol.

“They told me that they bought the guns from a soldier and they usually kept them at Area Mama’s shop, who is also a member of our cult. She normally hides the guns at the back of her shop where she sells pepper and tomatoes.

“She covers the guns with baskets and sacks. We have used the guns for several operations and we used to give her N5,000 after every successful operation. But the main thing we do with the guns is to fight our opponents, who are rival cult members.”

Akinmushire, in her statement to the police, said the gang forced her to keep the weapons because she was a member of their.

The mother of three said she did not know what the gang did with the guns.

She said, “Sometime in February 2016, Olatunde (Adetunji), Junior, and their friend started brining one Ghana-must-go bag containing some items which I did not know the content, to my shop. They usually bring the bag for me to keep for them.

“Initially, I did not know the content, but I asked them what was in the bag and they told me. They said I should not disclose it to anybody. Each time they came to pick the bag, they gave me N5,000 or more. I asked them what they were using the guns for, but they said it was none of my business.

“I know Olatunde and his friend belong to Eiye cult. I also belong to the same cult. But the guns in question are with Junior and their gang members and the reason I did not inform the estate management or security agencies was that they threatened me that if any third party got to know, they would kill me. I have never gone with them for any operation; I only keep their guns for them.”

The Force Spokesperson, Jimoh Moshood, had yet to respond to an enquiry sent to him as of the time of filing this report.

A barber, Tajudeen Erinosho, has been arrested by operatives of the Lagos State Police Command for allegedly attempting to swindle a trader out of N150,000.

The 43-year-old and others at large reportedly demanded the sum from the complainant, Rosemary Muritala, on the pretext of removing a curse on some dollars in their car.

PUNCH Metro learnt that Muritala boarded the car going to the Lagos Island, unknown to her that occupants of the vehicle were fraudsters.

It was gathered that the driver diverted and headed for the Ogba area of Lagos.

Our correspondent was told that Erinosho, who claimed that there were dollars in the car, called an herbalist on the telephone to join them in the car.

The herbalist was said to have demanded money from the passengers under the pretext of removing the curse on the dollars.

The victim, who noted that she did not know when the driver got to Ogba, said the sum of N150,000 was demanded from her.

She said, “As they stopped the car, Erinosho came down to call an herbalist to cleanse the dollars inside the boot of the car. The herbalist sat with the driver on the front seat and Erinosho came to join us at the back.

“The herbalist started rolling the spiritual materials in his hand. He said every one of us should contribute money to remove the curse on the dollars.

“Erinosho gave the herbalist N2,000; the other occupants gave N1,000 and the driver paid N8,000. The herbalist turned to me and said that he needs about N80,000 to N150,000 and I told him that I did not have the money and they should let me go.

“The herbalist told me to give them the money on me, but I told them that I did not have any money on me. They opened the door for me to come down from the vehicle.”

Muritala said Erinosho came down with her and crossed to the other side of the road to board a tricycle.

She said she quickly raised the alarm and a police officer arrested the suspect.

Erinosho was arraigned before an Ogba Magistrates’’ Court on three counts bordering on conspiracy and stealing.

He pleaded not guilty to the charges.

According to the police prosecutor, Kenrich Nomayo, the offences contravened sections 411 and 406 of the Criminal Laws of Lagos State 2015.

The charges read in part, “That you, Tajudeen Erinosho, and others still at large, on September 15, 2018, around 2.30pm, on College Road, Ifako Ijaiye, Ogba, Lagos, in the Lagos Magisterial District, did conspire together to commit felony, to wit: obtaining money under false pretences and stealing, thereby committing an offence punishable under Section 411 of the Criminal Law of Lagos State 2015.

“That you, Tajudeen Erinosho, and others at large, on the same date, time and place, in the aforementioned magisterial district, did attempt to commit felony to wit, stealing by diverting one Rosemary Muritala from her right route to another direction, and forcefully demanded the sum of N150,000 from her, thereby committing an offence punishable under Section 406 of the Criminal Law of Lagos State 2015.”

The magistrate, T.O. Ojo, granted the defendant bail in the sum of N100,000 with two sureties in like sum, adding that the sureties must be gainfully employed and provide means of livelihood.

She added that the sureties should show evidence of tax payments to the Lagos State Government.

The case was adjourned till October 10, 2018.
