LAGOS—The All Progressives Congress,
yesterday, rejected the impeachment of Ondo
State Deputy Governor, Alhaji Ali Olanusi,
stressing that the process of his removal
violated provisions of the impeachment clause
in the 1999 Constitution.
The party added that the decision of the State
House of Assembly was a contempt of court
that ordered all parties to maintain status quo
in a suit the deputy governor filed before he
travelled out to challenge the plan to impeach
him.
The party’s National Vice Chairman in charge
of South-west, Chief Pius Akinyelure faulted
Olanusi’s impeachment in a statement he
issued in Lagos, noting that the decision of
the state assembly would not stand.
Akinyelure described the impeachment process
as a mockery of constitutional order, which he
said, Governor of Ondo State, Olusegun
Mimiko and all members of the State House of
Assembly were sworn in to uphold.
He lamented that despite the decision of a
High Court sitting in Akure that all parties
should maintain status quo until substantive
suit is determined, the legislative arm of the
state went ahead to impeach the deputy
governor.
Akinyelure said the House of Assembly
committed three different infractions to the
1999 Constitution in the process of the deputy
governor, who had travelled out of the country
for medical check-up before impeachment
procedures started.

APRIL 27, 2015 : ETIM EKPIMAH, Uyo
An Akwa Ibom State High Court has
convicted and sentenced a former
commissioner, representing Akwa Ibom State
on the board of the Niger Delta Development
Commission, Pastor Godwin Eyo, to three
years imprisonment.
Eyo was accused of stealing 56 transformers
meant for oil producing communities in the
state.
The accused was prosecuted by the Economic
and Financial Crimes Commission on 56
counts bordering on stealing and conversion
of 56 electricity transformers released to him
by NDDC for distribution to communities in
Akwa Ibom State.
On Monday in Uyo, he was found guilty on 37
of those counts by Justice Idongesit Ntem-
Isua and sentenced to three years
imprisonment on each of the counts.
He was however discharged and acquitted on
19 counts. The sentences are to run
concurrently.
The convict was said to have applied for 90
electricity transformers and four generators
from NDDC for Akwa Ibom State sometime in
February, 2006.
Approval was given for 70 transformers but
he allegedly diverted same to his house in
Eket on the pretext that there was no space
to accommodate the newly issued 70 units of
transformers at the NDDC office in Uyo.
He was thereafter said to have sent only 14
Units to NDDC office in Uyo while he withheld
56 units which he could not account for till
date.
The price of the 56 transformers are put at
N220, 176,320.
One of the counts reads, “That you Pastor
Godwin Moffat Eyo being a former Akwa
Ibom State representative on the Board of the
Niger Delta Development Commission (NDDC)
on or about 14th April, 2006 at Uyo in the
Uyo Judicial Division did fraudulently steal a
300 KVA/33/0.415 Transformer Serial No.
1712496 valued at Four Million, Eighteen
Thousand, Five Hundred and Sixty Naira
(N4,018,560.00), property of NDDC and
thereby committed an offence of stealing
contrary to Section 399 and punishable under
Section 404 of the Criminal Code Cap. 38,
Volume 2, Laws of Akwa Ibom State, 2000.”

Youths of the oil producing Niger Delta region
have warned the in-coming administration of
Major General Muham-madu Buhari against
reducing the Niger Delta Development
Commission, NDDC, to a parastatal under the
Ministry of Niger Delta Affairs.
The warning came against the backdrop of the
alleged plan by the next government to
implement the recommendations of the Steve
Oransaye Committee Report on the
rationalization and merger of some Federal
Government Ministries, Departments and
Agencies, MDAs.
Rising from a meeting in Warri, Delta State, at
the weekend, a coalition, comprising 26 youth
and ex-militant groups under the aegis South-
South Mandate, vowed to resist any move
that could impede the rapid transformation of
the region currently being undertaken by the
NNDC.
According to the youths, in a communiqué
signed by the Chief Convener, Mr. Victor Akpe,
making the NDDC a parastatal under the
Ministry of Niger Delta Affairs would mean
bogging the commission’s projects down with
civil service bureaucracy.
“In as much as we grudgingly decided to allow
peace to reign after we were dubiously and
maliciously rigged out of the presidency, our
reluctant acceptance of that faulty March 28,
2015 electoral abracadabra over a sitting
President from Niger Delta, a charade never
recorded in the history of electoral contest in
Nigeria, should not be misconstrued as
capitulation by the youth of Niger Delta, now
galvanized under the South-south Mandate,
SSM,”the youths said.
“While we are still evaluating the import of
March 28, 2015 presidential poll robbery
through a well-orchestrated regional gang-up,
procedural compromise and massive
intimidation of the electorate in some parts of
the country, we shall vehemently resist further
humiliation and annihilation of our people”.
The youths noted in the communiqué which
was made available to newsmen in Abuja, that
as the closest government interventionist
agency to the poor and neglected people of
the Niger Delta region, they would not tolerate
any attempt to further suffocate the NDDC
since it remained the only government agency
that has direct impact on the oil bearing
communities.
“Niger Deltans shall no longer allow their
interest to be subjugated and trampled upon
by the Federal Government of Nigeria under
whatever guise”, they added.
They contended that if part of the reasons for
the planned merger was based on some
frivolous complaints of non-performance
against the agency by some disgruntled
individuals, the Federal Government should be
held responsible for its refusal to release over
N700billion statutory funds owed the agency
which would have gone a long way in
executing its projects and programmes.
While emphasizing that the NDDC must be
allowed to function independently under the
presidency as presently constituted and be
allowed to continue to draw its funding from
the current First-Line charge, the youths
warned that they neither issue threats without
a cause, nor strike without exhausting all
possible channels of consultation and seeking
redress. Rather than merge the commission
with the ministry, the youths urged the
incoming Buhari adminis-tration to release the
entire N700 billion being owed it and ensure
prompt release of its funds, subsequently.

Chris Olukolade says Boko Haram members
have resorted to using bows and arrows to
carry out their attacks after running out of
arms & ammunition. Olukolade said this while
speaking to newsmen in Abuja today April
23rd.
"The Boko Haram terrorists have run out of
arms and ammunition because the usual
supplies they get are not forthcoming. They
now have only bow and arrows, machetes,
daggers and other local weapons. You can
find more than 500 of them with only few
having rifles and even when one or two of
them have rifles, they have no ammunition. I
am optimistic that the military will succeed in
killing many of these insurgents who have
been terrorizing residents for the past three
years.”he said

Socio-Economic Rights and Accountability
Project (SERAP) has requested the Prosecutor
of the International Criminal Court Mrs. Fatou
Bensouda to use her “good offices and
position to investigate allegations of hate
speech by the Zulu King Goodwill Zwelithini,
which has resulted in killing, violence and
discrimination against Nigerians and other
African citizens living in South Africa, as well
as the complicity/negligence of the country’s
law enforcement agencies to prevent these
crimes against civilian population.”
The organisation also urged her to “bring to
justice anyone who is responsible for these
international crimes prohibited under the
Rome Statute of the International Criminal
Court.
In the petition dated 23 April 2015 and signed
by SERAP executive director Adetokunbo
Mumuni the organisation said that it
“considers the use of speech by the Zulu King
to promote hatred and/or incite violence
against non-nationals such as Nigerians,
particularly in the media as a clear violation
of the provisions of the Rome Statute of
International Criminal Court.
“Grave statements by political leaders/
prominent people that express discrimination
and cause violence against non-nationals
cannot be justified under any law. This hate
speech generated fear and hatred that created
the conditions for violence and discrimination
against Nigerians and other African citizens.
SERAP believes that this has given rise to
individual criminal responsibility under the
Rome Statute of the International Criminal
Court,” the organisation said.
The organisation argued that, “the statement
by the Zulu King amounts to a harmful form
ofexpression which incites or otherwise
promotes hatred, discrimination, violence and
intolerance. We are seriously concerned that
crimes against humanity are often
accompanied or preceded by the kind of
statement made by the Zulu King.”
“Once the climate of violence has been
created, direct and public incitement to crimes
builds on it, exacerbating the situation by
further heating up passions and directing
South Africans’ hatred towards non-nationals
such as Nigerians. Hate speech by King Zulu
is legally tied to contemporaneous, large-scale
violence and inhumane and discriminatory
treatment of Nigerians and other African
citizens,” the organisation also argued.
The organisation also said that, “The
statement by the Zulu King has contributed to
a climate of fear, demonization and
dehumanization of Nigerians and other African
citizens, thus violating their human dignity
through humiliation and expulsion from the
human community. SERAP is seriously
concerned that hate speech by the Zulu King
amounts to crime against humanity of
persecution and has directly contributed to an
infringement of the right to life, equality and
non-discrimination of Nigerians and other
African citizens.”
“SERAP considers the statement by the Zulu
King and the apparent complicity/negligence
by the country’s law enforcement agencies to
prevent the violence and discrimination as
amounting to active encouragement of South
African citizens to develop feelings of
contempt for Nigerians and other African
citizens; as amounting to incitement to
violence and discrimination against Nigerians
and other African citizens, and to mistreat
them; and as amounting to an appeal for
South African citizens to separate themselves
from Nigerians and other African citizens,” the
organisation further stressed.
“The statement by the Zulu King and the
apparent complicity/negligence by the
country’s law enforcement agencies to prevent
the violence and discrimination has
contributed to the level of persecution against
Nigerians and other African citizens.
According to Professor Bassiouni, persecution
in this instance is “a state action leading to
the infliction upon an individual of
harassment, torment, oppression, or
discriminatory measures, designed to or likely
to produce physical or mental suffering or
economic harm, because of the victims’
beliefs, views, or membership in a given
identifiable group (such as non-nationals),”
the organisation also said.
The petition further reads:
“In the Mugesera case, the Canadian Supreme
Court held that hate speech may constitute
persecution, even if it does not result in the
commission of acts of violence. In arriving at
this conclusion, the court considered that a
link was demonstrated between the speech at
issue and the widespread or systematic attack
against the civilian population. Thus, the
post-World War II jurisprudence generally
establishes that hate speech not urging an
audience to commit imminent violence can
constitute persecution.”
“The government does not have the political
will to bring those suspected to be responsible
for crimes under international law to justice.
Given the complicity/negligence by the
country’s law enforcement agencies to prevent
the violence, killing and discrimination, it is
unlikely that the government will take any
serious action to bring perpetrators to justice.”
“Without accountability for these serious
human rights crimes, the victims will continue
to be denied access to justice, and impunity of
perpetrators will remain widespread and the
result will continue to be a vicious cycle of
violence and discrimination against Nigerians
and other African citizens living in South
Africa.”
“SERAP believes that substantial grounds
exist to warrant the intervention of the
Prosecutor in this case. Under Article 17 of
the Rome Statute, the Court is a court of last
resort, expected to exercise its jurisdiction
only if states themselves are unwilling or
unable genuinely to investigate and prosecute
international crimes. Also, pursuant to the
Rome Statute, the Prosecutor has power to
intervene in a situation under the jurisdiction
of the Court if the Security Council or states
parties refer a situation or if information is
provided from other sources such as the
information SERAP is providing in this case.”
On the basis of the above, SERAP asks you to:

Urgently commence an investigation proprio
motu on the allegations of hate speech and
the accompanying killing, violence and
discrimination against Nigerians and other
African citizens living in South Africa, with a
view to determining whether these amount to
international crimes within the Court’s
jurisdiction. In this respect, we also urge you
to invite representatives of the South African
government to provide written or oral
testimony at the seat of the Court, so that the
Prosecutor is able to conclude on the basis of
available information whether there is a
reasonable basis for an investigation, and to
submit a request to the Pre-Trial Chamber for
authorization of an investigation.
Bring to justice those suspected to be
responsible for serious human rights crimes in
South Africa.
Urge the South African government to fulfil its
obligations under the Rome Statute to
cooperate with the ICC; including complying
with your requests to arrest and surrender
suspected perpetrators of international crimes,
take testimony, and provide other support to
the ICC.
It would be recalled that while addressing
Pongolo community members during a moral
regeneration event recently, Zwelithini
reportedly said, “Most government leaders do
not want to speak out on this matter because
they are scared of losing votes. As the king
of the Zulu nation, I cannot tolerate a
situation where we are being led by leaders
with no views whatsoever.
We are requesting those who come from
outside to please go back to their countries.
The fact that there were countries that played
a role in the country’s struggle for liberation
should not be used as an excuse to create a
situation where foreigners are allowed to
inconvenience locals. I know you were in their
countries during the struggle for liberation.
But the fact of the matter is you did not set
up businesses in their countries.”
Zwelithini, who spoke from a prepared speech,
made the remarks in the presence of Police
Minister Nathi Nhleko.

President Goodluck Jonathan’s loss in the
March 28 presidential election has started
taking its toll on his wife, Patience.
Arrangements had been concluded for her to
quit her position as the President of the
African Ladies Peace Mission, two months
before the expiration of her tenure.
The mission comprises of wives of Presidents
of all African countries.
Mrs. Jonathan was elected the mission’s
President at its seventh summit held in Abuja
in July 2012 and her tenure would have
expired in July 2015 when a new president
would have been elected.
But because she will cease to be Nigeria’s
President’s wife from May 29 when her
husband will hand over power to the
President-elect, Muhammadu Buhari , Mrs.
Jonathan had summoned an emergency
summit of the mission for May 15 for the
purpose of electing her successor.
According to a copy of the invitation to
members dated April 6 and personally signed
by the President’s wife, she explained that
she summoned the emergency summit to
ensure that there would not be leadership
vacuum in the organisation as it happened in
2010 when her predecessor left office without
handing over.
She said her desire was to put in place a
standard that would strengthen the
organisation and ensure effective mechanism
to guarantee seamless takeoff for the
incoming leadership.
The invitation partly read, “…Your Excellency
may recall that Nigeria was re-elected
President of the AFLPM at the 7th Summit in
Abuja in July 2012. With the recent election
in my country and a new government coming
on board from May 29, 2015, it has become
necessary to convene an emergency summit
of the AFLPM to facilitate a smooth and
formal hand over to the new Executive
Committee that will pilot the affairs of the
Peace Mission for the next two years.
“The Emergency Summit is proposed for
Friday, May 15, 2015 at the Interim
Secretariat of the African First Ladies Peace
Mission, Abuja by 2pm. The Summit will,
however, be preceded by the 4th meeting of
the Executive Bureau by 9am, on May 15 at
the same venue. The Bureau Meeting is for
members of the Executive Bureau, comprising
South Africa, Sudan, Cameroon, Libya and
Congo Brazzaville.
“…In the light of the above, may I appeal to
Your Excellency to give utmost consideration
to attending the Emergency Summit in order
to ensure that our organisation maintains its
current momentum.
“We will deeply appreciate your kind early
response to help us in planning the Summit,
in view of limited time available to us.”
When contacted on the telephone, the Special
Assistant to the President on Peace Mission,
Mrs. Martha Onwuzurumba, was hesitant.
She demanded to know the source of the
information from our correspondent.
Mrs. Onwuzurumba who is the wife of the
President’s Chaplain, Ven. Obioma
Onwuzurumba, is said to be in charge of the
Mission’s secretariat.
She said she would not speak on the matter.
“The African First Ladies Peace Mission is
not a Non-Governmental Organisation for
Nigeria, so I won’t be able to answer your
question,” she said.
The AFLPM, which aims at promoting peace
and harmony in Africa, was established in
1995 after the United Nations’ Conference on
Women in Beijing, China.

ABUJA – THE Senate President, David Mark
Tuesday said that the late Senator Uche
Chukwumereije will be buried on May 22 in his
country home Ngodo Isuoche, in Abia State
and will be given a heroic burial.
The burial date was contained in a letter from
the family of the late Senator Chukwumereije
which was read on the floor of the senate
during the plenary.
The Senate President described late Senator
Chukwumerije as national hero who was a
pan- Nigerian in all ramifications .
Mark told the bereaved family at Senator
Chukwumerije’s house in Abuja that the late
Senator was a nationalist and an unrepentant
crusader for the respect of human rights and
rule of law .

The Federal Ministry of Health and World
Health Organization, WHO, say that the
consumption of contaminated alcohol (gin) is
believed to be responsible for the outbreak of
the strange disease that has claimed at least
18 lives in Ondo state. At a joint press
conference today, the Minister of State for
Health, Mr Fidelis Nwankwo said the disease
is not in anyway related to Ebola virus disease
as was earlier speculated.
"Preliminary laboratory investigations
indicates that the outbreak cannot be
attributed to any infectious organism,
bacterial or viral. The outbreak is also clearly
not due to Ebola virus disease as feared by
many at first. Epidemiological findings
indicate a strong linkage of the outbreak to a
consumption of a local gin that had been
contaminated with methanol, a poisonous
material. At this stage the particular
poisonous substance is being ascertained. The
results of this very detailed investigation
currently been conducted by the government
and our partners are still been awaited and
will be made public as soon as possible"he
said.
