The Federal Government and the Joint Action Committee (JAC) of the non-teaching staff of Nigerian Universities have reached an agreement over the ongoing strike by the workers. The Minister of Labour and Employment, Sen. Chris Ngige, said this at a conciliatory meeting with the leadership of the JAC of the unions and other officials of the Ministry of Education on Friday in Abuja. It would be recalled that the non-teaching staff of Nigerian universities under the auspices of JAC embarked on strike on Monday over non- implementation of the 2009 agreement. The workers belong to the National Association of Academic Technologists (NAAT), Non-Academic Staff Union of Educational and Associated Institutions (NASU) and Senior Staff Association of Nigerian Universities ( SSANU). The demands of the unions included the payment of earned allowances, a review of the governance system in universities and improved funding in line with UNESCO recommendations. Other demands included provision of infrastructure in universities and payment of salary shortfall being owed members, implementation of the National Industrial Court judgment on university staff schools and registration of NUPEMCO, the Pension Fund Administrator proposed for university workers. Ngige, however, said agreements had been reached on all the issues raised by the workers. “We held discussions on all these areas and we reached agreement on all of them; government has already approved and released some N23 billion for earned allowances in the universities. “This is for teaching and non-teaching staff of the various universities in Nigeria. “We agreed on this that the Office of the Accountant General of the Federation is to expedite action on mandate for this payment. “We have the issue of shortfall; the issue is already being addressed and some universities are already credited with some amount of money for their short falls,” he said. On the implementation of NIC judgment for staff schools, he said that government through the National Universities Commission had issued circulars directing the universities to implement the judgement. He also said the Salaries and Wages Income Commission had initiated the process of ensuring compliance with the NIC judgment, expressing the hope that this would be completed within four weeks. On non-registration of NUPEMCO as Pension Fund Administrator, he said that the process had begun and a consultant would be handling this on behalf of the unions. “We have also reiterated our commitment that the appropriate filled forms and particulars be submitted within one week while the Federal Ministry of Education will expedite action to bringing out the certificates. “Also on the negotiation of the 2009 agreement, we realised that Babalakin Committee is handling that and has collected memorandum from the various unions,” he added. Ngige, who also reacted to the issue of inadequate infrastructure and poor funding of universities, said the Ministry of Education was in the process of inaugurating a nine-man committee that would develop an alternative means of sourcing for funds. He also said that the meeting jointly agreed that government should intensify efforts to checkmate the excesses of corrupt officials in the university system. The meeting further agreed that universities should also operate the Treasury Single Account and that the office of the Accountant General of the Federation should investigate cases of those operating multiple accounts. “We also agreed that government should expedite action and send visitation panels to federal universities that have not been visited and revisit the previous visitation panels for the purpose of implementation of their recommendations. “Again on whistle blowing which is the new anti-corruption policy of this administration, government agreed with the unions that whistle blowers should be protected “On the issue of CONTISS 14 and CONTISS 15 for technologists, the technologists’ union, NAAT, is to provide the Federal Ministry of Education with information that would assist the ministry to develop appropriate scheme of service for the new cadres among others. “Finally, it was agreed that the union members should not be victimised on account of this journey they have undertaken to go on strike and the unions also are to revert to government on Wednesday, Sept. 20, after presenting this to their National Executive Councils,” he said. Mr Samson Ugwoke, the National Chairman of JAC, commended the labour minister for his honesty and commitment in ensuring that the strike was called off. “We have all dotted these items one by one and agreed on them, but you know we are messengers; we were sent here by our principals and we cannot endorse any of these as either an agreement or MOU “So, what we agreed on today, on these issues that we have put our heads together on, will be taken back to our various National Executive Councils for deliberation and we will report by Wednesday, Sept. 20, ” he said. Stanley Opara and Ifeanyi Onuba The Federal Government on Thursday launched a fund with an initial value of $200m to support local oil and gas firms. The intervention fund, according to the Minister of State for Petroleum Resources, Dr. Ibe Kachikwu, is part of measures to improve access to low-cost credit for oil and gas firmsl operating in the economy. The Nigerian Content Development Fund is expected to be financed through the allocation of one per cent of the value of all contracts awarded in the upstream oil and gas industry, the petroleum ministry said. Oil sales make up about two-thirds of national revenues, which is in its first recession in 25 years largely caused by low global crude prices. The new fund would offer finance to energy firms setting up manufacturing facilities or acquiring assets such as oil rigs, ministry officials said. It would also offer project financing and help refinance existing loans, they said. “I would like to see this fund going to cutting-edge, tech-driven businesses,” Kachikwu told a gathering at the fund launch in Abuja. The minister called on the Bank of Industry to work with the Nigerian Content Development and Monitoring Board to raise the local content intervention fund from the current $200m (N61bn based on the official exchange rate of N305 to a dollar) to $1bn (N305bn). The event was attended by the Managing Director of BoI, Mr. Olukayode Pitan; the Executive Secretary, NCDMB, Mr. Simbi Wabote; and other major players in the oil and gas industry. Kachikwu said while the sum of $200m had been set aside for the fund for disbursement, the ultimate goal of the government was for the fund to increase to $1bn in order to meet some of its objectives for the sector. The minister described the fund as a game changer in the oil and gas industry as it would galvanise the much-needed investments into the sector through local content development. He commended the BoI and the NCDMB for coming up with the fund as it was in line with the objectives of the Federal Government to attract fresh investments into the oil and gas industry. He, however, cautioned that during the disbursement of the funds, there was a need for the bank to ensure geographical spread so as to avoid situations where the majority of the beneficiaries would come from a particular section of the country. He also advised that adequate attention should be given to the local communities during the disbursement of the funds so as to enable them to meet the environmental challenges being faced by them. He said, “The essence of the funds is to help galvanise Nigerian experts who want to invest in various areas but lack the funds to enter the industry. “This $200m will ginger everybody to begin to see how to expand the funds. My goal is to expand the funds to $1bn and after the launch today, we would have to set up a team to work internally to first of all get to the BoI to get their counterpart support for the funds.” In his comments at the event, Pitan said that the funds would be disbursed at a single-digit interest rate of eight per cent with a repayment period of five years. He added that for contractors that were located in the host communities, the loans would be given to them at a five per cent interest rate. He said that each beneficiary would get a maximum amount of $10m, adding that the funds would be used to increase the capacity of local players in the oil and gas sector. • NCC, CBN in crucial meeting with telco, banks • Commission’s board to meet Tuesday Iyobosa Uwugiaren in Abuja and Emma Okonji in Lagos The debt crisis rocking Etisalat Nigeria took a new turn Monday when the company’s chief executive officer (CEO), Mr. Matthew Willsher, and chief financial officer (CFO), Mr. Wole Obasunloye, resigned their appointments. Their resignation came a few days after its Emirati non-executive directors (NEDs), representing the interests of Mubadala Development Company and Emirates Telecoms Group Company (Etisalat Group) also stepped down from the board, following the Nigerian company’s inability to meet its loan repayments amounting to $1.2 billion to 13 Nigerian banks. The resignations also followed Etisalat Group’s reporting disclosure on the Abu Dhabi Stock Exchange two weeks ago that it had pulled out of Etisalat Nigeria and was transferring 45 per cent of its stake and 25 per cent of its preference shares in its Nigerian subsidiary to United Capital Trustees Limited, the legal representative of the lending banks. Aside Etisalat Group, other shareholders of Etisalat Nigeria include Mubadala Development Company with a 40 per cent stake and Emerging Markets Telecommunications Services (EMTS), representing the Nigerian shareholders, with 15 per cent. Etisalat had in 2013 approached a consortium of 13 local banks for a loan of $1.2 billion for network upgrade and expansion. The money was sourced in dollar and naira denominations. However, citing the economic downturn of 2015-2016 and naira devaluation, which negatively impacted on the dollar-denominated component of the loan, Etisalat wrote its creditors informing them of its intention to halt the repayment of the loan in instalments, until such a time that it was able to raise more money. Unsatisfied with the excuse from Etisalat, the banks threatened to take over the operations of the telecoms company should it fail to meet its payment obligations. The situation forced Etisalat to enter into negotiations with the banks, seeking unreasonable write-offs, which the banks rejected. Banks involved in the loan deal include: Zenith Bank, GTBank, FirstBank, UBA, Fidelity Bank, Access Bank, Ecobank, FCMB, Stanbic IBTC Bank and Union Bank. THISDAY had exclusively reported that a breakdown of the amounts owed the banks showed that Zenith Bank has the highest exposure to Etisalat amounting to $262 million and N80 billion, GTBank has the second highest exposure of $138 million and N42 billion, Access Bank follows with $131 million and N40 billion. Etisalat also owes UBA $125 million and N38 billion; FirstBank – $79 million and N24 billion; Fidelity Bank – $56 million and N17 billion; Stanbic IBTC – $25 million and N7.5 billion; FCMB – $15 million and N4.5 billion; and Ecobank – $10 million and N3.1 billion. But Etisalat, in a statement two weeks ago, had countered this information, stating that it had paid $500 million up till February 2017. It said the outstanding loan to the lenders stands at $227 million and N113 billion, a total of about $574 million if the naira portion is converted to US dollars. THISDAY had also reported that the CFO of the company was alleged to have diverted an estimated $700,000 realised from the sale of its telecommunications masts to IHS, a Nigerian towers and telecommunications infrastructure provider, instead of using the funds to repay the banks. According to bank officials, they had financed the importation and purchase of the towers through Huawei of China to help build the infrastructure backbone for Etisalat. But when the telco earned foreign currencies from the sale, Etisalat failed to repay its US dollar loans as was done by other telcos like MTN and Airtel. As a result, the lending banks had resolved to take over the firm and pursue the prosecution of Etisalat’s directors. However, their bid to take over Etisalat was halted by the Nigerian Communications Commission (NCC), the telecoms industry regulator, which made it clear that its licence was not transferable without its approval. NCC’s position was backed by the Central Bank of Nigeria (CBN). The suspicion is that the mass resignations were an attempt by the directors and senior executives of Etisalat to absolve themselves of criminal and civil liability over the debt default. As of press time, the NCC and CBN were in yet another crucial meeting with the banks and officials of Etisalat to address the crisis. It was expected that a decision would be made on the appointment of new directors, CEO and CFO for the company and may be announced Tuesday. An insider source told THISDAY that the banks are bent on restructuring the board and management of the telecoms company to reflect their interest. Also, another industry source disclosed that the board of NCC would hold an emergency board meeting Tuesday morning in Abuja to work out a plan to stem the value erosion and crisis of confidence that have hit Etisalat arising from the non-resolution of the debt crisis. An NCC board member, who spoke with THISDAY in Abuja Monday, said that unless the matter was “handled strategically”, the current challenges facing the company might lead to the loss of subscribers on the Etisalat network, job losses, and erosion of investor confidence, “I have just received a notice for an emergency meeting; the issue of Etisalat will be discussed and addressed. We have some other meetings that are coming up very soon where the issues will be addressed. One thing we don’t want to happen is for the company to collapse,” the board member told THISDAY. “That is why an institution like AMCON (Asset Management Corporation of Nigeria) was floated by the federal government. That is why you have Arik Airline still flying today, in spite of the huge financial challenges. It is not in our interest as a commission or as a nation to allow Etisalat to go down. “We will look into it and find ways to solve the problem. If the foreign investors are no longer interested in the company we will reposition it in such a way that it will attract other investors. I am sure other people will be interested. I don’t think workers will lose their jobs because we are going to look into the case of Etisalat,” he added. He also said that NCC was doing its best to ensure stability in the sector by ensuring that the necessary infrastructure is put in place to enhance efficiency in the sector. The Attorney General of the Federation and Minister of Justice has made a passionate plea to the Federal High Court in Lagos not to release a five-man gang who allegedly imported 661 pump-action rifles into the country without lawful authority. The prosecuting counsel from the office of the AGF, K.A. Fagbemi, while opposing the bail applications filed by the accused, told the court that it would not be healthy for them to be released into the society on bail. Fagbemi, who noted that one of the five accused persons was still at large, argued further that it was not even healthy for the court to release the other four on bail as their lives might be at risk. “He’s still out there. He could be a risk to their own lives. It’s one of the grounds that the defendants should not be granted bail for their own good,” Fagbemi said. The accused – Mahmud Hassan, Oscar Okafor, Donatus Achinulo, Matthew Okoye, said be at large, and Salihu Danjuma – had been arraigned by the AGF on June 14 for allegedly importing 661 pump-action rifles into the country without lawful authority. They were arraigned on eight counts before Justice Ayokunle Faji, who ordered that they should be remanded in the prison custody after they had pleaded not guilty to the charges. At yesterday’s proceedings, the defence counsel, Yakubu Galadima, Godwin Okaka, Olumide Oyewole and Adamu Ibrahim, brought bail applications for their clients, promising that if they were released on bail they would not abscond but make themselves available for their trial. Oyewole told the court that his client was ill and needed medical treatment, showing a medical report issued by the Isolo General Hospital. But the federal fovernment’s lawyer, opposed them and urged the court to dismiss the bail applications. After entertaining arguments from the counsel, Justice Faji adjourned till July 6, 2017 for ruling. In the charges, the AGF said the accused brought 661 pump-action rifles into the country from Turkey through the Apapa Port in Lagos, using a 40-feet container, which they falsely claimed contained steel doors. To facilitate the illegal importation, the accused allegedly forged a number of documents including a bill of lading, a Form M and a Pre-Arrival Assessment Report. According to the prosecution, in order to evade payment of customs duties, the accused allegedly forged a bill of lading issued at Istanbul on January 9, 2017, falsely claiming that it was issued at Shanghai, China. In the forged bill of lading, they allegedly filled “steel door” as the content of the container instead of rifles. They were also said to have allegedly offered a bribe of N400,000 to an official of the Nigeria Customs Service attached to the Federal Operative Unit to influence the said officer not to conduct a “hundred per cent search on the 40-feet container with number PONU 825914/3.” The prosecution also alleged that the first accused, Hassan, corruptly gave N1million to government officials at the Apapa Port in order to prevent the search of the container by customs officials. In the last count, the federal government alleged that the defendants had between 2012 and 2016 illegally imported several double-barreled shotguns, pump-action rifles and single-barreled shotguns into the country through Lagos. The eight counts pressed against them border on conspiracy, importation of prohibited firearms, forgery, uttering of forged documents, and bribery. The offences were said to be contrary to sections 1(2)(c), 1(14) (a)(i) and 3(6) of the Miscellaneous Offences Act Cap M17, Laws of the Federation of Nigeria, 2014. Alhaji Mujahid Dokubo-Asari, the leader of the Niger Delta Peoples Salvation Force, NDPSF, and one of the arrowheads in the struggle to redress perceived injustice in the Niger Delta has thrown his support on Nnamdi Kanu, saying he is not a Nigerian but a Biafran. He said an Nkwere man naturally knows that he is an Igbo man and that the name Biafra was given by an Ijaw man, likewise the Biafran anthem. He also said that Lagos will not be what it is now if the Ijaw oil cut off. Alhaji Dokubo-Asari also gave reasons while he said he is not a Nigerian, saying, when he goes up north, they don’t see him as Nigerian but rather, the northerners call him Nyamiri while when he goes to Yoruba land, they call him Kobokobo. He also said that he does not have any investment in Nigeria because it is an enemy territory and that his investments will not be safe. Corroborating what the leader of the Indigenous People of Biafra, IPOB, Mazi Nnamdi Kanu had said some days back, Alhaji Dokubo-Asari also said that the current agitation for the sovereign state of Biafra is not a call for war but that of self independence. Marketers have attributed recent drop in pump price of Auto Gas Oil (AGO) otherwise called diesel to deregulation of the product and competition among the players. They claimed that each marketer imports diesel from different sources and competition among the marketers was responsible for the drop in pump price of the product. When asked to react to claims by the Nigerian National Petroleum Corporation (NNPC) that it was solely responsible for the drop in price of the commodity, one of them said “NNPC is also a marketer and a major player in diesel importation and distribution. Because it pushes huge volume, it surely can influence product pricing by selling below cost price. “That is why we recommend that the sector should be fully deregulated and allow NNPC and other marketers to operate on level playing field. “The operating environment is not level at all. Do you know that at a time when a dollar was selling close to N500/$, the NNPC was subsidising premium motor spirit (PMS) otherwise called petrol. No other marketer can do that.” Recently, the NNPC announced it has crashed the pump price of diesel from as high as N250 per litre to between N155-N160 per liter at NNPC Retail stations across the country. This led other marketers to drop the pump price of diesel to as low as between N160- N170 per litre as at Sunday. Investigation by the Nigerian Tribune revealed that major oil marketers including Oando, Forte, MRS, NIPCO and others sell between N160-N170 per liter in Lagos and its environs. Meanwhile, a national survey by Oil and Gas Forum, NNPC’s weekly TV programme, indicated that in the last few weeks, the price of diesel has fallen steadily from between N175 and N200 per litre as at June 18, 2017, to as low as between N155 and N160 per litre in some stations across the country as at last week. The study showed that NNPC Mega Stations and its affiliates across the country sold the product for N160 per litre while many major and independent marketers in Abuja, Lagos, Kaduna, Onitsha, Enugu, Makurdi and most major cities were selling between N160 and N165 per litre. In Port Harcourt the average price is as low as N150 per litre. The Manager of a fuel retail station in Abuja, Ibrahim Isah, said the station had to reduce the selling price to N165 per litre in line with the prevailing market situation in order to sustain the turnover of the business. An independent marketer in Makurdi, Innocent Abbah, said the going ex-depot price of diesel from tarmac or local private depots is N155 per litre. The contents of the note read: “Mother, Father, brother, I’m sorry. Ify, may your children never suffer. Uncle Mathias, you gave me all. I am sorry. Death calls. Linguistic department, I am sorry.
