With his debut single released on April 3, SIL has set his eyes on a popular musician he said he would love to duet with very soon. He would not reveal the musician though.

His first single, entitled "Body", was released online on Friday after futile efforts to get a record deal, a major problem that other young talents in his mould has in Nigeria.

Tired of waiting for what may eventually not happen, the young musician decided to risk taking a shot at doing something with his career all alone, hence his decision to release the single online.

"Many up-and-coming musicians have done that and they've ended up not regretting it. I fancy my chances of success, hence my decision to take the bull by the horns," he told Doggone News Associated (DNA)

SIL also said he plans to collaborate with one of the raves in the country, but he would not let the cat out of the bag for now.

"I am already working on a remix of "Body", set to shoot a video for it and then drop another single from my EP. The EP is going to be a bang. My producer, Kingpin, will ensure that", he said.

On his inspiration for "Body", SIL disclosed that his debut single "is a song that appreciates the beauty and physique of a African women. It speaks about a black African woman's gorgeousness, her sexiness, how carriage, among others.

The less than four minutes song was  written by the young musician.

With another coronavirus victim identified in Lagos on Monday, popular choreographer, Adedayo Liadi, has drawn attention to the poor preparedness of Nigeria's immigration officials at curbing the spread of coronavirus into the country.

Liadi, who told DNA (Doggone News Associated) that he came back to Nigeria from Europe an ill man, was surprisingly not stopped for a search at the Muritala Mohammed International Airport recently.

He said 30 minutes before his flight landed in Lagos Airport, the cabin crew gave all passengers forms to fill, which he did to the best of his knowledge. "I filled the form truthfully concerning my health status and had decided that I was ready for anything that would happen for declaring the truth about my health situation. "For almost an hour, with everyone sweating on the queue, I was finally checked but I wasn't stopped. That was a surprise because I was sneezing and coughing. I felt it was God that was at work.

"I quickly went to see my doctor the next day, told him the condition of my health. He gave me four injections with lots of drugs. I stayed at home for two weeks, although I went out five times; on March 7 for my injections and drugs as prescribed by my doctor, to church the next day (RCCG Beula Chapel) for the second service between 10am and 12:30 noon. "I also attended my church special prayer night on March 12, from 6 to 9 pm, for an all-night special nonstop praise and worship program from 9pm to 5am on March 13 and finally for my church's fourth year special thanksgiving service on Sunday March 15 from 9am to 1:30pm.

Prior to his arrival from France, he had gone down with throat pain, cough, sneezing and fever five days before he left for Nigeria. "I was in France and Netherlands for meetings, holidays and work for about three months. I was always with my son during his holidays, who, unfortunately, had fever. He was sneezing, coughing for four days. I looked after him because his mother had to go to work everyday.


"After my son fully recovered, I started having serious throat pain, chest pain, coughing, sneezing and fever. I took the same medications (adult versions) as my son did and felt relived of the fever, throat pain and chest pain but the coughing, sneezing, chest irritation and spitting didn't stop. Also, my efforts to get an appointment with the doctor failed thrice because doctors were on vacation. The only date given to me to see a doctor wasn't okay with me because I would be in Nigeria by then.

"I became very curious, angry and frustrated with everything around me. But because I just finished a 50 day fasting, I put decided my faith in God to take care of me. Pharmacists would not give me anything to cure the sickness except I showed them signed doctor's prescriptions. That was when I decided it was God or nothing. But I was firmly resolved to make sure the devil must lose the battle by fire by force.


"Meanwhile, I was always feeling tired, very weak inside of me everyday. I couldn't do much or eat much, but I kept asking God to renew my strength daily and strictly followed all the instructions and directives I got online and TV concerning COVID-19 virus. I also continued to praying for my healing. To the glory of God, I can now say that I am completely okay, doing extraordinarily strong and doing great with no symptoms.

"I am seriously baffled till now that I wasn't stopped at any airport despite all the truth I declared about my health issue at all the boarders, despite the claims of controlling the corona virus. I remember too well that I crossed three different borders within four days and I got to my destination successfully. I believe God wants to reveal that He is the only One who can protect and heal us of every sickness, but are our immigration officials seriously preventing any dangerous virus at our boarder entries both land, sea and air? I leave that question for our immigration and government to answer while I continue to praise God for my freedom. I must let all Nigerians and the world know that it is only God that can heal, protect and safe. Closing boundaries can't protect any nation because the virus moves very easy and fast through the air and no one can stop the air.

As it is well known that controversy always accompanies anything that Fuji musician, Abass Akande Obesere, does, his recent installation as the Agbaakin Abobagunwa has not been an exception. For now, no one even knows if he was installed as the Agbaakin Abobagunwa of Owu Kuta, or the Agbaakin Abobagunwa of Ibadanland, or even the Agbaakin Abobagunwa of Yorubaland.

For the record, the late Sikiru Ayinde Barrister was the last Agbaakin Abobagunwa of Ibadanland. The stool has been vacant since the popular Fuji music creator died about a decade ago.

DNA gathered that Obesere had approached the Olubadan of Ibadanland, His Imperial Majesty, Oba Saliu Akanmu Adetunji, Aje Ogungunniso 1, to help him to the stool since he was an Ibadan indigene.

The Kabiyesi was favorably disposed to the idea, but he advised Obesere to follow the due process.

To install anyone to any traditional stool, it was expected that a letter of intent would originate from the palace. The secretary to Olubadan was said to have done this. DNA source, however would not give the man’s name so that it won’t be traced back to him that he had revealed the information.

“The problem, however, was that Kabiyesi did not know that any letter had been written because he wasn’t allowed to see it,” said the source.

In the letter, the date of installation was not given. How that escaped Obesere’s attention is a mystery. But in the letter, it was stated that Obesere would be installed as the Agbaakin Abobagunwa of Ibadanland.

Error

Excited that he had got a formal letter of confirmation from the palace, Obesere rushed into activating programs for the installation proper. He paid for advertisement, especially on radio and before long, his fans and well wishers became aware of the big event. Clothes had been sold as usually done by Fuji musicians, while entertainment of guests had also been paid for, all targetted at the May 2, 2019 date that had been widely announced in various medium by the celebrant. Kabiyesi’s subjects, who had access to radios, also heard about the event that was set to take place in the palace and started sending congratulatory messages to the traditional ruler. Surprised that an event, which he had not fixed a date for, was already generating such a massive interest from the public and his subjects, the palace again invited Obesere to Ibadan.

It was at the palace that he was asked who gave an approval for the date he had been announcing in the media. “Besides, letter has not been written to you yet,” Kabiyesi told him. Obesere presented the letter he had received. Kabiyesi was shocked, but he reprimanded the secretary for not consulting him about it first. “What saved the secretary was that he did not put a date for the installation in the letter. Obesere probably didn’t notice that omission, which turned out to be very important,” revealed DNA source.

To prevent what was going to be a huge embarrassment to himself, Obesere ran to the Olowu of Owu Kuta, His Royal Majesty, Oba Adekunle Makama Oyelude, for help as he had expended a lot of money on the project and he wouldn’t change the May 2 date again as that was too late to do, or even contemplate.

Another source told DNA that Obesere actually approached the Ooni of Ife, His Royal Majesty, Oba Adeyeye Enitan Ogunwusi, Ojaja ll, who prevailed on the former to help out.

Now that Obesere had found favor with the Olowu of Kuta, he continued with his activation plans. However, rumour had hit the streets that Wasiu Ayinde Marshall, K1, had used his connection with the Olubadan to stop the installation of Obesere as the Agbaakin Abobagunwa of Ibadanland that he, K1, was the only one who deserved to step in the shoes of Barrister.

“Obesere allowed the rumor to spread to hurt K1 because of the frosty relationship between the two of them. Wasiu did not stop Kabiyesi from doing anything as regards the matter. Besides, Wasiu is not from Ibadan and couldn’t have been installed as Agbaakin Abobagunwa of Ibadanland,” corrected Omotosho Akeem, another source of DNA.

Controversy

On May 2 2019, Obesere was installed as the Agbaakin Abobagunwa of Yorubaland, instead of Agbaakin Abobagunwa of Ibadanland. This is another controversy that is presently hanging around his neck. At the installation ceremony were Adewale Ayuba, Sir Shina Peters. Saheed Osupa performed to the guests, and other dignitaries.

As Obesere settles down to enjoy his newly added cap, only time will tell if he is occupying a stool that is restricted only to Owu Kuta; or that of Ibadanland, but without the approval for the Olubadan; or also the Agbaakin Abobagunwa of Yorubaland, but hurriedly done, and in hushed manner. From London, Ayo Jamiu faulted the entire process, describing it as a sham.

“I have been advised not to talk about Obesere because of some things, but all I know is that you can’t be installed to any stool by any oba but First class Obas, among whom are: the Alaafin of Oyo, the Ooni of Ife, the Ataoja of Oshogbo, the Awujale of Egba, etc. “I was among the few people who planned, and executed the crowning of Sunny Ade in 1977. The incumbent Alaafin of Oyo, accompanied by other First class Obas and many Baales, crowned Sunny back then. That’s the tradition and that’s all I can say,” he told DNA in a phone conversation.

Repeated efforts to talk to Obesere on the phone were futile as the man who always picked his call consistently said: “Abass is on vacation for now. Please call next week.”

Emerging from its first quarter NEC meeting held at the Wyndham Garden Hotel, North Dallas, Texas, the Egbe Omo Yoruba North America (National Association of Yoruba Descendants in North America), Dallas Forth Worth, Texas, between March 22 and 24, 2019, the association has, among other deliberations, approved the commencement of a programme for its youth in effort to support their aspirations as it prepares to mark its 25 years of existence. The Yoruba National Youth Program segment of the landmark anniversary has taken off immediately.

The silver jubilee is billed to attract about one thousand (1000) people – Egbe’s delegates and guests all over North America and around the world. special guests will include governors, politicians, public administrators, captains of industries, Obas and members of traditional institutions, opinion and community leaders, artistes and musicians of repute, partners and delegates from Nigeria and many individuals as well as organizations that share in the mission, goals, and objectives of Egbe Omo Yoruba.

At the conclusion of its deliberations, specifically directed toward the development of Yoruba community and, the strategic plans to protect the territorial lands belonging to Yoruba without compromise, the NEC passed the resolution to celebrate the 25th anniversary of EOYNA between July 17 and 22 this year.

According to the National Secretary of Public Affairs of the association, Bishop Adejube, the grand finale of the silver jubilee shall feature erudite scholars and resource personnel in a panel discussion that will address cultural, economic, social activities and policies that affect the Yorùbá race. The celebration will also include cultural display, beauty pageant, games, awards, carnival and fund raising for the Oodua House and Yoruba Development Fund (YDF).


Resolutions made at the plenary session are that: the Egbe Omo Yoruba Baton Rouge will host its national convention and silver jubilee; the association, through its youths, leaders and entire members, will embark on aggressive campaign for the fund-raising activities effective from March; that the theme of the special anniversary is “Changing World, Changing Times: Positioning Egbe Omo Yoruba for Assuring Yoruba Ascendancy.”

Other resolutions are: that proceed from all money raised will be directed towards building Oodua House and setting aside money for the Yoruba Development Fund; that awards be conferred on deserving members of the public, members of Egbe Omo Yoruba and community leaders; that the association should develop strategic short and long-term plans which would focus on the development of Yoruba people and the community and, finally, that EOYNA will collaborate with traditional rulers and all Yoruba leaders to ensuring that the development plans work, produce desired results, as well as guaranteeing economic and political empowerment for Yoruba people at home and abroad.

Ope Alabi, business associate with Mr Bimbo Ojugbele, the CEO of EBVande nightclub, has disclosed reason for the club’s love for organising talent hunts: “it is our contribution to discovering talents in the country”. The club recently held it’s maiden edition of a hunt that threw up a 20-year-old medical laboratory student, Emmanuella Bagudu. She also went back to the University of Benin with the N1 million price for winning the talent hunt.



Witnessed by the Oyo State commissioner for youth and sports, Mr Yomi Oke, the undergraduate emerged victorious after she was voted the best out of the over 1000 participants on Instagram during the month long competition. The organisers based their outcome on the voting and liking strength of contestants, determined by social media followers,, to determine the eventual winner.

The club embarked on the competition as a social response to it’s customer. This is one of the numerous ways we can encourage them in their careers. We will not stop at this, however, because we believe we should support upcoming acts in all ways possible,” Alabi told reporters at the newly renovated Ring Road site of the club.



In his congratulatory speech, the commissioner for sports urged the winner to look beyond the money and focus in how to plant herself in the entertainment industry, especially as youth unemployment increases.



“The government appreciates what EBVande has done. For posterity, however, you should go beyond just giving winners money because they can easily exhaust a million or even ten million. Creating opportunities for them to showcase their talents is more important. Get them signed to labels, appear in shows, etc.” Ella expressed her gratitude to the management of EBVande for the confidence reposed in her. She promised to do her best to be heard in the very competitive music industry.



Tokunbo Fajuyitan, an entertainment attorney, praised the winner a.d the organisers for the project. He, however, urged the winner not to relent in her efforts to make a headway in the industry. Nigerians should begin to look inwards for everything, including entertainment which has the capacity to employ youths. “A lot of opportunities are available for Nigerians, but we should be determined and focused in whatever we do. I thank the management of EBVande for organising this event,” he said.

PLANS TO CELEBRATE THE 60TH ANNIVERSARY OF THE FIRST TELEVISION IN AFRICA HOT UP



Some representatives of former staff of the Western Nigeria Television(WNTV)Ibadan, Africa’s first television station,on Monday,1st April, this year, paid a courtesy visit on the Governor of Oyo State, Senator Abiola Ajimobi,in his office at the Government Secretariat, Agodi, Ibadan, Oyo State of Nigeria.

The team, under the aegis of “Africa’s First Television Alumni Association”, was led on the courtesy visit by the first female Senior Advocate of Nigeria(SAN),Chief ‘Folake Solanke, who celebrated her 87th birthday on Friday,29th March, this year.

She was also the first and only female Chair of WNTV and her sister radio station, the Western Nigeria Broadcasting Service (WNBS),Africa’s first commercial radio station, established in 1960.

Chief Solanke, in her speech, informed Governor Ajimobi and some members of the Oyo State Executive Council present at the ceremony, that the 1st TV Alumni Association plans to celebrate the 60th anniversary of Africa’s first television station in October, this year, to commemorate the historic commissioning of the WNTV, Ibadan, on 31st October,1959,by the then Premier of Western Nigeria, Chief Obafemi Awolowo, GCFR,SAN

She said it was important that correct history of our past and living legends and their remarkable deeds are taught and documented for posterity.

Chief Solanke added that the 1959 feat of the introduction of television to Nigeria and Africa, among other achievements, by the Western Nigeria Government, led by Chief Awolowo, and his other worthy successors, deserve recognition and praises.

In his own speech at the ceremony, a former General Manager of WNTV/WNBS, Ibadan, Dr Yemi Farounbi, who is also a former Ambassador of Nigeria to the Philippines, said the celebration of the 60th anniversary of television in Africa, in October, this year, would include the production of a documentary detailing the vision and growth of WNTV, the publication of three books on the history of WNTV – the expected roles of television in the socio-economic development of the society and reminiscences by interested former staff of WNTV, Ibadan.

He added that the Alumni Association also plans to build a Hall of Fame for dead and living stars who passed through the two stations at the Television House, Agodi, Ibadan.

In his speech, Governor Ajimobi commended the sense of history and patriotism of the three conveners(Dr Yemi Farounbi, Mr Ayo Fasoro and Oloye ‘Lekan Alabi) of the 60th anniversary celebration of television in Africa and the Alumni Association,for buying into the vision.

He said it was imperative that history be appreciated,taught and documented, in order to motivate present and future generations.

Governor Ajimobi pledged the full support of the people and government of Oyo State to the Alumni Association and her set objectives.

Members of the Alumni Association on the courtesy visit included a former Head of Service and Secretary to Oyo State Government, Chief Adebisi Adesola, Honourable Justice Kunle Adeigbe(rtd),Pastor Biodun Aladekomo, Chief Sanya Oyinsan, Princess Sade Bankole,Mr Tunji Adepoju and Mr Ayo Babajide.

It will be recalled that WNTV/WNBS, and other states-owned radio and television stations were seized,without compensation, in 1976,by the Generals Murtala Muhammed/Olusegun Obasanjo-led Federal Military Government.

The national president of Fuji Musicians Association of Nigeria, (FUMAN), Mr a.k.a Sensation, has congratulated Taye Currency for the success of his son, Adebisi Yusuf Oladeni, at the election into the Oyo State House of Assembly.

Currency, an award winner, is a member of the music body. His son will represent the Ibadan South West 1 constituency in the government house.

Sensation said the victory of Yusuf is a victory for Nigerian youths as well as the entertainment industry where his father has made his landmark achievement as a musician and actor.

"We are proud of your family. You have proved that families of Fuji musicians can also achieve greatness in the academic and political profession. Your achievement at 25 is a landmark. We shall always make you a reference point in Nigeria's politics. Your father and FUMAN are happy for you," he said.

He also congratulated Mr Sanwo Olu, Engineer Seyi Makinde and Buhari for their successes as Lagos, Oyo states and Nigeria in the elections held late February and early March.

"It is our hope that all recently elected politicians would help to build the country's entertainment so that it can be self sustaining. Musicians we're very instrumental in the success of.many politicians. If we are not that important in promoting politicians, they won't be using us to gather crowd during their campaigns.

"They should not wait till the next political campaigns before they do what we have all been asking for, which is creating enabling environment and policies for the industry to thrive. The success so far recorded had been by out own efforts. We can do much better with the support of the government by creating a ministry for the industry," he pleaded.

VERA music award winner, Taye Currency, has debunked news that he had been shot dead in Ibadan following the success of Seyi Makinde at the gubernatorial poll on Saturday.
Taye, who has never hidden his support for the PDP (Peoples Democratic Party) since he publicity campaigned for former governor of Oyo State, Alao Akala against the incumbent, Senator Isiaka Ajimobi, reportedly incurred the wrath of some miscreants apologetic to the APC (All Progressive Party) who stormed his house at Oluyole Estate Saturday night.
In an exclusive chat with DNA (Doggone News Associated), Mr Tope Eluyefa, a close aide of the Fuji musician, the entertainment journalist said the story was the handwork of “a disgruntled blogger in Lagos known for not only spreading rumours, but also thrives on blackmailing people for filthy lucre.”
He denied the report. He also said it was not true that Taye’s mother was also killed in the aftermath of the fake story.
“I spoke with Mama an hour ago. She wanted to know how we were faring. She wasn’t even aware of the story and I didn’t discuss it with her not to cause her to panic.

“My phone has not stopped ringing since the news filtered out. Even a BBC (the British Broadcasting Corporation) correspondent called. I wasn’t surprised that people who never called regularly began to do so because we all know that bad news travels fast. However, it was also a demonstration of love on the part of many who were genuinely interested in Taye’s life and safety.
“I will only advice journalists, especially online practisioners, to be factual. The story was written to create chaos in Ibadan and it almost achieved that but for intervention by our fans and friends who did their best to also debunk the story.
“Taye is safe. Yussuf, his son who was just voted to the state House of Assembly, is safe. Mama is safe. Taye’s wife is safe,” he confirmed.

PEFTI Film Institute recently partnered with the prestigious Covenant University to provide added practical training for the university’s Mass Communication undergraduates. The intensive session lasted from 16th – 22nd December 2018, and took place at PEFTI Campus in Ajao Estate, Isolo, Lagos State.

The Film and Broadcast Workshop organized by PEFTI, integrated Content Creation, Script-Writing, Acting, Cinematography, Directing and Editing. The 105 students were in the capable hands of PEFTI’s best lecturers; as well as two renowned industry practitioners who have worked with several notable brands -Steve Sodiya (Wedding Party 1 & 2, Figurine, Wives on Strike, etc) and John Adeloju(Google, X-Factor, AFRIMA, etc).

During the one-week session, the200, 300 and 400 Level Mass Communication undergraduates also visited wapTV, Nigeria’s leading Family Entertainment TV channel, where they received thorough, real-world experience with the operations of different departments atthe station. They even co-hosted interactive live programmes which were watched by millions of viewers across Nigeria via all Satellite TV providersof wapTV Network; namely DStv 262, Star Times 116, GOtv 102, StarSat 189, PlayTV 275 and MyTV.

The Managing Director of PEFTI, Abiola Adenuga, has this to say: “We are really grateful to the Covenant University team who made this possible; especially the Mass Communication H.O.D. - Dr. Olusola Oyero; and the lecturers – Dr. Oscar Odion Odiboh, Dr. Suleimanu Usaini, Dr. Olatunji Oyedepo, Miss Tolulope Kayode-Adedeji and Miss Thelma Ekanem. The students had lots of fun at PEFTI while they were taught best industry practices as well as very practical tutorage with all the latest gadgets; including RED Cinematic Camera, Canon 5D MK IV camera, a wide range of Camera Drones and other ultramodern recording and broadcast equipment.”

The highest court in the land, the Supreme Court, has once again affirmed that the Musical Copyright Society Nigeria (MCSN) doesn't need the approval as collecting society or an exemption as one to enforce it rights.

In a unanimous decision, a panel of five Justices of the Supreme Court decided on14th December 2018, that Section 15(a) (now Section 17) and Section 32 (now Section 39) of the Copyright Act, as amended, which require a collecting society to seek the approval or exemption of the Nigerian Copyright Commission (NCC) before it can enforce its rights do not apply to the Musical Copyright Society Nigeria (MCSN).

In an appeal filed by MCSN at the apex court in[b] Suit No. SC 425/2010between MCSN vs. Compact Disc Technology Ltd, Nu Metro Home Entertainment (WA) Ltd and Nu Metro Retail Nigeria Limited[/b], the panel, consisting of Honourable Justice Mary Peter-Odili(JSC), Honourable Justice Olukayode(JSC), Honourable Justice Ariwoola (JSC), Honourable Justice Kudirat Kekere-Ekun,(JSC), Honourable Justice Amina Adamu Augie(JSC) and Honourable Justice Sidi Dauda Bage(JSC), set aside the decision of the Court of Appeal which held that MCSN can't enforce its rights unless it is approved as a collecting society or given an exemption by the NCC.

In the lead judgment delivered by Mary Ukaego Peter-Odili (JSC), the Supreme Court held that, "I am in agreement with submission of the learned counsel for the appellant, that Copyright (Amendment) Decree No. 42 of 1999 which introduced Section 15A(now 17) is not retrospective.

In fact, the Decree specifically stated its commencement date to be 10th of May 1999. Based on the above, I am of the humble opinion that since the law makers have specifically stated that commencement date for the Decree "to be 10th May, 1999”, it is clear that the law maker never intended the decree to have a retrospective effect. We rely on and adopt the statement of law in the case of AFOLABI v Governor of Oyo State (1985)16 NSCC (Pt.2) Vol. 16, page 11512 as follows:-

"A law is said to have retroactive effect when the commencement date is earlier in point of time than the date of commencement, for example, Tribunal of inquiry(Validation etc) Decree No. 18 of 1977 which was considered by this Court in the case of UWAIFO v AG Bendel State & ors(1982)13 NSCC 221 at 232,was dated the 18th day of March, 1977 but therein stated specifically that it shall be "deemed to have come into effect on 29th July, 1975"

Indeed the commencement of the Copyright (Amendment) Decree No. 42 of 1999 was clearly provided for to be 10th May, 1999 which is not earlier than 1986 and 1990 when the exclusive rights in the copyright works were transferred to the appellant.

The issue therefore raised on retrospectivity of the Act can be said to have been settled by this Court as seen in the case of Ojokolobo & Ors v. Alamu & Ors (1987) 2 NSCC 991, wherein it was held per Karibi-Whyte, JSC thus "the presumption of retrospective is displaced by the provision of a commencement date which is a future date "
Continuing, Mary Peter-Odili (JSC) added, "In fact the learned counsel for the appellant has referred this court to the earlier recent case before this court in[b] Adeokin Records & Anor v Musical Copyright Society of Nigeria(Ltd/GTE)[/b] delivered on the 13th July, 2018 which lead judgment was delivered by Ejembi Eko (JSC) which settled the questions right before this court now. That decision impels this court to hold that the exclusive licence of the copyright musical works which forms the basis of the suit at the trial court was transferred to the appellant since 1986 and 1990 respectively while the provisions of the Copyright Act, 2004 came into force on the 10th day of May, 1999 and so the Act cannot be said to affect the rights already transferred long before its commencement date.

Therefore, just as the court held in Adeokin Records & Anor v Musical Copyright Society of Nigeria (supra) on 13/7/18, the matter is properly before the trial Federal High Court and since the Court of Appeal went outside the clear situation, this court is best suited to intervene and hold that the position taken by the Court below is not the proper stand as supported by facts on ground in context with the necessary statutory provisions. The conclusion is that the appeal is allowed and the decision of the Court of Appeal set aside with the restoration of the decision of the High Court. It follows that the matter is remitted to the Chief Judge of the Federal High Court for assignment to a Judge to have the matter determined on its merits expeditiously.

Appeal allowed. Parties to bear own costs"

In her own concurring ten-page judgment, Honourable Justice Kudirat Motonmori Kekere-Ekun reasoned further that the Respondents can not go outside the Appellant's pleadings to justify their assertion.

"Locus standi or "Standing to sue" denotes the legal capacity to institute proceedings in a court of law. It has been held to be a threshold issue which has a fundamental bearing on the entire adjudication. It goes to the root of the competence of the court to entertain the proceedings. It is settled law that where a plaintiff lacks locus standi to institute an action, the court would have no jurisdiction to entertain it.See:DANIEL VsINEC(2015)LPELR-24566(SC) @ 47 A-D,Thomas and It's Vs Olufosoye(1986) 1 NWLR (PL699, Adesanya Vs President of FRN and And. (1981)5 SC112.

It is also settled law in determining whether a party had locus standi, the court. would have recourse to the plaintiff's pleadings only. Standing to sue does not depend on the success or merit of the claim but on the interest of the plaintiff in the subject matter of the suit. See: Banisnvo Motors Ltd VsWoermann-Lime andAnor(2009)13NWLR(Pt.1157)149,FawehinmiVs Skill (1987)12 SC. 136, AdesanoyeVs Aureole (2006)14NWLR(Pt.1000)242.

As rightly asserted by learned counsel for the Appellant, a cursory look at the statement of claim would show that there is nowhere therein where it pleaded that it is a collecting society. The respondents cannot go outside the appellant's pleadings to justify their assertion”.

The learned Jurist identified another issue, which she defines as crucial issue is whether the provisions of Section15 (A) of the Copyright Act, as amended are applicable in this case. She reasoned thus: “It is settled that it is the law existing at the time the cause of action arose and not the law at the time the suit was instituted that would govern the suit. See: Alibi VsOduntan(2000)7 SC (or II) 106, Adesanoye Vs Aureole (supra), OgboruVsUduaghan(2011)LPELR-8236(SC)@28-29 G-A.”

Justice Kekere-Ekun underscores yet another relevant principle of law; which is that in the interpretation of statutes, “there is a presumption against retrospective application unless it is expressly so stated in the statute. See[b]:OjokoloboVs Alamo (1987)3 NWLR (Pt.61)377@ 402F-N[/b],where this court held, inter alia:

"There is the presumption against intending justice or absurdity. It is one of the guiding canons of construction and interpretation of statutes. Upon this presumption rests the leaning against giving certain satutes retrospective operation. Generally, statutes are construed as operating only in cases or on facts which come into existence after the statutes were passed unless a retrospective effect is clearly intended.

It is a fundamental rule of Nigerian Law that no statute shall be construed to have a retrospective operation unless such a construction appears very clearly in terms of the Act or Law, or arises by necessary and distinct implication"


It was further held that:
"A statute is retrospective which takes away or impairs any vested right acquired under existing laws or creates a new obligation, or arises a new duty or attached a new disability in respect to transactions or consideration already past”

Based on its pleadings, the Appellant acquired its copyright in the various musical works in issue, as far back as 1984.In other words, as at that time it had vested rights, which were capable of being protected.

The acquisition of the rights preceded the enactment of the Copyright Act and the establishment of the Nigerian Copyright Commission.

The Respondents were unable to satisfy this court that the amendment of Section15 of the Copyright Act by the Copyright (Amendment) Decree No. 42 of 1999 which introduced Section 15A (now Section17 of the Copyright Act cap 28 LFN 2004) ,had retrospective application. This is particularly important, as the commencement date of the amendment is 10th May, 1999.

By virtue of it being an owner, assignee and exclusive and absolute licensee of the copyright in the works in issue, the appellant had vested rights, which included the right to institute an action for infringement of copyright, which could not be taken away by section 15A of the Act. The appellant therefore had the requisite locus standi to institute the suit before the trial court and there was no feature of the case that prevented it from assuming jurisdiction.”

Her Lordship finally anchored her judgment on the earlier decision of the Court in Adeokin Records Co &Anor vs. MCSN,“Besides, this case is on all fours with the earlier decision of this court in: Appeal No. SC. 336/2008: Adeokin Records &Anor. Vs MCSN ltd/GTE delivered on 13/7/18 wherein the appeal of the Respondent against the finding of the trial court that the Appellant, as owner, assignee and exclusive licensee had locus standi to institute the action, was dismissed. We are bound by our decision"
The three other members in their respective judgments concurred with the lead decision.

The recourse to the Supreme Court arose when MCSN sued Compact Discs Technology Ltd, Nu Metro Home Entertainment (WA) Ltd and Nu Metro Retail Nigeria Ltd. in 2007 for the violation of its copyright. As a defence the defendants claimed that having no approval as a collecting society or an exemption from the NCC, MCSN had no locus standi to institute the suit under the Copyright Act as amended.

Justice J. E Shekarho of the Federal High Court thought otherwise and ruled in favour of MCSN.

The defendants disagreed with the ruling and appealed to the Lagos division of the Court of Appeal. The Court of Appeal panel of I. M. M Saulawa (JCA), P. A. Galinje (JCA) and R. O. Nwodo(JCA) agreed with Compact Discs Technology Ltd and its sister companies that without NCC's approval or exemption, MCSN had no locus to institute the case.

Dissatisfied, MCSN through its counsel, DA Awosika and Associates, appealed the decision of the Court of Appeal to the Supreme Court which now set aside the decision of the Court of Appeal.

It would have been a tragic Christmas at the popular radio station of musician, Yinka Ayefele, as one of his loyal manager, Prince Aderibigbe, was said to be the target of juju planted under his chair at it's Ibadan, Oyo State office. Prince, however, denied this.

A source who witnessed the commotion that ensued after a fetish object was discovered on December 24, 2018, told Doggone News Associated (DNA) that but for vigilance on the part of the pastor, he might have walked into the trap and "anything might have happened thereafter." According to the source, "we had arrived office as usual that day to conduct business with the radio station and heard accusations and counter accusations that a particular individual had planted juju under Prince's chair and the man would have become a vegetable if he has mistakenly sat on it that day.

"In this part of the divide, we know what could have happened. The individual who planted the object meant harm for Prince. Of course fingers were pointed to an individual who had been eyeing Prince's office since he got to the organization. He has always coveted the post and yes not coy about it. That's why it was easy to suspect him (He would not name the individual).

In a sharp and quick response, Prince denied anything like an attempt on his life ever happened. "It is not true. Have a nice day," was his response and hurriedly hung up.

Our source, however, insisted that a spiritual attack was led on Aderibigbe, and for his spiritual and fatherly role in the organization, "many expected him to deny it because they don't want it out in the press. "Everybody knew what went down that morning. For the sake of the organization and the man behind the attack, Ayefele would have wanted peace to reign. That's exactly what Prince is trying to do. But denial doesn't mean it didn't happen because there were witnesses"

Ayefele radio station, pulled down by the Oyo state government sometime last year, was rebuilt by the government again and handed over to the musician recently

Popular comedian and Yoruba actor, Ola Omonitan, a.k.a Ajimajasan, finally succumbed to the years of bouts with prostate cancer early October 18, 2108, at the premier teaching hospital, University College Hospital, in Ibadan, Oyo State.

He is survived by children, grandchildren, sisters and brothers.

A source said Aji Fada had been admitted to the South West wing of UCH several weeks ago and had been expending lots of money on his I'll health, but couldn't survive the cancer attack this time. Twice, the actor was bailed out by the late Aare Musulumi of Yorbaland, Azeez Arisekola Alao, when he picked his medical bills for treatment in United States; the last of such trip reportedly in 2015.

With no sponsor this time, and not financially empowered; despite his many successes in the movie industry, the actor could not raise enough for the health institution. "We kept paying money on daily basis, hopeful he would be alright at the end, but we still lost him," one of his relatives told DNA (Doggone News Associated).

As many of his family members expected a miracle to happen, few were skeptical about his chances of surviving what has now becoming the silent killer of men in Nigeria.

Experts have called attention to Nigerian males to be wary prostate cancer as it is set to become the biggest killer of men in few years. Recently, a prominent professor in one of the federal government universities in the South West region recently.

Ajii, as he was also called, would have turned 82 in December.

His video series birthed season movies as he released "Bata Wahala" and "Ogun Laye", which were 13 parts in the 90s and sold in it's hundreds of thousands.

Although no burial plans have been released yet, DNA gathered from a family member that he would be buried at his house around Ina Olaji at Oluyole estate in Ibadan.

A new book about Fela Anikulapo Kuti has been released online by Kindle Publishing, an e-book publishing arm of Amazon. Released on Monday, the book is entitled “Bruised, Battered, Beloved” and is written by Tade Makinde.

Unlike the several other paper backs already published about Fela, this latest addition to the ever-growing library is strictly about his life off camera, and especially reveals how the controversial musician lived his private life; known to a selected few.

Edited by Mr Femi Osinusi and Dr Abiodun Awolaja, BBB; in the second part of the three-part book, reveals how Fela was brutally assaulted by soldiers and policemen, who raided his Kalakuta Republic on February 18, 1977, and many of his girls for almost 7 hours.

“Don’t believe what the Military said; Fela’s girls were raped and everyone in the house that day was bloodied,” said one of the 26 people interviewed in the book.

The author, who said he never set out to write about Fela, but for fate, thanks Mr Femi Esho for suggesting that he should write about Fela and promised to assist him in making the book happen.

“I am glad I took his advice. Finishing it, and finally getting it out online, is a dream come true,” he said.

Toyin Abraham, one of Nigeria’s most-talked about actresses may have had a rough start that almost killed her passion for acting, but the actress-turned producer is currently enjoying every moment of her time now. From overcoming her dark moments to becoming a blockbuster movie producer, Toyin, in this interview with SEYI SOKOYA, opens up on her early days in the industry, transformation and future plans.


How did you get into the movie industry?
My late brother’s friend had an uncle who is a marketer, High Waves. They said Bukky Wright was coming to town to shoot Dugbedugbe nbo and that she needed someone. I was called; so I went to meet her. When I got there, it happened that they needed help for a particular role. The person listed to play the role was not available. I was asked to takeover the role and I just did my thing. At the end, everybody started clapping.

Were you paid for the role?
Yes. It was not as if I was trained to be an actress from the onset, but immediately after that experience, I saw as an opportunity to explore into acting. So, I went for further training under Aunty Bukky.

At what point did you relocate to Lagos in the pursuit of your career?
At some point, I felt it would be ideal for me to relocate to Lagos because that was the only option. Lagos is where the money is, especially with the fact that I was coming from a poor background, I realised that I had to leave for Lagos. That was, and still is, the mainstream of acting. Being an upcoming act, you won’t have the opportunity to partake in movies if you are not available. Most of the time, the invitation is impromptu. If you are not available when called, another would take that chance. Sometimes you will only be called upon when a film production is going to come and pick up two or three scenes.

For a new entrant, how were you able to settle in the city?
It was not easy for me. I was with Aunty Bukky and later, with Aunty Opeyemi Ayeola. I stayed with my family friend at Fola Agoro, until I was able to pay for an apartment of my own.

How were you able to raise the rent?
I lived at Agoro for almost four years. The first apartment I was able to afford then was a room and parlour at Omole. Honestly, it was not easy getting the apartment, but I had to cut my cloth according to my size before I was able to save enough to do that. In fact, my elder siblings had to support me. That was when Big Sam provided me support beyond my expectations. He was always bailing me out of financial mess. That is why we are so close. People don’t know this.

All the while, were you tempted to give up your pursuit, or even offered your body?
As a Christian, I was conscious of what I was doing. My mum always advised us (her daughters) that our body is the temple of God and that we must not be involved in any act of sin.

Is your mother a preacher?
She is not just a pastor; she is a founder of churches under the Christ Apostolic Church (C.A.C). In fact, I play drums in her churches.

You play a drum?
Yes. I am a good drummer. I am especially good on akuba and Konga. I still play them till now, but only in her church in her church.

Back to how you got out of your poor financial situation…
After living in my apartment for about two years, I moved to another apartment in the same location. From this other apartment, things began to change for me. The roles started coming in. I always thank God for His divine intervention. It was not easy, but He made things easy for me at the end.

Do you ever have the feeling that you would also have made it if you stayed back in Ibadan?
I was born and raised in Ibadan and I knew I was still going to return home. As I said earlier, I came from a poor background. But, we never even let that bother us because we believed God would move. We were contented with what we had. Though, we were financially poor, we were not spiritually and mentally lacking. Then, I didn’t know we were poor because we still had something to eat. I remember we usually ate particular beans called feregede (African yam bean). Anybody that is familiar with this kind of food will have an idea of the stress one goes through before it is cooked. My parents will ask us to fast when there was nothing to eat at home. At that point, I had to move to Lagos, where there were better opportunities in the entertainment industry.

When would you say you actually got your breakthrough in the industry?
That definitely was last year. I am not saying that I have not been making money, but I made more money beyond my imagination last year. A large part of that fortune is from Lagos, though Ibadan is always my home. I feel at home whenever I am in Ibadan. It is my country home that I love to visit a lot. This is why I love to do anything that will be beneficial for the people of Ibadan. God is the pillar of my career, but Ibadan people have been my largest fans. They have been extremely supportive.

How are you repaying them for their loyalty?
I have several empowerment initiatives, especially in vocational skills. I still have a lot of plans for my fans generally waiting in the pipeline.

Did you have any formula you applied in having your break?
Initially I was doing my thing the usual way; I didn’t have a management team or any team for that matter. You know, sometimes you make mistakes, especially when you feel you are on top of your game. Being popular doesn’t mean you are successful. I made my mistakes, especially the mistake of believing that I could do all things by myself because I was popular. It doesn’t work like that. We need to delegate power and form strategic alliances with some experts. I can confidently tell you that it has been a different ball game since I had a team. Their experiences have been awesome.

What is the next thing for you after your recent production, Seven & Half Dates?
It wasn’t my production. I was only asked to participate. For me, I just finished auditioning for another movie. After that, I will travel to Benin Republic to appear in another movie by a friend. I am presently making plans to commence my soap opera. As for movies, I really want to slow down a little bit. I want to build my home to an accepted level and also concentrate on my soapie I am planning to raise lots of up-and-coming actors and actresses.


Could you shed light on the home you intend to build?

I have a man I am engaged to and I don’t want to give him out for now. I want to concentrate and build my home first.

An OAP said your post on social media that you had been engaged to an unidentified individual was a ruse and that there is no one in your life.
Male or female OAP? Before you answer though, I am guessing it would be a lady.

You are right. Why did you expect it to be a woman?
Don’t believe that anyone who smiles, laughs with you mean well. Let’s leave it at that. But then, I have had news about my marital life and I don’t care about any hearsay. People are entitled to their opinions; which, unfortunately for the lady, is not true and has nothing to do with me. People know that I am always real and that I don’t have any reason to lie about my life. It is my life. Even if I decide not to get married again, whose business is it? I know their trick. They are just trying to know the man in my life now.

You have been accused of adapting others’ work for your own production. How will you react to this?
That cannot be true. I hardly watch American movies. I only watch Nigerian movies, especially Yoruba, Igbo, Ghanaian and Indian movies. I can remake some of the works of these movies because it is professionally accepted. In fact, I have seen a Ghanaian movie that was a clear remix of Alakada and I did nothing about it. It is not as if I am supporting copyright infringement. Personally, I don’t do such; I always call or follow due process before I use people’s work.

What is your take on the claim by your ex-boyfriend that you guys have settled?
Someone drew my attention to the report, but I made the person realise that I am not interested. He has moved on and so have I. When I am ready to marry, you will be invited. I will also find out that OAP, who said I was lying and gladly invite her too.

Sean Dampte, a Nigerian, who has been enjoying the attention that his song, titled ‘Allignment’ has brought him in UK, is set to release another single titled ‘Million’. Having being a success story at home, Dampte plans to replicate such in England, and things are looking good that his latest song will also be as success. Million will be released on September 19 and will be available across all major platforms.

‘Million’ is a complex and catchy track, filled with saturated 808 bass drum; groove oriented drumbeats and concise lyrical delivery. Abdulala, who featured in the track, added to the alluring tone of the popular song. Shortly after moving to England, Sean featured Rayce in a single titled ‘Allignment’, which had 54k views on YouTube. He has also worked with some producers in England has to offer, including Goldhands.

Copyright Society of Nigeria (COSON) has warned that as the general elections approach, it will mobilize its thousands of members across Nigeria and the millions of music fans who support COSON members to campaign against politicians who have no well thought out plansto deploy Nigeria’s creative talents for the development of the Nigerian nation.

Delivering the annual ‘State of the Music Industry’ address to musicians, investors in the music industry, intellectual property lawyers and the media at COSON House, Ikeja on ‘No Music Day’, September 1, 2018, COSON Chairman, Chief Tony Okoroji said, “It is our firm belief that creative people in Nigeria cannot afford to keep quiet any longer as Nigeria goes through another electioneering campaign season in which politicians hop from one end of the country to the other but no one offers any direction for the development and optimal deployment of the millions of Nigeria’s creative talents for national development.

“Today, we wish to tell Nigerian politicians that we will not be taken for granted anymore and we will not help people canvass for votes who after getting into office will abandon the creative industry to suffer in an environment that completely discourages creativity.

“We are making it abundantly clear that it is only politicians who have developed a well thought out long-term plan for the progress of our industry and have shown clear interest in the development of the nation’s creative environment that can count on our significant support, the mobilization of our fans and their votes as elections approach. In the same manner, we will mobilize massively against those who have no plans to properly deploy the creative energy of young Nigerian people”

As has become the tradition, broadcast stations across Nigeria were requested by COSON not to broadcast music between the hours of 8am and 10am on Saturday, September 1, 2018 as a mark of solidarity with the nation’s creative industries which have suffered immensely from the debilitating infringement of copyright. Rather than broadcast music, most of the stations dedicated the 8 am to 10 am time belt to the broadcast of interviews, documentaries, debates and discussions which focussed on the rights of creative people and the potential contributions of creative activities to the national economy.
In an unprecedented communication masterclass, COSON on ‘No Music Day’ despatched over 60 top COSON members, Intellectual Property lawyers, and other music industry experts to diverse broadcast stations across Nigeria and the airwaves were bombarded with simultaneous discussions on“Copyright is Human Right” the theme of the 2018 ‘No Music Day’. Top notch social media activities on the same theme ruled the day as flags at the magnificent COSON House in Ikeja flew at half-mast.

“No Music Day” is traceable to that historic week in 2009 when Nigerian artistes of different persuasions embarked on a weeklong hunger strike staged in front of the National Theatre in Lagos. The hunger strike which was a result of the frustration brought about by the devastating level of intellectual property theft in the country was the prelude to what has become known as “No Music Day” in Nigeria.

For the first time in human history, the music industry in a nation called for the halt of the broadcast of music all over the country for a whole day, September 1, 2009. This action captured the imagination of the world and what is marked as “No Music Day” every year in Nigeria, was born.

In his ‘No Music Day’ address, Chief Tony Okoroji who spearheaded the 2009 hunger strike action said, “We wish to remind the different politicians and political parties canvasing for votes across the country that the disease which necessitated the hunger strike of 2009 has not quite been cured. At this time that other nations are building their economic growth on the creative and knowledge economy, Nigeria must take important steps to protect its creative industries to ensure the socio-economic progress of our nation”.

Okoroji who derided the politics of personalities that has enveloped the nation, called for politics of issues that attack the serious deprivations faced by the Nigerian people. Said the former President of PMAN, “We believe that the time has come for our music industry to go beyond simply providing entertainment but playing a key role in nation building.
“We cannot afford to give up as a nation despite the immense disappointments we have had. We must reinvent the Nigerian nation and speak truth to power. We believe that in this process, creative people in Nigeria must play a central role, stand up, take responsibility, work together, establish the strong advocacy necessary in every democracy to create positive change”.
